PRESIDENT OF THE REPUBLIC OF INDONESIA,

That to spur the development and progress of the province of Papua in general and Jayawijaya Regency in particular and the presence of aspirations developed in society, there needs to be increased governance, implementation of development, and public service in order to accelerate the welfare of the community;
., b. that with regard to geographical conditions, economic capabilities, region ' s potential, region-wide, fullness, and consideration of political aspects of politics, social culture, defense, and security as well as the increasing burden of duty and volume of work in the the area of governance, development, and the community in Jayawijaya Regency, needs to be done in the formation of Lanny Jaya County in the province of Papua province;
., c. that the formation of Lanny Jaya County is expected to be able to encourage improvement of services in governance, development, and society, and may provide capability in the utilization of potential areas;
., d. that under consideration as intended in the letter a, the letter b, and the letter c need to form an Act on the Establishment of the County of Lanny Jaya in the Province of Papua;

BAB I
UMUM PROVISIONS

Section 1
In this Act referred to:
., 1. The central government, subsequently called the Government, is the President of the Republic of Indonesia which holds the power of government of the Republic of Indonesia as referred to in the Basic Law of the Republic of Indonesia in 1945.
., 2. An autonomous region, next called the area, is a unity of the legal society that has the boundaries of the region that authorities regulate and take care of the affairs of government and the interests of the local community according to its own initiative based on aspiration People in the State of the Republic of Indonesia system.

ESTABLISHMENT, SCOPE OF TERRITORY,

With the formation of Lanny Jaya Regency, as referred to in Article 2, the region of Jayawijaya Regency is reduced with the territory of Lanny Jaya Regency as referred to in Article 3.

The Region limit

Section 5
(1) Lanny Jaya Regency has the boundaries of the region:

B. the east borders the Asologaima District of Jayawijaya;
.,, c. south of the border with Mbuwa District, Yigi District, Mugi District, Mapenduma District, Nduga County Geselma District; and
., d. It is bordered to the west by the Puncak Regency District and the Illu District of Puncak Jaya Regency.
., (2) The boundary of the region as referred to in paragraph (1) is described in the map of the region that is an inseparable part of this Act.
(3) The territorial extent of Lanny Jaya Regency is definitively in the field as referred to in verse (1) and verse (2) is set by the Minister of the Interior at least 5 (five) years since it was infused Lanny Jaya Regency.

The Head of the Regional Head

Section 9
The inauguration of Lanny Jaya regency and the appointment of the Regent of Lanny Jaya Regency was conducted by the Minister of the Interior on behalf of the president of the longest 6 (six) months after the Act was promultable.

The Second Part
The Local Government

Section 10
.,, (1) To lead the holding of government in Lanny Jaya County, elected and passed by a Regent and Vice Regent in accordance with the most prolonged legislation 1 (one) of the year since the formation of Lanny Jaya Regency.

Section 11
The first financing of the election of the Bupati and the Vice Regent Lanny Jaya as referred to in Article 10 of the paragraph (1) is charged to the Jayawijaya County Regional Revenue and Shopping Budget of Rp3.000.000.00 (three billion rupiah) and the Papua Provincial Regional Revenue and Shopping Budget amounted to Rp1,000.000.00 (one billion rupiah).

Section 13

PERSONNEL, ASSETS, AND DOCUMENTS

.,, (5) The removal of personnel as well as the submission of assets and documents to Lanny Jaya County is facilitated by the Governor of Papua.
., (6) Gaji and civil servant benefits as referred to in paragraph (4) as long as it has not been granted the Lanny Jaya County Regional Revenue Budget and Shopping Budget is charged on the income and shopping budget of the personnel working units are concerned with applicable laws.
(7) Assets and documents as referred to in paragraph (1) and paragraph (3) include:

.,, (9) The implementation of the transfer of personnel as well as the submission of assets and documents as referred to in paragraph (1) is reported by the Governor of Papua to the Minister of the Interior.

BAB VI
REVENUE, REBALANCING FUND ALLOCATION,
GRANT, AND THE HELP OF THE FUND

Section 15
.,, (1) Lanny Jaya County reserves the right to obtain the allocation of balancing funds in accordance with the laws.
.,, (2) In the balance funds as referred to in paragraph (1), the Government allocates special allocation funds of the government infrastructure in accordance with the laws.

Section 16
.,, (1) Jayawijaya County government in accordance with its interference grant money to support the activities of the governing of Lanny Jaya Regency by Rp10,000.000.00 (ten billion rupiah) every year for 2 (two) In a year
.,, (2) The government of Papua Province provides financial assistance to support the activities of the governing body of Lanny Jaya Regency by Rp5,000.000.00 (five billion rupiah) every year for 2 (two) consecutive years.
(3) The grant of the grant as referred to in verse (1) and the granting of the aid of funds as referred to in verse (2) began since the appointment of the Regent of Lanny Jaya.
.,, (4) If Jayawijaya County does not meet its interference in accordance with the provisions as referred to in paragraph (1), the Government reduces the acceptance of Jayawijaya County general allocation funds for granted to the Government Lanny Jaya County.
.,, (5) If the Province of Papua does not meet its interference in accordance with the provisions referred to in paragraph (2), the Government reduces the receipt of the general allocation of the Papuan Province to be granted to the Government Lanny Jaya County.
.,, (6) Regent Regent Lanny Jaya conveys the realization of the use of the grant as referred to in paragraph (1) to the Regent Jayawijaya.
(7) The regent of Lanny Jaya addressed the account of the responsibility of the realization of the use of grant funds and aid funds as referred to in verses (1) and verse (2) to the Governor of Papua.

BAB VII
COACHING

Section 18

THE TRANSITION PROVISION

Section 19
.,, (1) Before the creation of the Regional Representative Council, the Regent of Lanny Jaya drafted the Draft Rules of Regulation on the Budget and Shopping Budget of the Lanny Jaya Regency for the next budget year.
(2) The rule of the regent of Lanny Jaya as referred to in verse (1) is exercised after it was passed by the Governor of Papua.

Section 20
.,, (1) Before Lanny Jaya County set the rules of the area and the rules of the regent as the implementation of this Act, all the rules of the region and the Rules of the Regent Jayawijaya as long as it does not conflict with this Act remain in effect and It is held by the government of Lanny Jaya.

BAB IX
CLOSING PROVISIONS

Section 21
At the time of the enactment of this Act, all provisions in the laws relating to Lanny Jaya County must be adjusted to this Act.

Section 22
Further provisions as implementation of this Act are governed by the laws.

Section 23
This Act goes into effect on the promulgable date.

I. UMUM

.,, the province of Papua which had an area of ± 309,934.40 km² with the population in 2005 amounted to ± 1. 841,548, consisting of 20 counties and 1 (one) cities, needed to spur an increase in governance in order to maintain the Union of the Republic of Indonesia.
.,, Jayawijaya County, which has an area of ± 6,585 km², with a population in 2005, is 209,881, composed of 39 (thirty-nine) districts. The district has a potential development to support the increased governance of the government.
