GOVERNMENT ORDINANCE OF THE REPUBLIC OF INDONESIA
NUMBER 12 OF 2010
ABOUT
RESEARCH AND DEVELOPMENT, AS WELL AS EDUCATION AND FORESTRY TRAINING

BY THE GRACE OF ALMIGHTY GOD

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weighing: that to carry out the provisions Section 58. Act No. 41 of 1999 on Forestry, needs to establish Government Regulation on Research and Development, as well as Education and Forestry Training.

Remembering: 1. Section 5 of the paragraph (1) and Article 20 paragraph (1) of the Basic Law of the Republic of Indonesia Year of 1945;
2. Act No. 41 of 1999. The Forest of Indonesia in 1999 Number 167, Additional Gazette of the Republic of Indonesia Number 3888), as amended by Law Number 19 Year 2004 About the change in the 1999 Act 1999 Number 41 on Forestry Became The Law (sheet Of State Of The Republic Of Indonesia 2004 Number 86, Extra Sheet) Republic of Indonesia Number 4412).

DECIDED:

Establish: Government regulations on research and development, as well as education and forestry training.

SAB I
UMUM PROVISIONS

Section 1
In this Government Act, it is referred to as:
1. The further research and development of forestry called litbang forestry is an activity that includes research and development of forestry in support of forestry development.
2. Research is the activities performed according to the rules and scientific methods systematically to obtain information, data, and attachments that are related to the understanding of truth or untruths of an assumption and/or hypothesis in the the field of science and technology and drawing scientific conclusions for the needs of advancement of science and technology.
3. Development is the activities of science and technology that aims to leverage the rules and theorsciences that have proven its truth to improve the functioning, benefits, and application of science and technology that have been present, Or producing new technology.
4. Science is a series of excavated knowledge, compiled, and developed systematically by using a specific approach based on scientific methodology, whether quantitative, qualitative, or expressible to the purpose of the scientific methodology. To explain the symptoms of certain natural symptoms and/or certain symptoms of the society.
5. Technology is the way or method as well as the process or product resulting from the applicability or utilization of various science disciplines that results in the value for fulfillment of the needs, survival, and improvement of the quality of human life.

7. The research and development institute of forestry that is next called R&D institute is an institution that is through the activities of research and/or development in the field of forestry.

Section 2
(1) To obtain science and technology as well as improve the quality of human resources in the field of forest affairs is organized:
a. research and forestry development;
b. education and forestry training; and
C. Forestry counseling.
(2) The provisions of the hosting of forestry are governed by their own laws of invitations.

Section 3
(1) The densations of forestry as referred to in Article 2 of the paragraph (1) of the letter a aim to increase the ability of forest affairs in realizing sustainable forest management and increase in the value of forest results.

AB II
RESEARCH AND DEVELOPMENT

Part One.
General

Section 4
(1) Litt of forestry is organized by the Minister and the non-ministry litbang institute.
(2) The Minister in organizing the forescore forestry formed the Ministry of Forestry Forests.
(3) Non-ministerial R&D institutions as referred to in paragraph (1) in organizing the forestry litbang coordinate with the Ministry Litbang Board.

Section 5
(1) In addition to the Ministry of Forestry Litbang of the Ministry as referred to in Article 4 of the paragraph (2), the forescore forestry may be held by:
a. the provincial government;
b. district government/kota;
c. college;
d. The business world; and
e. society.

Section 6
The establishment of forestry R&D as referred to in Article 4 includes:
a. Planning;
b. execution; and
c. evaluation.

Second Part
Foresight Planning

Section 7
(1) The forescore planning of forestry as referred to in Article 6 of the letter a drafted by guideline on the National Forest Plan and the national forestry litbang plan.
(2) The National Level Forest Plan and the national forestry R&D plan as referred to in paragraph (1) are compiled and set by the Minister.

Section 8
The planning of forestry lites as referred to in Article 6 of the letter a concerted is compiled which involves various disciplines of scholarship with regard to:
a. Preservation of forest resources;
b. the welfare of the community around the forest area;
c. High saing power in the economic field; and
d. technology in the field of forestry.

Section 9
The forescore plan of forestry as referred to in Article 6 of the letter a consists of:
a. long-term forestry litbang plan;
b. a medium-term forestry litbang plan; and
c. short term foresight litdown plan.

Section 10
(1) The forest R&D Plan as referred to in Article 9 is compiled by the head of the Ministry of Forests Litbang of the Ministry.
(2) The forestry litbang plan compiled by the Forests Forests Board of the Ministry is redeemed by the Minister.

Section 11
(1) The plan of the forescore forestry foresies compiled by the Ministry of Forestry Centipede as referred to in Article 9 of the letter a compiled for a term of 20 (twenty) years and can be evaluated at least 1 times every 5 (five) years.

Section 12

(2) The medium-term forestry R&D Plan compiled by the Forest Litbang Board of the Ministry refers to the long-term forestry litbang plan as referred to in Article 11.
(3) The least medium-term forestry R&D plan contains little about the strategy and work program of the forestry lites.

Section 13
(1) The short-term forestry R&D Plan as referred to in Article 9 of the letter c is compiled for a term of 1 (one) year.
(2) The short-term forestry R&D Plan compiled by the Forest Board of Forestry Ministry refers to the medium-term forestry litbang plan as referred to in Article 12.
(3) The least short term forescore foresight plan has been about the activity of the forescore foresight.

Third Part
Forescore Forests

Paragraph 1
General

Section 14
(1) Litt of forestry is implemented in a unified way using a multi-disciplinary approach of science and technology to generate more effective and efficient technology packages and policies and to produce flagship products in the Forestry field.

a. forescore forestry activities;

Paragraph 2
Forescore Forests

Section 15
(1) The activity of forestry R&D as referred to in Section 14 of the paragraph (2) of the letter a, covering the activities:
a. Basic research;
b. applied research;
c. policy research; and/or
d. experimental development.
(2) The activity of forestry R&D as referred to in paragraph (1) at least includes research in the field:
a. Forest planning;
b. forestry management;
c. supervision;
d. protection of the buffer system of life;
e. preservation of the diversity of plants and animals and its ecosystems;
f. forest layout and the preparation of forest management plans;
g. forest utilization;
h. use of forest areas;
i. forest rehabilitation and reclamation;
j. forest protection and nature conservation;
k. forestry human resources; and
I. laws.
(3) Forestry R&D activities as referred to in paragraph (2), grouped by theme, subtheme, preeminent R&D cladding, and implemented in a wide range of R&D activities to generate policy recommendations and More efficient science and technology as well as flagship products.

Section 16

Section 17

Section 18
(1) The denizable forestry in the forest area as referred to in Article 17 of the letter a can be done in the forest area which:
a. not yet disburdened the rights or permission; or
b. have been burdened with the right or permission.
(2) The event of a forestry in the forest area which is not yet disburdened with the right or permission as referred to in paragraph a (1) letter a can be done at:
a. Forest area with special purpose (KHDTK); and
b. Forest conservation, protected forest, and production forest.
(3) Hosting of forestry in the area of the question has been disarmed or izincan be done on the basis of cooperation with the holder of the right or permission.
(4) The conservation of forestry in the forest area under the right or permission exercised by other than the Ministry of Forestry, the Ministry must report the results of the research and development to the Ministry of Forestry.

Section 19

Section 20
(1) In order to improve the quality of human resources of forestry, R&D activities, both within the forest area and outside of the forest area, must be done by the elite of the competent iforestry.
(2) The Government sets the standards of the competence of forestry researchers based on the field of expertise in accordance with the provisions of the

Paragraph 3
Forest Litbang Work

Section 21
The Ministry of Forests of the Ministry of Forestry in organizing the forestry R&D may cooperate with the provincial government, the county/city government, the college, the business world, or society.

Section 22
(1) Foreign R&D agencies, foreign researchers, foreign colleges, or foreign business entities can host forestry lites after obtaining the izindari of Government agencies as per the provisions of the laws.
(2) Foreign R&D agencies, foreign researchers, foreign colleges, or foreign business entities as referred to in verse (1) in organizing the forestry lites must work closely with the Ministry of Forestry Litbang Board.

(4) The further provisions of forestry R&D work as referred to in paragraph (3) are governed by the Minister ' s regulations.

Section 23
(1) The forestry of the forestry as referred to in Article 21 and Section 22 is exercised under the cooperation agreement.

c. The rights and obligations of the parties;

Section 24
(1) In order of cooperation R&D can be set up a national forestry research forum.
(2) The national forestry research forum as referred to in paragraph (1) is an informal institution that aims to improve communication, coordination, synergity and effectiveness of forestry lites.
(3) The national forestry research forum as referred to in paragraph (1) is formed by and over the agreement of the forestry litbang institutions and is set by the Minister.
(4) The national forestry research forum as referred to in verse (1) consists of the Ministry of Forestry Governing Body of the Ministry, provincial government, county/city government, college, business litbang unit of the business, and/or society.

Paragraph 4
Forestry R&D Results

Section 25
(1) The results of co-financed forestry R&D cooperation by the Ministry of Forestry Litbang of the Ministry became the property of the Government.
(2) The results of the forestry R&D cooperation with the Ministry of Forestry Litbang of the Ministry shall belong together if in part or entirely financed:
a. institutions R&D in the country;
b. domestic researcher;
c. collegiate in the country; and/or
d. world of domestic endeavour.
(3) The Ministry of Forestry Forests of the Ministry may take ownership of the results of the forestry R&D as referred to in paragraph (1) and paragraph (2) if it endangers the national interest, harming the development of technology, or the economy country.
(4) Further provisions concerning the results of the forestry R&D cooperation as referred to in paragraph (1) to the paragraph (3) are governed by the Minister ' s regulations.

Section 26
The result of a forestry R&D that is a specimen and the genetic material to be brought abroad must be granted permission to comply with the terms of the law.

Paragraph 5
HKI

Section 27
(1) The Government encourages and facilitates any hosting of forestry lites resulting in the invocation or other form of HKI to apply for HKI.
(2) The results of the forestry R&D cooperation as referred to in Article 25 may be submitted by the forestry R&D institute to obtain the protection of HKI in accordance with the laws.
(3) The results of the forestry R&D cooperation as referred to in Article 25 and Article 26 may be proposed to the protection of HKI in accordance with the cooperation agreement.

Section 28
(1) The Government provides an award and/or incentive of a certificate, gift, and/or royalty section to a forestry R&D institution, and/or researchers who managed to find an invency, and/or accomplishment as a result of cooperation and results It's pretty independent.
(2) The further provisions of an accomplished researcher as referred to in paragraph (1) are governed by the rules of the Minister.

Fourth Part
Evaluation of the Forests of Forests

Section 29
(1) The government or provincial government, the municipal/municipal government conducted an evaluation of the holding of forestry lites according to its authority.
(2) The further provisions of the evaluation of the implementation of the forestry R&D as referred to in paragraph (1) are governed by the Minister's regulations.

SAB III
HOSTING EDUCATION AND FORESTRY TRAINING

Part One.
General

Section 30
(1) The event of a forester is performed by the Government.

a. the provincial government;
b. district government/kota;

d. society.

Section 31

Ministry of Forest Service

Paragraph 1
General

Section 33

Planning

Section 34
(1) Planning on forestry as referred to in Article 33 of the letter a is compiled in the form of a dilate plan.

b. a medium-term forestry dilation plan; and

Section 35

(2) The long-term forestry dilation plan is compiled in a guideline on the National Level Forest Plan.
(3) The least long term forestry date of the forest contains:
a. vision and mission of foresight;
b. the purpose and direction of the forestry in the forestry policy;
c. types of forestry in forestry; and
D. A body of foresight.
(4) The long-term forestry dilates plan can be evaluated 1 (one) times every 5 (five) years.

Section 36
(1) Middle-term forestry-based plan referred to in Article 34 of the paragraph (2) of the letter b composed for a term of 5 (5) years.
(2) The medium term forestry dilation plan is compiled in a guideline on a long-term plan.
(3) The least medium term forestry date of the forest is available:
a. Strategy and work program dilates;
b. type and type of dilation;
(c) the following:

(4) The medium-term forestry dilation plan can be evaluated at most 2 (two) times.

Section 37

Section 38
Further provisions on the manner of drafting and setting up long-term, medium-term, and short-term plans are governed by the rules of the Minister.

Paragraph 3
Forestry In The Forest Service

Section 39
The exercise of forestry in the forest includes:
a. type of forestry in the forest;
b. curriculum and method;
c. participants in forestry; and
D. Power classed.

Section 40
(1) The type of Forests in Forestry as referred to in Article 39 of the letter a consists of:
a. a technical dilation of forestry; and
b. dictional functional forestry.
(2) The foresight, as referred to in verse (1), consists of a base, an advanced body, medium-level, and high level.

Section 41
(1) The type of forestry dilation as referred to in Article 40 paragraph (1) includes the field of competence:
a. Forest planning;
b. rehabilitation and reclamation of forests and lands;
c. Forest utilization;
d. forest protection; and
e. nature conservation.
(2) The field of competence as referred to in paragraph (1) may be augmented by the development of science and technology in the field of forestry established by the Minister.

Section 42
(1) The technical dilation of the forestry as referred to in Article 39 of the letter b is compiled based on the field of compensive.
(2) The Curriculum as referred to in paragraph (1) is set by the Central Leadership of the Ministry of Forestry.
(3) In terms of forestry being held by the provincial government, the municipal/city government, the business world, or the compulsory public use of the curriculum set by the Ministry of Forestry Diklat Center.

Section 43
(1) The method of the forestry dilation as referred to in Article 39 of the letter b includes:

Section 44

a. civil servants;
b. IBM employees; and/or
c. member of the community group in the field of forestry.

Section 45

Paragraph 4
Monitoring and Evaluation

Section 46

In the Forest of Provincial Forestry,
County/City Government, World Business, and Society

Paragraph 1
Provincial Government Forestry and District/City Government

Section 48
(1) The forestry-based plan organized by the provincial government is compiled by guidelines on the National Level Forestry Plan and the forestry dilate plan.
(2) The forestry-based plan organized by the county/city government is compiled by guidelines on the National Level of Forestry Plan and the provincial-level forestry dilation plan.

Paragraph 2
World Forestry ' s Forest Service and Society

Section 49
(1) The event of a foresdoing forestry by the world of effort and society is exercised according to the needs of the world of effort and society.

Fourth Part
Recognition and Certification

Paragraph 1
Recognition

Section 50

Section 51
The recognition as referred to in Article 50 of the paragraph (2) is performed transparently based on the norms, standards, procedures, and criteria set forth by the Minister.

Paragraph 2
Certifications

Section 52
(1) The participant in forestry as referred to in Article 44 of which has passed following the forestry in the forest is given a certificate.
(2) The Sertifikatas as mean to the verse (1) is published by the Ministry of Forestry Diklat Ministry.

Section 53
(1) The institution of the forestry in the world of effort and the public who has gained recognition can host a forestry in the field.
(2) The certificate for the participants in forestry as referred to in verse (2) is published by the Ministry of Forestry Diklat Center.

Section 54
Further provisions on the manner of obtaining accreditation and certificate of forestry as referred to in Article 50 to Article 53 are governed by the Minister's regulations.

BAB IV
THE USE OF FOREST AREAS WITH SPECIAL PURPOSE
FOR THE LITBANG AND THE FORESIGHT

Section 55
(1) The forestry R&D institution can use forest areas with special purpose for the purpose of forescore forestry after it is set by the Minister.
(2) The forestry-based institution may use the forest area with special purpose for the purpose of forestry after it is established by the Minister.

Section 56
(1) The forest area with special purpose as referred to in Article 55 can be specified in all forest area functions except on the nature reserve and the national park core zone.
(2) The forest area which has been encumbered by the BUMN can be designated as a forest area with special purpose provided that it does not change the core function of the forest area.
(3) In the forest area which has been encumbered for forest utilization, it can be designated as a forest area with special purpose after being removed from its work area.

Section 57
The forest area with special purpose is referred to in Article 55, administered by the forestry R&D agency or forestry-based institution based on the forest management plan in accordance with the provisions of the laws.

Section 58.
(1) In managing the forest area with special purpose as referred to in Article 56 and Section 57, the lembagalitstorks and lemes of the Government forestry may cooperate with the provincial government, the county/city government, the school high, the world of effort, and society.
(2) Further provisions on the use of forest areas with special purpose for forestry R&D institutions and forestry dilates are governed by the rules of the Minister.

Section 59
In terms of forestry R&D agencies or forestry dilates as maintainers of forest areas with special purpose carrying out forest utilization or forest yield for R&D interests or education and forestry training is not It's a levy on forestry in accordance with the laws.

BAB V
INFORMATION SYSTEMS

Section 60
(1) The sponsorship of the Ministry must be supported by a system of information accessible to the provincial government, the city/city government, the business world, and the public.
(2) The further provisions of the manner of the intercession of the information system as referred to in paragraph (1) are governed by the rules of the Minister.

BAB VI
TRANSITION PROVISIONS

Section 61
With this Government Regulation, the designated forest area and/or designated as a forest area with special purpose for R&D or forestry dicting remains in effect and its management is adjusted to the Government Regulation. Here.

BAB VII
CLOSING CONDITIONS

Section 62.
These Government regulations begin to take effect on the date of promulgations.
