ALLOCATION OF FUNDS FOR RESOURCE RESULTS EARTH AND EARTH OIL MINING

WITH THE GRACE OF GOD ALMIGHTY

THE FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,

DRAW: a that in Law Number 41 of the Year 2008 on Budget and State Shopping of the Budget 2009 as amended by Invite-Invite Number 26 Year 2009 contains changes to the allocation of funds for Mining Natural Resources Petroleum and Earth Gas Year 2009 Budget Year;

b. that in connection with the change in the allocation of the Fund for the results of the 2009 Budget and Earth Gas Mining Service, then in accordance with the provisions of Section 2 of the paragraph (5) of the Financial Minister Regulation Number 17 /PMK.07/ 2009 on Redemption Estimated Allocation Of Funds For The Natural Resources Products Of Petroleum Mining. and Earth Gas Year 2009 As amended by

Financial Minister Regulation Number 50 /PMK.07/2009, required adjustment of the estimated Alocation of the Fund for the Natural Resources and Earth Gas Mining Results of the 2009 Budget Year;

c. that is based on The consideration as indicated in the letter a and the letter b, need to establish the Minister of Finance Regulation on the Second Amendment to the Regulation of Finance Minister Number 17 /PMK.07/ 2009 on Establishing The Estimated Allocation Of Funds For Natural Resource Outcomes Earth Oil and Earth Gas Mine 2009 Budget Year;

Given: 1. Law No. 41 of 2008 on Budget and State Shopping of the Budget Year 2009 (leaf of State of the Republic of Indonesia 2008 No. 171, Additional Gazette of the Republic of Indonesia No. 4920) as amended by Invite- Invite Number 26 Year 2009 (sheet Of State Of The Republic Of Indonesia In 2009 Number 118, Additional Gazette Republic Of Indonesia Number 5041);

on Establishing Estimated Allocation of funds for Natural and Earth Gas Natural Resources for the 2009 Budget Year as amended by the Regulation of the Minister of Finance Number 50 /PMK.07/2009;

DECIDED: Set: REGULATION OF FINANCE MINISTERS ABOUT

THE SECOND CHANGE TO THE REGULATION OF FINANCE MINISTER NUMBER 17 /PMK.07/ 2009 ABOUT THE DESIGNATION OF THE ESTIMATED ALLOCATION OF FUNDS FOR THE RESULTS OF THE NATURAL RESOURCES OF PETROLEUM AND PETROLEUM MINING YEARS OF THE 2009 BUDGET.

Article I Some provisions in Finance Minister Regulation No. 17 /PMK.07/ 2009 on Establishing Estimated Allocation Of Funds For The Natural Resources of the Earth Oil and Earth Gas Budget Year 2009 as has been amended with the Finance Minister Regulation Number 50 /PMK.07/ 2009 changed as follows:

1. The provisions of Section 2 are amended, so that it reads as follows:

Section 2 (1) Estimated the allocation of DBH SDA Migas as

referred to in Article 1 of the paragraph (1) is the size of Rp22,720.074,399.000.00 (twenty-two trillion seven hundred and twenty) billion seventy-four million three hundred ninety-nine thousand rupiah) with the following details as follows: a. DBH SDA Oil of the Earth with a 15% (five

11 percent) portion of Rp12.627,083.485.000.00 (twelve trillion six hundred and twenty-seven million four hundred and eighty-five thousand rupiah), consisting of: i. DBH SDA Earth Oil with a 15% (five

11 percent) portion of Rp12.227.401,500.000.00 (twelve trillion two hundred twenty-seven billion four hundred one million five hundred thousand rupiah); and

ii. DBH SDA Oil of Earth with a portion of 0.5% (zero comma five percent) of Rp399.681.985,000.00 (three hundred ninety-nine billion six hundred and eighty-one million nine hundred and eighty-five thousand rupiah) that is directed by its use for extra basic education budget.

b. DBH SDA Gas Earth with a portion of 30.5% (thirty-five percent comma) of Rp10.092.990.914.000.00 (ten trillion ninety-two billion nine

hundred ninety million nine hundred and fourteen thousand rupiah), consisting of: i. The DBH SDA Gas Earth with a 30% (three

20 percent) portion of Rp9.934.169.024.000.00 (nine trillion nine hundred thirty-four billion sixty-six million twenty-four thousand rupiah); and

ii. DBH SDA Gas Earth with a portion of 0.5% (zero comma five percent) amounting to Rp158,821.890.000.00 (one hundred and fifty-eight billion eight hundred and twenty-one million eight hundred and ninety thousand rupiah) directed its use for additional budget. Basic education.

(2) Estimation of the DBH SDA Migas allocation in the 2009 Budget Year to the area adjusted to the Law No. 41 Year 2008 on the State Budget and State Shopping Budget Year 2009 as amended by Act Number 26 of the Year 2009 in particular regarding the assumptions of macroeconomic indicators with crude oil price level of US$ 61/barrel and with a Rp10,500/$ 1 exchange rate.

(3) Estimated allocation of DBH SDA Migas of Budget Year 2009 for each Region is as specified in the Inseparable Attachment of this Financial Minister Regulation.

2. Between Section 2 and Section 3 of each section, Section 2A, which reads as follows:

Section 2A In the case of the LDA List of Staffing Staffing (DIPA) for the estimated allocation of DBH SDA Migas of Budget Year 2009 specified in the one Year of the Budget and in accordance with the State Shopping and Shopping Budget (APBN), APBN Changes insufficient need or realization exceeding the pagu in the DIPA of the Year Budget running, then it can be carried out as a realization of acceptance realisation after receiving approval from the Minister of Finance.
