M E M U T U S K A N: setting: REGULATION of the MINISTER of STATE HOUSING SUBSIDIES for the IMPLEMENTATION of the ORDINANCE on HOUSING through SUBSIDIZED MORTGAGE article 1 housing subsidy program implementation through subsidized financing to simple healthy Home ownership (RSH), using the procedures for the implementation of the Housing Subsidy Through Subsidized MORTGAGE as an attachment that is inseparable from the regulation of the Minister. Simple healthy Mortgages (KPRSH) is a credit or financing Institution, published by the Issuer or Credit Financing that includes Subsidized MORTGAGES, KPRS/KPRS Subsidized MORTGAGE, or Micro Sarusuna Subsidized, either conventional or with the principles of the Sharia. 2. Subsidized Mortgages, Subsidized MORTGAGES, hereinafter referred to as the credit is issued by the Issuer of credit to low-income communities in the framework of a simple healthy home ownership (RSH) purchased from a developer. 3. The credit Issuer Institution, hereinafter the LPK, a bank or financial institution is a non bank or cooperative that are willing and have the ability to deliver a Statement carrying out Housing aid programs as well as able to provide the needed credit to principal possession of simple healthy Home as set forth in the Memorandum of understanding/Agreement (MoU) or partnership agreements and Operations (PKO) and the Ministry of State Housing. 4. The debtor is the target group that has signed a Credit Agreement Subsidized MORTGAGE Documents. 6. The reference Rate is BI BI Rate issued in January for the realization of Subsidized MORTGAGES in January until June and the BI Rate, issued in July for the realization of Subsidized MORTGAGES in July up to December of the current year. 15. the SBI Rate is the interest rate securities issued by Bank Indonesia as a recognition of the one-month short term debt issued in the first week of each month. 16. Market interest Margin is the number of components that comprise the overhead cost, risk premium and the profit margin used to determine the magnitude of market interest rates during the period of the subsidy consists of fixed and variable margin margin. 17. fixed Margins is the market interest margins set out in PKO. 18. a variable Margin is the difference between SBI Rate with BI Rate twelve months back, in terms of the absolute value of the difference between SBI Rate with BI Rate less than 0.25 (comma zero two five) then a variable margin equal to 0 (zero). 19. the average variable Margin is the average margin is variable twelve months back. 20. CHAPTER II INSTITUTIONAL ROLE and DIVISION a. Institutions involved: 1. Ministry of State public housing, namely: a. the Deputy field of financing (DBP). b. Formal Housing Deputy (DBPF). c. Financing of housing Center (PPP). 2. The Ministry of finance, namely: a. the Directorate General budget (HEIGHT DJA). b. the Directorate General of the Treasury (NOOBS UNITED). 3. The credit Issuer Institution (LPK). B. the role of the Institutions involved 1. DBP, DBPF, PPP, HEIGHT DJA, and it plays a role in drafting the NOOBS UNITED programme, provision, verification, liquefaction, and control (monitoring, evaluation, and follow-up hands down) the implementation of the housing subsidy. 2. the LPK was instrumental in publishing terms, the provision of Subsidized MORTGAGE principal credit/loans and channeling funds housing subsidies. Implementation Phase Implementation Phase is publishing activities ranging from Subsidized MORTGAGES by LPK Executor until disbursement of subsidies. The details of the implementation phase as follows: 1. The issuance of Subsidized MORTGAGES and Request verification. a. Implementing LPK Subsidized MORTGAGES to borrowers issuing that meet conditions; b. Managing housing subsidies count LPK rights of the debtor in accordance with skim chosen; c. Cash Management Directorate in particular the NOOBS UNITED State contested against SPM filed and issued the warrant of Disbursements (SP2D) in SPM submitted meet the requirements. f. Channeling subsidies to housing a. LPK Executor receives housing subsidies from the account in accordance with KUN SP2D published by authority of the State General Treasurer (BUN). b. Follow-up activities of monitoring and evaluation is a form of correction actions and recommendations or follow-up hands down over the performance of the execution of the program; 4. Recommendations for action or follow up correction and lend a hand to control program is in the form of: a. a warning letter; b. for the removal and restoration of subsidies; c. the legal process against the irregularities which occurred in accordance with the rules of the applicable legislation. Flow chart of the implementation of the Monitoring, Evaluation and control as listed in Figure 4. CHAPTER IV PROVISIONS IMPLEMENTING Provisions a. LPK 1. Financial institution Bank: a. national public banks or private banks of national or regional development bank (BPD) or of the people's bank (BPR); b. legal body, has a business license and permit the operation of establishments that are authorized; www.djpp.depkumham.go.id


2008, no. 104 10 c. asking the willingness and the ability to publish a Subsidized MORTGAGE using the Format A; d. specific to BPR must attach financial statements 2 (two) years that have been audited by public accounting or relevant authorities; e. sign the MoU and PKO with Ministries or public housing; f. follow all provisions that apply to the implementation of the program. 2. A Non Bank financial institution (LKNB)/Koperasi: a. law, has purchased a business license and permit the operation of establishments that are authorized; b. ask the willingness and the ability to publish a Subsidized MORTGAGE using the Format A; c. attach the recommendations as Subsidized MORTGAGE programs executing from the local Bupati/Walikota and from institutions/Association of the Builder; d. total assets of at least Rp. 1,000,000,000.00 (one billion dollars) on its own and not allowed the Consortium; e. have the ability to provide the loan principal as evidenced by the positive current assets (current assets is larger than the debt smoothly) and a letter of support from the Bank; f. already operate and do save the loan for at least 2 (two) years; g. have interested members against Subsidized MORTGAGES for a minimum of 20 (twenty) people; h. Attach annual report/Annual Member Meeting 2 (two) years that have been authorized by the Department/Office to local Cooperatives; i. attach financial statements 2 (two) years that have been audited by public accounting or relevant authorities; j. financial report audit results should go in categories healthy; k. have the staple Taxpayer Number (NPWP) on behalf of the Institution; b. have a checking account in the name of the institution; d. follow all provisions that apply to the implementation of the program. B. target group 1. Target group who qualify get the subsidies: a. has never had a home/dwelling. b. housing subsidies have not yet received. www.djpp.depkumham.go.id 2008, no. 104 11 c. has earnings from work/effort based upon principal or income base salary per month at most Rp. 2,500,000.00 (two million five hundred thousand dollars), which is divided into three (3) target group, as provided for in article 2 of the regulation of the Minister of State for Housing number 03/CANDY/M/2007 about the procurement of Housing and settlements with support Facilities Housing Subsidies Through Subsidized MORTGAGE. 2. Choice of skim subsidies provided through Subsidized MORTGAGE is as follows: a. skim subsidies target group I is the IO-BP Subsidies combined with Subsidies Subsidies Interest Difference or difference in Interest without the combination of the IO-BP or subsidy money upfront. b. skim subsidies target group II and III are Subsidies IO-BP combined with Subsidies Subsidies Interest Difference or difference in Interest without the combination of the IO-BP.
