THE PRESIDENT OF THE REPUBLIC OF INDONESIA
NUMBER 79, 2011
ABOUT
TOURIST SHIP VISIT (YACHT)FOREIGN TO INDONESIA

WITH THE GRACE OF THE ALMIGHTY GOD

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh: a. that Indonesia is the largest island country in the world that has a biodiversity and cultural wealth as a basic capital to develop the maritime tourist industry;
B. that in order to develop the maritime tourist industry and improve the economy of coastal communities, small islands, and inland waters, it is necessary to provide ease for the foreign travel ship (yachts) foreign visitors to Indonesia;
c. that under consideration as referred to in letter a and letter b, need to establish the Presidential Regulation on the Visiting Ship of Wisata (Yacht) Foreign to Indonesia;

Remembering: 1. Section 4 of the paragraph (1) of the Basic Law of the Republic of Indonesia Year of 1945;

DECIDED:

SET: THE PRESIDENT ' S REGULATION ON THE VISIT OF THE TOURIST SHIP (YACHT) FOREIGNERS TO INDONESIA.

Section 1
In this Presidential Regulation referred to:
1. Tourism is a wide variety of tourist activities and supported various facilities as well as services provided by communities, businessmen, governments, and local governments.
2. A vessel is a water vehicle with a specific shape and type, which is powered by wind power, mechanical power, other energy, withdrawn or postponed, including dynamic powered vehicle, vehicle under the surface of the water, as well as a floating device And a floating building that doesn't move around.
3. Foreign ships (yachts) are foreign-flagged waterway transports and are used by tourists to travel or perform races in good waters with wind power and/or mechanical power. and used only for non-nial activities.
4. Port is a place composed of land and/or waters with certain boundaries as a place of government activities and activities used as a place of lean ships, ride down passengers, and/or unpack. Load items, which are terminals and ship berths equipped with cruise security facilities and port support facilities and as a place of intra displacement and transport intermodes.
5. The port of entry or port to the outside is a port or a marina which is designated as an entrance and outside the tourist ship (yacht) foreign.
6. Organizers of tourist ship travel (yachts) foreign is the business agency, association, sports organization and the like that organizes nautical tourism activities.
7. The general agent is a national maritime transport company or a national corporation specifically established to carry out the efforts of the ship's agency, which is designated by the foreign transport company to take care of its ship's interests during its time in Indonesia.
8. Government is the President of the Republic of Indonesia which holds the power of the government of the Republic of Indonesia as referred to in the Basic Law of the Republic of Indonesia in 1945.
9. The Local Government is the Governor, the Regent, or the Mayor, and the area ' s device as an element of the organizing government of the area.
10. The associated Instancy is all government agencies that have a connection with the increased visit of the tourist ship (yacht) foreign.
11. Minister is the Minister who organizes government affairs in the field of affairs.

Section 2
(1) (yacht) foreign and board crew and/or passengers including luggage and/or vehicles that will enter Indonesia's territorial waters in order of tourist visits granted ease in the field Clearance and Approval for Indonesian Territory(CAIT), divinity, customs, immigration, and quarantine.
(2) The granting of convenience of the tourist ship (yacht) foreign as well as the crew and/or passengers including luggage and/or vehicles as referred to in verse (1) are only given at the port of entry and port to the outside as It is defined in this Presidential Regulation.
(3) Requests to obtain Clearance and Approval for Indonesian Territory(CAIT) and permissions associated with the divinity, paeiness, immigration, and quarantine as referred to in paragraph (1) can be done electronically.

Section 3
Cruise ship (yacht) foreign and ship crew that will make a tourist visit to Indonesia given ease in the application process and granting Clearance and Approval for Indonesian Territory(CAIT).

Section 4
(1) Tourist ships (yachts) foreigners who will make a tourist visit to Indonesia be granted ease in the field of the khanate if entered and outside through the port as follows:
a. Sabang Port, Sabang, Nanggroe Aceh Darussalam;
B. Belawan Port, Medan, North Sumatra;
C. Bayur Gulf port, Padang, West Sumatra;
D. Nongsa Point Marina, Batam, Riau Islands;
e. Bintan Telani Airport, Bintan, Riau Islands;
f. Cape Pandan Port, Belitung, Bangka Belitung.
G. Sunda Kelapa and Marina Ancol Port, Jakarta Capital Special Region;
h. Benoa Port, Badung, Bali:
i. Tenau Port, Kupang, East Nusa Tenggara
J. Kumai Port, West Kotawaringin, Central Kalimantan
No, Tarakan Port, Tarakan, East Kalimantan;
I. Nunukan Port, Bulungan, East Kalimantan;
M. Port of Bitung, Bitung, North Sulawesi;
N. Port of Ambon, Ambon, Maluku;
O. Saumlaki Port, West Southeast Maluku, Maluku;
p. Port Tual, Southeast Maluku, Maluku;
Q. Sorong Port, Sorong, West Papua; and
R. Port, breed, Papua.
(2) The port of entry and port to the outside as referred to in paragraph (1), can be changed with regard to:
a. the development of foreign tour boat visits (yachts);
B. preparedness of the means and supporting infrastructure to provide the service; and
c. Area development.
(3) The change in port of entry and port to the outside as referred to in verse (2) is set with the Regulation of the Minister of Transportation after coordinating with the related agencies.

Section 5
(1) (yachts) foreign ships, including luggage and/or vehicles included for the tourist activities are required to comply with the customs provisions of temporary imports.
(2) To obtain temporary import permission as referred to in paragraph (1) the owner of the tourist ship (yacht) foreign or through a general agent and/or the organizer of the tourist ship (yacht) foreign is applying for the Director General Bea and Excise.
(3) The visit of the tourist ship (yacht) foreign can be done by the Government and/or the organizers of the tourist ship visit (yacht) foreign.
(4) The Government and/or the organizer of the tourist ship (yacht) foreign as referred to (3) is responsible for the conduct of the activities as well as the guarantor of the duties of pausing to the income of goods and/or vehicles The crew was taken by the crew.

Section 6
(1) Instalters of the tourist ship (yachts) foreign and goods and/or vehicles carried by the crew are given ease in the area of the saltship.

Section 7
(1) Crew ships and/or passengers of the tourist ship (yacht) foreign who will make a visit to Indonesia must have a residence permit.
(2) The residence permit is referred to in paragraph (1) in the case of a specified residence permit granted to the foreign nationals as the crew of the tourist ship (yachts) foreign:
a. Representative Visa holder published by the Representative of the Republic of Indonesia;
B. Visa-holder (s): c. subject of the Free State Visa Free State Visit.
(3) A specific time-term visit permit for the Visiting Visa holder as referred to in paragraph (2) the letter a and the letter b may be extended in accordance with the provisions of the laws.
(4) The application of extension permission of the visit residence in a given time as referred to in paragraph (3) is performed at the nearest Immigration Office in which the tourist ship (yacht) is foreign, by attaching it:
a. Letter of invocation and assurance of the guarantor;
B. Photocopy of a valid national passport and still apply at least 6 (six) months; and
C. Photocopy permission to stay.
(5) The crew of the tourist (yacht) foreign as referred to in verse (2) is not required to perform the registration of a foreigner.

Section 8
(1) (yacht) foreign and ship crew including luggage that will make a tourist visit to Indonesia must undergo quarantine inspection.
(2) The quarantine examination as referred to in paragraph (1) is performed in accordance with the provisions of the laws.

Section 9
Examination of the divinity, pausing, immigration, and carnality and the awarding of the Sailing Approval Letter (SPB) are done in a unified port and port to the outside.

Section 10
Cruise ships (yachts) foreign and ship crew including luggage and/or vehicles going outside of the Indonesian territorial waters are required to complete all its obligations in the field of pabeeness, immigration, carantinization, and the ship's office. The divinity.

Section 11
The tourist ship (yacht)foreign which conducts tourist visits in Indonesian territory is forbidden to be commerciated and/or leased to the other side.

Section 12
(1) In order for the safety of visit of tourist ship (yacht) foreign, the Government is developing a ship monitoring system.
(2) The development of the ship monitoring system as referred to in paragraph (1) is conducted in accordance with the provisions of the laws.

Section 13
(1) In order to increase the visit of the tourist ship (yacht) foreign, Government and/or the Local Government may provide facilities support for the tourist ship (yachts) foreign.
(2) The support of the facility as referred to in paragraph (1) is:
a. (yachts)
B. ease in building a marina or special terminal of the tourist ship (yacht) foreign;
c. pier construction;
D. installation of the cruise navigation tool;
e. Ease of maintenance facilities and repair of tourist ships (yachts); and
f. Facilities and other ease as needed.
(3) The provisioning of the facility as referred to in paragraph (1) and paragraph (2) is exercised in accordance with the provisions of the laws.

Section 14
(1) In order to guarantee the effectiveness of implementation of the Regulation the President may be in coordination with the related agencies and/or other parties.
(2) The Coordination as referred to in paragraph (1) involves the elements:
a. Ministry of Foreign Affairs;
B. Ministry of Defence;
C. Ministry of Law and Human Rights;
D. Ministry of Finance;
e. Ministry of Transportation;
f. Ministry of Health;
G. Ministry of Marine and Fisheries;
h. Ministry of Culture and Creative Economy;
i. Headquarters of the Indonesian National Army; and
J. General agents and/or organizers of a foreign tour boat (yacht).

Section 15
The tourist ship (yacht) a foreign violation of the provisions as referred to in Article 5 of the paragraph (1), Article 7 of the paragraph (1), Article 8 of the paragraph (1), Article 10, and Article 11 are subject to sanctions in accordance with the provisions of the laws.

Section 16
Further provisions are required for the implementation of the Rule of the President governed by the Minister, the Minister of Affairs and the Leader of the instance, both together and alone in accordance with their respective fields of duty. the provisions of the laws.

Section 17
This President ' s regulation starts to apply to the date of the promulctest.
