REGULATION OF LABOR MINISTER AND TRANSMIGRATION

REPUBLIC OF INDONESIA NUMBER PER.09/MEN/VII/2010

ABOUT THE OPERATOR AND OFFICER OF THE LIFT AND TRANSPORT

WITH THE GRACE OF THE ALMIGHTY GOD THE MINISTER OF LABOUR AND TRANSMIGRATION

REPUBLIC OF INDONESIA,

Balanced: that with the growing use of the type and capacity of lift and transport capacity it needs to perfect the Regulation of Labor Minister Number PER.01/MEN/1989 about Kwqualifying and Terms of the Lift tap operator with the Minister ' s Regulation;

DECIDED:

SET: LABOR MINISTER REGULATION AND TRANSMIGRATION ABOUT OPERATOR AND AIRCRAFT OFFICER LIFT AND TRANSPORT.

CHAPTER I OF THE GENERAL PROVISION

Article 1 In this Ministerial Regulation is intended with: 1. Operator is the workforce that has the ability and has

special skills in the operation of lift and transport aircraft. 2. Officers are a workforce that has the ability and has

special skills in the plane of lift and transport consisting of a strap (rigger) and technician.

3. A bint (rigger) is a workforce that has the ability and has special skills in performing the engagement of goods and assisting in the operation of lifting of the lifting equipment.

4. A technician is the managing officer, maintenance, repair and/or inspection of the lifting and transport aircraft.

5. A lift and transport aircraft is an aircraft or device used to move, lifting the payload either of the material or person vertically and/or horizontally within a specified distance.

6. A lift device is a device that is constructed or built specifically to lift up and lower the payload.

7. A transport band is an aircraft or device used to continuously move the charge continuously (continue) by using the band's help.

8. A transport plane over the runway and above the surface is an aircraft or device used to move the payload or people using the steering wheel either inside or outside the aircraft and moving on the runway or surface.

9. A railroad is a freight device that moves over the rail road.

10. The next Occupational Safety and Health License (K3) is a signature card of an operator's authority to operate a lift and transport aircraft according to the type and its qualifications or officers for the aircraft handling. Lift and load.

11. Workbook (log book) is a work book given to an operator to record activities during the operation of an aircraft lift and transport according to its type and qualifications or officers to record the handling of the aircraft's lift and the aircraft. Transport.

13. The entrepreneur is: a. Individual persons, alliances or legal entities running

Article 2 of this Minister's Regulation governs qualifications, terms, authority, operator obligations and aircraft officer's lifting and transport.

Article 3 Of the Employers or the caretaker is prohibited from hiring an operator and/or officer of lift and load aircraft that do not have a K3 license and a work book.

Article 4 The number of lift and transport operators employed by the businessman or caretaker must meet the qualifications and amount according to the type and The capacity of the aircraft is lift and transport as set forth in this Order of Regulation.

CHAPTER II OF QUALIFICATIONS AND TERMS

OPERATOR AND OFFICER OF THE LIFT AND TRANSPORT SECTION

Aircraft Operator Lift and Angkut Section 5

(1) Lift and transport aircraft must be operated by the aircraft carrier. and transport that has a K3 license and a work book as well as its type and qualifications.

(2) Lift and transport aircraft operators as referred to in paragraph (1) include lifting equipment operators, transport bands, transport aircraft on the runway and on the surface, and the rail road freight device.

Paragraph of the Operator Lifting equipment

Section 6 (1) The lifting equipment operator includes a mechanical dongkrak operator (lier), taal,

electrical lifting device/freight elevator/passenger hoist, aircraft hydraulic, pneumatic, gondola, faucet, tap car, centipede tap, tap pedestal, tower faucet, tap gantry, tap overhead, portal faucet, magnetic tap, locomotive faucet, wall faucet, rotary axis tap, and stake machine.

(2) Lift equipment operator.

(2) The lift equipment operator as referred to in paragraph (1) is classified as follows:

a. Class I operator; b. Class II operators; and c. Class III operators.

(3) The classification as referred to in paragraph (2) does not apply to the operator of the gondola, the mechanical dongkak (lier), the notal, and the stake.

Article 7 (1) The operator of the lifting equipment as referred to in Article 6 of the paragraph (2)

the letter a must meet the requirements as follows: a. At least educated SLTA/simply; b. Experienced at least 5 (5) years of help

service in their field; c. healthy health according to the doctor's description; d. the age of at least 23 years; and e. have a K3 License and a workbook.

(2) The operator of the lifting equipment as referred to in Section 6 of the paragraph (2) letter b must meet the requirements as follows: a. At least educated SLTA/simply; b. experienced at least 3 (three) years of assisting the service

in its field; c. health care according to the doctor's description; d. the age of at least 21 years old; and e. have a K3 License and a workbook.

(3) The operator of the lifting equipment as referred to in Section 6 of the paragraph (2) of the letter c must meet the requirements as follows: a. At least educated SLTP/is simple; b. experienced at least 1 (one) year of assisting the service

in its field; c. health care according to the doctor's description; d. the age of at least 19 years; and e. have a K3 License and a workbook.

(4) gondola operators, mechanical dongles (lier), takal, and the stake referred to in Article 6 of the paragraph (3) must meet the requirements as follows: a. At least educated SLTP/is simple; b. experienced at least 1 (one) year of assisting the service

in its field; c. health care according to the doctor's description; d. the age of at least 19 years; and e. have a K3 License and a workbook.

Section 8 of the Class III lift equipment operator can be upgraded to a class II lifting equipment operator and the class II lift equipment operator can be upgraded to a class I lift equipment operator with the requirements as follows: a. experienced as an operator in accordance with its class of security-

a lack of 2 (two) years continuously; and b. pass the lift equipment operator test in accordance with its qualifications.

Third Paragraph the operator of the Aircraft Transport over the Landasan and above the Surface

Article 11 of the operator of the transport aircraft on the runway and above the surface include the operator: dump truck, truck crane/trailer, hazardous material transport device, tractor, suspension train, shovel, excavator/back hoe, compactor, giling machine, bulldozer, loader, tanden roller, tire roller, grader, vibrator, side boom, forklift and/or lift truck.

Article 12 of the operator forklift and/or lift trucks as referred to in Section 11 are classified as follows: a. class I operator; and b. Class II operator.

Article 13 of the operator of the transport aircraft over the runway and above the surface as in Section 11 except for the forklift operator and/or lift the truck must meet the requirements as follows: a. At least educated SLTP/is simple; b. experienced at least 1 (one) year of assisting services in

subject matter; c. healthy body according to the doctor's description; d. the age of at least 19 years; and e. have a K3 License and a workbook.

Section 14 (1) The operator forklift and/or lift the class I truck as referred to in

Article 12 of the letter a must meet the requirements as follows: a. At least educated SLTA/simply; b. experienced at least 3 (three) years of assisting the service

in its field; c. health care according to the doctor's description; d. the age of at least 21 years old; and e. have a K3 License and a workbook.

(2) The operator forklift and/or lift of class II trucks as referred to in Article 12 of the letter b must meet the requirements as follows: a. At least educated SLTP/is simple; b. experienced at least 1 (one) year of assisting the service

in its field; c. health care according to the doctor's description; d. the age of at least 19 years; and e. have a K3 License and a workbook.

Section 15 operator forklift and/or elevator class trucks can be upgraded to forklift operators and/or lift class trucks with the requirements as follows: a. experienced as an operator in accordance with its class of security-

a lack of 2 (two) years continuously; and b. pass the forklift operator test and/or lift the truck according to its qualification.

The Second Section of the Lift and Angkut Aircraft Officers

Article 18 (1) The aircraft and transport operations may be assisted by the officer

lift and transport aircraft that have a K3 license and book work on the type and qualifiers.

(2) The officer of the lift and transport as referred to in verse (1) includes a spokesman (rigger) and technicians.

Paragraph One of the Binding Scribe (rigger)

Article 19 Of The Carrier (rigger) as referred to in Article 18 of the paragraph (2) must meet the requirements as follows: a. At least educated SLTP/is simple; b. Experienced at least one (one) year in their field; c. healthy health according to the doctor's description; d. the age of at least 19 years; and e. have a K3 License and a workbook.

The Second paragraph of the Engineer Section 20

The engineer as referred to in Article 18 of the paragraph (2) must meet the requirements as follows: a. At least educated SLTA/equal and/or

experienced in the field at least 3 (3) years; b. Healthy bodies according to the doctor's description; c. age at least 21 years; and d. have a K3 License and a workbook.

CHAPTER III OF THE WAY OF OBTAINING A K3 LICENSE AND A WORK BOOK

Article 21 of the Director General or the appointed official publishes the K3 License and the operator ' s workbook or officer of the lift and transport.

Article 22 (1) To obtain the K3 License and the operator or officer workbook

the lift and transport aircraft as referred to in Article 21, the businessman or administrator submit a written request to the Director General by attaching it:

a. copy the last certificate; b. A working experience letter helps operators or officers

lift and load aircraft according to their field issued by the company;

c. The health-based certificate of the doctor; d. copy the resident tag card; e. copy of the competency certificate according to its type and qualifications; and f. Coloured photo 2 x 3 (3 sheets) and 4 x 6 (2 sheets).

(2) The written request as referred to in paragraph (1) is conducted a document check by Tim.

(3) Based on the results of the Team ' s examination as referred to in paragraph (2), the Director General publishes K3 License and the workbook.

Article 23 (1) of the K3 License and the work book apply for a term of 5 (five years), and

may be extended for the same time frame. (2) An extension (1) request referred to in paragraph (1) was submitted

to the Director General by attaching it: a. Old K3 license is original; b. The original workbook that his superiors had examined; c. A healthy body of doctors; d. copy the resident tag card; e. copy of the competency certificate according to its type and qualifications; and f. Coloured photo 2 x 3 (3 sheets) and 4 x 6 (2 sheets).

Section 24 In terms of the competency certificate as referred to in Section 22 of the paragraph (1) letter e and Article 23 of the paragraph (2) of the letter e cannot be implemented then may use the K3 coaching certificate issued by the Director General.

Article 25 of the operator ' s workbook or officer as referred to in Article 21 should be checked every 3 months by its superiors.

Section 26 of the K3 License and the work book only apply as long as the operator or officer of the lift and transport is concerned to work at the company that applied for the application.

Section 27 of K3 License and the workbook It can be revoked if the operator or officer of the aircraft lift and the relevant transport is proven: a. doing its job does not match the type and qualifications of the aircraft

lift and load; b. doing errors, or omission, or recklessness that

poses a dangerous state or work accident; and c. does not carry out its obligations as referred to in Article 34

according to its field. BAB IV

OPERATOR AUTHORITY AND OFFICER Article 28

(1) The Class I lift equipment operator as referred to in Section 6 of the paragraph (2) of the letter: a. operates the lifting equipment according to its type with

capacity of more than 100 tons or height of the tower more than 60 meters; and b. oversee and guide the activities of the Class II and/or

Class III operators, if necessary to be accompanied by the Class II and/or Class III operators.

(2) The Class II lifting equipment operator as referred to in Section 6 of the paragraph (2) of the letter b (b) is authorized: a. operates the lifting equipment according to its type with

the capacity of over 25 tons to less than 100 tons or height of the tower over 40 meters up to 60 meters; and

b. oversee and guide the activities of Class III operators, if need be accompanied by Class III operators.

(3) The Class III lift equipment operator as referred to in Section 6 of the paragraph (2) of the letter c is authorized to operate the lifting equipment according to its type with a capacity of less than 25 tons or height of the tower up to 40 meters.

(4) A gondola-type lifting equipment operator, mechanical dongkforce (lier), taal, and stake machine as referred to in Article 6 of the paragraph (1) are authorized to operate a gondola, a mechanical dongcak (lier), taal, and the stake.

Article 29 Operators of the transport tape as referred to in Article 9 of the authorities operate escalators, walking tires, and walking chains.

Section 30 (1) Transport aircraft operators over the runway and above the surface

as referred to in Article 11 of the authorized operating operator: dump truck, tow truck/trailer, the material transport tool dangerous, tractor, suspension train, shovel, excavator/back hoe, compactor, engine giling, bulldozer, loader, tanden roller, tire roller, grader, vibrator, side boom, forklift and/or lift trucks.

with a capacity of over 15 tons; and b. oversee and guide the activities of Class II operators.

Article 31 The operator of a rail freight device as referred to in Article 16 is authorized to operate the locomotive and its bases and lori.

Article 32 of the spokesperson (rigger) as referred to in Article 18 of the paragraph (2) is authorized to do: a. the binding of the goods or materials according to the binding procedure; and b. administration of aircraft operation lift and transport.

Article 33 Engineer the lift and transport as referred to in Article 18 of the paragraph (2) is authorized to do:

a. installation, repair, or maintenance of the lifting and load aircraft; and b. examination, ingestion, and evaluate the state of the lift aircraft and

load. BAB V

LIABILITY OPERATOR AND OFFICER Article 34

(1) The operator of the aircraft lift and load is obligated to: a. perform edits to aircraft conditions or capabilities

lift and load, safety tools, and other equipment tools prior to the operation of the lift and load aircraft;

b. be responsible for the operating activities of the lift and transport in a safe state;

c. does not leave the aircraft's fuselage and transport operations, as long as the engine is turned on;

d. stop the lift and transport aircraft and immediately report to the superior, if the safety or lifting of the lift and transport equipment does not function properly or damaged;

e. oversee and coordinate class II operators and class III operators for Class I operators, and class II operators oversee and coordinate class III operators;

f. comply with the regulations and perform the security measures that have been specified in the operation of the lift and transport aircraft; and

g. fill out a work book and make a daily report during operating the lift and transport.

(2) The spokesperson (rigger) is obliged to: a. conduct a selection of lift aids in accordance with the load capacity

secure work; b. perform edits to safe binding conditions and tools

help lift which is used; c. perform lifting aids treatment; d. comply with regulations and conduct security measures that have been

specified; and

e. fill the workbook and make the daily report according to the work it has done.

(3) The technicians are obliged to: a. report to a direct supervisor, lift and load aircraft condition

which is its responsibility if unsafe or unenviable;

b. be responsible for the installation, maintenance, repair, and/or inspection of the lifting and load aircraft components;

c. comply with the rules and perform the specified security measures;

d. assist employment supervising employees of aircraft specialists and transport in the implementation of the lifting and testing of the lift and transport; and

e. fill the workbook and create a daily report in accordance with the work done.

CHAPTER VI COACHING SAFETY AND WORK HEALTH

section 35 (1) Implementation of the K3 coaching for the operator and officer of the lift and

transport is performed by: a. The instance of the scope of duty and responsibility in the field

the employment of the provincial government and the county/kota; government of the government; and

b. Security and safety services companies, appointed by the Director-General, are coordinating with the agencies whose scope of duty and responsibilities in the field of employment in the provincial government and/or government -District/City.

(2) In which case the company will conduct self-coaching (in house training) then must apply to the instance of the scope of the task and its responsibilities in the field of employment in the provincial government and/or the government -District/City.

(3) The K3 coaching material for the operator and officer of the lift and transport is set by the Director General.

BAB VII SUPERVISION

Article 36 Oversight on its adherents to the Ordinance of this Minister's Regulation.

BAB VIII SANCTION Article 37

Employers or hiring administrators operator and/or officer of the lift and load that does not have a K3 License and a workbook, and does not meet the qualifications and amount as referred to in Section 3 and Section 4 is sanctioned in accordance with Act Number 1 of 1970.

CHAPTER IX TRANSITIONAL RULES

Article 38 (1) For the carrier or lift aircraft officer and transport officer who has had

the K3 license and the work book before the enactment of this Minister's Regulation remain in effect until the end of the term of the License K3 and workbook.

(2) Upon expiration of the expiring term as referred to in paragraph (1), may be extended in accordance with the procedure as referred to in Article 23.

CHAPTER X PROVISIONS OF THE COVER

Section 39 With the Ordinance of this Minister then Regulation of the Minister of Labor Number PER.01/MEN/1989 about Kwqualifying and the Lifting Operator 's Terms are revoked and declared not in effect.

Article 40 of the Minister' s Regulation is beginning to apply at a set date.
