P. 14/MENHUT-V/2008 ABOUT THE TECHNICAL GUIDELINES FOR THE REHABILITATION OF FOREST REHABILITATION AND LAND OF FUNDS FOR NATURAL RESOURCES

FORESTRY FUND REBOZATION

WITH THE GRACE OF THE GOD ALMIGHTY

MINISTER OF FORESTRY OF THE REPUBLIC OF INDONESIA,

DRAWS: A. that under the terms of the Government Regulation Number 55 of 2005 on the Balancing Fund Article 16 paragraph (5) states that the Fund for Forestry Results sourced from the Rebozation Fund of 40% (forty percent) is divided to the District/City producing to fund forest and land rehabilitation activities;

b. that the Forest and Land Rehabilitation Activities with the source of the Funds For the Rebozation Fund's Natural Resources Results have been governed by the Regulation Minister of Forestry Number P. 14/Menhut-V/2008;

c. that the results of the evaluation of the implementation of the Rehabilitation Forest And the Land of the Ministry of Forestry Regulation No. P. 14/Menhut-V/2008 is still found some constraints on the ground so that it needs to be adjusted to the current developments;

d. that based on the consideration of the letter a, the letter b and the letter c, need to establish the Ordinance of the Minister of Forestry about the Changes to the Ordinance of the Forestry Minister Number P. 14/Menhut- V/2008 on the Technical Guidelines of Rehabilitation Implementation Forests And Land Funds For The Rebozation Fund's Natural Resources Results.

DECIDED:

SET: THE MINISTER REGULATION OF FORESTRY ABOUT THE CHANGE

AT THE REGULATION OF FORESTRY MINISTER NUMBER P. 14/MENHUT-V/2008 ON THE TECHNICAL GUIDELINES OF THE REHABILITATION OF FOREST REHABILITATION AND THE LAND OF FUNDS FOR THE NATURAL RESOURCES OF THE REBOZATION FUND.

Article I

Some provisions in the Regulation of the Minister of Forestry Number P. 14/Menhut-V/2008 on the Technical Guidelines Implementation Of Forest Rehabilitation And Land Rehabilitation For the Natural Resources Results Fund Rebozation Fund is changed as follows:

1. The provisions of Article 1 of the paragraph (2) are amended, so that the entirety of Article 1 reads as follows:

Article 1

(1) The Fund for the Result of the Forestry Rebozation Fund (DBH SDA Forest DR) is used only to finance the activities of Rehabilitation. Forests and Lands inside and outside of the forest area.

(2) The Proportion of the use of the Funds For the Rebozation Fund (section 40%) of Forest Resources is set up as follows:

a. A minimum of 60% of the total budget amount in the year in question is used for RHL activities within the forest area;

b. A maximum of 40% of the total budget in the year is concerned for RHL activities outside the forest area.

(3) In terms of the district Government/city difficulties finding the location of RHL activities within the forest area, the proportion of use Funds for the Natural Resources Fund Rebozation Fund (Part Fund 40%) as referred to in verse (2), are arranged according to the conditions of forests and land in their respective regions.

2. The provisions of Article 2 are amended, so that the entirety of Article 2 reads as follows:

Article 2

(1) The RHL activities within the forest area are held in the Lindung Forest, the Greater Forest Park (Tahura) managed by the District/City Service, and Unburdened Production forests rights or permissions.

(2) RHL activities outside of the forest area are directed to watershed, urban water catchment areas, reservoirs and lakes, springs, water springs, rivers, mangroves, and marshes and peat.

Article II

The Ordinance of the Minister of Forestry comes into effect on the date of promulgations.
