Back COUNTRY SHEET Republic of INDONESIA No. 135, 2010 (Additional explanation in the State Gazette of the Republic of Indonesia Number 5171) GOVERNMENT REGULATION of the REPUBLIC of INDONESIA NUMBER 76 in 2010 ABOUT CHANGES to the GOVERNMENT REGULATION number 7 in 2009 ABOUT the TYPE and PRICE of the ABOVE TYPES of ACCEPTANCE STATE TAX is NOT APPLICABLE to the MINISTRY OF COMMUNICATIONS and INFORMATICS with the GRACE of GOD ALMIGHTY the PRESIDENT of the Republic of INDONESIA, Considering : a. that to optimize the use of radio frequency bands and encouraged the acceleration of equitable distribution and telecommunication services, the need for tariff adjustment over the kind of Acceptance State Tax form instead of the cost of the radio frequency spectrum usage rights that apply to the Ministry of communication and Informatics as set forth in a Government Regulation number 7 in 2009 about the type and price of the above types of Acceptance State Tax is not applicable to the Ministry of communications and Informatics;
b. that based on considerations as referred to in letter a, need to set about changing government regulations over the Government Regulation number 7 in 2009 about the type and price of the above types of Acceptance State Tax is not applicable to the Ministry of communications and Informatics;
Remember: 1. Article 5 paragraph (2) of the Constitution of the Republic of Indonesia in 1945;
2. Act No. 8 of 1997 about the acceptance of the country instead of taxes (State Gazette of the Republic of Indonesia Number 43 in 1997, an additional Sheet of the Republic of Indonesia Number 14);
3. Government Regulation number 22 of 1997 and about the types of Deposit Receipts State instead of taxes (State Gazette of the Republic of Indonesia Number 57 in 1997, an additional Sheet of the Republic of Indonesia Number 3694) as amended by the Government Regulation Number 52 in 1998 about the changes to the Government Regulation number 22 Tahun1997 about type and Deposit Receipts State Tax instead of State Gazette of the Republic of Indonesia (1998 Number 85 Additional Sheets, the Republic of Indonesia Number 3760);
4. Government Regulation number 7 in 2009 about the type and price of the above types of Acceptance State Tax is not applicable to the Ministry of communications and Informatics (State Gazette of the Republic of Indonesia Number 20 in 2009, an additional Sheet of the Republic of Indonesia Number 4974);
Decide: define: GOVERNMENT REGULATIONS ABOUT the CHANGES to the GOVERNMENT REGULATION number 7 in 2009 ABOUT the TYPE and PRICE of the ABOVE TYPES of ACCEPTANCE STATE TAX is NOT APPLICABLE to the MINISTRY OF COMMUNICATIONS and INFORMATICS.
Article I a few provisions in the Government Regulation number 7 in 2009 about the type and price of the above types of Acceptance State Tax is not applicable to the Ministry of communications and Informatics (State Gazette of the Republic of Indonesia Number 20 in 2009, an additional Sheet of the Republic of Indonesia Number 4974) is amended as follows: 1. The provision of article 4 is amended to read as follows: article 4 Right of use of the Radio Frequency Spectrum consisting of : a. the costs of use of the Radio Frequency Spectrum to Permit Radio stations; and b. the cost of Rights of use of Radio frequency spectrum for Radio-Frequency Spectrum Bands Permission.

2. The provisions of article 6 is amended to read as follows: article 6 costs of the use of the Radio Frequency Spectrum for Radio-Frequency Spectrum Bands Permit as referred to in article 4 subparagraph b defined by: a. having regard to the reasonableness of selection mechanism and the ability of purchasing power; or b. the counting mechanism by using a formula.
3. In between article 6 and article 7 is inserted 5 (five) article, namely Article 6A Article 6B, 6 c, chapter, article, and section 6 d 6E which reads as follows: article 6A (1) the costs of the use of Radio Frequency Spectrum Bands Permissions assigned through the mechanism of the selection referred to in the article 6 letter a consists of: a. the cost of Initial Permits; and b. the cost of the Radio Frequency Spectrum Bands Permits yearly.
(2) the cost of the initial Permit and Permit cost Radio Frequency Spectrum annual Ribbon referred to in paragraph (1) established by the Ministry of communications and Informatics of the selection based on the results referred to in the article 6 letter a.
(3) the cost of the initial Permit and Permit cost Radio Frequency Spectrum Bands for the first year of mandatory annual repaid prior Permission of Radio frequency spectrum Bands were published.
(4) the cost of the Radio frequency spectrum Bands Permit an annual second year up to the time of practice of Radio frequency spectrum Bands Permits ends mandatory repaid each year at the latest the date and month of publication of the corresponding Permission of the Radio frequency spectrum Bands.
Section 6B (1) the costs of the use of Radio Frequency Spectrum Bands Permissions assigned through the mechanism of the calculation using the formula referred to in the article 6 letter b Permit fee in the form of a tape of the Radio frequency spectrum.
(2) the costs of the use of Radio Frequency Spectrum Bands Permit referred to in subsection (1) applies to the use of: a. radio frequency bands 800 MHz mobile networks for the mobile and fixed network organizing local wirelessly with limited mobility on the radio frequency range 824 MHz-845 MHz paired with 869 MHz-890 MHz;
b. radio frequency bands 900 MHz for the mobile networks in the frequency range radio 890 MHz — 915 MHz paired with 935 MHz — 960 MHz; and c. 1800 MHz radio frequency bands for the cellular mobile networks on radio frequency range 1710 MHz-1785 MHz paired with 1805 MHz-1880 MHz.
(3) the costs of the use of Radio Frequency Spectrum Bands Permit referred to in subsection (1) is calculated by the formula: cost of Right of use Permission-----------------------------= N x K x I x C x B Radio Frequency Spectrum Bands (4) N, K, C, and B as referred to in paragraph (3) are defined by the Ministry of communications and Informatics.
(5) I, as referred to in paragraph (3) set out in the annex to this Regulation.
(6) in determining C as referred to in paragraph (4) the Minister of communication and Information using data obtained from government agencies to non governmental affairs wing ministries in the field of statistics.
Article 6 c (1) Calculating the cost of Rights of use of Radio Frequency Spectrum Bands Permission for the use of radio frequency bands by using the formula referred to in Article 6B paragraph (3) is in effect gradually in the period of 5 (five) years counted from the date of December 15, 2010.
(2) the phasing referred to in subsection (1) for one year until the fifth year using the calculation: 1Y1-year = X + ((20% x Δ)-Z)-2Y2 = X + (40% xΔ) 2nd year 3Y3 = X + (60% xΔ) 2nd year 4Y4 = X + (80% xΔ) 2nd year 5Y5 = X + (100% xΔ) (3) the magnitude of N and K over two quantities as referred to in paragraph (2) is a single unit of quantity which is set by the Ministry of communications and Informatics.
Article 6 d (1) the costs of the use of Radio Frequency Spectrum Bands Permission referred to in the article 6 letter b mandatory paid annually.
(2) the costs of the use of Radio Frequency Spectrum Bands Permit referred to in subsection (1) for the first year of mandatory repaid prior Permission of Radio frequency spectrum Bands were published.
(3) the costs of the use of Radio Frequency Spectrum Bands Permit referred to in subsection (1) for the second year up to the time of practice of Radio frequency spectrum Bands Permits ends mandatory repaid each year at the latest the date and month of publication of the corresponding Permission of the Radio frequency spectrum Bands.
Article 6E based on the formula referred to in Article 6B paragraph (3) and the calculation referred to in Article 6 c subsection (2), the Minister of communication and information decided to establish the magnitude and timing of payments for each network provider moving mobile and local fixed network provider without a cable with limited mobility as referred to in article 6B paragraph (2).
4. Change in the Appendix I of the Roman numeral letter K so be referred to in the annex to this Regulation.
Chapter II of this Regulation comes into force on the date of promulgation.

In order to make everyone aware of it, ordered the enactment of this Regulation with its placement in the State Gazette of the Republic of Indonesia.
