THE ESTABLISHMENT OF THE JAVATA STATE COURT, THE ROTE NDAO STATE COURT, THE STATE COURT OF THE ADVERSARIES, THE LOWER-ROKAN STATE COURT, THE NUNUKAN STATE COURT, AND THE CIVIL COURT OF MALINAU

PRESIDENT OF THE REPUBLIC OF INDONESIA,

.,, weighed: a. That in order to get justice and increased legal service to the public for the sake of solving the case with simple, quick, and light expenses, it is deemed necessary to form the Supreme Court of Lembata, Rote Ndao, The opponent, the Lower Rokan, the Nunukan, and the Malinau;
., b. that under Article 7 of the Law No. 2 Act 1986 of the General Judicial Act as amended by Law No. 8 of 2004, the State Court is established with the Presidential Decree;
., c. that based on consideration as referred to in the letters a and b, need to establish the Presidential Decree on the Establishment of the Lembata State Court, the Court of State of Rote Ndao, the State Court of the Students, the Lower Rokan State Court, The Nunukan State Court, and the State Court of Malinau;

.,, Given: 1. Section 4 of the paragraph (1) of the Basic Law of the Republic of Indonesia of Indonesia Year 1945;
., 2. Law No. 4 of the Year 2004 on the Power of Justice (State Gazette 2004 No. 8, Supplement of the Republic of Indonesia States No. 4358);
., 3. Law No. 14 Year 1985 on the Supreme Court (State of the Republic of Indonesia Year 1985 number 73, Additional Gazette Republic of Indonesia Number 3316), as amended by Law No. 5 of 2004 (State Sheet) Republic of Indonesia 2004 Number 9, Additional Gazette of the Republic of Indonesia No. 4359);

Act No. 2 Year 1986 on the General Judicial (sheet of state of the Republic of Indonesia in 1986 No. 20, Additional Gazette of the Republic of Indonesia No. 3327), as amended by Law No. 8 Year 2004 (State Sheet) Republic of Indonesia 2004 Number 34, Additional Gazette Republic of Indonesia Number 4379);
. .5. The Presidential Decree No. 21 of 2004 on the Transitional Organization, Administration, and Financial Services of the Public Judicial and Judicial Governing Law, and the Judicial Justice to the Supreme Court;

.,, SET: THE PRESIDENT ' S DECISION ON THE ESTABLISHMENT OF THE JAVATA STATE COURT, THE ROTE NDAO STATE COURT, THE COURT OF THE STATE OF THE COURT, THE LOWER HOUSE COURT OF THE LAND, THE NUNUKAN STATE COURT, AND THE CIVIL COURT OF MALINAU.

Section 1
(1) Shaped the Lembata State Court, based in Lewoleba.
(2) Forming The Rote Ndao State Court, based in Baa.
(3) Shaping the Court of State Labeling, based at the Kerinci Base.
(4) Forming The Lower Rokan State Court, located at the End of the Cape.
(5) Forming The Nunukan State Court, based in Nunukan.
(6) Forming The State Court Of Malinau, based in Malinau.

.,, (1) The legal area of the Lembata State Court covers the area of Lembata County, East Nusa Tenggara Province.
.,, (2) The Rote Ndao State Court ' s legal area covers the area of Rote Ndao County, East Nusa Tenggara Province.
.,, (3) The legal area of the State Court of Pelaopponents covers the area of Pelaopponent County, Riau Province.
.,, (4) The legal area of the Lower Rokan State Court covers the region of Lower Rokan Regency, Riau Province.
.,, (5) The legal area of the Nunukan State Court covers the territory of Nunukan County, East Kalimantan Province.
.,, (6) The legal area of the Malinau State Court covers the area of Malinau County, East Kalimantan Province.

Section 3
.,, (1) With the creation of the Lembata State Court, then Lembata County county was removed from the Larantuka State Court law area.
., (2) With the formation of the State Court of Rote Ndao, then the area of Rote Ndao County was removed from the Kupang District Court law area.
.,, (3) With the establishment of the State Court of Pelaopponents, then the area of Pelaopponent County was removed from the legal area of the Bangkinang State Court.
.,, (4) With the formation of Lower Rokan State Court, then the Lower Rokan Regency region was removed from the Dumai State Court law area.
.,, (5) With the formation of the State Court of Nunukan and the State Court of Malinau, then the territory of the Nunukan County and Malinau County was removed from Tarakan State Court law area.

Section 4
.,, (1) the Lembata State Court and the Rote Ndao State Court are included in the East Nusa Tenggara High Court law area.
.,, (2) the State Courts of Students and the Lower Rokan State Court are included in the law area of the Riau High Court.
.,, (3) the Nunukan State Court and the Malinau State Court are included in the legal area of the East Kalimantan High Court.

Section 5
.,, (1) Penal Perkara and the civil matter which included the scope of the authority of the Lembata State Court which at the time of this Presidential Decree is set to have been examined but has not been broken up by the Larantuka State Court, remains checked and distrauted by the Larantuka State Court.
.,, (2) Criminal justice and civil matter which includes the scope of the authority of the Rote Ndao State Court which at the time of this Presidential Decree is set to be examined but has not been broken by the Court of Land of Kupang, remains inspected and dissired by The Court of Land of Kupang.
.,, (3) Criminal Perkara and civil matters which include the scope of authority of the State Court of the Students that at the time of this Presidential Decree is set to be checked but have not been broken up by the Bangkinang District Court, remain checked and distrauted by the Supreme Court of the Resurrected.
., (4) Criminal Perkara and civil matters which included the scope of authority of the Lower Rokan State Court which at the time of this Presidential Decree is set to be checked but has not been broken up by the Dumai State Court, remains checked and distrauted by the Dumai State Court.
.,, (5) Criminal Perkara and civil matters which included the jurisdiction of the Nunukan State Court and the State Court of Malinau that at the time of this Presidential Decree are set to be examined but have not been broken up by Tarakan's Court of State, It remains checked and disconnected by the Tarakan District Court.

Section 6
.,, (1) the criminal complaint and the civil matter which included the scope of the authority of the Lembata State Court which at the time of this Presidential Decree is set to have been filed but has not been checked by the Larantuka State Court, devolve to the Court The Land Of Lembata.
., (2) the criminal and civil matter which included the scope of the authority of the Rote Ndao State Court which at the time of the Presidential Decree is set to have been filed but not yet checked by the Court of State of Kupang, devolve to the Court The Rote Ndao Country.
