REGULATION OF THE NATIONAL POLICE CHIEF OF THE REPUBLIC OF INDONESIA

NUMBER 6 IN 2010 ABOUT

INVESTIGATION MANAGEMENT BY CIVIL SERVANTS INVESTIGATORS

WITH THE GRACE OF THE GOD ALMIGHTY, THE STATE OF THE REPUBLIC OF INDONESIA,

IN A draw: a. that in Article 7 of the paragraph (1) of the Law No. 8 of the Year of 1981 on the Law of Criminal Events, has authorized the inquiry authority to the Investigator of the State of the Republic of Indonesia;

b. that in Article 7 of the paragraph (2) of the Law No. 8 of the Year of the Criminal Event, it has authorized the Investigator of the State of the Republic of Indonesia to conduct coordination and oversight of the execution of the investigation duties by the Investigator of the Civil Service;

c. that the implementation of the inquiry by the Civil Server Investigator, needs to be supported under the provisions of the laws so resulting in an effective and efficient performance;

d. that based on consideration as referred to in the letter a, the letter b and the letter c, need to establish the Rule of the Chief of the State Police of the Republic of Indonesia on the Management of Inquiry by the Civil Servlet Investigator;

Given: 1. Law No. 8 of 1981 on the Law of Penal Events (State Sheet of Indonesia Year 1981 Number 76, Additional Gazette of the Republic of Indonesia Number 3209);

2. Law Number 2 of the Year 2002 on the State Police of the Republic of Indonesia (Gazette of the Republic of Indonesia in 2002 No. 2, Additional Gazette of the Republic of Indonesia Number 4168);

3. Government Regulation No. 27 of 1983 on the Implementation Guidelines Of The Law Of The Penal Act (sheet Of State Of The Republic Of Indonesia In 1983 Number 36, Additional Gazette Of The Republic Of Indonesia Number 3258);

DECIDED:

SET: REGULATION OF THE HEAD OF STATE POLICE OF THE REPUBLIC OF INDONESIA ON THE MANAGEMENT OF INVESTIGATION BY CIVIL SERVANT INVESTIGATORS.

CHAPTER I OF THE GENERAL PROVISION

Article 1 In this rule is referred to: 1. The next Indonesian state police, abbreviated as Polri

is a tool of the state responsible for maintaining security and public order, enforcing the law, as well as providing protection, screening, and service to the community in order to keep the domestic security.

2. An investigator is an officer of the State Police of Indonesia or a specific civil servant officer who is authorized by law to conduct an investigation.

3. The next civil servant investigator is an official civil servant who is authorized by law to conduct criminal conduct appropriate under the law, and in the conduct of its duties is under the coordination and supervision of the Police Investigator.

4. The investigation is a series of investigative actions in terms of and by means of an act set in law to seek and collect evidence that with the evidence makes light of the crimes committed and in order to locate the suspect.

5. The management of the Inquiry by the PPNS is the management of the investigation of criminal acts by the government of premeditated, controlled, controlled and effective effective and efficient conduct.

6. The employer of the PPNS is a PPNS appointed by its instincts and/or structurally carrying the PPNS tasked with handling certain criminal acts that are its authority.

7. A criminal offence is any act that is punitive or unlawful as a criminal or violation of the law, referred to in the Penal Code and other laws.

8. Oversight, Observation, Research or Examination is a series of measures to search and find an event suspected of being a criminal offence through activities as set out in laws according to the scope of the task and its authority.

9. A suspect is someone who is because of his actions or circumstances, based on preliminary evidence, should be alleged to be a perpetrator of the criminal.

10. A witness is a person who can provide information in the interests of the investigation, prosecution, and the judiciary about a criminal case heard, viewed and/or experienced alone.

11. The witness is one of the evidence in the criminal case that witnesses witness to a criminal event that he heard alone, and he sees himself and naturally himself by calling the reasons for his knowledge.

12. Expert information is a description given by a person who has a special skill set about what is necessary to make light of a criminal case in the interest of the examination.

13. A clue is the deeds, events or circumstances that are due, either between one and the other, or with the criminal act itself, indicates that there has been a criminal offence and who committed it.

14. A letter is the news of the show and other letters in the official form made by the general official or made in front of him, which bears the description of the events or circumstances that are heard, seen or made themselves, accompanied by clear and clear reasons about his interest.

15. The defendant's description is what the defendant stated at the hearing about the deeds he did or whether he knew it himself or nature himself.

16. A report is a notice that is delivered by a person due to the rights or obligations under the law to the official who is authorized to have or is being or is alleged to be a criminal event.

17. An Event Report is a written report made by officers about an event suspected of being a criminal, either to be found alone or by notification of a person due to the rights or obligations under the law.

18. A person is caught in the hands of a person who is committed to a crime, or shortly after a brief period of time after the crime is committed, or is then called by a crowd as a person to do so, or when a second is found to be a criminal or a criminal offence, and shows that he is the culprit or may have committed or assisted in committing the criminal.

19. A crime scene is a place where a crime is committed/occur and other places, where suspects and/or victims and/or evidence related to the criminal act can be found.

20. An invocation is an action to present a witness, expert, or suspect to be heard of in connection with a criminal offence based on the incident report.

21. Examination is an activity to obtain the description, clarity, and identification of suspects, expert witnesses and/or evidence items or about

elements of the criminal act that have occurred, so that the position or role of a person or evidence in the criminal act becomes clear and poured in the News of the Examination.

22. An arrest is an act of investigator while the timing of the freedom of a suspect or a defendant, if there is sufficient evidence and legal provisions to the interests of the inquiry or prosecution and/or the judiciary in terms of and in the manner set out in the law.

23. Detention is the placement of a suspect or a defendant in a particular place by the Investigator or the Public Prosecution or the Judge with his repressors, in terms of as well as in the manner set forth in the law.

24. Detention delivery is a delay in temporary detention of the suspect for health reasons (requiring an outpatient or outpatient) that is corroborated with the doctor's description, until the concerned is declared to be recovered again.

25. The House shakedown is an investigator's act to enter the house of residence and/or other enclosed premises in order to conduct an inspection and/or seizure of evidence and/or arrest of a suspect in matters according to the ways set in the Criminal Code.

26. The search for the Agency was an investigator's act to conduct a body check or a suspect's clothing to search for a body that was allegedly hard on his body or brought in for it to be confiscated.

27. Forfeiture is a series of acts of investigators to take over and/or store under its control of moving or unmoving objects, tangible or intangible for the sake of proof in the investigation, prosecution and judiciary.

28. The administration of the Commission is a form of activity in the company of the company to supplement the administration required in the process of inquiry.

Article 2 of the Asas in the implementation of these regulations, covering: a. legality, i.e. any policy and investigation process by PPNS and

co-ordination and supervision by the Polri Investigator based on the provisions of the laws of the laws;

b. obligations, which is a mandatory PPNS to conduct criminal conduct investigation with coordination and supervision by the Polri Investigator;

c. Concurrently, the investigation of the investigation by the civil service and the coordination and supervision of the Polri Investigator by involving the Atasan of PPNS, or the related agencies based on the mutual respect of the duties and authority and hierarchy of each instance;

d. Accountability, which is the responsibility of the investigation process by PPNS and the implementation of the coordination and supervision by the Polri Investigator;

e. Professional, the mechanism of the investigation process by PPNS and the execution of coordination and supervision by the Police Investigator based on the technical and investigative tactics as well as the laws of the legislation;

f. Proactive, the implementation of the investigation by PPNS and the coordination and supervision by the Polri Investigator are actively;

g. uphold its human rights, i.e. an attitude of every PPNS and Investigator Polri is obliged to respect and uphold the same human rights and treatment to each person to be served;

h. Effective and efficient, all efforts and actions are executed by considering a reasonable balance between the results to be achieved by the effort, the means and the budget used; and

i. transparency, i.e., all efforts and actions that are performed clearly and openly.

Article 3 of the purpose of this rule is: a. as a guideline in the implementation of the investigation process by PPNS as well as

coordination and supervision by the Investigator Polri; and b. The implementation of a synergy and professional investigation

between the PPNS with the Investigator Polri, by depaning the PPNS in dealing with criminal cases in the purview of duty and authority.

Article 4 of the scope of this regulation, covering: a. supervision, observation, research or examination; b. The investigation. And c. Coordination and supervision by the Polri Investigator.

CHAPTER II SUPERVISION, OBSERVATIONS,

RESEARCH OR EXAMINATION Section 5

(1) Oversight, observations, research or examination are executed on the basis: a. the results of the findings from the officer; and/or b. Public reports/complaints, which may be submitted in writing

and orally. (2) Against the report/public complaint as referred to in paragraph

(1) the letter b, to the port is given a report acceptance letter. (3) The results of supervision, observations, research or examination as

referred to in paragraph (1), if found in a criminal offence, are set forth in the incident report.

Section 6 (1) The incident report as referred to in Section 5 of the paragraph (3) is reported

to the Atasan of PPNS and is recorded in the registration receipt of the incident.

(2) The incident report as referred to in Article 5 of the paragraph (3), contains a brief description of the event occurring or an alleged occurrence of a criminal offence.

(3) The Atasan of PPNS after receiving a report of events as referred to in paragraph (1), publishes the inquiry's warrant and provides instructions on the execution of the inquiry.

Article 7 (1) The supervision, observation, research or examination as

is referred to in Article 5 of the letter a, executed by the designated officer and in carrying out its activities is based on the provisions of laws that are the basis of its law.

(2) In terms of surveillance, observation, research or examination requires the activities of the investigation, the PPNS requesting assistance to the Polri Investigator.

Article 8 (1) In terms of conducting surveillance, observations, research or

the examination as referred to in Article 5, then the actions performed against the crime scene are: a. Crime scene security; b. Crime scene handling; and c. crime scene processing.

(2) The implementation of crime, handling, and crime scene processing as referred to in paragraph (1), adjusted to the respective character and field of service of PPNS respectively.

(3) In terms of implementation of activities as referred to in paragraph (1) requires tactical and technical action at the scene, the PPNS may request assistance to the Polri Investigator.

CHAPTER III OF INQUIRY Section

Form Activity Article 9

(1) Forms of activities in the investigation process by PPNS as follows: a. Commence notification of the investigation; b. invocation; c. arrest; d. containment; e. penggeledahan; f. foreclosure; g. Check; h. legal aid; i. The settlement of the file; j. No matter what, k. Investigation cessation;

l. The administration of the investigation; and m. The safety of the investigation.

(2) The order of activities as referred to in paragraph (1) is adjusted to the case of the case in which the investigation is performed.

(3) The inquiry process as referred to in paragraph (1) is exercised with the provision not to be devolve to other officers who are not investigators and other PPNS not listed in the inquiry's warrant.

(4) PPNS and Investigator Polri monitor the subsequent legal proceedings until the verdict is set.

The Second Part of the Broadcast Plan

Article 10 of the investigation plan by PPNS is made by determining: a. The target is a target; b. the resources involved; c. manner of action; d. the time to be used; and e. Investigation control.

Section 11 (1) The plan of determination of the inquiry objectives as referred to in the Section

10 letters a, includes the designation: a. People who are suspected of committing crimes; b. A crime or a crime; c. elements of the section to be applied; and d. Evidence and evidence.

(2) the inquiry/use of the investigation resources as referred to in Article 10 of the letter b, among others, the preparation: a. The executor team has authority, competence, and

integrity; b. means and infrastructure;

c. Budget required; and d. Software completeness.

(3) The plan of determining how to act as referred to in Article 10 of the letter c includes the technical and procedure form of the inquiry as referred to in Article 9.

(4) The time determining plan as referred to in Article 10 of the letter d is specified with regard to the inquiry activities as referred to in Article 9.

(5) the inquiry control plan as referred to in Article 10 of the letter e includes: a. Setup administration setup with a grammar system; b. The setup of the investigation control book by PPNS contains among others:

1. Preparation of schedule and supervision materials and/or assistance; 2. Drafting of the planning activity evaluation schedule,

organizing and execution; and 3. creation of a report in the event of a setup and resolution of a solution. Article 12

The inquiry plan as referred to in Article 10 made by the PPNS prior to the activities of the inquiry, submitted to the superiors of the PPNS in case of matter control.

Third Section of the Organizing

Article 13 (1) In the execution of an investigation by the PPNS required organizing

resources included: a. PPNS personnel; b. the means and the pre-means; c. budget; and d. Rules or software.

(2) The implementation of resource organizing as referred to in paragraph (1) is exercised by a PPNS superior based on the relationship and organizational governance in the environment of the PPNS instance.

Section 14 For the implementation of the organizing of PPNS personnel as referred to in Section 13 of the paragraph (1) letter a based on the relationship and governance of the organization's work in the environment of the PPNS instance, with the criteria: a. Has a moral good, integrity, dedication and professional; b. Adjusting the number of PPNS personnel with the task load encountered; c. has a pattern of cooperation between PPNS in the conduct of the investigation; d. forming a supervision or assistance team that can supervise the process

the inquiry; and e. Avoiding the subjectivity between the PPNS and the suspect.

Article 15 (1) of the organizing of PPNS personnel as referred to in Section 13

paragraph (1) the letter a is classed as follows: a. on an easy case, can be implemented by 2 (two) PPNS; b. on a moderate case, can be implemented by 3 (three) PPNS; c. on difficult cases, can be carried out by 4 (four) PPNS; and d. on a very difficult case, performed by a team that

consists of at least 5 (five) PPNS. (2) In the handling of certain cases, the number of PPNS is adjusted to

the situation. Section 16

Criteria the determination of an easy case as referred to in Article 15 of the paragraph (1) letter a, among other things: a. seen from the witness aspect, among other things:

1. There are witnesses who see, hear, and know firsthand the events that occurred;

2. the witness residence is in one district with the PPNS office; and

3. Witness victims of a criminal act of more than 2 (two) people. B. seen from the evidence aspect of the letter, among others:

1. there is a proof of the letter relating to the case that occurred;

2. easy to get; and

3. There is no evidence of the letter in the case of the case; b. viewed from the aspect of the clue that there is a suitability between the description of the

witness, the suspect's description, and the evidence found;

c. viewed from the expert aspect, in the preparation process is not an expert captions;

d. seen from the suspect aspect, among others:

1. caught hand;

2. Surrender;

3. existence and identity are known as well as easily obtained;

4. Suspect's description is easy to come by;

5 no more than 2 (two) people; and

6. healthy physical and spiritual;

e. seen from the crime scene aspect, among others:

1. easy to reach;

2. still intact; and

3. no crime scene processing required in a specific case;

f. viewed from the evidence item aspect, among others:

1. easy to get;

2. against evidence of evidence not required forensic or expert checks;

3. easy secured;

4. no special security required;

5. no transport required with special tools; and

6. no special place needed to secure; g. From the special tool aspect of the police support tool, no tools are required

specifically to support the case of the investigation that is handled;

h. For the role of other agencies, there is no need for the role of other agencies in the process of inquiry into matters being handled.

Section 17 Criteria the determination of the case is as contemplated in Article 15 of the paragraph (1) letter b, among others: a. seen from the witness aspect, among other things:

1. There are witnesses who see, hear, and know firsthand the events that occurred;

2. The witness residence is in one county/city with a PPNS office;

3. Witness a victim of a criminal act; and 4. no more than 3 (three) people;

b. There are: 1. There is evidence of a letter relating to the case of the case; 2. Easy to get; and 3. required in case of the case;

c. viewed from the aspect of the clue, among others: 1. there are some clues that match the description of the

witness, the suspect's description, and the evidence found; 2. There's evidence of a lead that comes with the suspect;

d. In the case of an expert, in the process of investigating criminal conduct, there is no expert information required, but if an expert is required in the jurisdiction of the investigator's law;

e. seen from aspects of the suspect, among others: 1. undisturbed his health; 2. the whereabouts and identity of the suspect are known and easy to come by; 3 is not part of an organized crime offender; and 4. no more than 3 (three) people;

f. From the facets of the crime scene, there are: 1. easy to reach; 2. Still intact; 3. required crime scene processing in a specific case; and 4. required police technical assistance in the crime scene processing;

g. seen from the aspect of evidence items, among others: 1. easy to get; 2. against evidence required forensic examination or expert; 3. Easy secure; 4. no special security required; 5. unrequired transport with a special tool; 6. no special place needed to secure;

h. From the special tool aspect of the police support tool, police special equipment is required to support the case of the investigation that is handled;

i. For the role of other agencies, it is necessary for the role of another agency and it is easy to obtain in the process of investigation of matters being handled.

Article 18 Criteria the determination of the case is difficult as referred to in Article 15 of the paragraph (1) letter c, among others: a. seen from the witness aspect, among other things:

1. The witness residence is in a single province with the office of PPNS; 2. not more than 2 (two) people; 3. is not the first source; 4. associated with other institutions; 5. required interpreter; and 6. to examine the witnesses required a special procedure/bureaucracy;

b. viewed from the evidence aspect of the letter, among others: 1. available part of the required letter evidence; 2. It is necessary; and 3. required a special permission to obtain proof of the mail;

c. viewed from the aspect of the clue that there are some unmatched clues between the witnesses ' description, the suspect's description, and the evidence found has not yet led to the suspect;

d. seen from an expert aspect, among others: 1. required captions of some experts; and 2. not yet available experts in the law area of investigators;

e. seen from the facets of the suspect, among others: 1. not yet known identity; 2. disturbed his health; 3. protected a specific group; 4. have certain posts that have special rights set up

in undrau; and 5. more than 4 (four) people;

f. From the facets of the crime scene, there are: 1. difficult to reach/away from the office of PPNS; 2. is not intact; and 3. required crime scene processing; 4. required technical assistance of the police in the crime scene; 5. required special safeguards against the crime scene; and 6. Crime scene is more than one location on the legal area of PPNS;

g. On the aspect of evidence, there are: 1. difficult to come by; 2. required a forensic examination or expert; 3. required special safeguards; 4. required transport with special tools; and 5. required a special place for safeguards;

h. From the special tool aspect of the police support tool, a special tool is required to support the case of the investigation that is handled;

i. For the role of other agencies, the role of other agencies is necessary in the process of investigation of matters being handled.

Article 19 Criteria the determination of the case is extremely difficult, as referred to in Article 15 of the paragraph (1) letter d, among others:

a. seen from the aspect of the witness, among others: 1. the presence of witnesses abroad, the address is not clear, remote areas; 2. less than 2 (two) people; 3. not directly related/not the first source; 4. associated with other institutions; 5. required a sworn interpreter; 6. required special permission in presenting the witness; 7. required special safeguards; and 8. The witness is a sickly witness.

b. seen from the evidence aspect of the letter, among others: 1. difficult to find; 2. It's necessary; 3. required special permission to obtain proof of mail; and 4. required a forensic examination of the proof of the letter;

c. viewed from the aspect of the clue that the existing clue has not shown any agreement between the witnesses ' description, the suspect's description, and the evidence found;

d. viewed from an expert aspect, among others: 1. very necessary; and 2. must be imported from outside the province or abroad;

e. seen from the facets of the suspect, among others: 1. not yet known identity; 2. disturbed his health; 3. protected a specific group; 4. more than 4 (four) people; 5. In a check, required interpreter/linguist; 6. in check, require special permission; 7. foreign nationals (WNA); and 8. Escape abroad;

f. From the facets of the crime scene, there are: 1. difficult to reach; 2. is not intact; 3. required crime scene processing in certain cases; and 4. Technical support is required for the crime scene.

g. On the aspect of evidence, there are: 1. difficult to come by; 2. required a forensic examination or expert; 3. required special safeguards; 4. required transport with special tools; and 5. It takes a special place for security.

h. viewed from the special tool aspect, among other things: 1. very necessary; 2. The necessary equipment needs to be imported from abroad; and 3. The required equipment is not available in the jurisdiction of the PPNS.

i. For example: 1. the role of other agencies is absolutely necessary; and 2. It's more than one agency that plays a role in the investigation process.

Fourth section Execution of Inquiry

paragraph 1 of the crime scene Processing

Article 20 (1) In case of cases requiring crime scene processing, then the action that

is carried out by PPNS as follows: a. search for information, clues, evidence and identity of the suspect

and victims and witnesses for the benefit of further investigations; and

b. search, retrieval, collection, and security of evidence items, performed with specific methods or technical assistance

investigation such as forensic laboratory, identification, forensic medicine, and other expert fields.

(2) The actions carried out by the PPNS in crime scene processing as referred to in paragraph (1), are poured in the news of the inspection event at the scene.

paragraph 2 of the Start of Inquiry

Article 21 (1) In the event of the start of the investigation, the mandatory PPNS first

notifies the start of the investigation into the Public Prosecuting via the Polri Investigator with the start of the inquiry's commencement notice (SPDP), unless the laws define another.

(2) SPDP as referred to in paragraph (1), is attached to: a. Event report; b. An inquiry was made; and c. news of the event that has been made.

(3) SPDP as referred to in verse (2) after the study of its agility, passed on by the Polri Investigator to the General Prosecuting with an introductory letter from the Polri Investigator.

Article 22 (1) Before the announcement of the start of the inquiry as intended

in Article 21 of the paragraph (1), the PPNS may notify orally or telephone, the email, and a brief message to the Polri Investigator to prepare for the investigation assistance that at any time required a PPNS.

(2) Notice as referred to in paragraph (1) contains a brief description of the occurrence of a criminal or violation event, the identity of the perpetrator or the suspect, the evidence item, and the inquiry's plan.

Article 23 (1) In terms of the SPDP has been received by the Polri Investigator, the mandatory Polri Investigator

prepares the investigative support requested by the PPNS. (2) Support as referred to in paragraph (1), coordinated in advance

formerly with PPNS.

Paragraph 3 Summoning

Article 24 of the summoning is carried out in accordance with the laws of the criminal event and laws that are the basis of the law of PPNS, provided: a. A subpoenaed was signed by a PPNS boss as an investigator; b In the case of a PPNS superior not an investigator, a summons was signed

by the PPNS and known to the superiors of the PPNS; c. The delivery of the summons was carried out by the officer appointed by

the concerned PPNS and accompanied by a sign of receipt of the receipt; d. a call letter is already received by the slowest 3

(three) days prior to the specified attendance date; e. a mandatory call letter is numbered according to the agency registration provisions

PPNS is concerned; f. In the event that the first call was not met for no legitimate reason,

a second call was done with a carrying order letter, whose administration was made by the PPNS;

g. In terms of carrying a suspect and/or a witness, the PPNS may request assistance to the Polri Investigator who is in the process of being performed together as well as making the news of the event;

h. Polri investigators were able to grant the request after studying and considering, then informed of his decision to PPNS;

i. In the case of being called domiciled outside the work area of the PPNS, summoning is done with the help of the Police Investigator who is in the law with the called; and

j. For calls to the suspect and/or WNI's witnesses who are overseas in the country are asked for assistance via Investigator Polri to the country's representative where the suspect and/or the witness are located.

Article 25 (1) Request assistance as referred to in Section 24 of the letter g, created

in writing by attaching a call letter that has been made by the PPNS.

(2) Prior to the PPNS requesting assistance in writing to the Investigator Polri as referred to in paragraph (1), the request may be preceded orally by mentioning/explaining the case and identity of a person to be called upon status as a suspect or a witness.

Paragraph 4 Arrest

Article 26 (1) of the PPNS who has the authority to make arrests,

its implementation in accordance with the criminal event law. (2) the PPNS who do not have the authority to make an arrest,

Paragraph 8 Examination

Article 31 (1) In terms of collecting the captions, the PPNS has

Paragraph 9 Legal Aid

Article 35 (1) In the event of granting legal assistance to a person vetted

as a suspect, exercised according to the order specified in the law of the criminal event that applies.

(2) In the case of a suspect or a convicted felon committed to a criminal offence of death or a criminal threat of fifteen years or more or for those who are incapable of being threatened with a five-year criminal or more without a legal counsel, the PPNS is required to appoint a legal advisor for them to provide assistance with free.

Paragraph 10 The File Completion

Article 36 (1) The case of the case file is the final activity of the process

the investigation. (2) The Overview or conclusion of the case dealt with, poured in the resume

Submission of Case 37

the case file is declared complete by the Public Prosecutor.

Article 38 (1) The first phase of the submission of the case file as

referred to in Article 37 of the letter a was carried out with an introductory letter signed by a PPNS supervisor as an investigator.

(2) In terms of the superiors of the PPNS not an investigator, a letter of introduction is signed by the concerned PPNS and known to the superiors of the PPNS.

(3) The implementation of file submission to the General Prosecuting is carried out via the Polri Investigator.

(4) Polri Investigators who have received the handover of the case files from the PPNS as referred to in verse (3), conduct joint research with the PPNS, and should the complete immediate surrender to the General Prosecuting.

(5) If the case file is returned by a public prosecutor, the PPNS completes according to the General Prosecuting Guide in which it is assisted by the Polri Investigator.

(6) After the PPNS completes the file of the case according to the General Prosecuting Guide as referred to in verse (5), the PPNS is required to submit the case file to the General Prosecuting via Investigator Polri in the time of 14 (fourteen) days, since the receipt of the guidance as referred to in verse (5).

(7) If in time 14 (fourteen) days the case file is not returned by the General Prosecuting, the investigation is considered complete and the PPNS hand over the suspect's responsibility and evidence to the Public Prosecuting via the Polri Investigator.

Article 39 (1) The second phase of the submission of the suspect and the evidence

as referred to in Article 37 of the letter b, carried out after the submission of the first stage file was declared complete by JPU (P21).

(2) The second-stage case of action as referred to in verse (1) to the General Prosecuting is carried out via the Polri Investigator.

(3) Surrender of suspect and evidence as referred to in verse (2) is carried out with an introductory letter signed by a PPNS supervisor as an investigator.

(4) In terms of PPNS superiors not an investigator, a letter of introduction was signed by the PPNS and known to the superiors of PPNS.

(5) The execution of the suspect and the evidence as referred to in verse (3) are made up of the news.

Paragraph 12 Termination Investigation

Section 40 Termination of the inquiry is one of the activities of the completion of the matter performed if: a. there is not enough evidence; b. the event was not a criminal offense; c. stopped by law, because:

1. The suspect died; 2. Criminal charges have expired; and/or 3. The criminal offence has obtained a Judge's ruling

(2) In terms of the termination of the investigation is declared invalid by the pre-judicial ruling and/or found any new evidence, the Investigator is mandatory:

CHAPTER IV BUDGET

Article 53 (1) Any fees arising in the framework of the conduct of the inquiry by the PPNS

are charged to the budget of the PPNS agencies in accordance with their respective duties, functions and entrepreneowork.

(2) In the implementation of the coordination and supervision of the investigation by the Polri Investigator against the PPNS in the form of investigation assistance, it is charged to the Polri budget.

CHAPTER V PROVISIONS CLOSING
