NUMBER 56/M-DAG/PER/12/2008 ON THE TERMS OF THE IMPORT OF CERTAIN PRODUCTS

THE COMMERCE MINISTER OF THE REPUBLIC OF INDONESIA,

THE DRAW: A. that to support the retaining effort

DECIDED:

Establish: REGULATION OF TRADE MINISTERS ABOUT THE SECOND CHANGE OVER TRADE MINISTER REGULATION NUMBER 56/M-DAG/PER/12/2008 ON THE TERMS OF THE IMPORT OF CERTAIN PRODUCTS.

Article I

Some provisions in the Regulation of Trade Minister Number 56 /M-DAG/PER/1 2/2008 on Provisions I Mpor Of Certain Products as amended by Trade Minister Regulation Number 60 /M-DAG/PER/1 2/2008, amended as follows:

1. The provisions of Article 1 are amended so that it reads as follows:

Article 1

In the Regulation of this Minister referred to: 1. Import is the activity of inserting goods into

the customs area. 2. Certain products are the products affected

import under this Minister Regulation which includes food and beverage products, clothing so, footwear, electronics, children's toys, traditional medicine and herbs, and cosmetics.

3. Importers Listed Specific Products, subsequently called IT-Products are certainly the company that performs the Definite Product import activities.

4. The verification and the Import Technical Search are the technical examination activities of the Certain Products performed at the loading port of the goods by Surveyor.

5. Surveyor is a survey company that is authorized to conduct the verification and technical search of imported products.

6. The Minister is the minister who organizes government affairs in the field of commerce.

7. The Director General is the Director General of Foreign Trade Ministry of Commerce.

8. The Director is the Import Director of the Directorate General of Foreign Trade Ministry of Commerce.

2. The provisions of Section 4 are amended so that it reads as follows:

Section 4

(1) The Company which has acquired the designation as IT-Product shall be required to deliver a written report on the execution of the Product of Certain Products.

(2) The delivery of the report as referred to in paragraph (1) is performed either of its importation and is not terealized.

(3) The report as referred to in paragraph (1) is delivered to the Director every 3 (three) months

3. The provisions of Section 5 are amended so that it reads as follows:

Section 5

(1) Each import of Certain Products by the Relevant Products can only be done through the destination port: a. seaport: Belawan di Medan, Tanjung Priok di

Jakarta, Tanjung Gold in Semarang, Tanjung Perak in Surabaya, Sukarno Hatta in Makassar, Dumai in Dumai, and Jayapura in Jayapura: dan/or

b. All international air ports.

(2) Imports of Certain Products by Certain IT-Products undertaken through the seaport of Dumai and the seaport of Jayapura only for food and beverage products.

(3) Imported Product Imports for The needs of the Free Trade Area and Free Port are governed under the provisions of laws regarding the Free Trade Area and the Free Port.

4. The provisions of Section 8 are amended so that it reads as follows:

Section 8

(1) Redemption as an IT-Product is certainly revoked in terms of: a. The company does not perform the delivery obligations

within the term 6 (six) consecutive months; and/or

c. the recommendation of the Directorate General of Customs and Excise of the Ministry of Finance, the company has committed a breach in the field of paeiness.

(2) The Company that has been repealed as IT-The Specified Product as referred to in paragraph (1) may apply as a new Valid Product after 6 (six) months since the date of the date revocation.

5. Between Section 11 and Section 12 of the section 1 (1) section, Section 1 1A thus reads as follows:
