Back NEWS REPUBLIC of INDONESIA No. 489, 2011 REGULATIONS STATE MINISTER of PUBLIC HOUSING number 14 in 2011 ABOUT the IMPLEMENTATION of the GUIDELINES on AID for the COMMUNITY of SELF-HELP HOUSING STIMULANT on LOW INCOMES with the GRACE of GOD ALMIGHTY STATE MINISTER of PUBLIC HOUSING Considering: a. that the distribution of relief funds to implement its housing self-help stimulant more accountable and speed up submission of requests for help to self-help Housing Minister stimulant , the need to enable UPK/BKM;
b. that in order for the utilization of the grant housing self-help more stimulant is right on target and right of use, there needs to be criteria and requirements of recipient objects, help, and kabupaten/kota in a clear and unequivocal;
c. that the regulation of the Minister of State for Housing number: 08/CANDY/M/2006 regarding the implementation of the guidelines for the granting of a stimulant For Self-help Housing For low income Communities Through microfinance institutions/Non Bank financial institution does not comply anymore to meet the requirement referred to in letter a and letter b, so it needs to be replaced;
d. that based on considerations as referred to in letter a, letter b, letter c and a, as well as to implement the provisions of article 54 paragraph (5) of Law No. 1 year 2011 about Housing and Neighborhoods, need to set rules of State Minister of public housing on Guidelines Implementation Assistance For Self-help Housing Society Stimulant on low incomes;

d. has a master or land;

h. precedence that has had plans to build or improve the quality of the homes are evidenced by: 1. have savings of building materials;

2. has started to build a House before getting the help of stimulants;
3. has another asset that can be used as an additional aid funds or improving the quality of construction of the stimulant homes;
4. have a saving money that can be used as an additional aid funds or improving the quality of construction of the stimulant homes; and/or 5. has been empowered by a system of self-help housing empowerment;
i. serious program help self-help housing and empowerment of stimulants; and j. precedence already empowered through the national community empowerment Program (PNPM).

Paragraph 2 of the criteria Object Help article 4 (1) the object of the aid in the form of stimulant: a. PB;

b. the lowest building floor area 36 (thirty-six) square meters and the highest 45 (forty five) square metres; and c. is the home of the first or the only house owned by condition: 1. heavily damaged;

c. materials floors, walls, roof or do not meet the standards of the habitable floor area with least 36 (thirty-six) square meters and the highest 45 (forty five) square metres; d. floor area less than 36 (thirty-six) square metres; or e. has no bedroom; the bathroom, wash, and outhouse (PUBLIC).

Paragraph 3 Kabupaten/Kota Criteria of article 5 (1) district/city grant allocation recipient stimulant self-help housing must meet the criteria of General and/or specific criteria.
(2) the General Criteria referred to in subsection (1) is given by a score of a particular assessment.

Article 6 (1) General Criteria referred to in article 5 paragraph (1) includes the following: a. regions lagging behind;

b. poverty levels;
c. number of deficiencies (backlog) home; d. the amount of the House is not livable;

e. human development index (HDI); and f. gross regional domestic product (GDP);
(2) the Data area, the border area of the country, the level of poverty, HDI, and GDP as stipulated in paragraph (1) letter a, letter b, letter c, letter d, e and letters retrieved from Bappenas or Central Bureau of statistics.
(3) the General Criteria referred to in paragraph (1) rated with the highest total score 100 (one hundred) consisting of: a. regions with lagging category was given a score of 20 (twenty);

b. poverty levels below the national average were given a score of 20 (twenty);
c. the amount of backlog of homes above average number of backlog kabupaten/kota were given a score of 20 (twenty);
d. the amount of the House is not livable above average number of House is not livable kabupaten/kota were given a score of 20 (twenty); e. under the national HDI HDI was given a score of 10 (ten); and f. GDP below average GDP kabupaten/kota were given a score of 10 (ten);

Article 7 (1) the specific criteria referred to in article 5 paragraph (1) and paragraph (5) is: a. has a special program;

b. included in the program of acceleration of national development;

c. handling the program after the devastating natural disaster emergency response; and/or d. implementation of understanding (MoU) between the Minister of the Governor, the leadership of the ministries/government agencies, and/or the direction of governmental institutions;
The second part of the requirement of Paragraph 1 Recipient Requirements article 8 (1) the requirements of the recipient non-governmental housing stimulant is: a. a letter of petition from MBR b. affidavit stating: 1. have never received the help of stimulants or PK PB from the Ministry of Housing;
2. are the property of the land itself and not the land heritage yet divided; c. an affidavit stating: 1. do not have homes to PB or the only house owned for PK;
2. will inhabit a House that gets the help of stimulants PB or inhabit a House that will have the help of stimulants PK; and 3. striving to follow the program of assistance and empowerment of self-help housing stimulant;
d. photocopies of certificate of land rights, photocopying letters evidence ruled the land, or master certificate from the village chief/head;
e. photocopying family card and photocopy card sign affidavits or domicile resident on site self help housing developments; and f. the income certificate from working place for the fixed income or from village chief/head for people on low incomes is not fixed.
(2) the form of the statement referred to in subsection (1) letter a is attached as Annex I; a waiver as referred to in paragraph (1) letter b and c letters attached as annex II and annex III; certificate of earnings referred to in subsection (1) letter f attached as Annex IV to this regulation of the Minister.
Paragraph 2 of article 9 Assistance Object Requirements (1) the requirements of an object the aid of stimulants include requirements to: a. PB;

b. PK; and c. the construction of PSU.
(2) the requirements of PB as referred to in paragraph (1) letter a is DED home livable development, showing the original state and the desired end state.
(3) the requirements referred to in paragraph 5 (1) letter b DED is improving the quality of the House livable, showing the original state and the desired end state.
(4) the requirements for the construction of the PSU as referred to in paragraph (2) Letter c is: a. RTK results agreement SHGS recipient stimulant; and b. (5) the Technical Instructions for preparing the DED as referred to in paragraph (2), subsection (3), and subsection (4) is defined by the deputies.
Paragraph 3 Kabupaten/Kota Requirement of article 10 (1) the requirements of the district/city: a. letter of proposal from the Regent/Mayor and/or UPK/BKM equipped with a list of detailed data recipient stimulant (by name, by address);
b. precedence to the district/city has a list of the data backlog of home and home is not livable per villages;
c. precedence to the district/city which has a checklist of implementation of the budget (DIPA) region in support of implementation of the self-help housing that stimulants help poured in affidavits bupati/walikota; d. DIPA area as stated on the letter c can be a budget for: 1. verification of the proposed aid self-help housing from UPK stimulant/BKM;

2. preparation of the DED PB, PK, and/or construction of the PSU;

3. supervision and monitoring of the implementation of activities; and/or 4. operational pokja kabupaten/kota.

e. detailed data referred to a letter containing information on: 1. full name;

2. gender;

3. IDENTITY CARD number;

4. age;

5. work;

6. address;

7. earnings;

8. the number of dependents; and 9. the State House or land depicted visually (photo).
(2) the form of the letter of the proposed Regent/Mayor and/or UPK/BKM as referred to in paragraph (1) letter a is attached as Annex V or Annex VI; list of detailed data recipient stimulant as mentioned in subsection (1) letter a is attached as Annex VII Annex VII A and B; data list backlogrumah and the House is not livable as referred to in paragraph (1) letter b is attached as Annex VIII to this regulation of the Minister.
CHAPTER III IMPLEMENTATION of AID is considered Part of the use of STIMULANTS Help section 11 (1) self-help housing stimulants Aid can be used for: a. PB;

b. PK; and/or c. construction of the PSU.
(2) the help of stimulants to PB as referred to in paragraph (1) letter a given to build new homes that meet the criteria referred to in article 4 paragraph (2).
(3) the help of stimulants to PK as referred to in paragraph (1) letter b provided for repair, replacement, or expansion of a home that meets the criteria referred to in article 4 paragraph (3).
(4) the help of stimulants for the construction of the PSU as mentioned on paragraph (2) Letter c is given to build the PSU that meets the criteria referred to in article 4 paragraph (5) as well as in accordance with the amount and location of the PB and/or the PK that got the help of stimulants as referred to in paragraph (1) letter a and/or the letter b.
The second group of recipients of Assistance article 12 (1) the MBR recipient stimulant must form groups in the form of SHGS at any villages.
(2) in terms of number of MBR recipient stimulant in 1 (one) villages is insufficient to form a 1 (one) group, SHGS can consists of MBR recipient stimulants from other villages that border.
(3) in case there is no MBR recipient stimulants from other villages that border referred to in subsection (2), SHGS can consists of MBR recipient stimulants from other villages that are closest.
The third part of the great Fund Assistance Article 13

(2) funds to enhance the quality of home based organizations as referred to in subsection (1) does not include to pay the wages of workers and levy license.
(3) funds to enhance the quality of home based organizations as referred to in paragraph (1) established the Minister according to the degree of damage was light and medium.
Article 15 (1) in respect of the implementation of the national policy on the provision of the House very cheap, large grants to stimulant PB is the difference in funds to build a home based organizations as stipulated in article 13 paragraph (1) with house prices so cheap that is assigned by the Government to the PB.

CHAPTER IV IMPLEMENTING ACTIVITIES of article 20 (1) Deputies carry out the function of: a. policy formulation and preparation of technical implementation instructions help self-help housing stimulant to the MBR;

Article 23 (1) Pokja Centre as referred to in article 21 letter a consists of: a. an element of Self-help Housing Deputy Ministry for public housing;

b. elements of the Secretariat of the Ministry of Housing; and c. the element Housing Development Center of the Ministry of Housing.
(2) the composition of the membership of the Centre as mentioned on Pokja subsection (1) consists of: a. the Assistant Deputy of facilitation and empowerment of Community Self-help speaker;

b. Assistant Deputy Self-help Housing Planning as Vice Chairman;
c. the head of the field of facilitation of Self-help Housing Agencies Assistant Deputy facilitation and empowerment of Community based organizations as Secretary;
d. the head of Programme and Budget Assistant Deputy Self-help Housing Planning as Deputy Secretary; e. evaluation of Self-help Housing Deputy Assistant as a Member;

f. Planning and budget Bureau Chief as members; and g. head of Residential Development Centre as a member.
(3) membership Appointment pokja referred to in subsection (2) are set with the decision letter of the Minister.
Paragraph 2 of article 24 Province Pokja Pokja provinces as stipulated in article 21 letter b carry out duties: a. coordinate pokja kabupaten/kota in the discharge of his duty;

b. technical guidance to implement pokja district/city;

c. controlling performance pokja district/city;

d. evaluate the implementation of the assistance activities of stimulants; and e. report to the Governor with the task of implementing effluent to Pokja Center.
Article 25 (1) Pokja provinces as stipulated in article 21 letter b composed of: a. elements of SEGWAY handles residential areas;

b. elements of the regional development planning Board;

c. elements of the Regional Office of national land Agency; and d. the SEGWAY handles the elements of the field of community empowerment.
(2) the order referred to provincial pokja membership at subsection (1) consists of: a. a SEGWAY Head handle housing as Chairman;

b. Chief of Bappeda as Vice Chairman;

Article 27

(1) Pokja kabupaten/kota referred to in Article 21 Letter c consists of: a. elements of SEGWAY handles residential areas;

b. elements of the regional development planning Board;

c. elements of the Land Office;

d. elements of a SEGWAY handles the field of community empowerment; and e. the SEGWAY handles elements of the social field.
(2) the membership makeup of pokja kabupaten/kota referred to in subsection (1) consists of: a. a SEGWAY Head handle housing as Chairman;

b. the head of the regional development planning board as Deputy Chairman;
c. the head of the housing on a SEGWAY that handle housing as Secretary; d. the head of the Office of land as members;
e. head of SEGWAY handles the field of community empowerment as a Member; and f. the SEGWAY's head handle social fields as members.
(3) membership Appointment pokja referred to in subsection (2) are set with the decision letter of the bupati/walikota.
The second part of article 28 TPM TPM as mentioned in Article 8 paragraph (2) carry out tasks: a. help pokja kabupaten/kota verifying field prospective recipient stimulant;
b. facilitate the SHGS make DED upon the wishes or needs of the recipient stimulant and in accordance with the funds available;
c. facilitating implementation activities help self-help housing stimulant made by SHGS in accordance with DED; d. nurture and empower SHGS; and e. to report the progress of the activities (progress report) and make a final report to the Unit Work with copy to the central provincial pokja Pokja, pokja and kabupaten/kota.
Article 29 (1) TPM as mentioned in Article 8 paragraph (2) was made with the decision letter of the Minister.
(2) the TPM as mentioned in subsection (1) may be either individuals or legal entities.
(3) legal entities referred to in paragraph (2) is a business entity in the field of consulting that employs the individual TPM.

The third part UPK/BKM article 30 (1)/BKM UPK as stipulated in article 8 paragraph (2) carry out tasks: a. menyosialisasikan self-help housing stimulants help activity to the prospective candidates recipient stimulant;

j. reporting the receipt and channelling the grant to Work with units of stimulant effluent to Pokja Center; and k. report of the implementation of the activities to the Unit Work with copy Pokja Center.

Article 31 (1) in carrying out its duties as stipulated in article 30, paragraph (1) was given the BKM/UPK operational funds sourced from the STATE BUDGET.

c. reporting the utilization of grant development and self-help home stimulant to UPK/BKM; and d. make and approve the list of present TPM.

(3) in case of DED arrangement facilitated by pokja kabupaten/kota, DED using drafting Fund DIPA district/city.
Article 34 (1) SHGS as stipulated in article 8 paragraph (2) consists of MBR recipient stimulant self-help housing;
(2) the number of members of SHGS least 5 (five) and most high 11 (eleven) persons.
(3) the number of members of SHGS Attempted is odd and differentiated according to the type of help a stimulant to PB or PK.

(7) in the case of members of SHGS comprising more than one villages referred to in article 12 paragraph (2) and paragraph (3), the membership makeup of SHGS as intended in paragraph (5) set with the decision letter of the Chairman of the UPK/BKM villages a number of recipient communities more.
(8) the form of a decision letter as referred to in paragraph (6) is attached as Annex IX to this regulation of the Minister.

c. the head of the unit of Work requesting payment to KPPN to transfer the grant of the first stage of the stimulant by 50% (fifty percent) to UPK/BKM;
d. UPK/BKM must disburse grant stimulant as mentioned in letter c to recipient stimulant and Treasurer SHGS in the longest period of four working days since the grant account to sign in to UPK stimulant/BKM.
(2) the request for payment of the grant a stimulant the second stage referred to in article 19 paragraph (1) letter b is: a. UPK/BKM proposed a request for payment to the head of the unit of Work by attaching a news event: 1. the progress of the work of at least 30% (thirty per cent), photo development and/or PSU.
2. original receipt receipt of the grant of the first stage of the stimulant by MBR for PB and/or the PK and by Treasurer SHGS for the construction of a PSU.
3. the MBR when it received payment of the grant of the first stage of the stimulant for PB and/or PK or photo Treasurer SHGS when receiving payment of the grant for the construction of the first phase of stimulant PSU.
b. units of Work verifying administration over a proposal request for payment as stated on the letter a is adjusted with the allocation of funds available;
c. the head of the unit of Work requesting payment to KPPN to transfer the grant stimulant second stage of 50% (fifty percent) to UPK/BKM;
d. UPK/BKM must disburse grant stimulant as mentioned in letter c to recipient stimulant and Treasurer SHGS in the longest period of four working days since the grant account to sign in to UPK stimulant/BKM.
CHAPTER VI CONTROL, evaluation and REPORTING of article 38 (1) make reports BKM/UPK channeling relief funds disbursement reports include stimulants help a stimulant in the first phase, the second phase, and a final report.
(2) the report referred to in subsection (1) must be known by Chairman pokja kabupaten/kota.

(3) the report of the first stage referred to in subsection (1) is sent to UPK/BKM within 45 (forty-five) calendar days since the first stage of the stimulant grant received by the entire recipient stimulant and Treasurer SHGS.
(4) the report of the second stage referred to in subsection (1) is sent to UPK/BKM at least sixty (60) calendar days since the second stage of the stimulant grant received by the entire recipient stimulant and Treasurer SHGS.
(5) the SHGS are prohibited from using grant funds for the purposes of operational stimulant.
(6) the form and content of the report of the first stage and the second stage referred to in subsection (1) is designated by the head of the unit of work.
CHAPTER VII miscellaneous PROVISIONS article 40 (1) provincial governments and district/city governments that provide help for stimulant MBR by using GRANT funds, their implementation based on the regulations of the Minister, except set in another province or applicable local regulations regional district/city.
(2) the help of stimulants as referred to in paragraph (1) was given only to the MBR that have never got the help of stimulants from the Government, provincial government, or district/city governments.
CHAPTER VIII TRANSITIONAL PROVISIONS of article 41 of the regulation State Minister of public housing number: 08/CANDY/2006 regarding the implementation of the guidelines for the granting of a stimulant for Self-help Housing For low income Communities Through microfinance institutions/Non Bank financial institutions remain in use for the implementation of self-help housing stimulants help a 2011 County/city location has been established by a decision of the Minister of State for Housing number 18 in 2011 on March 18, 2011 about the determination of the Kabupaten/Kota Recipient Stimulant Self-help Housing in 2011.

CHAPTER IX PROVISIONS COVER Article 42 at the time of this Ministerial Regulation Regulations took effect, State Minister of public housing number 08/CANDY/M/2006 regarding the implementation of the guidelines for the granting of a stimulant For Self-help Housing For low income Communities Through microfinance institutions/Non Bank financial institutions was revoked and declared inapplicable.
