ABOUT THE CHANGE TO THE FINANCE MINISTER ' S REGULATION NUMBER 104 /PMK.02/ 2010 ABOUT THE ARRANGEMENT OF THE DRAFTING AND THE REVIEW OF THE WORK PLAN AND

THE MINISTRY OF THE MINISTRY OF STATE/INSTITUTE 2011 BUDGET YEAR

WITH THE GRACE OF GOD ALMIGHTY

FINANCE MINISTER,

Counterpart: a. that under the Financial Minister Regulation No. 104 /PMK.02/2010, it has been established on the basis of the drafting and penance of the Ministry of State/Institute (RKA-KL) of the 2011 Budget Year;

b. that in the course of acceleration and simplification of the RKA-KL designation process as well as the enactment of the Budgeting Implementation (DIPA) List of the Budget Year 2011, it needs to change some of the provisions regarding the RKA-KL Budget Year's composition and suppressor. 2011 as set in Regulation of Finance Minister Number 104 /PMK.02/ 2010 on the Drafting Guidelines and the Ministry of Work Plan and Budget of the Ministry of State/Institute of the Budget Year 2011;

c. that based on consideration as meant in letters a and the letter b, need to establish the Minister of Finance Regulation about the Changes to the Financial Ministerial Regulation Number 104 /PMK.02/ 2010 on the Drafting Guidelines and the State of the Office of the Ministry of Work and Budget of the State Budget Year 2011;

Given: 1. President's Decision No. 56/P of 2010;

2. Regulation of Finance Minister Number 104 /PMK.02/ 2010 on the Drafting Guidelines and the State of the Ministry of Work Plan and Budget of the Ministry of State/Instituations 2011;

STIPULATING: THE REGULATION OF THE FINANCE MINISTER ON THE CHANGE IN THE REGULATION OF FINANCE MINISTER NUMBER 104 /PMK.02/ 2010 ABOUT THE ARRANGEMENT OF THE DRAFTING AND THE REVIEW OF THE WORK PLAN AND THE MINISTRY OF THE MINISTRY OF THE COUNTRY 2011 BUDGET YEAR.

Article I

Some provisions in Finance Minister Regulation Number 104 /PMK.02/ 2010 on the Drafting Guidelines and the Ministry of Work Plan and Budget of the Ministry of State/Society of the Year of Budget 2011, are amended as follows:

1. The provisions of Article 9 are amended to read as follows:

Article 9

(1) In the case of the RAPBN discussion between the Government and the DPR does not result in a change of RKA-KL which has been agreed between the related commissions in the House and the Ministry State/Institution as referred to in Article 7, RKA-KL may be set by the Finance Minister c.q Director General of the Budget.

(2) The RKA-KL Redemption as referred to in paragraph (1) also includes the RKA-KL adjustment as long as it is not resulting in a change in the budget allocation and the performance target.

2. The provisions of Article 10 are amended so that it reads as follows:

Article 10

(1) In the case of the RAPBN discussion between the Government and the DPR results in a change of RKA-KL which has been agreed between the related commissions in the House and the Ministry State/Institution as referred to in Article 7, the Ministry of State/Instituts performing an adjustment of RKA-KL.

(2) The RKA-KL Adjustment as referred to in paragraph (1) must be given the approval of the DPR.

3. Section 11 is deleted.

4. The provisions of Article 12 are amended so that it reads as follows:

Article 12

(1) RKA-KL which the DPR has agreed to in Article 9 and Article 10 is presented by the Minister/Leader of the Institution to the Minister of Finance c.q. Director General of the Budget to receive the designation, at least 2 (two)

-3-weeks prior to the termination of the Presidential Decree on the Central Government Shopping Budget Details.

(2) RKA-KL that the Finance Minister c.q. Director General of the Budget as referred to in paragraph (1) Further outlined for each working unit becomes a Work Plan and the Working Unit Budget as well as being the basis for the President's Decision on the Central Government Shopping Budget Details.

(3) In terms of RKA-KL as referred to in the Article 9 and/or Article 10 is not yet accepted, the President ' s Decision on the Details of the Shopping Budget The Central Government is composed based on the RKA-KL as referred to in Article 7.

5. The provisions of Article 14 are amended to read as follows:

Article 14

(1) The President's decision on the Central Government Shopping Budget Details becomes the basis for the drafting and authoring of the Budget Implementation Filings (DIPA).

(2) The drafting guidelines and the enactment of the DIPA of the Budget Year 2011 are set forth in its own Financial Ministerial Regulation.

6. Appendix I, Annex II, and Annex III of the Financial Minister Regulation Number 104 /PMK.02/ 2010 on the Drafting Guidelines and the Ministry of Work Plan and Budget of the Ministry of State/Institute of the Budget Year 2011 are changed so that it becomes as specified in Appendix I, Annex II, and the inseparable Attachment III of this Minister of Finance.

Article II

This Finance Minister Regulation shall begin in effect on the date of the promulgable.
