REGULATION OF THE REPUBLIC OF INDONESIA FORESTRY MINISTER NUMBER P. 13/MENHUT-II/2010

ABOUT THE SECOND CHANGE IN FORESTRY MINISTER ' S REGULATION

P. 37/MENHUT-II/2007 OF THE PENITENTIARY FOREST

WITH GRACE GOD ALMIGHTY MINISTER OF THE REPUBLIC OF INDONESIA,

DRAWS: A. that under Article 93 paragraph (2), Article 94 of the paragraph (3), Article 95 of the paragraph (2), Section 96 of the paragraph (8), and Article 98 of the paragraph (3) of the Government Regulation No. 6 of 2007 Jo. Government Regulation No. 3 of 2008, stated that further provisions of the correctional forest are governed by the Ordinance of the Minister;

b. that to follow up on the terms of the letter a, it has been established Regulation Minister of Forestry P. 37/Menhut-II/2007 about the Forest of Corrections;

c. that in order to expedite the establishment of the workforce forest work then it needs to be immediately simplifying proposal application procedures and verification in order to set up community forest workspace;

d. that based on consideration as referred to in the letter c, it is necessary to change the Minister of Forestry Ordinance about P. 37/Menhut-II/2007 of 2007 on the Corrections Forest;

DECIDED:

Establishing: REGULATION OF THE MINISTER FORESTRY ABOUT THE SECOND CHANGE IN FORESTRY MINISTER REGULATION NUMBER P. 37/MENHUT-II/2007 ON THE FOREST OF CORRECTIONS

Article I Some provisions in Regulation Minister of Forestry Number P. 37/Menhut- II/2007 about the Forest of Corrections as it has been changed to

Regulation Minister of Forestry Number P. 18/Menhut-II/2009, amended as follows: 1. The provisions of Article 8 are amended, so that the entirety of Article 8 reads as

following: Section 8

(1) UPT Directorate General of Rehabilitation Lands and of the Social Forestry conduct coordination with the UPT Eselon I Ministry of Forestry related and Local Government to determine the prospective work area of HKm and facilitate the local community to make a wish.

(2) The Governor or Regent/Mayor based on the results of the determination of the work of HKm work as referred to in paragraph (1), propose Areal Work HKm to the Minister based on the application of the local community.

(3) Proposed Governor or Regent/Mayor is equipped with: a. Digital maps location of prospective land work forest work with

the smallest scale of 1: 50,000; and b. region description, among other physical states, social

economics, and region potential. (4) In the process of proposing an areal work of HKm as intended

on paragraph (2), the Governor or Regent/Mayor facilitates the formation of a local community group.

2. The provisions of Section 9 are amended, so that the entirety of Article 9 reads as follows:

Article 9 (1) Against the proposed Governor or Regent/Mayor as

referred to in Article 8 of the paragraph (3), is conducted verification by the Verification Team created by the Minister.

(2) The verification team consists of elements of the eselon I elements related to the scope of the Ministry of Forestry with the charge of the Director General of Rehabilitation Lands and the Social Forestry.

(3) Verification is done in a manner Confirmation to the Governor or Regent/Mayor against matters of certainty. free hak/permission, as well as conformance with the region function.
