REGULATIONS OF THE REPUBLIC OF INDONESIA FINANCE MINISTER

NUMBER 93 /PMK.06/ 2010 ABOUT

DIRECTIONS FOR THE IMPLEMENTATION OF THE AUCTION

WITH THE GRACE OF THE GOD ALMIGHTY REPUBLIC OF INDONESIA,

DRAW: a. that in order to improve the service of the auction, as well as to realize the execution of an auction that is more efficient, effective, transparent, accountable, fair, and guaranteed legal certainty, is seen as necessary to perform a provision of the auction;

CHAPTER I OF THE GENERAL PROVISION

7. The Minister is the Finance Minister of the Republic of Indonesia. 8. The Directorate General of Wealth of State, which is subsequently called DJKN,

20. The owner of the Goods is a person or legal entity/venture that has the ownership rights of a auctioned item.

21. An auction participant is a person or legal entity/entity that has been eligible to follow the auction.

22. A buyer is the person or body of the law/body of the venture that submitted the highest offer and was passed as the winner of the auction by the Officer of Lelang.

23. CHAPTER II OF THE AUCTION OFFICE

Article 8 (1) The Officer of Lelang consists of from:

a. Top-class auction officials; and b. The Class II Auction Officer.

(2) Class I Lelang officials are authorized to carry out auctions for all types of auctions at the request of the seller/owner of the Goods.

(3) Class II Lelang officials are authorized to carry out a Voluntary Voluntary Auction on the invocation of the Lelang Hall or Seller/Owner of the Goods.

CHAPTER III PREPARATION OF AUCTION

SECTION OF THE AUCTION REQUEST

The Second Section of the Goods/Owners

Section 16 (1) The seller/Owner of Goods is responsible for:

a. the validity of the ownership of the goods; b. the validity of the auction requirements document;

c. submission of movable goods and/or non-mobile items; and d. ownership document to Buyer.

(2) The seller/Owner of the Goods is responsible to a civil suit or criminal charge arising out of not being subject to any law in the field of auction.

(3) the seller/Owner The goods are responsible for damages for damages arising out of the validity of goods and documents of auction requirements.

Article 17 (1) The seller/owner of the Goods may submit additional auction terms

to the extent not in conflict with the laws, including but not limited to: a. term for the auction participant to see, physically research

the goods to be auctioned; b. term of the retrieval of goods by the Buyer; and/or c. schedule an auction explanation to the auctioneer prior to the execution

auction (aanwijzing). (2) The additional auction terms as referred to in paragraph (1)

are attached to the auction request. Section 18

Article 19 of the auction site must be in KPKNL's work area or the area of the office of Lelang Officer II where the goods are located.

(2) The authorized officer as referred to in paragraph (1) among others: a. Director General on behalf of the Minister for goods located outside

territory of the Republic of Indonesia; b. The Director of the Auction on behalf of the Director General for the goods located

within the region between the Territory Office; or c. Head of the local Area Office for the goods located in

area of the local Area Office. (3) Request approval of the auction of goods outside

KPKNL work area or outside of the Class II office area of the office, submitted by the seller to the official as referred to in paragraph (2), on condition Part of the item must be in the KPKNL/Class II workspace of the Class II auction where the auction is intended.

The Fifth Part Of The Land Description (SKT)

Article 22 (1) Execution of an auction over land or land and a mandatory building is equipped

is submitted by the KPKNL Chief or Class II Lelang Officer. (3) In terms of land or land and buildings to be auctioned yet

registered at the local Pertanahan Office, Head of the KPKNL or Class II Lelang Officer requires the seller to request a Letter of Attraction from Lurah/Head of the Village

(4) Based on the Letter of Attraction as referred to in paragraph (3), Head of the KPKNL or Class II Lelang Officer requesting SKT to the local District Office.

The Sixth Part of Cancellation Prior To Auction

Article 24 Auctions to be implemented only may be cancelled with the request of a vendor or a provisional designation or a ruling from a public judicial institution.

Article 25 (1) The cancellation of the auction with a court ruling is delivered

h. The announcement of the auction held by the seller was not implemented according to the laws of the law;

Article 38 In terms of execution Re-auction, Value Limit on previous auctions may be changed by the seller/owner of the Goods by mentioning the reasons that may be accounted for.

i. the bidding of an auction; and a j. The term of the payment of Lelang Payment by Buyer.

(2) The Lelang announcement is set in such a way that it is published on KPKNL's work day and does not make it difficult for the auction to perform the Lelang Offer Guarantee.

Article 43 (1) The Lelang announcement is carried out through the daily newspaper published in

the district/county venue of the goods is located. (2) In the case of no daily newspaper as referred to in paragraph

(1), the Lelang announcement was announced in a daily newspaper published in the nearest city/county or in the capital city or capital of the country and circulated in the work area. KPKNL or the office of the office of Officer Lelang Class II is auctioned.

Article 44 (1) Announces Lelang for Execution Lelang against goods not

moving or non-mobile items sold together with movable goods, performed with the following provisions:

a. The announcement is performed 2 (two) times, the term of the first Lelang Announcement to the second Lelang Announcement Announcement 15 (fifteen) days and is set in such a way that the second Lelang Announcement does not fall on a big day/day off;

Article 48 (1) Announces Lelang for the Compulsory Auction Nonexecutions and Lelang

The Nonexecution of the Volunteers is performed with the provisions as follows: a. non-moving items or movable items sold together

with non-moving items, performed 1 (one) times via the shortest daily newspaper 7 (seven) days prior to the execution of the auction;

(2) The Lelang Announcement for the Compulsory Nonexecutions Auctions and the Voluntary Nonexecution Auctions are repeated in the applicable as it is in verse (1).

Article 49 (1) Announces the Lelang for the implementation of the Compulsory Nonexecutions Auctions and

b. Auctions that originate from outside DJKN:

1) are healthy and spiritual;

2) the lowest education of the Public Secondary School or the equals; and

3) has the ability and the ability to guide the auction.

Section 55 (1) In the Direct Lelang Offer, the valid Lelang Participant or

(2) In the Indirect Bid of the Lelang Offering, the valid Lelang Participant or its power at the time of the auction is not required to be present at the auction and offer it is done with using information and communication technology.

Article 56 (1) Offer Lelang in the Execution Lelang and the Mandatory Nonexecution Auction

must be done with the Direct Lelang Offering. (2) Direct Lelang Offer may use an offer with

through a letter sent before the execution of the auction. (3) Offer of Lelang in Voluntary Nonexecution Auctions may be performed

with Direct Lelang Offering or Indirect Lelang Offer.

Article 57 (1) In terms of the auction offer not directly verbally, the Lelang Participant

submit an offer using visual and telephone audio media.

(2) In terms of the auction offer not directly in writing, the Lelang Participant is offering an offer using information technology and communication among others: LAN (local area network), Intranet, Internet, short messages (short message service service/SMS), and facsimile.

Section 58 (1) Non-Direct Lelang Offer in Voluntary Nonexecution Auctions

via the Internet, must meet the provisions below, including but not limited to: a. using the software specifically for hosting auctions

via the Internet at prices is increasing; b. Valid Auction participants get the Lelang Participant's number and password

access (password) so as to make an offer;

c. The offer is performed continuously from the time set up to the closing of the offering as mentioned in the Lelang Announcement;

d. The Limit value is open/no secret and must be aired on the site;

e. Participants of the Auction can find out the highest offer submitted by the other Lelang Participant is continuous; and

f. The auction official passed the highest bidder as a Buyer based on the recapitulation prints that the auction software processed through the Internet at the time of the closing of the offer.

(2) Further provisions regarding the execution of the auction through The Internet is governed by the Minister's Rules.

Article 59 (1) The auction offering hosted by KPKNL may be conducted with

an inclusive Lelang Price or with an exclusive Lelang Price. (2) The Lelang with an inclusive Lelang Price is done with the offer price

already includes the buyer ' s Bea Lelang. (3) The Lelang with exclusive Lelang Price done with the offer price

has not included the buyer ' s Bea Lelang. Section 60

(1) Each Lelang participant is required to make the offer and offer the least equal of the limit in terms of an auction with the Value of Limit announced.

b. Conduct a draw among the Lelang Participants who submit an offer the same if the provisions as referred to in the letter a cannot be implemented.

Article 62 (1) The Lelang applicant/Vendor determines the way the auction bids with

listed in the Lelang Announcement. (2) In the event the Lelang applicant/seller does not specify how to offer

auction as referred to in paragraph (1), Head of the KPKNL/A Class I Lelang Officer or Class II Lelang Officer is entitled to determine its own way of bidding at auction.

Section 63 Further provisions of auction offer are arranged with the General Director's Rules.

Third Section Bea Lelang and Money Miskin

Article 64 Any implementation of the auction is subject to Bea Lelang and Miskin's Money in accordance with Government Regulation. About The Tarif Of The Type Of State Acceptance Not The Taxes Applicable To The Ministry Financial.

Section 65 (1) The cancellation of the auction execution plan conducted by

Fourth Section

Enlarging Section 66

(1) Lelang officials pass the highest bidder that has reached or exceeded the Value of Limit as Buyer, in the execution of an auction using the Value of Limit.

(2) Lelang officials pass the highest bidder as the Buyer in the execution of the Voluntary Nonexecution Auctions which do not use the Value Limit.

(3) Excluded from the provisions as referred to in paragraph (1), in the execution of The Voluntary Nonexecution Auction that the highest bidder does not reach the Value of Limit, Officials The auction may pass the antidote referred to as the Buyer, after receiving written approval from the owner.

Article 73 (1) In terms of Buyer not to pay off the Lelang Payment Oblicity

Article 76 (1) In terms of the seller/Owner of the Goods handing out the original document

entitlements as referred to in Section 18 of the paragraph (2) to the Officer of Lelang, the Officer of Lelang must surrender the original document of ownership and/or goods delivered to the Buyer, at least 1 (one) business days after the Buyer shows proof of repayment

Article 83 (1) In terms of important matters known after the closing of the Treatise

(4) Long-term Deposit Minuta Auctions for 30 (thirty) years since the implementation of the auction.

Article 85 KPKNL or Officer Lelang Class II can only show or notify Minuta Risalah An auction to a party of interest directly with the Auction Treatise, its heir or a person acquiring the right, unless otherwise determined by the laws.

Article 86 (1) of the interested parties may obtain the Quotation/Copy/Grosse

authentic of the Minuta Treatise Auction with the disburdened Bea Materai. (2) The party of interest as referred to in paragraph (1) includes:

a. The buyer obtained the Auction Treatise citation as a Purchasing Deed for the benefit of the name or Grosse Treatise Auction as needed;

b. The seller obtained a Copy of the Auction Treatise for the auction of the auction or Grosse Treatise Auction as needed;

c. Superintendent of Auction (Superintenden) obtained a Copy of the Auction Treatise for the execution of the auction/service interest; or

d. Authorized instance of the auction object's ownership name obtain a Copy of the Auction Treatise on the need.

(3) The authentic Minuta/Grosse of Minuta The Auction Treatise is signed, given the wet stamp/seal stamp and is given a date of expenditure by the Head of the KPKNL or the Class II Lelang Officer in question.

(4) Citation Treatise Auction for auction of land or land and building signed by KPKNL/Acting Chief Lelang Class II after the Buyer Submit proof of BPHTB payment.

(5) Missing Or Broken Auction Treatises may be issued replacements at the Buyer's request.

Article 87 (1) In the interest of judicial proceedings, photocopies Minuta Treatise auction

and/or embedded letters on Minuta ' s Treatise Auction may be given to investigators, the public prosecutor or judge, with the approval of the Head of KPKNL for the Officer Lelang Class I or Superintendent of Lelang (Superintenden) for the Class II Officer II.

(2) The Minuta Photocopy Minuta Treatise and/or letters as referred to in paragraph (1) are made News of the Surrender Event.

Article 88 The further provisions of the Auction Treatise are set up with the Rules of Director General.

CHAPTER VI OF OFFICE ADMINISTRATION

AND REPORTING Article 89

(1) KPKNL, Lelang Hall and the Office of Lelang Class II organize office administration and make reports relating to the execution of the auction.

(2) The DJKN Regional Office and Central Office make a recapitulation report auction on its kind of auction.

(3) Further provisions concerning the hosting of office administration and reporting on KPKNL, Lelang Hall and the Office of Lelang Office II as referred to in paragraph (1) are governed with the Regulation. Director General.

BAB VII TRANSITION provisions
