Back COUNTRY SHEET REPUBLIC of INDONESIA No. 17, 2010 (Additional explanation in the State Gazette of the Republic of Indonesia Number 5099) GOVERNMENT REGULATION of the REPUBLIC of INDONESIA number 12 in 2010 ABOUT research and development, AS WELL AS the EDUCATION and TRAINING of FORESTRY with the GRACE of GOD ALMIGHTY the PRESIDENT of the Republic of INDONESIA, Considering: that in order to implement the provisions of article 58 Act No. 41 of 1999 on Forestry, the need to establish government regulation of research and development education and training, as well as forestry.
Remember: 1. Article 5 paragraph (1) and article 20 paragraph (1) of the Constitution of the Republic of Indonesia in 1945;
2. Act No. 41 of 1999 on Forestry (State Gazette of the Republic of Indonesia Number 167 in 1999, an additional Sheet of the Republic of Indonesia Number 3888), as amended by Act No. 19 of 2004 concerning the determination of the Replacement Government Regulations Act No. 1 of 2004 concerning the change in the law in 1999 Number 41 on Forestry into law (Gazette of the Republic of Indonesia Number 86 in 2004 Additional Sheets, the Republic of Indonesia Number 4412).
Decide: define: GOVERNMENT REGULATION of research and development, EDUCATION and TRAINING AS WELL AS forestry.
CHAPTER I GENERAL PROVISIONS article 1 In this Regulation the definition: 1. the forestry research and development r & d hereafter forestry are activities that includes research and development of forestry for forestry development.
2. 4. 5. Technology is the means or methods as well as process or produkyang resulting from the penerapanatau utilization of multiple disciplines knowledge that generates value for fulfilment, continuity, and an increase in the quality of human life.
6. Forestry Research and Development Agency of the Ministry of the R & D Agency hereinafter referred to as the Ministry of Forestry is lembagayang manage the research and development of forestry.
7. forestry research and Development Agency which is hereinafter referred to as an r & d institution is the institution of yangmelaksanakankegiatanpenelitiandan/or development in the field of forestry.
8. Education and training of forestry training hereinafter referred forestry is the process of organizing learning in order to foster attitudes and behaviors, as well as improving employee skills and ability of forestry and other forestry human resources towards human resources professional forestry and noble character.
9. Vocational education and training of Forestry Ministry Training Centre, hereinafter referred to as the Ministry is the Government agencies as the organizer of the training of forestry.
10. the forestry education and training institutions provincial government training institutions hereinafter referred to as the Government of the province is the province of government agencies as the organizer of the training of forestry in the region of the province.
11. Forestry Training Institute pendidikandan kabupeten Government/city government training institutions hereinafter referred to kabupeten/city is a County/city government agencies as the organizer of the training of forestry in the region of County/city.
12. Business entity is a State-owned enterprise, local, and private-owned enterprises.
13. Intellectual property rights, hereinafter called the INTELLECTUAL PROPERTY right is the protection by law of intellectual property in accordance with the legislation.
14. the Minister is the Minister of the organizing Affairs of the Government in the field of forestry.
Article 2 (1) to acquire science and technology as well as improve the quality of human resources in the field of forest management was held: a. research and development of forestry;

b. education and training of forestry; and c. extension forestry.
(2) the provisions on conducting extension forestry laws set forth in the invitation.
Article 3 (1) Conducting r & d forestry as referred to in article 2 paragraph (1) letter a aims to improve the ability of forest management in realizing sustainable forest management and an increase in value-added forest products.
(2) organizing the training of forestry as referred to in article 2 paragraph (1) letter b aims to: a. establish a human resources professional and forestry is capable of mastering, harnessing and developing the science of pengetahuandan technology in the management of the forests in a fair and sustainable, based on faith and taqwa to God Almighty;
b. manifest human resources competent and forestry work effectively, efficiently and able to serve as guides, impeller, and reformers in the sustainable forestry development;
c. fostering human resources the noble character and forestry have the attitude, behavior and spirit of dedication, service, shelter, community empowerment and forestry.
CHAPTER II ORGANIZATION of the RESEARCH and DEVELOPMENT Part I General article 4 (1) organized by the Minister of forestry R & D and r & d institutions nonkementerian.
(2) the Minister of the organizing Body formed the forestry r & d R & D Forestry Ministry.
(3) non r & d Institutions the Ministry referred to in subsection (1) in r & d R & D Agency coordinate with the forestry Ministry.
Article 5 (1) in addition to R & D by the Forestry Ministry referred to in article 4 paragraph (2), forestry r & d can be organized by: a. the provincial government;

b. the Government of the district/city;

c. College;

d. the corporate world; and e. community.
(2) the corporate world as intended in paragraph (1) letter d in r & d r & d unit may establish forestry forestry.
Article 6 Conducting r & d forestry as referred to in article 4 are as follows: a. the planning;

b. implementation; and c. evaluation.

The second part of planning a forestry R & D of article 7 (1) forestry r & d Planning as mentioned in article 6 letter a prepared based on National Forestry Plans and forestry r & d national plan.
(2) National Forestry Plans and forestry r & d national plan referred to in subsection (1) are organized and established by the Minister.
R & d Planning section 8 forestry as referred to in article 6 letter a structured integrated academic discipline involving many different having regard to: a. the sustainability of forest resources;

b. social welfare around forest areas;

c. high competitiveness in the field of Economics; and d. technology in the field of forestry.

Article 9 r & d Plan of forestry as referred to in article 6 letter a consists of: a. a long-term forestry r & d plan;

b. medium-term r & d forestry plans; and c. a short-term forestry r & d plan.

Article 10 (1) forestry r & d Plan referred to in article 9 are arranged by the leadership of the Ministry of Forestry R & D Agency.
(2) forestry r & d Plan drawn up by the Ministry of Forestry R & D ditetapkanoleh Minister.
Article 11 (1) forestry r & d Plan jangkapan jang compiled by Ministry of Forestry R & D Bodies referred to in article 9 of the letter a drawn up for a period of 20 (twenty) years and can be evaluated at least one (1) time every 5 (five) years.
(2) Rencanalitbangkehutananjangkapanjang as referred to in paragraph (1) contains at least: a. the vision and mission of forestry r & d; and b. the purpose and direction of forestry r & d policy.
Article 12 (1) of the medium-term plan of forestry r & d as referred to in article 9 letter b composed for a period of 5 (five) years and can be evaluated at least one (1) times every 2 (two) years.
(2) forestry r & d Plan medium-term R & D Entities drawn up by the Forestry Ministry refers to long-term forestry r & d plan referred to in article 11.
(3) medium-term plan of forestry r & d at least load on r & d strategy and work program of forestry.
Article 13 (1) short-term forestry r & d Plan referred to in article 9 c letter drafted for a period of 1 (one) year.
(2) short-term forestry r & d Plan drawn up by the Ministry of Forestry R & D refers to the medium-term plan of forestry r & d as referred to in article 12.
(3) short-term forestry r & d Plan at least load on r & d activity is forestry.
The third part of the implementation of Paragraph 1 the General Forestry R & D Article 14

(1) forestry R & D implemented in integrated multidisciplinary approach by using science and technology to produce a package of technologies and policies that are more effective and efficient and to produce a superior product in the field of forestry.
(2) implementation of forestry r & d as referred to in subsection (1) include the following: a. r & d activities of forestry;

b. forestry r & d cooperation;

c. results of forestry r & d cooperation; and d. the HKI.
Paragraph 2 of article 15 Forestry R & D Activities (1) forestry r & d Activities as referred to in article 14 paragraph (2) letter a, include the following activities: a. basic research;

b. applied research;

c. policy research; and/or d. experimental development.
(2) forestry r & d Activities as referred to in subsection (1) at least include research in the areas of: a. the planning of forestry;

b. management of forestry;

c. supervision;

d. protection of the buffer system of life;

e. preservation of the diversity of plants and animals along with their ecosystems;

f. forest governance and the preparation of forest management plans;

g. utilization of forests;

h. use of forest areas;

i. forest rehabilitation and reclamation;

j. forest protection and nature conservation;

k. human resources of forestry; and b. legislation.
(3) forestry r & d Activities as referred to in paragraph (2), grouped by theme, subtema, flagship r & d cluster/priorities, and implemented integrated in various r & d activities to generate policy recommendations and in science and technology more efficient as well as's flagship products.
Article 16 (1) in carrying out r & d activities of forestry as referred to in article 14 and article 15 compulsory pay close attention to the development of science and technology, traditional wisdom, society, socio-cultural conditions and maintain germplasm of wealth from theft, tampering, and utilization exceeding dayadukung in order to keep the preserved.

Article 17 r & d forestry Activities as referred to in article 14 paragraph (2) letter a may be held: a. in forested areas; or b. the outside forest areas.

Article 18 (1) Conducting research and development of forestry in forest areas as referred to in article 17 the letter a can be done on a forest area that: a. has not been encumbered by the rights or permissions; or b. have burdened the rights or permissions.
(2) Conducting forestry r & d in the forest area that has not been encumbered by the rights or permissions referred to in subsection (1) the letter a can be done on: a. forest area with a special purpose (KHDTK); and b. forest conservation, protected forest, and forest production.
(3) Conducting forestry r & d in the area of hutanyangtelahdibebanihakatauizindapat is done based on the cooperation with the holders of the rights or permissions.
(4) Conducting research and development of forestry in forest area are vested with rights or permissions that are implemented by the Ministry of Forestry in addition to R & D Agency should report the results of research and development R & D to the Forestry Ministry.
Article 19 r & d forestry Activities outside the forest area referred to in article 17 the letter b which is implemented by the Ministry of Forestry in addition to R & D Agency, must submit a report, both activities as well as the results in writing, to the Ministry of Forestry R & D Agency.

Article 20 (1) to improve the quality of human resources in r & d, r & d activities forestry forestry, both inside and outside the forest area forest area, it should be done by a competent ikehutanan penelit.

Paragraph 3 of article Forestry R & D cooperation agency in the Ministry of Forestry R & D r & d forestry can work together with the Government of the province, kabupaten/kota Government, College, business, or community.

Section 22 (1) of foreign r & d Institutes, researchers, universities, foreign or foreign business entity can organise a forestry r & d after getting a izindari government agencies in accordance with legislation.

(4) further Provisions regarding forestry r & d cooperation as referred to in paragraph (3) subject to the regulations of the Minister.
Article 23 (1) forestry r & d cooperation as referred to in article 21 and article 22 of the cooperation agreement is implemented.
(2) forestry r & d Cooperation Agreement referred to in paragraph (1) contains at least: a. the object of cooperation;

b. Forms of cooperation;

c. rights and obligations of the parties;

d. the period of cooperation;

e. implementation and utilisation of the results;

f. dispute resolution; and g. the ownership of INTELLECTUAL PROPERTY.
(3) objects memorandum r & d forestry as referred to in paragraph (2) letter a, at least include the provision of expertise, r & d, technical assisting the provision of funds and means of r & d, education and training in the field of kelitbangan, pengembanganilmu pengetahuandan technology, the development of quality human resources, utilization of overall results can accelerate the development of forestry.
(4) the form of the cooperation referred to in paragraph (2) letter b include cooperation between national research institutes, bilateral cooperation, regional cooperation and multilateral cooperation.
(5) further Provisions regarding forestry r & d cooperation is regulated by regulation of the Minister.
Article 24 (1) in the framework of forestry r & d cooperation can be formed of the national forestry research forum.
(2) the national forestry Research Forum as referred to in subsection (1) is an informal institution that aims to enhance communication, coordination, synergy and effectiveness of r & d forestry.
(3) the national forestry Research Forum as referred to in paragraph (1) was formed by and upon agreement of forestry r & d institutions and designated by the Minister.
(4) the national forestry Research Forum as referred to in subsection (1) consists of the Ministry of Forestry R & D Agency, the provincial government, district/city governments, the universities forestry r & d units, business establishments, and/or the community.
Paragraph 4 results of Forestry R & D Cooperation Article 25 (1) forestry r & d cooperation which is financed entirely by the Ministry of Forestry R & D belong to the Government.
(2) results of forestry r & d cooperation with the Ministry of Forestry R & D Entities belong together when partially or completely funded r & d institutions: a. within the country;

b. the researchers in the country;

c. the College of Internal Affairs; and/or d. business establishments in the country.
(3) the Agency's R & D Forestry Ministry can take ownership of the results of r & d cooperation forestry as referred to in paragraph (1) and paragraph (2) if the harm to national interests, is detrimental to the development of technology, or the economy of the country.
(4) further Provisions regarding forestry r & d cooperation as referred to in paragraph (1) to paragraph (3) subject to the regulations of the Minister.
Article 26 forestry r & d cooperation Results in the form of genetic danmateri specimens will be taken out of the country must have a permit in accordance with peraturanperundang-invitation.

INTELLECTUAL PROPERTY article 27 paragraph 5 (1) the Government encourages and facilitates each organizing forestry r & d that produces the invention or other forms of HKI to apply for INTELLECTUAL PROPERTY.
(2) forestry r & d cooperation as referred to in article 25 may be submitted by institutions for forestry protection r & d HKI according legislation.
(3) the results of r & d cooperation in forestry as referred to in article 25 and article 26 protection of INTELLECTUAL PROPERTY may be brought according the agreement of cooperation.
Article 28 (1) the Government gave awards and/or incentives in the form of certificates, prizes, and/ataubagian r & d Institute of forestry to royalty, and/or the researcher who found the invention, and/or accomplished as a result of cooperation as well as the results of r & d independently.
(2) further Provisions regarding the researchers accomplished as intended in paragraph (1) are governed by regulation of the Minister.
Part four R & D organization of the Evaluation of forestry Article 29 (1) of the Government or the Government of the province, kabupaten/kota Governments undertake r & d Organization of the evaluation of forestry in accordance with those powers.
(2) the provisions on forestry r & d Organization of the evaluation referred to in paragraph (1) are governed by regulation of the Minister.
CHAPTER III ORGANIZATION of the FORESTRY EDUCATION and TRAINING Part One General article 30 (1) Conducting training of forestry carried out by the Government.

(2) in addition to the Government, forestry training and education can be organized by: a. the provincial government;

b. the Government of the district/city;

c. the business world; and d. the community.

Article 31 Training forestry organized by the Government of the province, kabupaten/kota Governments, businesses, and the public as stipulated in article 30 paragraph (2) in the implementation of forestry training institutions can form.

Article 32 training and education center of the Ministry of Forestry, the Government of the province, kabupaten/kota Governments, businesses, and communities in organizing forestry training and education can work together with international institutions in accordance with the legislation.

The second part of the training of Forestry Ministry of Paragraph 1 of article 33 Penyelenggaraandiklatkehutanankementerianmeliputi Common activities: a. planning;

b. implementation; and c. monitoring and evaluation.

Paragraph 2 of article 34 Planning (1) Planning the training of forestry as referred to in article 33 are arranged in the form of a training plan. (2) Forestry Training Plan referred to in subsection (1) consists of: a. a long-term forestry training plans;

b. the medium-term plan of forestry training and education; and c. a short-term forestry training plan.
Article 35 (1) a long-term forestry training Plan as referred to in article 34 paragraph (2) letter a drawn up for a period of 20 (twenty) years.
(2) long-term forestry training Plan arranged with Forestry Plans based on the national level. (3) long-term forestry training and education Plans at least contain: a. the vision and mission of forestry training and education;

b. the purpose and direction of the training of forestry policy;

c. types of forestry training and education; and d. the level of training of forestry.
(4) long-term forestry training Plans can be evaluated one (1) time every 5 (five) years.
Article 36 (1) of the medium-term plan of forestry training as referred to in article 34 paragraph (2) letter b composed for a period of 5 (five) years.
(2) Forestry Training Plan drawn up with the medium term based on a long-term plan. (3) training of forestry Plan medium-term at least contain: a. a work training and education strategies and programs;

b. close the type and level of training;

c. distribution of target group training; and d. the education budget.
(4) the medium-term plan of forestry training and education can be evaluated at most 2 (two) times.
Article 37 (1) short term training Plan of forestry as referred to in article 34 paragraph (2) Letter c arranged for a period of 1 (one) year.
(2) short-term forestry training Plans prepared based on the medium-term plan. (3) short-term forestry training and education Plans at least contain: a. the identification of training needs;

b. plan of training activities;

c. training budget; and d. monitoring and evaluation training.
Article 38 further Provisions regarding the procedures for the preparation of training plans and defining long term, medium term, short term and subject to the regulation of the Minister.

Paragraph 3 of article 39 of Forestry Training Implementation Implementation training forestry include: a. type of forestry training and education;

b. curriculum and methods;

c. forestry training participants; and d. power kediklatan.

Article 40 (1) the type of training Forestry as referred to in article 39 letter a consists of: a. a forestry technical training; and b. functional training of forestry.
(2) the training of forestry as referred to in subsection (1) consists of the basic level, advanced level, level, medium, and high level.
Article 41 (1) the type of training forestry as referred to in article 40 paragraph (1) of competence covering the areas of: a. the planning of forestry;

b. rehabilitation and forest and land reclamation;

c. utilization of forests;

d. forest protection; and e. the conservation of nature.
(2) the fields of competence referred to in subsection (1) may be supplemented in accordance the development of science and technology in the field of forestry established by the Minister.
Article 42 (1) the technical forestry training Curriculum as stipulated in article 39 letter b composed based on the field of kompentensi.
(2) the curriculum as referred to in paragraph (1) established by the leadership of the Ministry of Forestry Training Centres.
(3) in the case of forestry training was organized by the provincial government, district/city government, the business community, or the community is obligated to use the curriculum set by the Ministry of Forestry Training Centres.

Article 44 training Participants of forestry as referred to in article 39 of the letter c, include the human resources of forestry that can come from: a. the civil servant;

b. employees of the business world; and/or c. members of community groups in the field of forestry.

Article 45 Power kediklatan as stipulated in article 39 d consists of: a. widyaiswara in accordance with the competencies; and b. the organizers of training established by the leadership of the Ministry of Forestry Training Centres.
Paragraph 4 Monitoring and evaluation Article 46 (1) the Monitoring and evaluation referred to in Article 33 the letter c is implemented by the Ministry of Forestry Training Centres.
(2) the Monitoring and evaluation referred to in paragraph (1) are made against the implementation of forestry training.
(3) the Monitoring and evaluation referred to in paragraph (1) of activities: a. implementation of training; and b. pascadiklat.
(4) Monitoring and evaluation of implementation of training forestry as referred to in paragraph (2) letter a is done towards conformity with curricula that include content, methodology, location, timing, participants and faculty, facilities and infrastructure, and implementation.
(5) evaluation of pascadiklat as referred to in paragraph (3) the letter b was conducted to measure the efficiency and effectiveness, as well as the benefits and impact of the training.
Paragraph 5 of the pattern of Training Forestry Article 47 (1) Forestry Training Centre of the Ministry of forestry training pattern drafting.
(2) the provisions on training pattern of forestry as referred to in subsection (1) is controlled by a regulation of the Minister.
The third part of the Training of forestry Government of the province, Kabupaten/Kota Governments, Businesses, and Community Forestry Training 1 paragraph of provincial governments and district/city Governments of article 48 (1) Forestry Training Plan organized by the provincial government organized with Forestry Plans based on the national level and training of forestry plans.

Article 51 the recognition referred to in article 50 paragraph (2) is performed transparently based on the norms, standards, procedures, and criteria established by the Minister.

Paragraph 2 of article 52 Certification (1) Forestry training Participants as stipulated in article 44 that have passed following the training of forestry are given certificates.
(2) Sertifikatsebagaimanadimaksudpadaayat (1) published by the Ministry of Forestry Training Centres.
Article 53 (1) Forestry Training Institutions and the business community who have obtained recognition can organise training of forestry.
(2) a certificate of training for participants of forestry as referred to in paragraph (2), published by the Ministry of Forestry Training Centres.
Article 54 the provisions of lebihlanjut concerning procedures for obtaining accreditation and training of forestry certificates as referred to in article 50 to with article 53 set by regulation of the Minister.

CHAPTER IV USE of FOREST AREAS with the SPECIFIC PURPOSE of R & D and TRAINING of FORESTRY Article 55 (1) forestry r & d Institutions can use the forest area with the aim of r & d special for forestry after the set by the Minister.
(2) Forestry Training Institutions can use the forest area with the specific purpose of training forestry purposes after the specified by the Minister.
Article 56 (1) forest area with special purposes as stipulated in article 55 can be set on all functions of the forest area except at the nature reserve and the National Park's core zone.
(2) forest areas that have burdened the rights management by STATE-OWNED ENTERPRISES can be specified as a forest area with a special purpose with the terms does not change the principal function of the forest area.
(3) in a forest area that has saddled the permit utilization of the forest can be designated as a forest area with special purpose after excluded from the area of the works.
Article 57 forest area with special purposes referred to in Article 55, managed by forestry r & d institutions or training institution of forestry based on forest management plans in accordance with the legislation.

Article 58 (1) managing forested areas with special purposes referred to in Article 56 and article 57, lembagalitbangkehutanan forestry lembagadiklat and Government can work together with the Government of the province, kabupaten/kota Governments, universities, businesses, and communities.

(2) further Provisions regarding the use of forest areas with the specific purpose of r & d institutions training institution of forestry and forestry is regulated by regulation of the Minister.
Article 59 in terms of r & d Institute of forestry training institutions or a maintainer forestry as forest area with the specific purpose of carrying out the utilization of forest or woodland results ballots for the benefit of r & d or forestry education and training is not subject to the levy in the field of forestry according legislation.

Chapter V INFORMATION SYSTEM Article 60 (1) Conducting r & d and dikla tkehutanan Ministry must be supported by information systems that can be accessed by the Government of the province, kabupaten/kota Governments, businesses, and communities.
(2) further Provisions regarding the procedures in the system the information referred to in subsection (1) is controlled by a regulation of the Minister.
CHAPTER VI TRANSITIONAL PROVISIONS Article 61 With the establishment of this Government Regulation, forest areas which have been designated and/or specified as a forest area with the specific purpose of r & d or training forestry remains valid and its management adapted to the Government regulations.

CHAPTER VII PROVISIONS COVER Article 62 of this Regulation comes into force on the date of promulgation.

In order to make everyone aware of it, ordered the enactment of this Regulation with its placement in the State Gazette of the Republic of Indonesia.
