CHANGES TO THE REGULATION OF FORESTRY MINISTER NUMBER P. 01/MENHUT-II/2009 ON THE HOLDING

PERBENIHAN FOREST PLANT

WITH THE GRACE OF GOD ALMIGHTY MINISTER OF THE REPUBLIC OF INDONESIA,

: a. that as a further implementation of the Government Regulation No. 44 of 1995 on the Perbenihan Plants, it has been established the Ordinance of Forestry Minister Number P. 01/Menhut-II/2009 on the Governing Forest Plant;

b. that in order to provide more legal and bureaucratic certainty in the field of forest plants, then it is necessary to change the Ordinance of the Forest Minister Number P. 01/Menhut-II/2009 on the Governing Law Of Forest Plants with the Ordinance of the Minister " The Republic of Indonesia.

DECIDING: THE REGULATION OF THE REPUBLIC OF INDONESIA ' S FORESTRY MINISTER ON THE CHANGES TO THE REGULATION OF FORESTRY MINISTER NUMBER P. 01/MENHUT-II/2009 ABOUT THE ESTABLISHMENT OF FOREST PLANT BENIHAN.

Article I Some provisions in the Regulation of the Minister of Forestry Number P. 01/Menhut- II/2009 on the Governing of the Forest Plant, are amended as follows: 1. The provisions of Article 1 of the number 6 are changed, so that Article 1 of 6 reads as

following: Article 1

6. The next genetic resource called area of genetic resource conservation is an areal managed to maintain the presence and benefit of genetic resources of a type of forest plant, in the form of genetic conservation, arboretum, a gene bank, or a clone bank.

2. The provisions of Article 14 plus one new letter are letters a, so that the entirety of Article 14 reads as follows:

Article 14

The glorification of the forest plant as referred to in Article 13 may be exercised by:

a. The government, the Provincial Government, and the District/City Government. B. Individual;

c. Enterprise (BUMN, BUMS, BUMD, Koperating); or

d. College.

3. The provisions of Article 19 of the paragraph (2) of the letter g and verse (5) are changed, so that the entirety of Article 19 reads as follows:

Article 19

(1) The absence of the seed from the domestic production comes from the source of the seed managed by the seed of the seed.

(2) The source of the seed as referred to in paragraph (1) is distinguished according to the genetic quality with the following classification:

a. The seed teg is identified;

b. The selecteest seed;

c. areal seed production;

d. The seeds of the provenant seeds;

e. Seed garden as well;

f. Clone seed garden;

g. garden pagile.

(3) The sequence of genetic qualities on the classification as referred to in verse (2) starts from the lowest in the letter a to the highest in the letter g.

(4) The source class of the seed as referred to in paragraph (2) of the letter a up to the letter g must be specified with the seed source certificate.

(5) The source standard of the seed as referred to in paragraph (2) is set forth in Annex 1 of the Regulation. This.

(6) Further provisions on the standard implementation of seed sources are governed by the Director General.

4. The provisions of Article 34, are removed. 5. Terms of Section 41, deleted. 6. The provisions of Article 45 are amended, so the entirety reads as follows:

Article 45 (1) The certificate of the source of the seed as referred to in Article 44

is published by the Head of the Propinsi/District/City or Hall Service. (2) The seed-source certification procedure is as set forth in

Attachment 7 of this Regulation. 7. Terms of Section 46, deleted. 8. Terms of Section 49, deleted. 9. The provisions of Section 50 are amended, so that the entirety of Article 50 shall be read

as follows: Section 50

(1) The District/City Service and the Provincial Service that perform the certification must meet the criteria and standards of the certification executor.

(2) The criteria and standards of certification of the certification as referred to in paragraph (1) are as set forth in Annex 10 of this Regulation.

10. The provisions of Article 53 are amended, so that the entirety of Article 53 reads as follows:

Article 53 of the provisions of the manner of voting and the magnitude of the levies and the manner of the repayment of the forest plant service is governed by its own rules in accordance with the laws.

Article II of the Ordinance of the Minister of Forestry is beginning to take effect on the date of the promulcity.

STANDARD SEED SOURCE

A. Seed-source classification Based on the genetic material used to build seed sources, seed sources can be distinguished by classification as follows: 1. Identified Seeds (TBT), which is the source of the seed with quality

The average tegakan, designated from the natural forest or the forest forest and its location identified appropriately.

2. The Seed of Selection (TBS) is a source of seed derived from TBT with the quality of the above average.

3. The Areal Seed Production (APB), which is a source of seed built specifically or derived from TBT or TBS enhanced quality through logging of the trees that the phenotide is not good.

4. The Provenan Seed (TBP) is the source of the seed built from the seed which the provenal provenant has tested.

5. The Semai Seed Garden (KBS), is a seed source built from a generative material derived from a tree plus on the tegakan which is treated by the prison for the production of the offspring to produce the generative material (seeds).

6. The clone seed garden (KBK) is a seed source built from a vegetative material derived from a tree-plus on the tegakan which is treated as a prison treatment based on the result of a seed test to produce the generative matter (seeds).

7. The Pagile Garden (KP) is a seed source built from a vegetative material derived from a superior clone based on the result of a clone test to produce vegetative matter.

B. Seed Source Standards

1. The common standard of seed sources a. Accessibility

The source location of the seed must be easy to reach so it makes it easier for its exposure as well as its fruit download as well as accelerating the time of transport. The location of a seed source that has good accessibility will also further guarantee the physical quality of seeds.

b. The enlarging of Tegakan should ever be flowering and fruiting, except for the seed garden of the vault.

c. Security. Tegakan should be safe from the threat of fire, illegal logging, moving field, grazing and regional looting.

d. The health of the teg. It should not be stricken with pests and diseases.

e. Areal limit. The areal limit must be clear, so the seed collector knows the tegakan which is included as a seed source.

f. Well managed. The seed source is clearly its ownership status as well as having good management indicators, such as maintenance, organizing, seed utilization and others.

2. Special standard seed source

a. "Identifiable Seeds" (TBT) 1) The origin of natural forest or plant forest. If the tegakan is

of the plant forest, it is not planned from the beginning to serve as a seed source.

2) The origins of the seed are not known. 3) The number of trees is at least 25 parent trees. 4) The quality of the average tegakan. 5) The isolation line is not required. 6) The Pennet is not performed. 7) See illustration in image 1.

b. The Originating Seed of Selection (TBS) 1) is the origin of natural forest or plant forest. If the tegakan is

of the plant forest, it is not planned from the beginning to serve as a seed source.

2) The origins of the seed are not known. 3) The number of trees is at least 25 parent trees.

4) The quality of the tegakan above average. 5) The isolation line is not required. 6) Limited use in poor trees. 7) See the illustration in image 2.

c. Areal Seed Production (APB) 1) The origin of the natural forest or plant forest. If the tegakan is

of the plant forest, it can be derived from the conversion of existing or built specifically to the APB.

2) The origins of the seeds for the converted tegakan as APB should be known. If built specifically for APB, the origin of the seed must be known. Lot of seeds to build minimal APB comes from 25 parent trees to maintain genetic diversity.

3) The number of trees is at least 25 bars in one stretch after the prison. 4) The quality of the tegakan above the quality of TBS. 5) The isolation path is required. 6) The groaning is done to maintain the best of the trees

and increase seed production. 7) See illustration in image 3.

d. The origin of the seed of provenan (TBP) 1) is derived from the plant forest. 2) The origins of the seeds of one of the best provenants of the provenal test results. Lot

seeds to build a minimum TBP derived from 25 parent trees to maintain genetic diversity.

3) The number of trees is at least 25 bars after the prison. 4) The quality of the tegakan above the quality of APB. 5) The isolation path is required. 6) The groaning is done to maintain the best of the trees

and increase seed production. 7) See illustration in image 4.

e. Seed garden Semai (KBS) 1) Seed comes from a plant forest or natural forest. 2) The family ' s origins of the parent tree/tree plus. Family identity

listed on the map (garden design) or family sign in the field.

3) The number of trees is at least 25 families after the prison. 4) The quality of the genotipa is good. 5) The isolation line is required. 6) The groaning is done to maintain the best familial-families

and increase seed production. The prison is based on the method of selection according to the results of the offspring test.

f. Clone Seed Garden (KBK) 1) Clone comes from the tree plus offspring test results. 2) The origin of the clone of a plus tree. Seeds are separated according to kloni (tree

parent). The identity of a clone in a seed garden is inscribed on a map (garden design) and/or a sign in a tree.

3) The number of trees is at least 25 clones after the prison. 4) The quality of the genotipa is good. 5) The isolation line is required. 6) Replers are performed to maintain the best clones

and increase seed production. This prison is based on the results of the offspring based on sightings of clones in seed gardens. The prison consists of a clone prison (cutting down the uglier clone) and the prison in a clone (cutting down the ugly phenotype in a clone and leaving one tree).

g. Petting Garden (KP) 1) The origins of vegetative materials are derived from the superior clone of the clone test results.

The herb is separated (the offspring of one parent tree in each bedeng) or a mixture (offspring of some stem trees in a single bedeng).

2) The quality of the genotipa is good. 3) There is no need for an isolation path. 4) The KP is managed with triming, weathering and other treatment for

increasing the production of stek materials. The safe garden for a certain period is replaced with new plant material if it is considered the steak is hard to take root because it is too old.

ANNEX 7 REGULATIONS MINISTER FORESTRY REPUBLIC OF INDONESIA Number: P. 72/Menhut-II/2009

SEED SOURCE CERTIFICATION PROCEDURE. Seed

1. The owner of a seed source or seed-holder proposes a seed-source certification request to the Propinsi/County/City Service in its territory with a supporting document lamped.

2. Special for District/City that does not have an agency that is assigned to the task and is responsible in the field of forestry, then a request is submitted to the instance designated by the Regent/Mayor.

3. On the basis of the plea: a. The Head of the Service or Head of the Hall formed the Assessor Team for the source

the seed with the TBT, TBS, and APB classifications by engaging the skilled or expert power of the associated elements among other Hall, UPT Agency.

b. In terms of seed-source certification for the classification of TBP, KBS, KBK and KP, the Head of the Service requested a technical recommendation from the Hall or delivered the request to the Hall. Next the Hall forms a Team of Assessor by engaging skilled or expert forces from other related elements of the Hall, UPT Agency.

4. The team conducts information gathering with field orientation (quick tour) to determine eligibility as a seed source.

5. The information collected to determine the worthiness of the seed source as referred to in item 4 is used as the material to meet the general criteria of the seed source.

6. Identification results that meet the common criteria of seed sources can be accepted as potential seed sources, then followed by a description of the state of the seed while for the source of the rejected seed, Tim did not perform the description. Identification and description are performed by filling the list of fillings as presented on Blanko 1 and the determination of the seed source classification using the standard and criteria as contained in Appendix 1.

7. The seed-source certification team of the TBT, TBS and APB classification seed sources provide the report results to the Head of the Service or the Head of the Hall. While the seed-source certification team classification TBP, KBS, KBK and KP provide a report of the examination results to the Head of the Hall.

B. Seed-Source Certificate Publishing 1. The head of the Propinsi/District/City Service or the Hall publishes the certificate

the source of the seed on the basis of the report of the Team or the recommendation of the Hall and is delivered to the seed source owner by busan to the Hall.

2. The seed-source certificate format is presented on Blanko 2. 3. The provisions of the seed source certificate are:

a. One seed source certificate number only applies to one seed source location and for one type of plant (species).

b. The seed certificate does not apply in the event of any damage to the seed source, the change in the function/status of the seed source, and is not productive anymore.

c. The period applies to seed source certificates 5 (five) years, after which it can be re-evaluated with the same procedure.

CRITERIA AND STANDARDS ACTING CERTIFICATION

A. The executor criteria for the Provincial/District/City Service Certification that select the field of sub-

fields of forest plant must have the ability to:

1. Host seed-source certification; 2. Organing seed quality certification; 3. Organing seed quality certification. The Governor/Regent/Mayor makes a report to the Minister about the readiness of the Provincial/District/City Service to host the certification.

B. Certifications 1. Organization standards include:

a. It has an organizational structure, a description of duty and responsibilities related to the activities of the benihan and nursery activities;

b. Has a standard work procedure for managing documents and data; c. It has a standard work procedure in carrying out the certification.
