(2) The international average price or average price of FOB or CIF Rotterdam as referred to in paragraph (1) is set by price average during the last periodic prior to the designation of HPE.
(3) Average Price as referred to in paragraph (2) is calculated from the periodic start up to 10 (ten) days prior to the expiration of the next periodic HPE designation.
Article 5
(1) HPE of the export goods as referred to in Section 2 of the paragraph (1), set forth after coordinating with the minister/head of the related technical entity/head of the technical body.
(2) The Coordination as referred to in paragraph (1) the implementation is performed by element of the Department of Commerce alongside non-department/body department/government agencies The technical and associated commodities associations are incorporated into the HPE Penetration Team.
(3) The HPE Penetration Team as referred to in paragraph (2) is formed by the Minister.

Article 6
(1) HPE as referred to in Section 5 of the paragraph (1) may be proposed by:
a. Minister of Agriculture in this regard Director General of Processing and Marketing of Agriculture Results, Department of Agriculture for the export goods of Agriculture and Plantation products;
b. Minister of Industry in this regard the Director General of Industrial Agro and Chemistry, Director General of the Metal, Machine, Textile and Industrial Department of Industry for the export goods of the industrial products; and/or
c. Minister of Forestry in this case Director General Bina Production Forestry, Department of Forestry for export goods of Forest products.
(2) The proposal as referred to paragraph (1) is delivered in writing to the Minister through Chairman of the Team Ten (10) days prior to the expiration date of the HPE period.
(3) The proposal as referred to in paragraph (2) is discussed by the HPE Penetration Team.
(4) Based on the results of the discussion as referred to in paragraph (3), the HPE Redemption Team proposes the designation of HPE to the Minister.
Article 7
In case of the new HPE, HPE has expired previously. expires, declared to remain in effect.
Article 8
At the time of the enactment of this Minister Regulation, the Regulation of Trade Minister Number 25/M-DAG/PER/12/2005 on the Tata Way Pricing Of Export Benchmark (HPE) Over Certain Export Goods, revoked and declared not applicable.
