PLANTING OF CAPITAL

WITH THE GRACE OF GOD ALMIGHTY

GOVERNOR OF WEST JAVA,

DRAW: A. that in order to realize the fair and prosperous society

based on Pancasila and the Constitution of the Constitution of 1945, it needs to be implemented sustainable economic development by the berlandaskan economic democracy;

b. that capital planting is one of the driving factors of the region's economy, financing the construction of the Regions and the creation of jobs, so it needs to be realized the ease of service and the climate of capital planting which is conducive and promotively based on Keracyatan economics, which encourages Mikro, Small, Medium and Koperative Effort to increase the realization of capital planting;

c. that based on considerations on the letters a and b, as well as to provide assurance of legal certainty, service and capital planting protection, need to establish the Regional Regulation of the Province of West Java about Planting Capital;

SET: THE REGIONAL REGULATIONS ON CAPITAL PLANTING.

BAB I

provisions Of UMUM

Part Kesatu

Definition

Article 1

In this Region Regulation, it is referred to:

1. The area is the province of West Java.

2. The Regional Government is the Governor and Regional Device as the organizer of the Regional Government of West Java Province.

3. The Governor is the Governor of West Java.

4. District/Town is District/City in West Java.

5. Bupati/Mayor is the Regent/Mayor in West Java;

6. The Coordinating Agency for Promotion and Cultivation Of The Area next to Governing Body is the Promotion Coordination Board and Cultivation Of Capital Of The Province Of West Java.

7. The Integrated Perizinan Service Agency is the Integrated Services Agency of West Java Province.

8. Capital Cultivation is all forms of capital planting, both by domestic investors and foreign investors to conduct business in the area.

9. Domestic Capital Plant is a growing capital activity in the state of the Republic of Indonesia undertaken by domestic planters by using domestic capital.

10. Foreign Capital Plant is a growing capital activity in the territory of the Republic of Indonesia which is carried out by foreign investors, either using fully foreign capital and a joint venture of investors in the United States. country.

11. Investors are individuals or businesses that make up a capital investment, domestic planters or foreign investors.

12. Domestic Investors are individuals of Indonesian citizens, Indonesian business agency, State of the Republic of Indonesia, or Region, which conducts capital cultivation in the country territory of the Republic of Indonesia.

13. Foreign investors are individuals of foreign nationals, foreign entities, and/or foreign governments conducting capital cultivation in the State of the Republic of Indonesia.

14. Capital is an asset in the form of money or other forms that are not money, which are owned by investors and have an economic value.

15. The Home Capital is a capital owned by the State of the Republic of Indonesia, an individual of the Indonesian Citizen, or a legal or legal entity in the form of a legal entity.

16. Foreign Capital is a capital owned by a foreign country, a person of foreign nationals, foreign entities, foreign legal entities, and/or Indonesian legal entities in part or all of its capital is owned by a foreign party.

17. Promotion is a communication activity to potential investors.

21. Micro-Business is a productive effort that belongs to an individual person and/or individual business entity that meets the criteria of the Mikro Business as per the provisions of the laws.

22. A small business is a self-established, productive economic entity committed by a person or a business entity that is neither a subsidiary nor a branch of a company owned, controlled, or part of either directly or indirectly (for example, an entity that is not a subsidiary of a corporation). not directly from the Medium or Great Effort, which meets the Small Business criteria in accordance with the rules of the invite-invitation rules.

23. A medium is a productive economic entity that is self-founded, committed by a person or an entity that is neither a subsidiary nor a branch of a company owned, controlled, or part of either directly or indirectly. not directly from Small Business or Greater Business with the amount of net wealth or annual sales results in accordance with the provisions of the laws.

24. A Great effort is a productive economic effort undertaken by an entity with a net worth of wealth or annual sales results greater than the Intermediate Effort, which includes national or private-owned businesses, joint ventures and foreign ventures. who conducts economic activities in Indonesia.

25. The World of Business is Mikro's Effort, Small Business, Medium Effort and Great Effort which conducts economic activities in Indonesia and is domiciled in Indonesia.

26. The incentive is the support of the Local Government to the investors in order to encourage the increase in capital cultivation in the Regions.

27. Ease is the provision of facilities from the Regional Government to investors to make it easier for any capital raising activities in order to encourage increased capital cultivation in the Regions.

The capital planting is aimed at:

a. increased Regional economic growth;

b. creating jobs;

c. enhancing sustainable economic development and environmental insight;

d. enhancing the region's business dayasaing capabilities;

e. improving capacity and technology capabilities;

f. encouraging economic development of keracyatan;

g. Cultiving a potential economy becomes a real economic power by using funds that are derived both from domestic and abroad; and

h. improving community welfare.

Article 3

Planting of capital in the Region is organized under asas:

a. legal certainty;

b. openness;

c. accountability;

Target capital planting in the Region, i.e.:

e. increasing the realization of capital planting;

f. optimize the potential of natural resources and other resources; and

g. the increasing potential of capital planting opportunities for the Mikro, Small, Medium, Medium and Koperative Effort.

BAB II

AUTHORITY

Article 6

Area Government Authority in the holding of capital planting, includes:

a. the drafting and determination of the development policy of Regional Capital cultivation in the form of the Regional Capital Cultivation Plan and the Regional Strategic Plan in accordance with the Provincial Regional development program, coordinating with the Government;

b. the formulation and determination of the guidelines, coaching and supervision of provincial-scale capital cultivation development, coordinating with the Government;

c. coordination in the framework of services and the facilitation of capital planters;

d. coordination, formulation, designation and implementation of Regional policies in the field of capital cultivation, covering:

1. The preparation of a business-field plan that needs to be considered closed;

2. The preparation of a business-field plan that needs to be considered open with requirements;

3. The preparation of the business-field proposal that needs to be considered is a high priority on the provincial scale;

4. Drafting of the Regional investment map and the potential of Regional resources, composed of natural resources, institutional and human resources, including micro, small, medium, cooperative, cooperative, and large employers, based on input from the Regency/Kota; and

5. Proposals and facilitation of capital planting facilities outside of the national fiscal and non fiscal facilities are the provincial authority.

j. The study, formulation and drafting of the layout guidelines and the implementation of a one-door integrated services plant/city management activities, based on the layout guidelines and the implementation of a one-door integrated service. capital planting specified by the Government;

DIRECTION OF POLICY

Article 7

c. develop and provide protection and/or capital planting opportunities to Mikro, Small, Medium, Medium and Koperative Enterprises.

BAB IV

PLANNING AND DEVELOPMENT

Planning

Section 8

(1) The Local Government is compiling the General Plan of Regional Capital Cultivation And The Regional Strategic Plan in development investment.

(2) The Capital Cultivation Plan and the Strategic Plan of Capital Cultivation as referred to in paragraph (1), arranged in accordance with the National Capital Cultivation Plan, the Regional Long Term Development Plan and the Plan Regional Mid-Term Development, Regional Development Program.

(3) Annual Work Plan the field of capital cultivation in the Region refers to the General Plan of the Regional Capital Planting Area as referred to in paragraph (2).

(4) Planning as referred to in paragraph (1), (2) and (3) is exercised through a participatory capital planting planning mechanism.

Capital Development Development

Article 9

(1) The Regional Government compiled a map of Regional Capital cultivation and resource potential as well as a means of supporting infrastructure for the development of capital cultivation in the Regions, including:

a. natural resources;

b. Supporting tools and infrastructure;

c. Institutional;

d. Human resources;

e. Micro, Small, Medium, and Koperative enterprises; and

f. other efforts.

(2) The drafting of the capital planting map and resource potential as well as the means of supporting infrastructure as referred to in paragraph (1) are executed by the Agency in accordance with the Minimal Service Standards in the field of capital planting.

(3) The cultivation map of capital and resource potential and the means of supporting infrastructure as referred to in paragraph (1) and (2) are defined by the Governor's Decision, as per the provisions of the laws.

BAB V

PROMOTION OF CAPITAL CULTIVATION

Article 10

(1) The Regional Government organizes the promotion of capital planting through the marketing and communications systems to potential investors in the country and abroad.

(2) The promotion of capital cultivation as referred to in paragraph (1), done through:

a. guidance and consulting;

b. Analysis of capital investment (market intelligence);

c. exhibition;

d. (bussines meeting);

e. investment seminar;

f. Facilitation of investment missions; and

g. dissemination of capital planting information through print and electronic media.

(3) In the holding of capital planting promotion as referred to in paragraph (1) and (2), the Local Government provides the means and infrastructure.

(4) The promotion of capital cultivation as referred to in paragraph (1), (2) and (3) is coordinated by the Agency.

Article 11

(1) Promotion of capital planting as referred to in Article 10, is held with regard to development of Regional potential opportunities and regional economic development, national and international.

(2) The promotion of capital planting as referred to in paragraph (1), exercised independently and/or together with the Government, other Provincial Governments, the District/City Government and non-Government agencies.

BAB VI

MINISTRY AND PERMISSIONS

Article 12

The Local Government organizes the capital planting service, including:

a. Field of business;

b. modal growers;

c. form body form;

e. Employment;

Paragraph 2

Field of Effort

Article 13

(1) All business areas or types of business open for Regional Capital cultivation, except for the field of business or the type of business being declared closed and open with the requirements, under the terms of the laws.

(2) The Local Government proposes a closed field of business and an open field of business with requirements as referred to in paragraph (1) to the Government, in accordance with the criteria and requirements of the field of business as well as the priority and the Regional interests.

(3) Criteria and requirements as referred to in paragraph (1), must meet the following provisions:

a. provide the natural and environmental protection of the environment;

b. developing Mikro, Small and Medium Enterprises, as well as Koperations;

c. oversees production and distribution;

d. improving the technology capacity; and

e. prioritizing domestic capital participation and cooperation with the enterprise entity.

Capital Planner

Capital planting in the Regions is done by an individual or an enterprise entity, including:

a. Domestic growers; and

b. foreign investors.

Paragraph 4

The Form of Effort

Article 15

(1) The domestic capital planter as referred to in Article 14 of the letter is done by the legal entity, not the legal entity or the Individual business.

(2) The cultivation of foreign capital as referred to in Article 14 of the letter b, is required to form Limited Perseroan under Indonesian law and is based in the Republic of Indonesia.

Paragraph 5

Registration and Licensing

Article 16

The capital growers are required to register capital planting, under the provisions of the laws.

Article 17

(1) The capital planter as referred to in Article 14 of which the capital planting in the Territory is required to have:

a. the principle of capital planting principle;

b. location permission;

c. Permission To Establish Building (IMB);

d. disruption permit (Hinderordonnantie/HO); and

e. attempt.

(2) The Local Government publishes a provincial-scale licensing according to the authority under the provisions of the invitational regulations.

(3) the District/City Government publishes the municipal/City-scale licensing of the City. authority under the provisions of the laws.

Paragould 6

Employment

Article 18

(1) Capital planters are required to meet the workforce needs by focusing on workforce in the Regions.

(2) Capital planters must improve the workforce competence as it is referred to in paragraph (1) through the training of work, under the provisions of the laws.

(3) In terms of investor investors employing foreign labor, concerned are required to host training and perform technology to the Regional workforce, as per the provisions of the laws.

(4) Foreign Labour as referred to in paragraph (3) is required to be accompanied by a designated Regional workforce, as per the provisions of the laws.

Paragraph 7

Capital Planting Location

Article 19

(1) The Regional Government establishes the location of capital planting as per the West Java Provincial Regional Plan.

(2) The District/City Government is setting out the location of capital planting as per the District/City District Space Plan Plan, with reference to the Provincial Regional Governance Plan.

Second Section

Capital Cultivation Ministry

Article 20

(1) The Local Government organizes a One-Door Integrated Services area of capital planting fields, including:

a. perizinan and non-licensing in the field of capital cultivation;

b. Incentive and ease services;

c. Public complaint.

(2) Integrated Services One Door of Capital cultivation as referred to in paragraph (1), exercised by the Agency.

(3) In the implementation of a unified one door as referred to in paragraph (2) may be formed by the Technical Managing Unit of the Agency under the provisions of the laws.

BAB VII

CAPITAL PLANTING COOPERATION

Article 21

(1) The Local Government is conducting capital planting cooperation with other Provincial Governments and/or the Kabupaten/ City Government, overseas or third parties on the basis of the principle of cooperation, under the provisions of laws.

(2) Capital planting cooperation as referred to in paragraph (1), includes:

a. capital planting planning;

b. promotion of capital planting;

c. capital planting service;

d. development of capital planting;

e. capital cultivation control; and

f. other capital planting activities.

Article 22

(1) The Local Government and Government/City Government facilitate the world cooperation in the areas of local, regional and international capital cultivation.

(2) Cooperation as referred to in paragraph (1) is exercised by the Agency, including planning, promotion, service, development and other capital planting activities.

(3) Cooperation as referred to in paragraph (1) and (2) is implemented with consideration of the feasibility of planting the capital, based on:

a. Regional investment development policy review;

b. local economic development;

c. modal planting map; and

d. Regional potential.

(4) Capital planting cooperation may involve the Regional Property Agency and other enterprise entities.

RIGHT, LIABILITIES AND LIABILITIES

Article 33

SANCTION

Article 39

d. Withdrawal of business activities and/or capital planting facilities.
