Back NEWS REPUBLIC of INDONESIA No. 54, 2009 REGULATIONS the MINISTER of INDUSTRY of the REPUBLIC of INDONESIA number: 37/M-IND/PER/3/2009 on the IMPLEMENTATION of the INDONESIAN NATIONAL STANDARD (SNI) SAFETY SHOES are MANDATORY with the GRACE of GOD ALMIGHTY MINISTER of INDUSTRY of the REPUBLIC of INDONESIA,.,, Considering: a. that in order the application of standard industrial products, in order to guarantee the quality of industrial products and achieve power production as well as to protect consumers against product quality , as well as creating a healthy business competition, the need to enact national standards Indonesia (SNI) Safety Shoes are mandatory;
.,, b. that based on considerations as referred to in letter a, needs to be issued Ministerial Regulation of industry;

DECIDED:.,, define: REGULATION of the MINISTER of INDUSTRY REGARDING the ENFORCEMENT of the NATIONAL STANDARD (SNI) SAFETY SHOES are mandatory.
Article 1 In this ministerial regulation is:.,, 1. certificate Products Use Standard National Indonesia Marks hereinafter referred SPPT-SNI is the use of Telltale Products SNI Certificate issued by Certifying Products to manufacturers who are able to produce goods or services and the appropriate terms of SNI.
., ,2. National Accreditation Committee hereinafter called KAN is a non structural institutions that are under and is responsible directly to the President, is authorized to accredit an institution/laboratory for conducting certification.
., ,3. Certifying products hereinafter referred to as LSPro is an institution that has been accredited by the National Accreditation Committee or appointed by regulation of the Minister of industry to make use of the product certification mark of SNI.
., ,4. Director General the Director General of industry is a builder of Industrial Metal and textile machinery, the Ministry of industry.
., ,5. The head is the head of Agency BPPI research and industrial development, the Ministry of industry.
., ,6. The Head Office of the province is the province of the head of Department carry out the Affairs of Government in the field of industry.
., ,7. The Head Office of Kabupaten/Kota is the Head Office of Kabupaten/Kota that carry out the Affairs of Government in the field of industry.
Article 2, (1) to impose a national standard (SNI) Indonesia and those revisions or compulsorily, against three (3) Safety Shoes as follows:.,,.,, a. Safety Shoes with Rubber Soles of leather Print System Vulcanization according SNI 12-0111-1987 HS 6403.40.00.00;
.,, b. Safety Shoes from the skin with Goodyear Welt, the quality and the way the Test, according to SNI 03-7037-2004 HS 6403.40.00.00; and, c.., Shoe leather Seat with Polyurethane Soles and Polyurethane Thermoplastic injection molding Systems, according to SNI 12-7079-2005 HS 6403.40.00.00.
.,, (2) Safety Shoes as mentioned in subsection (1) is working to protect the shoe away workers from the hazards associated with the work environment.
Article 3 industrial company producing Safety Boots as mentioned in article 2, mandatory:.,, a. applying the SNI-SNI SPPT and have Safety Shoes in accordance with provisions of the SNI; and, b.., affix a mark SNI on any product in a way that is not easily lost match conditions.
Article 4 Safety Shoes as stipulated in article 2, which are derived from the results of the domestic production or import is obligated to comply with the STANDARD referred to in article 3.

Article 5, (1) the publication of the SPPT-SNI Safety Shoes as referred to in article 3 a, executed by LSPro which has been accredited by the RIGHT and or designated by the Minister of industry, through:.,,.,, a. testing the suitability of quality Safety Shoes according to the provisions in the SNI; and, b.., auditing the implementation of the quality management system of the SNI 19-9001-2001/ISO 9001-2000 and those revisions or other quality management system recognized.
.,, (2) the test referred to in subsection (1) can the letters a to disubkontrakkan:.,,.,, a. laboratory examiners accredited KAN or designated by the Minister of industry; or, b.., laboratory examiners in foreign countries all had Mutual Recognition Agreement or Mutual Recognition Arrangement (MRA) between Accreditation Bodies with the RIGHT of countries concerned, as well as have bilateral agreements in the field of technical regulation multirateral or between the Government of the Republic of Indonesia with the country concerned.
.,, (3) Audit of the quality management system referred to in subsection (1) letter b on the basis of a guarantee issued by an institution quality system certification is accredited by the Accreditation Body or RIGHT in foreign countries that have the agreement of mutual Recognition with the RIGHT.
Section 6.,, (1) the Import Safety Shoes that will enter the Customs area of Indonesia is obligated to comply with the STANDARD as evidenced by SPPT-SNI.
.,, (2) a safety Shoe imports that has possess SPPT-SNI must be registered in accordance with the provisions of the legislation.
Chapter 7.,, (1) a safety Shoe imports that do not meet the conditions referred to in article 2 and article 4 prohibited entry into the customs area of Indonesia and must be direekspor or destroyed.
.,, (2) the Ordinance reekspor and or destruction referred to in subsection (1) is carried out in accordance with the legislation.
Article 8 LSPro who published a safety Shoe SNI SPPT is responsible for the implementation of the supervision and monitoring of the use of Safety Shoes from SNI Sign SPPT SNI published.

Article 9 LSPro as stipulated in article 5 clause (1) report to the Director General of the sertifikasinya implementation of the constructor of the industry, with copy to the head of a provincial Department Head, BPPI, head of Department and district/city where the location of the factory.

Section 10.,, (1) the Director General of the Builder of the industry implement coaching and supervision of implementation of the enforcement against SNI Safety Shoes as mentioned in article 2 and article 3 in the plant which was carried out by a supervisory Officer of standard goods and services at the factory (PPSP) at least one (1) times within 2 (two) years.

.,, (2) the head of the Institution carry out coaching against BPPI conformity assessment in the framework of enforcement of Safety Shoes SNI compulsorily referred to in article 2.
.,, (3) the implementation of the supervision referred to in subsection (1) may coordinate with the head of Department or head of Department provincial and Kabupaten/Kota.
Article 11 the Director-General of industry Builder set technical guide in the implementation of the regulation of the Minister.

Article 12 businessmen who commits a violation of the provisions in the regulations the Minister is penalized in accordance with the legislation.

Article 13 this Ministerial Regulation entered into force 6 (six) months from the date set.
