PLANT QUARANTINE INTO THE STATE TERRITORY OF THE REPUBLIC OF INDONESIA

.,, weighed: a. that with the Minister of Agriculture Decree Number 38 /Kpts/HK.310/1/ 90 has set the Terms and Conditions of Quarantine Plants For The Income Of Plants and Plant Bibits Into The State Territory Of The Republic Of Indonesia;
., b. that with the development of science and technology, the Decree of Agriculture Minister Number 38 /Kpts/HK.310/1/ 90 is no longer in compliance and needs to be reviewed;
., c. that on the basis of those things above and to follow up the mandate of Article 27 of the Government Regulation No. 14 Year 2002 on the Quarantine Plant, is seen needing to establish the Requirements and Acts of the Plant Quarantine Act on Media Inclusion Of A Quarantine Plant Disruptor Organism Into The Indonesian State Of The Republic Of Indonesia;

.,, establish: AGRICULTURAL MINISTER REGULATIONS ON THE REQUIREMENTS AND EVENTS OF PLANT QUARANTINE MEASURES AGAINST THE INCOME OF MEDIA CARRIERS OF THE BULLY PLANT QUARANTINE PLANT INTO THE COUNTRY OF THE REPUBLIC OF INDONESIA.

BAB I
UMUM PROVISIONS

Section 1
In this Regulation referred to:
., 1. Plant quarantine is an act of prevention of entry and availability of plant disruptor organisms from abroad and from an area to other areas within the country or beyond within the territory of the Republic of Indonesia.
., 2. Plant disruptor organisms that are next called OPT are all organisms that can damage, disrupt life and/or lead to plant death.
., 3. The Quarantine Plant disruptor organism that is next called OPTK is all OPT set by the Minister to be prevented from entering into and its dissolution within the territory of the Republic of Indonesia.
., 4. Important plant-Penggangu organisms called OPTP are OPT in addition to OPTK, whose presence in laminated plant seeds may lead to an economically adverse effect on the purpose of the use of plant seeds. It was assigned by the Minister to be subject to a plant quarantine.
. .5. The OPTK and/or OPTP carrier media is next called the Carrier Media is a plant and its parts and/or other objects that can carry OPTK and/or OPTP.
., 6. Plants are all kinds of natural resources in life or death, whether or not being processed or processed.
., 7. Other objects include biological control, organisms, soil, compost, organic fertilizers, or other plant growth media, and vectors.
., 8. OPTK Group I is an OPTK that cannot be released from the media carrier by way of treatment.

.,, 12.The carrier media carriers are all land, water or air transport tools used to outstrip the carrier media.
.,, 13,Places of income is a seaport, a river port, a shipping port, an airport, a post office, a border post with another country, which has been designated as a place to include the media carriers from abroad.
.,, 14.Goods submissions are cargo (cargo) or postal submissions from abroad that will be incorporated into the country territory of the Republic of Indonesia.

., 19.National Plant Protection Organization hereafter called the NPPO is a government organization of a country that handles plant protection nationwide.
.,, 20.Owner of the carrier media hereafter called the owner is the person or legal entity that owns the carrier media and/or who is responsible for the inclusion or transit of the carrier media.
.,, 21.Officers Plant Quarantine is the functional officer of the Controlling Organism Bully Organism that works on the Plant Quarantine Agencies.
., 22.Certificate of Plant Health is a letter of information made by the authorized officer in the country of origin/transit stating that the plants or plant parts listed in it are free of OPT, OPTK, and/or OPTP as well as have met the specified plant quarantine requirements and/or stated the required details.
.,, 23.Media carrier transit is a carrier medium that temporarily stops and is derived from the transport tools within the country of the Republic of Indonesia before the carrier's media reach the destination country.
.,, 24,Pestillation or explosi was a sudden-onset OPT attack, its population developed very quickly and spread widely quickly.
., the 25.State that has a high risk is a country that has a strong potential as a place that is the source of the deployment of OPT.

Section 2
.,, (1) This Regulation is intended as the basis for the execution of a quarantine act by the Officer of Plant Quarantine to the income of the carrier media into the territory of the Republic of Indonesia, and to the individual or legal entity in entering the media The carrier into the country of the Republic of Indonesia.

Section 3

1. Plant quarantine requirements;
., 2. Quarantine actions against the carrier media entered into the country of the Republic of Indonesia;

4. Notifications of inconsistness (Notification of Non Compliance);
5. Recognition and ecivalence; and
6. Plevy of quarantine action services.

BAB II
PLANT QUARANTINE REQUIREMENTS

The Kesatu section
Common

Section 4
.,, (1) Any of the carrier media entered into the country of the Republic of Indonesia, it is mandatory:
.,
., a., a. Provide a plant health certificate from a country of origin and transit country for plants and parts, except for the carrier's media.
B. through specified entry points; and
., c. reported and submitted to the Plant Quarantine Officer in the area of income for the purposes of quarantine action.
., (2) The use of a plant health certificate from a country of origin and/or transit country as referred to (1) the letter a with the electronic model applies, if:
.,
., a., a. way of publishing and security has been approved by the Agricultural Quarantine Agency;
., b. The description listed in the plant health certificate corresponds to the model set by International Plant Protection Convention (IPPC);
C. publishing terms in accordance with the IPPC provisions; and
D. the identity of an instance that publishes clear and easily recognizable.
., (3) The terms of the validity of plant health certificates from the country of origin and/or transit country as referred to in paragraph (1) the letter a, as well as the reporting and submission of the carrier media as referred to in paragraph (1) of the letter c as listed on Appendix I as part is inseparable with this Regulation.
.,, (4) The change of Annex I as referred to in paragraph (3) is further set by the Chief of the Agricultural Quarantine Agency on behalf of the Minister of Agriculture.

Section 5
., (1) If the health certificate as referred to in Section 4 in accordance with the laws may not be published by the authority in the country of origin, against the carrier media may be subject to quarantine action.
(2) The (2) media carrier as referred to in verse (1) is the result of a dead plant which has undergone a processing process as set forth in Annex II as part of this Regulation.
.,, (3) The change of Annex II as referred to in paragraph (2) is further set by the Chief of the Agricultural Quarantine Agency on behalf of the Minister of Agriculture.

The Second Part
Additional obligations

Section 6
Any media carrier entered into the country of the Republic of Indonesia, in addition to the mandatory meeting of requirements as referred to in Article 4, may be subject to additional obligations.

Section 7
., (1) The additional obligation as referred to in Section 6 is subject to the circumstances specified under the result AROPT is assessed as having the potential to result in the spread of plant disruptor organisms.
(2) Additional Liability as referred to in paragraph (1) may be:
., a., a. technical requirements; and/or
B. Document completion requirements.
., (3) The provisions of the technical requirements and/or the terms of the document completeness as referred to in paragraph (2) are further set by the Chief of the Agricultural Quarantine Agency.

Section 8
., (1) AROPT as referred to in Article 7 paragraph (1) of the inclusion of the carrier media performed by the Plant Quarantine Officer and the result is authorized by the Chief of the Agricultural Quarantine Agency based on the recommendation of the AROPT Team.
.,, (2) The AROPT team as referred to in paragraph (1) was formed by the Chief of the Agricultural Quarantine Agency.
.,, (3) The implementation of AROPT as referred to in paragraph (1) as set forth in Annex III as part inseparable with this Regulation.
.,, (4) The change of Annex III as referred to in paragraph (2) is further set by the Chief of the Agricultural Quarantine Agency on behalf of the Minister of Agriculture.

BAB III
QUARANTINE ACTIONS AGAINST THE SPECIFIED CARRIER MEDIA
INTO THE REPUBLIC OF THE REPUBLIC OF INDONESIA

The Kesatu section
The Quarantine Action Is Performed

Section 9
Quarantine action can be performed:
a. in the home country; and/or
B. in the country territory of the Republic of Indonesia.

Section 10
.,, (1) quarantine measures in the country of origin as referred to in Article 9 of the letter a may be done to the carrier media which is not prohibited, and based on AROPT results:
.,
., a., a. The carrier media is not a carrier media that is exposed to the act of exile and observation; and
., b. It is considered to be more effective and efficient than in place of income within the country of the Republic of Indonesia.
.,, (2) The quarantine measures in the home country as referred to in paragraph (1) are the replacement of the quarantine measures executed in the area of income within the country of the Republic of Indonesia.
.,, (3) quarantine measures in the home country as referred to in paragraph (1) must be agreed upon by NPPO state sender and recipient country, importer, exporter, and carrier media manufacturer.
.,, (4) The quarantine measures in the home country as referred to in paragraph (1) are performed for each one time the carrier media income.
.,, (5) The provisions of the quarantine measures in the country of origin as set forth in Annex IV as part are inseparable with this Regulation.
.,, (6) The change of Annex IV as referred to in paragraph (5) is further set by the Chief of the Agricultural Quarantine Agency on behalf of the Minister of Agriculture.

Section 11
The quarantine action in the country region of the Republic of Indonesia as referred to in Article 9 of the letter b, can be performed:
a. in the income place; and/or
B. out of revenue space.

Section 12
.,, (1) quarantine measures in place of admission as referred to in Section 11 of the letter a, may be performed on top of the transport and/or after being derived from the transport.
.,, (2) The quarantine action after being downgraded from a transport device as referred to in paragraph (1) may be performed inside or outside the quarantine installation.
.,, (3) quarantine measures outside the quarantine installation as referred to in paragraph (2) among others in the container terminal, gundang, or dock.

Section 13
.,, (1) quarantine measures outside of the income premises as referred to in Section 11 of the letter b, may be performed in the quarantine installation or elsewhere outside the quarantine installation.
.,, (2) The execution of a quarantine action outside of the income place as referred to in paragraph (1) is governed in its own regulations.

The Second Part
Quarantine Actions

Section 14
Based on the report of the carrier media inclusion as referred to in Section 4 of the paragraph (1) the letter c, the Chief Technical Managing Unit (UPT) of the Agricultural Quarantine assign it in writing to the Plant Quarantine Officer to conduct quarantine measures.

Paragraph 1
The check

Section 15
.,, (1) Plant Quarantine Officer after receiving the task as referred to in Article 14 of conducting inspection action.
.,, (2) The actions of the Examination as referred to in paragraph (1) include administrative checks and health checks.

Section 16
In the event of an administrative examination results referred to in Section 15 of the paragraph (2) the carrier media is still above the transport, it turns out:
a. not carrier media, no quarantine action done;
., b. It is the bearer's media whose suppliers are subject to exile and observation, acts of exile and observation;
c. does not meet the required provisions, carried out a rejection act;
., d. It's the kind of carrier-media that you don't want to do about it.
e. Incomplete requirements document, detentions are performed;
., f. Invalid and/or uncorrect document document, unauthorised or rejected.
., g. Complete, legitimate, and correct terms document, health check action.

Section 17
The health check action as referred to in Article 16 of the letter g is done above the transport tool, if:
., a., a. the media carrier comes from a country or transit in a country that is contracting the plague;
., b. a carrier media transport device originating from a country or transit in a country that is contracting the plague;
.,, c. media carriers are from countries or transit in countries that have a high risk; or
., d. Based on the consideration of the Plant Quarantine Officer, a media check the carrier needs to be carried on the transport.

Section 18
In the event of an administrative examination results referred to in Article 15 of the paragraph (2) the carrier media is already derived from the transport, it turns out:
a. not carrier media, no quarantine action done;
., b. It is the bearer's media whose suppliers are subject to exile and observation, acts of exile and observation;
., c. are the types of carrier media that are prohibited from their suppliers, carried out extermination acts;
D. not meeting the required provisions, carried out the rejection act;
e. Incomplete requirements document, detentions are performed;
., f. Invalid and/or uncorrect document document, unauthorised or rejected.
., g. Complete, legitimate, and correct terms document, health check action.

Section 19
.,, (1) If after the conduct of the health examination act as referred to in Article 16 of the letter g, it turns out:
.,
., a., a. not free from OPTK Golongan I, foul or damaged, performed a rejection act;
., b. not free from OPTK Golongan II, performed treatment action above the transport tool;
.,, c. free from OPTK or after a treatment act can be released from OPTK Golongan II, carried out an act of liberation.
., (2) If the act of treatment as referred to in paragraph (1) the letter b is not possible, it is an act of rejection of the carrier's media.
., (3) Against the media carrier imposed by the rejection act as referred to in paragraph (1) the letter a or verse (2) is prohibited from being derived from the transport.

Section 20
.,, (1) If after the conduct of the health check act as referred to in Article 18 of the letter g, it turns out:

., a., a. Carrier media is not free of OPTK Golongan I, rotten or damaged, carried out extermination act;
., b. less-free carrier media from OPTK Golongan II, carried out treatment act;
.,, c. free from OPTK or after a treatment act can be released from OPTK Golongan II, carried out an act of liberation.
.,, (2) Against the foul or damaged carrier media as referred to in paragraph (1) the letter a is performed:
., a., a. extermination actions, if caused by OPTK;
., b. An act of destruction on a part that is rotten or damaged, if not caused by OPTK.

Paragraph 2
Containment

Section 21
.,, (1) The act of detention as referred to in Article 16 of the letter e and Article 18 of the letter e is done to secure the medium of the carrier by means of sealing and placing under the mastery and supervision of the Plant Quarantine Officer.
.,, (2) The carrier ' s media imposed detention action as referred to in paragraph (1), to the owner or its power is given the most time of 14 (fourteen) working days to meet the completeness of the documents required.
.,, (3) If in the term of 14 (fourteen) business days referred to in paragraph (2) the completeness of the document which requires not or cannot be met by an act of rejection.

Paragraph 3
Observation and Exile

Section 22
.,, (1) The act of exile and observations is carried out against the carrier media by placing in an isolated location so that if there is OPTK not spreading to the surrounding environment.
., (2) The actions of exile and observations as referred to in paragraph (1) are performed during a given time to detect the possibility of OPTK which due to its nature requires a long time, special means and condition.
.,, (3) Special conditions as referred to in paragraph (2) among other temperatures, climate, and altitude of the place.

Section 23
If after the act of exile and observation as referred to in Article 21, it turns out:
., a., a. the carrier media is not free of OPTK Golongan I, rotten or damaged, carried out an act of extermination;
., b. carrier media not free of OPTK Golongan II, carried out treatment act; or
.,, c. free of OPTK or after a treatment act can be released from OPTK Golongan II, carried out an act of liberation.

Paragraph 4
The treatment

Section 24
(1) The act of treatment is carried out in a physical and/or chemical manner.
(2) The actions of the treatment as referred to in paragraph (1) are performed:
., a., a. to free the media carriers of OPTK group II; or
B. Requires an additional liability.
.,, (3) The act of treatment as an additional liability as referred to in paragraph (2) the letter b may be performed in the country of origin, above the transport device during the trip, in the transit country, and/or after arriving in the country territory of the Republic of Indonesia.

Section 25
If after the act of treatment as referred to in Article 23 of the paragraph (1) letter a, it turns out:
., a., a. cannot be released from OPTK Golongan II and the carrier media is still on top of the transport carried out of denial action;
., b. cannot be released from OPTK Golongan II and the carrier media has been derived from the transport carried out of extermination action; or
c. can be released from OPTK group II carried out the release act.

Section 26
The provisions regarding the standard of the treatment act as referred to in Article 23 are further set by the Head of the Agricultural Quarantine Agency.

Paragraph 5
The rejection

Section 27
(1) The rejection measures against the carrier media which:

., (4) If in the term of 14 (fourteen) the day of its owner or its ruler after receiving a letter of rejection of not immediately issuing the carrier media out of the state of the Republic of Indonesia carried out the extermination act.

Paragraph 6
Annihilation

Section 28
.,, (1) The extermination action against the carrier media can be done by burning, heating, burying, destroying and/or other ways so that carrier media is not possible to be the source of the OPTK deployment.
.,, (2) The implementation of the extermination act as referred to in paragraph (1) is published the News Event of the extermination.
.,, (3) The facilities required in the execution of the extermination act as referred to in paragraph (2) be the responsibility of the owner or its power.
.,, (4) The provisions of extermination as referred to in paragraph (1) are further set by the Chief of the Agricultural Quarantine Agency.

Paragraph 7
The release of

Section 29
.,, (1) The act of liberation is carried out by releasing and/or allowing the carrier media into the territory of the country of the Republic of Indonesia.
., (2) Liberation as referred to in paragraph (1) is carried out against free carrier media and/or may be exempt from OPTK Category A1, OPTK Category A2 and/or OPTP.
.,, (3) The carrier media which has been conducted the act of liberation as referred to in paragraph (1) can be lamented free within the territory of the country of the Republic of Indonesia.
.,, (4) the implementation of the release act as referred to in paragraph (1) with the published Certificate of Release.

BAB IV
QUARANTINE ACTIONS AGAINST THE REINCORPORATED CARRIER MEDIA
INTO THE REPUBLIC OF THE REPUBLIC OF INDONESIA

Section 30
.,, (1) The return of the carrier media issued from within the territory of the Republic of Indonesia can occur, because:
., a., a. rejected its input by the destination country; or
B. Returned from the destination country.
.,, (2) The carrier media as referred to in paragraph (1) of the letter b among others used for exhibition purposes, race and/or research.

Section 31
.,, (1) the return of the carrier media as referred to in Section 30 of the paragraph (1) letter a, if:
.,
., a., a.  accompanied a Plant Health Certificate from the State of Indonesia at the time of the expense was imposed as a plant quarantine requirement, conducted quarantine measures other than detention and rejection measures,
., b. not accompanied the Plant Health Certificate from the State of Indonesia and the country of purpose requires, carried out the termination act;
.,, c. not accompanied by the Certificate of Plant Health from the State of Indonesia and the state of the destination does not require, carried out quarantine measures other than acts of detention and rejection.
., (2) The return of the carrier media as referred to in paragraph (1), must be accompanied by a rejection letter from the NPPO or any other party in the destination country that is accompanied by reason of rejection.
.,, (3) If the reincome of the carrier media is not accompanied by a letter of description as referred to in paragraph (2) of the rejection act.

Section 32
Reentry of the carrier media as referred to in Article 30 of paragraph (1) letter b if:
., a., a. accompanied by a Certificate of Plant Health from Indonesia, conducted a quarantine action and Plant Health Certificate that accompanies the carrier media at the expense time may be enforced as a plant quarantine requirement; or
., b. not accompanied by the Certificate of Plant Health from Indonesia, carried out the extermination act.

BAB V
RECOGNITION, ECIVALENCE AND NOTIFICATION OF INCONSISTENCY

Section 33
.,, (1) In the implementation of the quarantine measures against the inclusion of the carrier media into the Republic of the Republic of Indonesia can be done through the Mutual Recognition Agreement and Ekivalence with the country of origin.
.,, (2) The terms and events of the implementation of the Agreement Recognised and Ekivalence as referred to in paragraph (1) are further set by the Chief of the Agricultural Quarantine Agency.

Section 34
.,, (1) Notifications of inconsistness are published by UPT Karantina Agriculture if the income of the carrier media from abroad:
.,
., a., a. not in accordance with the laws of the Plant Quarantine legislation; and/or
B. The media carriers are subject to acts of treatment, rejection and/or annihilation.
.,, (2) The Notifications of inconsistness as referred to in paragraph (1) are addressed to NPPO in the country of carrier media origin.

BAB VI
QUARANTINE ACTION SERVICES LEVY

Section 35
.,, (1) The owner of the carrier ' s media or its ruler is obliged to pay the services of the quarantine action service.
.,, (2) The levy of quarantine action services as referred to in paragraph (1) is the State Revenue Not Tax (PNBP) that must be paid to the country's coffers.
., (3) The charge of a quarantine action service charge as referred to in paragraph (1) is specified under applicable law.

BAB VII
THE TRANSITION PROVISION

Section 36
Quarantine action against the ongoing carrier media entry before it is specified, resolved by following the provisions of the Minister of Agriculture's Decree Number 38 /Kpts/HK.310/1/ 90 about the Terms and Conditions Plant Quarantine for Plant Penitter and Plant Bibit into the State Territory of the Republic of Indonesia.

BAB VIII
CLOSING PROVISIONS

Section 37
Under this Regulation, the Decree of the Minister of Agriculture No. 38 /Kpts/HK.310/1/ 90 on the Terms and Acts of the Plant Quarantine for Plant and Bibit Quarantine Measures into the State Territory of the Republic of Indonesia, revoked and declared not applicable.

Section 38
This rule is set to apply at the specified date.
