WITH THE GRACE OF THE ALMIGHTY GOD

PRESIDENT OF THE REPUBLIC OF INDONESIA,

.,, weighed: a. that in order to realize the aspirations of a thriving community in Ogan Komering Ulu County and Ogan Komering Ilir regency to improve service to the community, in the areas of governance, development, and the community, Ogan County Komering Ulu and Ogan Komering Ilir regency need to be metered;
., b. that with regard to the above and based on the criteria of economic ability, regional potential, cultural social conditions, political social conditions, population, area, and other considerations, formed by Ogan Komering District Ulu Timur, Ogan Komering Ulu South, and Ogan Ilir County in South Sumatra Province;
., c. that with the formation of the regency as such in the letter b, it will be able to encourage increased service in governance, development, and society, as well as provide opportunities to utilize and develop potential region;
., d. that based on consideration as referred to in the letter a, the letter b, and the letter c, need to form an Act on the formation of the Ogan Komering County of the East, Ogan Komering County of South Ulu, and Ogan Ilir Regency;

BAB I
UMUM PROVISIONS

Section 1
In this Act referred to:
., 1. The area is as referred to in Article 1 of the letter i Act No. 22 of 1999 on the Local Government.
., 2. The Province of South Sumatra is as referred to in the Law No. 25 of 1959 Army Regulation of Regulation Law Number 3 of the Year 1950 on the Establishment of South Sumatra Level Area and Emergency Law Number 16 Year 1955 on Change of Government Regulation Substitute No. 3 Act 1950 (State of the Republic of Indonesia in 1955 No. 52) as Act, which has been reduced to the Province of Bangka Belitung. based on Law No. 27 of the Year 2000 of the Establishment The province of Bangka Belitung.

Ogan Komering Ulu and Ogan Komering Ilir Regency are as referred to in the Nomor28 Act 1959 of the Decree of Emergency Law Number 4 of 1956 (sheet of State of the Republic of IndonesiaTahun 1956 Number 55), Emergency Law Number 5 of 1956 (State of the Republic of Indonesia in 1956 No. 56) and Emergency Law Number 6 of 1956 (State Gazette of Indonesia's Republic of Indonesia Year 1956 No. 57) on the Establishment of Level II including Kotapraja. in the South Sumatra Grade I Environment, as the Act.

BAB II
THE ESTABLISHMENT, THE BOUNDARY OF THE REGION, AND THE CAPITAL

Section 2
Under this Act, Ogan Komering Ulu Timur, Ogan Komering Ulu South, and Ogan Ilir Regency in the Province of South Sumatra in the Republic of Indonesia.

Section 3
Ogan Komering Ulu Timur district comes from parts of the Ogan Komering Ulu County region consisting of:
a. District Cempaka;
B. The District of Semendawai Tribe III;
C. Belitang II Subdistrict;
D. Belitang III Subdistrict;
e. Belitang District;
f. Buay Madang Subdistrict;
G. District Buay Leaders;
h. District Dignity;
i. The Subdistrict of Madang Tribe II; and
J. The District of Madang Tribe I.

Section 4
Ogan Komering South Ulu district comes from parts of the Ulu Komering Ogan County region consisting of:
a. High Kisam District;
B. Buay Runjung Subdistrict;
C. The District of Buay Sandang Pay;
D. Muaradua Subdistrict;
e. Simpang Subdistrict;
f. The Subdistrict of Buay Pemaca;
G. Supreme Court of Appeal;
h. Meki Ilir District;
i. The District of the Island Wants; and
J. Muaradua Kisam Subdistrict.

Section 5
Rolling Ogan County comes from parts of the Ilir Comering Ogan County region consisting of:
a. Indralaya Subdistrict;
B. Adoratrial Subdistrict;
C. Cape King Subdistrict;
D. Rantau Subdistrict;
e. The Kuang Sink District; and
f. Tanjung Batu Subdistrict.

Section 6
.,, (1) With the creation of Ogan County Komering Ulu East and South Ogan Komering Ulu County as referred to in Article 2, the Ogan Komering Ulu County region is reduced with the Ogan Komering County region of Eastern Ulu as it is referred to in Article 3, and the region of OganCommercial UluSelatanas are meant in Article 4.
.,, (2) With the formation of Ogan Ilir regency as referred to in Section 2, the Ogan Komering Ilir County region is reduced with the Ogan Ilir County region as referred to in Article 5.

Section 7
(1) The East Ulu Komering Ogan County has a region boundary:

., a., a. It is the north border with the Tanjung Lubuk District and the subdistrict of Ogan Komering Ilir Regency;
., b. the east is bordered by the District of Lemdebris and the District of Mesuji District Ogan Komering Ilir;
.,, c. south of the border with the Right Way County of Lampung Province as well as the Simpang District of Ogan Komering Ulu South; and
., d. It is bordered to the west by the subdistrict of Lengkiti, Sosoh Buay Rayap District, Baturaja District, and Ogan Ilir County Review District.
(2) The South Ulu Komering Ogan Komering regency has a region boundary:

., a., a. The north is bordered by Ulu Ogan District, the District of Onan, And The District Of Lengkiti District Of Ogan Komering Ulu;
., b. the east is bordered by Dignity District Ogan Komering Ulu Timur and County Way Right Province Lampung;

., d. the west is bordered by Bengkulu South Province of Bengkulu Province and the District Semendo Land Ulu District Muara Enim.
(3) Ogan Ilir regency has the region limit:

., a., a. the north is bordered by Gandus, the District of Kertapati, and the Subdistrict Ulu I Kota Palembang;
., b. Border of the district of Jelah, the district of JeJah, the district of Sirah Pulau Padang, the district of Kayuagung, the district of Pedamaran, and the subdistrict of Tanjung, Ogan Komering, and Cempaka District. East Ogan Ogan Komering County;
.,, c. south of the border with Ogan Komering Ulu County Review District; and

.,, (5) Determination of the Ogan Komering Regency region boundary of the East, Ogan Komering South Ulu County, and Ogan Ilir regency is definitively in the field, as referred to in (1), paragraph (2), and verse (3), set by the Minister of the Interior.

Section 8
.,, (1) With the establishment of Ogan Komering County Ulu East, South Ogan Komering Ulu County, and Ogan Ilir County as referred to in Article 2, Government of Ogan Komering Ulu Timur, Ogan County Government Komering Ulu South, and the Government of Ogan Ilir Regency establishes the Regional Governance Plan in accordance with the laws.
.,, (2) The designation of the Ogan Komering County District Layout Plan East, Ogan Komering South Ulu District, and Ogan Ilir Regency as referred to in paragraph (1), carried out in accordance with the National Area Tata Plan And the Plan of TataRuangWilayahProvincial of South Sumatra and also paid attention to the District/City District Plan for the surrounding area.

Section 9
.,, (1) The capital city of Ogan Komering Ulu East is based in Martapura.
.,, (2) The capital of Ogan Komering District Ulu South is based in Muaradua.
(3) The capital of Ogan Ilir County is based in Indralaya.

BAB III
REGION AUTHORITY

Section 10
Ogan Komering Ulu Timur Regency, Eastern Ogan Komering Ulu district, and Ogan Ilir Regency include the authority, duties and obligations to govern and take care of the governing field which is submitted in line to the parent district, accordingly. with laws.

BAB IV
DEVELOPMENT OF THE AREA

Section 11
.,, (1) The Government of South Sumatra Province is conducting coaching and facilitating specifically against Ogan Komering County of East Ulu, KabupatenOganKomering Ulu South, and Ogan Ilir County within 3 (three) years since its inauguration, for The establishment of regional government functions.
.,, (2) After 3 (three) years since its inauguration, the Government along with the Provincial Government of South Sumatra conducted an evaluation of the holding of the Ogan Komering County Government East, Ogan Komering Ulu South District, and Rolling Ogan County.
.,, (3) The results of the evaluation as referred to in paragraph (2) are recommended as further coaching materials in accordance with the laws.

BAB V
LOCAL GOVERNMENT

The First Part
The Regional People ' s Representative Council

Section 12
.,, (1) the People's Representative Council of the District of Ogan Komering ulu east, the People's Representative Council of the District of Ogan Komering Southern ulu, and the Council of Representatives of the District of Ogan Ilir County for the first time formed through the results of the General Election 2004.
., (2) The number and layout of the membership of the Council of Representatives of the People's Representative DaerahKabupatenOgan Komering ulu east, the People's Representative Council of the District of Ogan Komering Southern ulu, and the Regional People's Representative Council of the District of Ogan Ilir, as is the case of the Council of Representatives of the Council of Representatives referred to in paragraph (1), governed in accordance with the laws.

The Second Part
The Local Government

Section 13
Regent and Vice Regent Ogan Komering Ulu Timur, Regent and Vice Regent Ogan Komering Ulu South, and Regent and Vice Regent Ogan Ilir, were selected and passed most slowly 2 (two) years after the oath/appointment of members of the House of Representatives of the People's Representative Council. Section 14

Section 15

THE TRANSITION PROVISION

Section 16

., d. Ulu Komering Ulu County loan debt for Ogan Komering County Eastern and South Ogan Komering Ulu County; and Ogan Komering Ilir Regency debt debt for Ogan Ilir County; as well as
., e. documents and archives which are due to their nature required by Ogan Komering Ulu Timur, South Ulu Komering Ogan Komering County, and Ogan Ilir County.
.,, (2) The implementation of the submission, as referred to in paragraph (1), is facilitated by the Governor of South Sumatra and completed within 1 (one) year count since the appointment of the Regent Ogan Komering Ulu East, The Regent Of Ogan Komering Southern Ulu, and the Regent of Ogan Ilir.
.,, (3) In terms of execution of submission as referred to in paragraph (1) and paragraph (2) are subjected to obstacles facilitated by the Minister of the Interior.

Section 17
.,, (1) Ogan Komering Eastern Ulu District, Ogan Komering South Ulu District, and Ogan Ilir County have the authority over tax and regional retribution since the formation of the Ogan Komering County District (Ogan Komering Ulu Timur), Ogan County. .,, (2) Ogan Komering Eastern Ulu District, South Ogan Komering Ulu district, and Ogan Ilir Regency are entitled to an allocation of balancing funds in accordance with the laws.

Section 18

Section 19
.,, (1) The Hosting of the 2004 General Election prior to the formation of the Electoral Commission in Ogan Komering County East and Ogan Komering Ulu Komering Ulu County was implemented by the Central Election Commission of Ogan Komering Ulu County, and Staging the 2004 General Election before the formation of the Electoral Commission in Ogan Ilir Regency was implemented by the Ilir Comering County General Election Commission.

CLOSING PROVISIONS

Section 20
At the time of the enactment of this Act, all laws not in accordance with this Act are declared to be not applicable.

Section 21
The further provisions are required as the implementation of this Act, set in accordance with the laws.

Section 22
This law goes into effect on the promulgated date.

FORMATION OF THE EAST OGAN COMERING OGAN REGENCY,
SOUTH OGAN OGAN KOMERING ULU, AND
ROLLING OGAN COUNTY,
IN THE PROVINCE OF SOUTH SUMATRA

I. UMUM

.,, South Sumatra Province which has an area of ± 97.257.72 km2 with residents in 2002 totalling 6,614,777 inhabitants has shown progress in holding government, implementation of development, and service as well as Improving public welfare.
.,, Ogan Komering Ulu County, which has an area of ± 13,661 km2with residents in 2003 amounted to 1,159,719 inhabitants and Ogan Komering Ilir County which has an area of ± 21,025.49 km2with the population of the Year 2003 totalled 366,377, has the regional potential and economic ability to support increased governance, development, and social services.
.,, with the area of such areas above and the high rate of population growth, so until now the implementation of development and service to the community has not been fully affordable. Such conditions need to be overcome by shortening the rule of government through the formation of new autonomous regions. This is in line with national policy in the framework of the Indonesian National Council, especially in South Sumatra Province, with the form of Ogan Komering Ulu Timur Regency, Ogan Komering Ulu Selatan Regency, and Ogan Ilir Regency.
The district of Ogan Komering Ulu Timur consists of ten (ten) districts, namely Cempaka District, Semendawai Tribe III, Belitang II District, Belitang III District, Belitang District, Belitang District, Buay Madang District, Buay Pemerged Subdistrict, Buay Pemerged Peliung, " The Subdistrict of Madang Tribe II, and Madang Tribe I District with an area of total area ± 3.370 km2; and Ogan Komering Ulu South District is composed of 10 (ten) districts, namely Kisam Tinggi, Buay Subdistrict. " The subdistrict of Buay Sandang Aji, the subdistrict of Muaradua, the subdistrict of Simpang, The Subdistrict of Buay Pemaca, the District of the Grand Appeal, the District of Mekiah Ilir, the District of Beringin Island; and the subdistrict Muaradua Kisam, with an area of total area + 5.493.94 km2.
., Ogan Komering Ilir County, which has an area of ± 21.691.58 km2 needs to be formed by Ogan Ilir Regency, which is the district of Indralaya, Subdistrict, Tanjung Raja District, Rantau Alai District, The district of Kuang Mouth, and the District of Tanjung Batu with an area of total area ± 2.666.09 km2.
