., b. that in connection with that, and in order to be more successful and useful, it is necessary to regulate the management of static archives in a single entity of the arcency system, with the President's Decision;

Establish: THE PRESIDENT ' S DECISION ON THE MANAGEMENT OF STATIC ARCHIVES.
BAB I
UMUM PROVISIONS
Section 1
In the Presidential Decree this is referred to:
1. The archive is:
.,
., a., a. Manuscripts created and accepted by the State and Governing Forces in any form of form are either in a single state or group, in the course of the execution of government activities;
., b. Manuscripts are made and accepted by private and/or individual bodies, in any form of form, in both a single state and in a group in the course of the exercise of the national life.
., 2. A static archive is an archive that is not used directly for planning, hosting the national life in general and for the day-to-day administration of the state.
., 3. Static archive management is a series of collection activities, storage, maintenance, rescue, use and coaching on the execution of the archive in a single system of kearsipan systems.
., 4. The National Archives of the Republic of Indonesia is the institution of the Central Government responsible for governance in the field of governance in accordance with the provisions of the laws of the Republic of Indonesia.
. .5. The Kearsipan Propinsi institute is a unit of the Propinsi Region's device organization responsible for the governance of the Province of Propinsi in the field of security in accordance with the provisions of the laws of the applicable laws.
., 6. District/City Kearsipan Institute is a unit of District/City hardware organization responsible in the administration of District/City government affairs in the field of kearcipan in accordance with the provisions of applicable laws.

STATIC ARCHIVE MANAGEMENT
The First Part
Common
Section 2
(1) The management of static archives is exercised by the Kearsipan Institution.
(2) The Kearsipan Institute as referred to in paragraph (1) consists of:
., a., a. National Archives of the Republic of Indonesia;
B. Institute Kearsipan Propinsi;
C. District/City Kearsipan Institute.
Section 3
Static archive management includes:
a. collection;
B. storage;
C. treatment;
D. rescue;
e. use;
f. coaching on the implementation of static archive submission.
Section 4
Static archival management is carried out by and is the responsibility of the National Archives of the Republic of Indonesia, the Kearsipan Institute of Propinsi, and/or the Regency/City Kearsipan Institution.
Section 5
.,, (1) In order to management static archives, the National Archives of the Republic of Indonesia, the Kearsipan Institute of Propinsi and/or the Regency/City Kearsipan Institute may cooperate with international bodies or agencies and/or foreign government agencies.
.,, (2) The cooperation as referred to in paragraph (1) does not include the management in terms of coaching on the implementation of the static archive as referred to in Article 3 of the letter f.
., (3) The provisions of the manner of cooperation in the management of static archives as referred to in paragraph (1) are further regulated by the Chief of the National Archives of the Republic of Indonesia.
Section 6
The management of static archives by the National Archives of the Republic of Indonesia, Kearsipan Propinsi Institute, and/or the Regency/City Kearsipan Institution is implemented against:
., a., a. Static archival manuscripts in any form of form are either in a single state or group handed over by a state-sheet country and governmental bodies both Central and Regional as an obligation to the archive as intended in 1971 The Number 7 Year of the Pokok Kearsipan.
., b. Static archival manuscripts in any form, whether in a single state or group made and received private bodies and/or persons required to be secured by the Government in order to perform the national life. with applicable laws.
The Second Part
Collection
Section 7
Static archival collection by the National Archives of the Republic of Indonesia, Kearsipan Propinsi Institute, and/or the Regency/City Kearsipan Institution is carried out through activities:
a. assessment;
B. alignment;
c. The creation of a static archive list.
Section 8
.,, (1) Head of the National Archives of the Republic of Indonesia, the leadership of the Kearsipan Institute Propinsi, and/or the Chairman of the Regency/City Kearsipan Institution conduct an assessment of the static archives submitted from the State Agencies and the Government Badsions both the Centre and the Regions and/or the acquired from private and/or individual bodies.
., (2) The assessment as referred to in paragraph (1) is done to the completeness and tenacity of the physical condition as well as the information value of the static archive for the proof of national accountability.
Section 9
In the event the results of the assessment as referred to in Article 8 indicate the complete and complete static archive of the physical condition and have the information value for the proof of national accountability, Head of the National Archives of the Republic of Indonesia, the Chairman of the Institute Kearsipan Propinsi, and/or the Regency/City Kearsipan Institution/City received static archives.
Section 10
.,, (1) In terms of the results of the assessment as referred to in Section 8 shows the static archive is incomplete and/or undergoes physical state damage but has the value of information for the proof of national accountability, the Head of the National Archives The Republic of Indonesia, the leadership of the Kearsipan Institute, and/or the Chairman of the Regency/City Kearsipan Institute:

., a., a. require the State and Local Government Agencies both Central and Regional, private and/or individual bodies to complete the static archive;
., b. receive static archives by conducted treatment efforts against the physical condition of the static archive that is damaged.
.,, (2) In terms of the results of the assessment as referred to in Article 8 indicating the static archive has no information value for the national accountability evidence, the National Archives of the Republic of Indonesia, the Chairman of the Institute of the Propinsi Kearsiment, and/or The leadership of the Central/City Kearsipan Institute returns the archive to the State Agencies and Government of the Government both the Centre and the Regions that give up static archives and can be recommended to be exterminated.
.,, (3) The static archive Criteria that has the value of information for national accountability is set by the National Archives of the Republic of Indonesia with regard to the applicable laws.
Section 11
.,, (1) Against the static archive received as referred to in Article 9 and Section 10 of the paragraph (1), the Head of the National Archives of the Republic of Indonesia, the Chairman of the Institute of Kearsipan Propinsi and the Chairman of the Regency/City Kearsipan Board made the News Event Serah Accept The Static Archive.

The Third Part
Storage
Section 14
.,, (1) static archive storage by the National Archives of the Republic of Indonesia, the Kearsipan Institute Propinsi, and/or the Regency/City Kearsipan Institution is executed on a special place of static archive storage.
.,, (2) The static archive storage as referred to in paragraph (1) is executed in accordance with the terms of the place and the technical manner of the static archive storage.
., (3) The terms of place requirements and technical methods of static archive storage as referred to in paragraph (2), are further regulated by the Head of the National Archives of the Republic of Indonesia.
The Fourth Part
The care
Section 15
.,, (1) static archival treatment by the National Archives of the Republic of Indonesia, the Kearsipan Institute Propinsi, and/or the Regency/City Kearsipan Institute is carried out through the prevention and restoration activities of the occurrence of damage.
.,, (2) The treatment of static archives through preventive activities as referred to in paragraph (1) is directed against the physical condition and information conceived in the static archive.
.,, (3) The treatment of static archives through restoration activities as referred to in paragraph (1) is directed against the physical condition of the static archive that is damaged.
Section 16
Preventive activities as referred to in Section 15 of the paragraph (2) are conducted with:
a. Selecting and clearing the physical condition of the static archive;
B. document the information contained in the static archive;
c. sterilized from the archive destroyer;
., d. restoring static archive, whose physical condition is malleable, whose implementation is performed in accordance with the provisions of the static archive restoration activities;
., e. storing static archives, which are performed in accordance with the provisions of static archive storage;
., f. controls the repository and the physical condition of the static archive periodically;

.,, (1) The restoration activities as referred to in Section 15 of the paragraph (3) are conducted with:

Section 18
The provisions of the static archive treatment manner as referred to in Article 15, Section 16, and Article 17, are further regulated by the Chief of the National Archives of the Republic of Indonesia.
The Fifth Part
Save
Section 19
The rescue of static archives by the National Archives of the Republic of Indonesia, Kearsipan Institute Propinsi, and/or the Regency/City Kearsipan Institute is carried out against the completeness and integrity of the physical condition as well as the information contained in the static archive.
Section 20
.,, (1) For the purposes of a static archive rescue, the National Archives of the Republic of Indonesia, the Kearsipan Propinsi Institute, and/or the Regency/City Kearsipan Institution may create a duplicate of static archive and/or alid the static archive into the form The other media.
.,, (2) the execution of the provisions as referred to in paragraph (1) is done with regard to the provisions of the applicable laws.
Section 21
Head of the National Archives of the Republic of Indonesia, Chairman of the Institute of Kearsipan Propinsi, and/or the Chief Executive Officer of Kearsipan Regency/City notifying it in writing to the Lembagalembaga state, the Government of the Government, both the Centre and the Regions, private bodies, and/or individual creators or archive recipients whose statistics are made duplicated and/or alidled into other media.

The provisions regarding the static archive rescue method as referred to in Article 19 and the notice as referred to in Article 21, are further set up by the National Archives of the Republic of Indonesia.
The Sixth Part
Usage
Section 23
.,, (1) The static archive managed by the National Archives of the Republic of Indonesia, the Kearsipan Institute Propinsi, and/or the Regency/City Kearsipan Institute is used for the benefit of government activities, research, education, scientific development and technology, as well as information dissemination.
.,, (2) The use of static archive as referred to in paragraph (1) is executed by keeping an eye on the safety and integrity of static archives as well as the provisions of applicable laws.
Section 24
.,, (1) The use of static archive can be carried out in and/or outside the Indonesian National Archives environment, the Kearsipan Institute of Propinsi, and/or the Regency/City Kearsipan Institution.
.,, (2) The use of static archives conducted outside the Indonesian National Archives environment, the Kearsipan Institute Propinsi, and/or the Regency/City Kearsipan Institute can only be done on the basis of written permission of the National Archives of the Republic of Indonesia Indonesia, the leadership of the Kearsipan Institute, and/or the Chairman of the District/City Kearsipan Institution.
.,, (3) To obtain the permission as referred to in paragraph (2), the concerned conveyances a written request.
(4) The answer to the applicant as referred to in paragraph (3) may be:
., a., a. static archive usage permissions;
B. Static archive usage permission denied.
.,, (5) In terms of permission of the use of the static archive rejected as referred to in paragraph (4) the letter b, Head of the National Archives of the Republic of Indonesia, the Chairman of the Institute for Kearsipan Propinsi, and/or the Chairman of the Regency/City Kearsipan Institution/City provides an excuse Rejection.
., (6) The terms of the grammar of the use of static archives conducted outside of the Indonesian National Archives environment, the Kearsipan Institute, and/or the Regency/City Kearsipan Institution as referred to in paragraph (2), are governed by further by the National Archives of the Republic of Indonesia.
Section 25
.,, (1) Head of the National Archives of the Republic of Indonesia, the leadership of the Kearsipan Institute Propinsi, and/or the Chairman of the Regency/City Kearsipan Institution/City can stop the activities of use of static archives if in implementation do not comply with the use of the Static archive as referred to in Article 23.
., (2) The provisions of the method of termination of the use of static archives as referred to in paragraph (1) are further regulated by the Chief of the National Archives of the Republic of Indonesia.
Section 26
.,, (1) The static archive that is due to its secret nature to be common, can only be used after receiving written permission of the National Archives of the Republic of Indonesia, the leadership of the Kearsipan Institute Propinsi, and/or the Leadership of the Kearsipan Institution District/City.
.,, (2) To obtain the permission as referred to in paragraph (1), the concerned conveyances a written request.
(3) The answer to the applicant as referred to in paragraph (2) may be:
., a., a. static archive usage permissions;
B. Static archive usage permission denied.
.,, (4) In terms of the permission of the use of the static archive are rejected as referred to in paragraph (3) letter b, Head of the National Archives of the Republic of Indonesia, Chairman of the Institute of Public Affairs, and/or the Chairman of the Regency/City Kearsipan Institution/City gives reason Rejection.
., (5) The provisions of the static archive of which are confidential and the manner of the granting of their permission for use as referred to in paragraph (1), paragraph (2), paragraph (3), and paragraph (4), are further regulated by the Chief of the National Archives of the Republic of Indonesia.
Section 27
.,, (1) In order of granting services to the use of static archives, formed the National Kearsipan Information Network.
.,, (2) The implementation of the creation of the National Kearsipan Information Network as referred to in paragraph (1) is conducted in accordance with the provisions regarding the National Kearsipan Information Network set forth in this Presidential Decree.
The Seventh Part
Coaching On The Implementation Of The Static Archive
Section 28
In order to exercise the duty of the handover of static archives by both the Centre and the Government both Central and Regional as referred to in Law Number 7 of 1971 on the provisions of Pokok Kearsipan, implemented coaching on the implementation of static archive submission.
Section 29
Coaching on the implementation of a static archive is intended to allow the static archives to be submitted to the National Archives of the Republic of Indonesia, the Kearsipan Institute of Propinsi, and/or the Regency/City Kearsipan Institute has the completeness and integrity of the conditions The physical as well as the value of information for the national accountability.
Section 30
(1) Coaching on the implementation of the static archive executed by:

., b. The Kearsipan Institute of Propinsi against the Institute or the working unit responsible for the management of the archive in the State Institutions Environment and the Provincial Government of the Province of Propinsi and the Central Government Badment in Propinsi;
., c. District/City Kearsipan Institute of Institutions or Working Units responsible for the management of archives in the State Institutions Environment and the District/City Local Government/City as well as the Central Government and Propinsi Government in the District/City.
.,, (2) In carrying out coaching, the Kearsipan Propinsi Institution and the District/City Kearsipan Institution guidelines on the way of coaching on the implementation of the static archive set by the National Archives of the Republic of Indonesia and Regard to the terms of the applicable laws.
Section 31
Coaching on the execution of a static archive covering the field:
a. archive, both in its manuscript form and other forms;
B. Human resources of the arsipan;
c. The means and the kearsipan infrastructure.
Section 32
Coaching on the implementation of the static archive is implemented through:
a. guidance;
B. consultation;
C. Counseling;
D. supervision and monitoring;
e. education and training;
f. other activities in the coaching frame.
BAB III
NATIONAL KEARSIPAN INFORMATION NETWORK
Section 33
In order to improve the form of good static archive management, the National Kearsipan Information Network is a nationwide network of information networks and information systems that are nationally static archive information services.
Section 34
The National Kearsipan Information Network has a function:
., a., a. Facilitate search and search of static archive in all areas of the Republic of Indonesia;
B. improving the provision of static archive usage services;
c. enhancing the dissemination and understanding of knowledge in the archive field.
Section 35
(1) The National Kearsipan Information Network consists of:
., a., a. Network Center;
B. Network Members.
.,, (2) The Network Center as referred to in paragraph (1) the letter a is the National Archives of the Republic of Indonesia.
(3) The Network Member as referred to in paragraph (1) the letter b is:
., a., a. Institute Kearsipan Propinsi;
B. District/City Kearsipan Institute.
Section 36
The Kearsipan Propinsi institute acts as a Network Center in Propinsi with Member Network of the District/City Kearsipan Institution.
Section 37
.,, (1) In the National Kearsipan Information Network loading information for any static archival manuscripts at least the description of:
., a., a. static creator name and/or archive recipient;
B. places and times of creation and/or static archive receipts;
c. form or static archive media;
D. brief description of the information conceived in the static archive;
e. The agencies and physical places of the static archive are stored;
f. Anything else is necessary.
.,, (2) The information contained in the National Kearsipan Information Network for a confidential static archive is set by the Head of the National Archives of the Republic of Indonesia.
Section 38
.,, (1) In the course of implementing the National Kearsipan Information Network function as referred to in Section 34, the Network Members host:

., a., a. the drafting of information for each static archive manuscript as referred to in Section 37 in the static archive list according to the guidelines set out by the National Archives of the Republic of Indonesia;
B. delivery of static archival lists to the Network Center;
c. management of the National Kearsipan Information Network in its environment;
D. provisioning and dissemination of static archive information;
., e. Periodic evaluation of the management of the National Kearsipan Information Network and conveying the results to the Network Center.
.,, (2) Delivery of static archival lists to the Network Center as referred to in paragraph (1) letter b by the Regency/City Kearsipan Institute is implemented through the Institute of Propinsi Kearnment.
Section 39
.,, (1) The National Archives of the Republic of Indonesia as the Centre of Network has the task of conducting the coaching, development, monitoring, and service of the National Kearsipan Information Network system.
.,, (2) The implementation of the provisions as referred to in paragraph (1) is further regulated by the Head of the National Archives of the Republic of Indonesia.
Section 40
All costs necessary for the implementation of the National Kearsipan Information Network are charged to the budget of each Network Member.
Section 41
.,, (1) In addition to the Kearsipan Propinsi Institute and the District/City Kearsipan Institute, the Archive Creator Institute can be a Network Member.
., (2) The terms regarding the requirements and manners of being a Network Member for the Archive Creator Institute as referred to in paragraph (1), are further regulated by the Chief of the National Archives of the Republic of Indonesia.

CLOSING PROVISIONS
Section 42
The President ' s decision comes into effect on the promulgated date.
