ESTABLISHMENT OF AD HOC HUMAN RIGHTS TRIBUNAL
AT THE CENTRAL JAKARTA STATE COURT
PRESIDENT OF THE REPUBLIC OF INDONESIA,
.,, weighed: a. that as the implementation of Article 43 of the paragraph (1) of the Law No. 26 of the Year 2000 of the Court of Human Rights determined that a severe breach of Human Rights, which occurred before the enactment of Law No. 26 of the Year of the Year 2000. The Court of Human Rights, examined and disowned by the Ad Hoc Human Rights Court;
., b. that in accordance with Article 43 of the paragraph (2) of the Law No. 26 of the Year 2000 on the Court of Human Rights, the establishment of the Ad Hoc Human Rights Tribunal is conducted on the proposal of the House of Representatives;
., c. that the House of Representatives of the People's Republic of Indonesia through Decision Number 44 /DPR-RI/III/2000-2001 dated 21 March 2001 has approved the establishment of the Ad Hoc Human Rights Tribunal against the alleged violations of the heavy Human Rights occurred in East Timor and in Tanjung Priok in 1984, which was then proposed to the President with the Letter of the Speaker of the People's Representative Council of the Republic of Indonesia Number KD.02/1733/DPR-RI/2001 dated 30 March 2001;
., d. that under such consideration above, it needs to establish the President ' s Decision on the Establishment of the Ad Hoc Human Rights Tribunal on the Central Jakarta District Court;
.,, Given: a. Article 4 of the paragraph (1) of the Basic Law of 1945;
., b. Law Number 26 of the Year 2000 on the Court of Human Rights (State Sheet of 2000 Number 208, Additional Gazette State number 4026);
DECIDED:
.,, SET: THE PRESIDENT ' S DECISION ON THE ESTABLISHMENT OF AN AD HOC HUMAN RIGHTS TRIBUNAL ON THE CENTRAL JAKARTA STATE COURT.
Section 1
Form the ad hoc human rights tribunal at the Central Jakarta State Court.
Section 2
The Ad Hoc Human Rights Tribunal as referred to in Article 1 of the authorities examine and discontinue the heavy Human Rights violations occurring in East Timor after the polls and which took place in Tanjung Priok in the year 1984.
Section 3
All costs are necessary in the framework of the establishment and procurement of the Ad Hoc Human Rights Court at the Central Jakarta District Court charged on the budget of the Department of Justice and Human Rights.
Section 4
The President ' s decision comes into effect on the promulgated date.
