REGULATION OF ENERGY MINISTER AND MINERAL RESOURCES

REPUBLIC INDONESIA NUMBER 32 IN 2009

ABOUT THE BENCHMARK PRICE OF THE PURCHASE OF ELECTRIC POWER BY PT PLN (PERSERO) FROM THE GEOTHERMAL POWER PLANT

WITH THE GRACE OF GOD ALMIGHTY THE MINISTER OF ENERGY AND MINERAL RESOURCES OF THE REPUBLIC OF INDONESIA,

THE DRAW: THE that to implement the provisions of Article 19 and Section 20 of the paragraph (1) of the Government Regulation Number 59 of 2007 on the Activities of the Geothermal Effort and Section 32 A paragraph (4) of the Government Regulation Number 10 of 1989 on the Supplies and Heating Of Power Electricity as it has been twice amended by the Government Regulation No. 26 of 2006, needs to establish the Minister's Regulation on the Price of the Supply of Electric Power Purchase By PT PLN (Persero) of the Earth's Geothermal Power Plant;

DECIDED: Establishing: REGULATION OF MINISTER OF ENERGY AND RESOURCES

MINERALS ABOUT THE BENCHMARK PRICE OF PURCHASING POWER POWER BY PT PLN (PERSERO) FROM THE GEOTHERMAL POWER PLANT.

Article 1 (1) In order to meet the needs of electricity in the

region of its business and the use of eco-friendly energy, assigning PT PLN (Persero) to purchase electric power from geothermal power plants.

(2) The purchase of electric power as referred to in paragraph (1) is implemented in accordance with the PT PLN (Persero) Electric Power Supply Plan.

(3) The purchase of electric power as referred to in paragraph (1) is carried out on geothermal power plants within the geothermal mining work region of the Earth: a. winner of the auction of geothermal mining worklands;

and b. The holder of a geothermal mining workforce that

has been derived from the granting of power or permission of the geothermal enterprise under legislation prior to the promulgitation of the Law Number 27 Year 2003 on Heat Earth.

Article 2 (1) In order for the auction of the thermal mining work region

the earth as referred to in Article 1 of the paragraph (3) letter a, set the highest benchmark price of 9.70 cent USD /kWh for the purchase of electric power by PT PLN (Persero).

(2) The highest benchmark price as referred to in paragraph (1) is applied to the purchase of an electric power on the high voltage side.

Article 3 against the auction that has been implemented before the Ordinance of this Minister, results The auction became a reference in the purchase of electric power by PT PLN (Persero) by guideline at the highest benchmark price as referred to in Article 2.

Article 4 For the purchase of electric power from the holder of the thermal mining workspace the earth as referred to in Article 1 of the paragraph (3) of the letter b by PT PLN (Persero) is performed under the terms of the parties 'agreement with guidelines on the highest benchmark price as referred to in Article 2.

Article 5 of the Minister' s Regulation shall begin in effect on the specified date.
