REGULATIONS MINISTER ORDINANCE REPUBLIC OF INDONESIA

NUMBER 122/M-IND/PER/11/2010 ON

ENFORCING INDONESIAN NATIONAL STANDARDS (SNI) OF MANDATORY DRINKING WATER METER SPECIFICATIONS

WITH GRACE ALMIGHTY GOD MINISTER OF INDUSTRIALIZATION OF THE REPUBLIC OF INDONESIA,

DRAWS: A. that in order to improve the competuing of the national industry and ensure the quality of industrial output, protect consumers against the quality of products and create a fair and fair business competition, needs to enact Indonesian National Standards (SNI) Water Meter Specification is mandatory;

b. that under consideration as intended in the letter a, it is necessary to be issued by the Minister of Industry Regulation;

DECIDED: Establishing: INDUSTRY MINISTER REGULATIONS ON

THE ENFORCEMENT OF INDONESIAN NATIONAL STANDARDS (SNI) THE WATER METER SPECS ARE DRINKING MANDATORY.

Section 1 In this Ministerial Regulation referred to: 1. The next SNI Use Product Certificate is called SPPT-

SNI is the SNI-issued Certificate of Use Product issued by the Institute Certification of the Product to the manufacturer which produces the Drinking Water Meter as per SNI requirements.

2. The Product Certification Institute that is next called LSPro is an agency that performs the SNI Use Product Certification activities.

3. The Laboratory of Testing is a laboratory that conducts testing activities against the Drinking Water Meter as per the specification/test method of the SNI.

4. The Board of Supervising Goods and Services in the Factory (PPSP) is a civil servant in the center or area assigned to conduct surveillance of goods and services at the production site and outside of the production site. The SNS is mandatory.

5. The next National Accreditation Committee is designated an agency in which it is authorized to accrue institutions and laboratories to conduct certification activities.

6. The Minister is the Minister who's been drugging Industrial Affairs 7. The Director/Directorate General Pembina Industries is the Director/Directorate

General of the Manufacturing Industry Base, Ministry of Industry. 8. BPKIMI is the Agency for Climate Policy Review and the Industrial Mutu,

Ministry of Industry. 9. Provincial Service is the Provincial Office of the Province that carries out the task

of the governance of the industrial field. 10. County/City Services are the Service in the District/City that performs

the task of governance of the industrial field. Article 2

(1) Compulsory SNI Water Meter Specifications as per SNI 2547:2008 at the Tarif HS number HS 9028.20.10.00.

(2) Drinking Water with Tarif HS 9028.20.10.00 The SNI-imposed SNI Liquid Water Meter Specification as referred to in paragraph (1) is a tool for measuring the amount of water flow

flows continuously through the work system of equipment equipped with: a. sensor unit; b. the unit counters; and c. The measuring indicator for stating the volume of the water passing by

measures the nominal diameter of the 50 mm maximum water entrance diameter. (3) The Drinking Water Meter Product as referred to in paragraph (1) stated

pursuant to SNI 2547:2008 if it has passed the test by using the SNI Testing Method 2418.3:2009.

(4) When the SNI Specification of the Water Meter as referred to in paragraph (1) is revised, the SNI Specification of the Water Meter Specification results last revision.

Section 3 of the Company producing the Drinking Water Meter as referred to in Article 2 is required to apply SNI with: a. have SPPT-SNI of Water Meter Specification in accordance with the provisions

applicable; and b. grow the SNI mark on any Drinking Water Meter products in a way

puts it in a place that is easy to read and not easily lost. Section 4

Each Water Meter as referred to in section 2 is traded within the country, which is derived from the results of a domestic production or import shall meet the requirements of the SNI as referred to in Section 3.

Article 5 (1) The SPPT-SNI Publishing Specification of Water Meter as

referred to in Article 3 of the letter a, through: a. the testing of product quality suitability for

The Drinking Water Meter product in accordance with the provisions in the SNI as referred to in Section 2; and

b. audit the application of the SNI ISO 9001:2008 or other recognized quality management systems or other quality management systems.

(2) The SPPT-SNI Specification of the Drinking Water Meter as referred to in paragraph (1) is exercised by the Accredited LSPro and is appointed by the Minister in accordance with the provisions of the invitational regulations.

(3) If there is not yet available LSPro and or Test Testing Laboratories as per the SNI scope of the Drinking Water Meter Specification, the Minister may designate the LSPro and or the Test Laboratory whose competitors have been evaluated by BPKIMI.

(4) The LSPro and or the designated Test Laboratory as referred to in paragraph (3) the longest 2 (two) years since the appointment must be already accredited by KAN.

Section 6

(1) The LSPro as referred to in Section 5 of the paragraph (2) is required to report and attach a copy of SPPT-SNI which has been published or revoked by LSPro to the Director General of the Industry and Head of BPKIMI.

(2) The LSPro which publishes SPPT-SNI The Drinking Water Meter is responsible for the implementation of the surveillance and monitoring use of the SNI sign on the published SPPT-SNI.

Article 7

(1) The Drinking Water Meter is from Domestic production that does not meet the provisions of the SNI as referred to in Article 3 is prohibited from circulating and must be destroyed.

(2) Import Water Meter Products that do not comply with the SNI provisions as referred to in Article 3 if entered to the Indonesian customs area banned from circulating and must be destroyed or exported back by the importer in question.

(3) The import of imported water meter products which meet the requirements of the SNI as referred to in Section 2 and have SPPT-SNI, which will be imported to be registered tipenya to the Directorate General of Pembina Industry.

(4) Tata's way of withdrawal of products from circulation, shipping back to home country, or destruction of the Water Meter product as referred to in paragraph (1) and paragraph (2) is conducted in accordance with the provisions of the laws.

Section 8

(1) Coaching and supervision of the implementation of the application of the SNI Specification of Drinking Water as referred to in Section 2 is conducted by the Directorate General of Industry Enlarging at least 1 (one) times in a year executed by the Supervising Officer of the Goods and or Services in the Factory (PPSP).

(2) In conducting surveillance as referred to in paragraph (1) the Industrial Pembina Directorate may coordinate with the Provincial Service and or the County/City Service or related agencies.

Article 9

(1) BPKIMI executable Coaching on the Assessment Board in order to implement the SNI Specification of Drinking Water.

(2) In carrying out the coaching as referred to in paragraph (1), BPKIMI provides a written reprimand to LSPro that does not deliver The report referred to in Article 6 of the paragraph (1).

Article 10

Director General Pembina Industry sets Technical Instruction and Guidance Surveillance of SNI Specification of Drinking Water Meters.

Article 11

The business offender and or the LSPro are committing a breach of the provisions in Regulation of this Minister are subject to sanction in accordance with the provisions of the laws.

Article 12

The Minister ' s Regulation is starting to apply 6 (six) months from the date of the invitation.
