SUBSIDIZED FERTILISER DESIGNATION
AS GOODS IN THE SUPERVISION OF

WITH THE GRACE OF THE ALMIGHTY GOD

PRESIDENT OF THE REPUBLIC OF INDONESIA,

.,, weighed: a. That fertilizer is a very important commodity in the effort to achieve national food security and the government has subsidized the procurement and distribution of certain types of fertilizer;
., b. That in order to oversee the procurement and supply of fertilizers that are subsidized, it is necessary to establish subsidized fertilizers as goods under surveillance;
., c. that based on consideration as referred to in letter a and letter b, need to establish the Presidential Regulation on Subsidizing Fertilizers as Goods in Oversight;

.,, Given: 1. Section 4 of the paragraph (1) of the Basic Law of the Republic of Indonesia of Indonesia Year 1945;
., 2. Law No. 8 Prp Year 1962 on the Trade of Goods in Supervision (State Sheet of the Republic of Indonesia Year 1962 Number 42, Additional Gazette Republic of Indonesia Number 2469);
., 3. Government Regulation No. 11 of 1962 on the Trade of Goods in Supervision (State Sheet of the Republic of Indonesia Year 1962 Number 46, Additional Gazette Republic of Indonesia Number 2473) as amended by Regulation. Government Number 19 Of 2004 (Sheet State Of The Republic Of Indonesia In 2004 Number 68, Additional Sheet Republic Of Indonesia Number 4402);

DECIDED:

.,, SET: THE PRESIDENT ' S REGULATION ON THE DESIGNATION OF SUBSIDIZED FERTILIZERS AS GOODS IN SURVEILLANCE.

Section 1
In this Presidential Regulation referred to:
., 1. Subsidized fertilizer is the fertilizer that is procuring and the distribution is subsidized by the Government for the needs of farmers exercised on the basis of Government programs in the agricultural sector;
., 2. Procurement is the process of providing subsidised Pupuk derived from domestic and/or import production;
., 3. Mixing is the process of distributing the subsidised Pupuk from the manufacturer's level up to the level of the farmer as the end consumer.

Section 2
., (1) With the Regulation of this President, Pupuk subsidised is set as an item in oversight as referred to in the Prp Number 8 Act of 1962 on the Trade of Goods in Supervision.
.,, (2) The subsidised Pupuk as referred to in verse (1) consists of Urea, SP 36, ZA and NPK.
., (3) The supervision as referred to in paragraph (1) includes the Procurement and the Fulfillment, including the type, number, quality, marketing region and the highest retail price of the Subsidised, as well as the procurement time and the distribution time.

Section 3
The further provisions are necessary for the implementation of this Presidential Regulation governed by the Minister responsible in the trade field after coordinating with the associated minister.

Section 4
With the enactment of this Presidential Regulation, any provision regarding the supervision of the Subsidised Pupuk is declared to remain in effect as long as not contradictory and has not been replaced with a new one under this Presidential Regulation.

Section 5
This President ' s regulation begins to apply at the set date.
