Back COUNTRY SHEET Republic of INDONESIA No. 57, 2010 (Additional explanation in the State Gazette of the Republic of Indonesia Number 5123) GOVERNMENT REGULATION of the REPUBLIC of INDONESIA NUMBER 42 YEAR 20102010 on the rights of MEMBERS of the INDONESIAN NATIONAL POLICE with the GRACE of GOD ALMIGHTY the PRESIDENT of the Republic of INDONESIA, Considering: that in order to implement the provisions of article 26 paragraph (2) of Act No. 2 of 2002 on State police of the Republic of Indonesia, the need to establish a government regulation on the rights of the members of the State police of the Republic of Indonesia;

Decide: define: GOVERNMENT REGULATION on the rights of MEMBERS of the INDONESIAN NATIONAL POLICE.
CHAPTER I GENERAL PROVISIONS article 1 In this Government Regulation is: 1. A member of the State police of the Republic of Indonesia which is hereinafter referred to as members of the national police is a civil servant in the State police of the Republic of Indonesia.
2. The head of the State police of the Republic of Indonesia which is hereinafter referred to as Assistant was Chairman of the State police of the Republic of Indonesia and in charge of organizing the functioning of the police force.
3. The rights of members of the national police is a privilege that may be granted by the State on any member of the Police because the duties and Office.

CHAPTER II SALARY article 2 (1) each Member of the Police obtain the base salary.

Article 3 (1) in addition to the salary referred to in article 2 paragraph (1), to the members of the national police provided: a. Family Allowances, allowances consisting of wife/husband and children;

b. Allowances Office;

c. Allowances side dishes; and d. rice Allowance.
(2) the provisions regarding the salary and benefits of members of the national police in accordance with the provisions of the legislation.
Article 4 (1) in addition to the allowances referred to in article 3 paragraph (1), to the members of the national police can be given: a. common Stipends; and b. other Allowances.
(2) the provisions concerning the common stipends and allowances to other members of the national police in accordance with the provisions of the legislation.
CHAPTER III rights of OTHER parts of the Union the right type of article 5 of the rights of other members of the national police includes the following: a. medical services;

b. legal aid and security protection;

c. leave;

d. Kapor Police;

e. sign Honorary;

f. Housing Office/dorm/mess;

g. transport or transport service;

h. MPP/retirement;

i. the funeral service and funeral money; and j. construction of spiritual, mental and traditions.

The second part of health services article 6 (1) every Member of the Police and their families are entitled to obtain health services. (2) health service referred to in subsection (1) include the following: a. Health promotif;

b. Preventive Health;

c. the curative Health; and d. rehabilitative Health.
(3) health service referred to in subsection (2) subject to the regulations of the Assistant.
The third part of legal aid and security protection of article 7 (1) any member of the Police and their families are entitled to obtain legal assistance from the Department both inside and outside the judicial process.
(2) any member of the Police who carry out specific task defending a specific criminal acts are entitled to obtain security protection.
(3) the provisions on execution of legal assistance and protection of the security referred to in subsection (1) and paragraph (2), be governed by the regulations Assistant.
The fourth part of leave article 8 (1) any member of the Police has the right to obtain a leave of absence.

(2) the leave of absence referred to in subsection (1) include the following: a. annual leave;

b. sick leave;

c. special leave;

d. leave the religious worship;

e. leave pregnant/giving birth;

f. on leave outside the country dependent; and g. the leave with important reasons.
(3) the provisions on the implementation of the leave of absence referred to in subsection (2) subject to the regulations of the Assistant.
Part five Kapor Police article 9 (1) in order to execute his duties, each Member of the national police has the right to obtain Kapor Police according to the needs and interests of its work. (2) Police Kapor as mentioned on subsection (1) consists of: a. Kapor coaching: 1. Staple Kapor;

2. Kapor function; and 3. The Gear Units Of The Field; b. Kapor operation: 1. Kapor Operations within the country;

2. Kapor foreign operations; c. Kapor Education Abroad: 1. summer; and 2. Winter; d. Kapor Visits abroad;

e. Kapor Education first: 1. education the first Police Academy;

2. First Resource police officer Education Bachelor's degree; and 3. The First Nco Education; f. Kapor Education Development: 1. School staff and Chairman of the high level of Administration;

2. School staff and the head of the national police;

3. The College of police Science;

4. Secondary School Inspector; and 5. Establishment Of School Officers.
(3) the provisions concerning Kapor Police referred to in subsection (1) and paragraph (2) is set in accordance with the regulations of the Assistant.

The seventh part of the Housing Office/Dorm/Mess of article 11 (1) to support the implementation and the smooth running of the task, members of the national police are able to obtain housing Office/dorm/mess.
(2) For members of the Police who have not obtained the Housing Office/dorm/mess house rental may be compensated according the country's financial capability that are set by regulation of the President.
(3) the provisions concerning the Housing Office/dorm/mess as referred to in paragraph (1), subject to the regulations of the Assistant.
The eighth section of the Department of Transport transport or article 12 (1) to support the implementation and the smooth running of the task, members of the national police can obtain transportation facilities or transport service.
(2) For members of the Police who have not acquired the facility transport or transport service can be given money transport in city accord the country's financial capability that are set by regulation of the President.
The ninth part of the MPP/Retirement of article 13 (1) the members of the national police who will enter the maximum retirement age given the chance live longest MPP 1 (one) year.
(2) members of the national police who undergo MPP gain rights as stipulated in article 2, article 3 paragraph (1) letter a, letter c, letter d, article 6, article 7, article 9 paragraph (2) letter a, article 10 and article 11.

c. rights to allowances for members of the national police who have working period in the Office of the national police the shortest 5 (five) years and 14 (fourteen) years, awarded for a period equal to the period of service that has suffered;
d. the level of disability and as stated on the letter a and letter b, set by the National Police Personnel Health Examiners are governed more by Rule Assistant.
Article 15 members of the national police or the national police CIVIL SERVANTS fall, were killed or died of ordinary, missing in action, dismissed with respect of the Office of the national police, to his heir was given income in accordance with the provisions of legislation.

The tenth section of the cemetery and Funeral Money article 16

(3) a funeral as referred to in paragraph (1) letter b and c letters arranged further by Regulatory Assistant.
Article 17 (1) the beneficiary of a member of the national police that fell, were killed or died of ordinary, has the right to earn money.
(2) a quantity of money and grief as referred to in subsection (1) is set in accordance with the provisions of the legislation.
The eleventh section of the construction of the spiritual, Mental and traditions of article 18 (1) any member of the Police are entitled to spiritual, mental coaching and tradition.
(2) the construction of the spiritual, mental and traditions as referred to in subsection (1) includes 3 (three) principal tenets: a. faith/religious;

b. moral/ethics; and c. social/societal.
(3) the provisions concerning the construction of the spiritual, mental and traditions is governed more by the rules Assistant.
CHAPTER IV CLOSING PROVISIONS article 19 implementation of the rules on the rights of existing members of the national police stated remains valid along does not conflict with or not specifically regulated in this government regulation.

Article 20 this Regulation comes into force on the date of promulgation.

In order to make everyone aware of it, ordered the enactment of this Regulation with its placement in the State Gazette of the Republic of Indonesia.
