THE ESTABLISHMENT OF THE SAMBAS STATE COURT, THE STATE COURT OF
BENGKAYANG, AND THE CIVIL COURT BUOL
WITH THE GRACE OF THE ALMIGHTY GOD
PRESIDENT OF THE REPUBLIC OF INDONESIA,
.,, weighed: a. that in order for the opportunity to obtain justice and the increase of legal services, the need to form the Crown Court of Sambas, the District Court of Bengkayang, and the Court of State of Buol;
., b. that under Article 7 of the Act No. 2 of 1986 of the General Judicial Act as amended by Law No. 8 of 2004 on the Changes to the Act No. 2 of 1986 of the General Judicial, the Court of State was created. with the Presidential Decree;
., c. that based on consideration as referred to in letter a and letter b, need to establish the Presidential Decree on the Establishment of the Sambas State Court, the District Court of Bengkayang and the Buol State Court;
.,, Given: 1. Section 4 of the paragraph (1) of the Basic Law of the Republic of Indonesia of Indonesia Year 1945;

Law No. 14 Year 1985 on the Supreme Court (State of the Republic of Indonesia Year 1985 Number 73, Additional Gazette Republic of Indonesia Number 3316), as amended by Law No. 5 Year 2004 (State Sheet) Republic of Indonesia 2004 Number 9, Additional Gazette of the Republic of Indonesia No. 4359);

Act No. 2 Year 1986 on the General Judicial (sheet of state of the Republic of Indonesia in 1986 No. 20, Additional Gazette of the Republic of Indonesia No. 3327), as amended by Law No. 8 Year 2004 (State Sheet) Republic of Indonesia 2004 Number 34, Additional Gazette Republic of Indonesia Number 4379);

.,, SET: THE PRESIDENT ' S DECISION ON THE ESTABLISHMENT OF THE SAMBAS STATE COURT, THE BENGKAYANG STATE COURT, AND THE CIVIL COURT OF BUOL.
Section 1
It forms the Sambas State Court, the Bengkayang State Court, and the Buol State Court each based in Sambas, in Bengkayang, and in Buol.
Section 2
.,, (1) The legal area of the Sambas State Court, covering the area of Sambas County, West Kalimantan Province.
.,, (2) The laws of the Bengkayang State Court include the area of Bengkayang County, West Kalimantan Province.
.,, (3) The legal area of the Buol State Court covers the area of Buol County, Central Sulawesi province.
Section 3
., (1) With the creation of the Sambas State Court and the Bengkayang State Court, then the area of Sambas County and the area of Bengkayang County was removed from the Singkawang State Court law area.
.,, (2) With the formation of the Buol State Court, the area of Buol County was removed from the Toli-Toli State Court law area.
Section 4
.,, (1) the Sambas State Court and the Bengkayang State Court are included in the law area of the West Kalimantan High Court in Pontianak.
.,, (2) The Buol State Court is included in the law area of Central Sulawesi High Court in Palu.
Section 5
.,, (1) Penal Perkara and the civil matter which included the jurisdiction of the Sambas State Court and the Bengkayang State Court which at the time of this Presidential Decree is set to have been examined but have not been broken by the State Court Singkawang, remains inspected and dissired by the Singkawang District Court.
., (2) Penal Perkara and the civil matter which included the scope of the authority of the Buol State Court which at the time of this Presidential Decree is set to be examined but has not been broken up by the Toli-Toli State Court, remains examined and broken by Toli-Toli State Court.
Section 6
.,, (1) the criminal complaint and civil matter which includes the jurisdiction of the Sambas State Court and the Bengkayang State Court which at the time of the Presidential Decree is set to have been filed but have not been checked by the District Court Singkawang, devolve to the Sambas State Court and the Bengkayang State Court.
.,, (2) Penal Perkara and the civil matter which included the scope of the authority of the Buol State Court which at the time of the Presidential Decree is set to have been filed but unchecked by the Toli-Toli State Court, devolve to the Court The Land of Buol.
Section 7
Financing is required in the formation and coaching of the Sambas State Court, the Bengkayang State Court and the Buol State Court charged on the Supreme Court ' s budget.
Section 8
Class assignments, duties, functions, organizational arrangements, Secretariat and the Secretariat of the State of the Sambas State, the District Court of Bengkayang and the Buol State Court, were appointed by the Chief Justice of the Supreme Court after receiving the approval of the Minister. that is responsible in the field of the country's apparatus.
Section 9
This President ' s decision comes into effect at the set date.
