BAB I

provisions of UMUM

Article 1

In this Regional Regulation is intended with:

1. The area is Garut County.

2. The Regional Government is the Regent and the area's device as an element of the regional government's organizer.

3. " Bupati is the regent of Garut.

4. The Regional People's Representative Council (DPRD) is the representative body of the local people as an organizer of the local government.

5. The Regional Revenue and Shopping Budget (APBD) is the annual financial plan of the Local Government which is discussed and agreed jointly by the Regional Government and the Regional People's Representative Council, and is established with the Regional Regulation.

6. The inclusion of regional capital is any attempt to include regional capital on a joint venture with a third party, with a certain reward.

7. Regional Companies are all companies established under the No. 5 Act of 1962, whose capital is for the whole or for some part a wealth of the separated regions, unless otherwise specified under the Invite-Invite.

8. The People's Bank of Representatives (PD.BPR) is a people's credit bank that is all over or most of its capital is owned by the Government of Garut Regency through direct capital inclusion that is derived from the government. the wealth of the separated regions.

9. -Yeah. PK is the District Company of the District.

10. -Yeah. BPR LPK is a subsidiary of the Percrediting Bank of the People's Institution of Subdistrict.

11. The next General Meeting of Shareholders, called RUPS, is the Organ PD. BPR and PD. PK holds the highest power in the PD. BPR and PD. PK and hold any authority not submitted to the Board of Directors and/or the Leadership and/or Supervising Board.

12. Area financing is all the receipts that need to be repaid and/or expenses to be readmitted, either in the year of the budget in question or in the next budget years.

13. Investment is the use of assets to benefit economic benefits such as interest, royalty, social benefits and/or other benefits so as to improve the ability of the government in order to service to the community.

BAB II

PURPOSE

Article 2

The regional capital dispute is on PD.BPR, PD. BPR LPK and PD. PK aims to:

a. Improving the PD's application. BPR, PD. BPR LPK and PD. PK as a Regional Government investment, thus having a high saing power;

b. The fulfilment of the capital is suitable for the composition of the shareholdings;

c. development of financial services/banking services for the productive efforts of Small and Medium Mikro Business Credits (UMKM), especially in the desiccation; and

d. contribute to the original income of the area.

BAB III

INCLUSION OF CAPITAL

Article 3

(1) The inclusion of regional capital is on the PD. BPR, PD. BPR LPK and PD. PK based on the base capital corresponds to the proportion of the holdings in total of Rp. 15,700,000,000,-(fifteen billion seven hundred million rupiah).

(2) The inclusion of the Government of the Local Government as referred to in verse (1) to 31 December 2007 has been named for Rp. 5,769,863,322.86 (five billion seven hundred and sixty-nine million eight hundred and sixty-three thousand three hundred and three thousand. twenty-two rupiah eighty-six cents).

(3) The remaining capital obligations of the Regional Government on PD.BPR, PD. BPR LPK, and PD. PK is Rp. 9.930.136.677.14 (nine billion nine hundred and thirty million one hundred and thirty-six thousand six hundred and seventy-seven rupiah).

(4) The inclusion of regional capital was budgeted in the APBD of Garut Regency of Budget Year 2008 of Rp. 9.400,000,000,-(nine billion four hundred million rupiah).

(5) The use of regional capital inclusion as referred to in paragraph (4), provided in accordance with the provisions of the Bank of Indonesia with the emphasis of financial/banking services for productive efforts of Small and Medium Mikro Business credits (UMKM) at the desicization.

BAB IV

MANAGEMENT OF REGIONAL CAPITAL INCLUSION

Article 4

(1) The inclusion of regional capital as referred to in Section 3, in the form of money and is budgeted on APBD Garut County 2008 Budget.

(2) The implementation of regional capital inclusion in the APBD as referred to in paragraph (1), is budgeted in the financing expenditure on the Regional Government (investment) type of capital.

(3) The Regent conducts coaching and supervision against the implementation of regional capital inclusion on the PD. BPR, PD. BPR LPK and PD. PK.

(4) The execution of the coaching and supervision as referred to in paragraph (3) may be exercised by the Regional Secretary.

Article 5

Any changes in the magnitude of the inclusion of capital in the PD. BPR, PD. BPR LPK and PD. PK as referred to in Article 2 and Section 3, must be included in the Garut County Regulation on APBD and executed by the Decree of the Regent.

Article 6

(1) In terms of PD. BPR suffers losses or may not provide benefits during consecutive budget years based on the audit results of authorized officials, the Local Government can stop the inclusion of permanent and non-permanent capital in accordance with the with the provisions of the laws.

(2) The capital of the inclusion of capital as referred to in paragraph (1) is carried out upon consideration of the City Council of Garut.

(3) the implementation of the cessation of capital disputes has been given the consideration of the Garut County Council. as referred to in paragraph (2) reported to the DPRD Garut Regency.

BAB V

CONTROL Article 7

PD.BPR, PD. BPR LPK and PD. PK is required to deliver an annual financial report to the Regent.

Article 8

(1) In an effort to drive the economic growth rate of the area, PD.BPR, PD. BPR LPK and PD. PK must be:

a. implement the good corporate governance principle principle that includes the principle:

1. transparency;

2. justice;

3. accountability; and

4. Liability.

b. improving the capabilities, competency and commitment of human resources;

c. enhancing the ability to conduct business strategies in order to do a healthy venture competition; and

d. conduct a strategic alliance to improve the performance and productivity of the venture.

(2) The Regent is required to conduct an assessment of the PD.BPR, PD obligations. BPR LPK and PD. PK as referred to in paragraph (1), at least 2 (two) times in a year.

(3) The regent may designate other parties that are independent and professional in performing judgment as referred to in verse (2).

(4) The Regent provides a report to the Garut County DPRD regarding the results of the assessment as referred to in paragraph (2) and (3).

(5) Garut County DPRD conduct a review of the Bupati report as referred to in paragraph (4).

BAB VI

OTHER CONDITIONS AND CLOSING

Section 9

Things that are not sufficiently set in this Section Regulation, as long as the technical implementation will be further set up with the Bupati Regulation. in accordance with the provisions of this

Article 10

The rules of the Regions begin to take effect on the date of the promulgations and the retroactive effect since January 2008.
