REGULATION of the MINISTER of STATE for WOMEN'S EMPOWERMENT of the REPUBLIC of INDONESIA number 01 in 2009 ABOUT the MINIMUM SERVICE STANDARD INTEGRATED SERVICES for WITNESSES and/or VICTIMS of PEOPLE TRAFFICKING OFFENSE in KABUPATEN/KOTA with the GRACE of GOD ALMIGHTY STATE MINISTER of the EMPOWERMENT of WOMEN of the REPUBLIC of INDONESIA, Considering: that in order to implement the provisions of article 7 paragraph (1) Government Regulation No. 9 in 2008 about Procedures and mechanism of Integrated Services for Witnesses and/or victims of criminal acts of Trafficking People need to set rules of State Minister of the empowerment of women Minimum service standard Integrated Services For Witnesses and/or victims of criminal acts of Trafficking of people in the district/city; Remember: 1. Government Regulation Number 65 in 2005 about the drafting of the Guidelines and the application of the minimum service standard (State Gazette of the Republic of Indonesia Number 150 in 2005, an additional Sheet of the Republic of Indonesia Number 4166); 4. Presidential Decree Number 194/M in 2004 as it has been modified several times, the last presidential Regulation number 17 in 2007 on the establishment of a United Indonesia Cabinet; www.djpp.depkumham.go.id 2009, no. 180 3 decide: define: REGULATION of STATE MINISTER of the EMPOWERMENT of WOMEN of the REPUBLIC of INDONESIA on MINIMUM SERVICE STANDARD INTEGRATED SERVICES for WITNESSES and/or VICTIMS OF CRIMINAL ACTS of TRAFFICKING of PEOPLE in the district/city. CHAPTER I GENERAL PROVISIONS article 1 in this rule is meant by: 1. a minimum service standard hereinafter the SPM is the benchmark of the performance of service Integrated Services Centre at the Kabupaten/Kota in providing protection and social rehabilitation and reintegration services to witnesses and/or victims of criminal acts of trafficking people. 2. District/city zoning administration in Indonesia after the province led by the Regent/Mayor, and in the context of this regulation kabupaten/kota is a division of the administration area and geography including districts, subdistricts/villages, certain areas, households and families. 3. Local Governments are the Bupati/Walikota and other areas as the organizer of the local government. 4. Integrated Service Centers hereafter PPT is a functional work units which hosted services integrated for witnesses and/or victims of people trafficking and criminal acts can also serve victims of violence against women and children. 5. Rehabilitation is the restoration of witnesses and/or victims of people trafficking offense of impaired physical condition, psychological, and social-so that it can carry out its role reasonably well back in the family and in society. 6. Social Reintegration is the reunification efforts of witnesses and/or victims with the family, the family of a replacement, or a community that can provide protection and fulfillment of a need for witnesses and/or victims TPPO. www.djpp.depkumham.go.id 2009, no. 180 4 Article 2 SPM for witnesses and/or victims of criminal acts of trafficking people are meant to be guidelines for the region in carrying out the planning of the implementation, control and monitoring and accountability for conducting integrated services for witnesses and/or victims of criminal acts of trafficking people. Article 3 the granting of a minimum service for witnesses and/or victims of people trafficking offense aims to provide services to witnesses and/or victims of people trafficking a criminal offence in accordance with the basic needs of witnesses and/or victims of criminal acts of trafficking people. Article 4 MSS Services Integrated for witnesses and/or victims of people trafficking offense based on the principles of: a. respect the rights of witnesses and/or victims, it means services given to witnesses and/or victims protection reflect and respect human rights, the dignity and the dignity of witnesses and/or victims of criminal acts of trafficking of persons; b. non-discrimination, that is to say services apply to all witnesses and/or victims of crime without distinguishing trade status, religion, tribe, race, class and gender; and c. accountability, meaning that the service of witnesses and/or victims of criminal acts of trafficking people responsive to the community in accordance with the provisions of the legislation. Article 5 technical implementation Instructions SPM integrated services for witnesses and/or victims of people trafficking offense as listed in the appendix to this Regulation. CHAPTER II MINIMUM SERVICE STANDARD INTEGRATED SERVICES for WITNESSES and/or VICTIMS OF CRIMINAL ACTS of TRAFFICKING of PEOPLE in the district/city article 6 SPM integrated services for witnesses and/or victims of criminal acts of trafficking of people in district/municipality include: www.djpp.depkumham.go.id 2009, no. 180 5 a. handling public complaints; b. health rehabilitation services; c. the Ministry of the protection of the law; d. Ministry of social rehabilitation; e. the Ministry of repatriation; and f. the Ministry social reintegration. Article 7 (1) the handling of public complaints about criminal acts of trafficking of people referred to in the article 6 letter a include the percentage coverage of the availability of the officer who has the ability to follow up public complaints about the existence of criminal acts of trafficking people. (2) the ability of officers to deal with complaints about the existence of the crime trade people as intended in paragraph (1) is done through certification training. Article 8 Health Rehabilitation Services as stipulated in article 6 letter b include: a. the percentage coverage of rehabilitation services provided by a health officer who trained on witnesses and/or victims of criminal acts of trafficking of persons; and b. the rehabilitation Ministry of health coverage that provides special room for witnesses and/or victims of acts of trafficking of people in hospitals or clinics. Article 9 the Ministry of protection of the law as stipulated in article 6 letter c covers: a. the scope of cases of criminal acts of Trafficking People who managed it was decided on the basis of Act No. 21 of 2007 about the eradication of criminal acts of Trafficking of persons; and b. the scope of service of legal protection to witnesses and/or victims of People Trafficking Offense given by law enforcement. Article 10 of the social rehabilitation Services as stipulated in article 6 letter d include the percentage coverage of social rehabilitation assistance services at home www.djpp.depkumham.go.id 2009, no. 180 6 social protection and the like to witnesses and/or victims of criminal acts of trafficking of people by social rehabilitation officers. Article 11 of Ministry for the repatriation referred to in the article 6 letter e includes the percentage coverage of the services provided to witnesses and/or victims of criminal acts of trafficking to return to areas of origin. Article 12 social reintegration Services as stipulated in article 6 letter f includes the percentage coverage of social reintegration services to witnesses and/or victims of criminal acts of trafficking people who returned to the family, the community and other substitute families. Article 13 determination of performance indicators and targets Integrated Services for SPM witnesses and/or victims of people trafficking offense in Kabupaten/Kota referred to in Article 7 to article 12, the minimum target is to be achieved gradually. CHAPTER III CONSTRUCTION of clause 14 of the country's Ministry of women empowerment along with related sectors doing the construction to local government district/municipality in implementing SPM Ministries women's empowerment of Integrated Services for Victims/witnesses and criminal acts of Trafficking people. 2009, no. 180 7 article 16 the granting of facilitation as referred to in article 3 a include: a. calculation of the resources and funds needed to reach the MSS including financing gap; b. preparation of the plan of the achievement of annual targets and defining SPM achievement; c. assessment of the achievements of the work achievement of SPM; and d. report preparation work achievement achievement of SPM. Article 17 granting of general orientation as referred to in article 15 the letter b include granting knowledge of PPT, service, and management. Article 18 the instructions as referred to in article 15 of the letters c include directives in writing and not writing about PPT, service, and management. Article 19 the giving guidance as mentioned in Article 15 the letter d include technical or non technical guidance about PPT, service, and management. Article 20 granting of education as stipulated in article 15 of the letter e include granting technical skills either through formal education, informal and non formal. CHAPTER IV MONITORING, evaluation and REPORTING of article 21 (1) State Minister for women empowerment along with related sectors are responsible for carrying out monitoring and evaluation of the implementation of the integrated service SPM for witnesses and/or victims of people trafficking in PPT at the Kabupaten/Kota. (2) in carrying out monitoring and evaluation, State Minister of the empowerment of women working with the local government.
