(3) More provisions on the type of Food Olahan that can be produced by the household industry as referred to in paragraph (1) of the letter a specified by the Head of the Agency.

Article 4

The food household industry is producing Processed Foods as referred to in Section 3 of the paragraph (1) the letter a shall have a household industry food production certificate under the provisions of the laws.

BAB II

THE CRITERIA

FIRST PART

PROCESSED FOOD CRITERIA

ARTICLE 5

(1) PROCESSED FOODS ARE DISTINGUISHED ABOVE:

a. Production Products are self-produced;

b. Licensed Foods;

c. Packaged foods are repackaged;

d. Processed foods produced under contract.

(2) The Olahan Food Registry as referred to in paragraph (1) letter b, letter c, and the letter d must be accompanied by supporting data in a letter of agreement or similar letter.

Section 6

(1) The Olahan Food to be registered must meet the security, quality, and nutrition criteria.

(2) The security, quality, and nutrition criteria as referred to in paragraph (1) include:

a. Security parameters, which are the maximum limit of microbial exposure, physical spruce, and chemical spruce;

b. Quality parameters, the fulfilment of quality requirements according to the standards and requirements that apply as well as the manner of good food production for the Food Olahan which is produced in the country or in the manner of a good Food distribution for the Food of Olands which entered into Indonesia; and

c. nutrition parameters according to the requirements specified.

(3) In addition to meeting the criteria as referred to in paragraph (1) and paragraph (2), also must meet the requirements of the label.

Article 7

(1) For Olahan Food, which contains raw materials, Food Additional Materials, other materials, and/or include claims that have not been set forth in the provisions of the laws, should be conducted first.

Criteria and Company Responsibility

Section 8

(1) The Olahan Food Registry as referred to in Section 5 of the letter a, letter b, and c. Producer.

(2) The Olahan Food Registry as referred to in Section 5 of the paragraph (1) of the country produced in the country is submitted by the Contracting party.

(3) The manufacturer as referred to in paragraph (1) and the Contract Recipient Must Be meets the requirements as follows:

a. have an industrial business permit in accordance with the laws of the legislation; and

b. meets the requirements of a good Food Production way for the type of Food listed.

Article 9

(1) The Olahan Food Registry entered into Indonesia is submitted by Importers or Distributor.

(2) Importers or the Distributor as referred to in the paragraph (1) must meet the requirements of the following:

a. have a permit in the field of importation or distribution of the Food;

b. have a letter of appointment from the Company of origin abroad; and

c. meet the requirements of a good Food distribution suit in accordance with the provisions of the laws.

(3) Olahan Food Registry entered into Indonesian territory that is a licensed processed food, repackaged Olahan Food, or Food produced under contract abroad must be accompanied by supporting data May be a letter of agreement or letter.

Article 10

Fulfillment of the requirements of the manner of the good Food production as referred to in Section 8 of the paragraph (3) the letter b and the requirements of the good Food distribution as referred to in Article 9 verses (2) of the letter c, evidenced by the letter of description of the results of the audit of the officers local.

Article 11

(1) Before performing the Olahan Food Registry, Penlisting is required to apply for an audit of the means of production or distribution means to the local Hall Chief.

Section 12

Third Part

Criteria and Penlisting Responsibility

Article 13

(1) The implementation of the Processing of processed Food Registry is performed by Penlisting.

(2) The registrations as referred to in paragraph (1) must understand the criteria and requirements of the Food Olahan registered.

Article 14

In terms of the Registration is done by the authorized party, then:

a. The company must report the recipient ' s party to the Head of the Agency.

b. The Processed Food Registration Agreement is published for the company submitting the registration.

Article 15

(1) The registrations are responsible for the completeness, correctness, and validity of the documents submitted during the Food Registry Processed.

(2) In the event it is known that the document submitted at the Registration as referred to in paragraph (1) is a false or falsified document, then the Registration application is rejected and the Company in question cannot conduct the Olahan Food Registry for 3 (three) years since the date of the rejection letter.

BAB III

PROCESSED FOOD REGISTRATION REQUIREMENTS

First Section

General Registration

Article 16

(1) Registration Requirements includes administrative requirements and technical requirements.

(2) Requirements The registration as referred to in paragraph (1) is set forth in Appendix 1 which is an inseparable part of this Regulation.

The Second Section

The Change of Food Data

Article 17

(1) The Company may perform data changes for the Food Olahan that have already had thekaging for Traded.

Article 3

(1) Excluded from the provisions referred to in Section 2 of the paragraph (1) and the paragraph (2), the Food of Olahan which:

a. produced by the household industry;

b. have a save of less than 7 (seven) days at room temperature;

c. incorporated into Indonesian territory in small quantities for the purpose of:

1. sample in order of registration application;

2. research;

3. own consumption; and/or

d. used further as raw materials and not sold directly to the end consumer.

(2) The small amount referred to in paragraph (1) letter c is the amount required for purposes only in accordance with the results of the study The eligibility for the invocation of the Importers is requi Registration Agreement Letter.

(2) Data changes as referred to in paragraph (1) must be obtained by the Head of the Agency.

(3) The change of Olahan Food data as referred to in paragraph (1) may be done as long as it does not lead to changes in the Food Registry Number and/or changes in the Evaluation and Registration Fee.

(4) In terms of The Olahan Food Data changes that cause changes in the Food Registration Number and/or changes in the evaluation fee, the registrations must submit a new Registration application.

Article 18

(1) Changes as referred to in Article 17 of the paragraph (1) may be:

a. Company name change;

b. Change the name of the Importer and/or Distributor;

c. The inclusion and or the Gizi Value Information change;

d. Changes and or add a claim;

e. Trade name change;

f. Packaging design changes;

g. Changes and/or extra weight/net additions;

h. Changes in composition; and/or

i. Changes to the promotion interest in a given time.

(2) The requirements and completeness of the document for change as referred to in paragraph (1) are listed in Annex 2 which is an inseparable part of this Regulation.

Third Part

Olahan Food Label Requirements

Section 19

The label requirements as referred to in Section 6 of the paragraph (3) in accordance with the Olahan Food label requirements as set forth in Annex 3 which is a part of inseparable from this Regulation.

BAB IV

LAYOUT OF FOOD REGISTRATION PROCESSED

First Section

Registration Submissions

Article 20

Registration is filed for any Food Olahan including those with differences in terms of:

a. Label design;

b. type of packaging;

c. composition; and/or

d. the name and/or address of the party producing.

Article 21

Application Application is submitted in writing by filling the Registration form with the completeness of the Registration document.

Section 22

Registration Document is a confidential document only used for purposes of evaluation by authorized use.

The Second Section

Examination and Assessment

Article 23

(1) Against the registration document as referred to in Section 21 conducted checks and judgments according to criteria and requirements as intended In Section 6.

(2) In the case of the registration document listing the variation of the claim, the discussion is conducted with the expert team.

The Third Section

Decision

Section 24

The results of the assessment as referred to under Section 23 can be:

a. Registration Approval Letter; or

b. Letter of Rejection.

Article 25

(1) The decision of the Registration Approval Letter as referred to in Article 24 of the letter a is specified by the Head of the Agency.

(2) The Head of the Agency may delegate the issuer of the Approval Letter Registration to other designated officials.

Section 26

(1) The Registration Agreement Letter as referred to in Section 25 of the paragraph (1) is accompanied by a draft of the approved Label.

(2) The Registration Approval Letter for the Processed foods are published by listing the Food Registry Number.

Article 27

(1) The Food Registration Number as referred to in Article 26 of the paragraph (2) for the Food Olahan of the domestic production of "BPOM RI MD" is followed by a digit number.

(2) The number The Food Registry as referred to in Article 26 of the paragraph (2) for the Food Olahan of the overseas production is the writing of "BPOM RI ML" followed by the digit number.

(3) Digit the figure as referred to in paragraph (1) and paragraph (2) contains information Processed food identities that include companies, manufacturer locations, product type numbers, packaging types, and the food type.

(4) The Food Registration Number is mandatory on the Label in such a way that it is easy to see and read by the consumer.

Article 28

(1) In the event of a decision of the Registration refusal as it means in Section 24 of the letter b, will be issued a rejection letter accompanied by a reason for rejection.

(2) In case the Registration is rejected for security, quality, or nutrition reasons, the reregistration can only be filed after the latest supporting data.

Section 29

The processing of processed food registration will be further established.

BAB V

COSTS

Article 30

(1) Against the Olahan Food Registration application in order to obtain the Registration Approval Letter or the Food Data change Olahan charge is charged as state acceptance is not a tax according to with the provisions of the laws.

BAB VI

HEARINGS

Section 31

(2) Requests for hearings as referred to in paragraph (1) must be supplemented with new data and/or data already submitted that are supplemented with justification.

BAB VII

REVIEW BACK

Article 32

(1) In case of any objection to the registration rejection, the Company may submit a review request to the Head of the Agency in writing.

(2) The review request must be supplemented with new data and/or data already submitted that are supplemented with justification.

(3) Return review requests may be submitted in the form of hearings.

BAB VIII

THE EXPIRATION OF THE REGISTRATION CONSENT LETTER

Article 33

(1) The Registration Agreement is valid for 5 (five) years and may be extended by ReRegistry.

(2) The expired Registration Agreement Letter is declared to be not valid.

(3) The Olahan Food Term Approval Letter Approval Letter has been banned. circulated.

BAB IX

REGISTRATION RETURNS

Article 34

The Olahan Food Return Registry may be conducted at least 6 (six) months prior to the expiration of the Registration Approval Letter.

BAB X

IMPLEMENTATION OF THE REGISTRATION AGREEMENT

Article 35

(1) The processed processed food must conform to the security, quality and nutrition criteria and the requirements of the approved Label at the time registration.

(2) The circulating Olahan Food Label must be in accordance with the approved Label design at the time of registration.

Section 36

Section 37

(1) The Company is responsible for the security, quality, and nutrition and the Olahan Food Label that is circulated in accordance with the information approved at the time of Registration.

(2) The responsibility as referred to in the paragraph (1) for the Food Olahan of its own production, licensed processed food, and the Food Olahan re-located on the party of the Producers.

(3) The responsibility as referred to paragraph (1) for the Food of Olahan produced in the country is based on contract is on the Contracting party.

BAB XI

JUDGEMENT AGAIN

Article 38

(1) Against the Food of Olahan has got a Registration Consent Letter can be re-assessment by the Head of the Agency.

(2) Reassessment as referred to in paragraph (1) is done if there is data and/or new information related to the security, quality, nutrition, and Food Label Olahan.

(3) The Assessment results are returned submitted in writing to the Registration of the Registration Letter.

(4) The Registration Letter of the Registration Letter is required to act in accordance with the results of the Reassessment as referred to in paragraph (3).

BAB XII

ADMINISTRATIVE SANCTION

Article 39

(1) The violation of the provisions in this Regulation may be subject to administrative sanction of:

a. Written warning;

b. It was a temporary ban on time;

c. Temporary termination of activities; or

d. Revocation of the Registration Agreement Letter.

(2) administrative sanctions as referred to in paragraph (1) the letter d may be subject to or in the case of:

a. Assessment results are found that does not meet the security requirements;

b. Processed foods do not comply with the data agreed upon at the time of obtaining a Registration Agreement or data change agreement;

c. results of the outstanding inspection and/or testing of the Food Olahan do not meet the criteria as referred to in Article 7;

d. Processed Foods were advertised in violation of the provisions of the laws of the law;

e. a court ruling that has had a fixed legal force relating to the Food of Olahan;

f. The Company commits a breach in the field of production and/or the distribution of the Food;

g. The importer or Distributor of the Registration Agreement holder has not received an appointment from an overseas factory;

h. Food industry business permit to produce, Importer's permission, and/or Distributor's permission are revoked;

i. The location of the Importers does not comply with the Registration Approval Letter or the data change agreement;

j. the location of the means of production does not comply with the Registration Approval Letter or the data change agreement; and/or

k. (3) The company is responsible for the Olahan Food, which is still in circulation that has been revoked.

BAB XIII

TRANSITION provisions

Article 40

(1) The Food Registration Agreement issued under Health Minister Regulation No. 382/Menkes/Per/VI/1989 of the Food Registry is mandatory in accordance with this Regulation the longest 1 (one) year since the date of this Regulation is promulred.

(2) The Registration Request Processed foods that have been submitted prior to the enactment of this Regulation, remain processed under the Decree of the Head of the Food and Drug Administration of HK.00.05.1.2569 Year 2004 on the Criteria and the Food Products Assessment.

BAB XIV

provisions CLOSING

Article 41

At the time this Regulation is in effect then:

1. Decision of the Head of the Food and Drug Administration Number HK.00.05.52.4321 Year 2003 on the General Guidelines of the Food Product Students; and

2. Decision of Head of the Food and Drug Administration Board HK.00.05.1.2569 of 2004 on Criteria and Tata Laksana Assessment of Food Products;

THE PROCESSED FOOD LABEL

I. UMUM CONDITIONS

1. Processed foods produced within the country or incorporated into Indonesian territory to be traded in packaging, required to list the labels on, inside, and/or in food packaging.

2. Labeling of labels must meet the provisions of the laws.

3. In addition to having to meet the provisions of the laws, the inclusion of the label must also fulfill the provisions as set forth in this Regulation.

4. The description and or statement of processed foods in the label must be correct and not misleading either of the writing, image or any form of any other.

5. The label contains a clear writing, can be easily read, regular and unforced-insistence.

6. The use of background, either image, color or other design should not obscure the writing on the Label.

7. The labeling is done in such a way that:

a. It is not easy to remove from the packaging;

b. It is not easily worn or damaged; and

c. It is located in an easy food packaging section to be seen and read.

8. In addition to the provisions as listed on the number 7, the Label attached or pasted to the packaging must be attached strongly so that if it is removed will corrupt the original label/packaging.

9. The inclusion of statements on food benefits for health in the Label can only be done if supported by scientific facts that can be accounted for and in accordance with the provisions specified.

10. The processed food label is made up of the main parts and other parts.

11. The least processed food label should list:

a. processed food names;

b. Net weight or net content;

c. party names and addresses of the parties that produce or include food into Indonesian territory;

d. List of materials which are used;

e. Food registration number;

f. The caption was expired; and

g. production code.

12. In addition to the description as referred to at number 11, the processed food label must also be listed as follows:

a. An account of the nutritional content,

b. The maturity of food irradiation,

c. Organic food,

d. On the nature of genetically engineered foods,

e. The interest in food made from natural raw materials,

f. Usage/setup instructions,

g. Instruction on how to store,

h. Description of the directions or presentation suggestions,

i. Description of the description,

j. Other details that need to be known about the food impact on human health,

k.Warning.

13. The inclusion of the caption as referred to in numbers 11 and 12 in accordance with the provisions of the laws.

II. WRITING AND DRAWING

1. Language, Font and Numbers

a. The description as referred to in Part I figure 12 and number 13 is written

and printed using the Indonesian language, Arabic numeral and letter

Latin.

b. The use of a foreign term in the description as referred to in section I

number 12 and number 13 can be done as long as there is no padre, not

may be created in the padre or used for trading purposes

A food overseas.

c. A foreign term as referred to in the letter b is the language, numeric or

letter other than the Indonesian language, Arabic numeral or Latin letters as well as the technical terms

or scientific, for example the chemical formula for mentioning a type of material that

is used in composition.

d. In the label with the caption as referred to in the letter a and the letter b

may be added to the same description in language other than the language

Indonesia, Arabic numeral and Latin letters.

2. Image

a. The image must indicate the actual state, including the nature and/or

of the processed food state as well as not misleading;

b. Images of fruit, meat, fish or other ingredients can only be listed

if food contains the material, not as a perisa (including

natural perisa, natural identical perisa, and artificial perisa). In the composition section

must be listed as the sum of the ingredients used.

Misal:

"Composition: water, sugar, mango juice (10%), mango perisa"

"Composition: sugar, oranges extract (2%), orange perisa"

c. The provisions as intended in the letter a and the letter b do not apply to

an image inclusion provision as a presentation of advice.

d. For processed foods that require or have a presentation of a presentation

3. Font Size and Writing

c. The Indonesian language must be written in the size of a letter that

with the provisions specified in the rules of the legislation;

whose packaging is too small, so it is technically difficult to contain all of

preservatives, antioxidants, dyes and taste amplifiers.

g. BTP inclusion on the list of ingredients:

1) The processed foods containing BTP should include the name

group.

2) In addition to listing the description as referred to at number 1),

specifically for artificial sweeteners, antioxidants, preservatives, taste amplifiers,

and the dye must list the name of the additional ingredient

food.

3) In addition to listing the captions as referred to at number 1),

and the number 2), specifically for the dye must list the number

index (CI ...).

4) In addition to the description as referred to at number 1),

3. Description of Clean Weight or Clean Content

a. Net weight or net content is a statement on the label that gives

a description of the quantity or amount of processed foods contained in

in packs or containers.

b. The weight of the tuntas or the weight of the tuntas is a heavy measure for solid food that

V. PROHIBITED ITEMS ARE LISTED ON PROCESSED FOOD LABELS

Statements, images or adverts that are prohibited are listed on the Label include:

1. A statement or a statement that is not true. An untrue description is a description which is contrary to the actual fact or does not contain the necessary information so that the description may provide an actual image or impression of food.

2. Misleading statements or statements. A misleading statement is a statement relating to matters such as nature, price, materials, quality, composition, benefits or food safety that, although true, can lead to misleading images of the understanding of food. is concerned.

7. The statement that processed foods may increase intelligence or IQ.

8. The statement of excellence in food is processed if the excellence is not entirely derived from that food but is partly given from other foods that can be consumed together.

9. A statement that contains the absence of a component that naturally does not exist in processed foods, unless there is a general supporting data/standard of processed foods that contain such components.

10. A specific material statement of material but containing such material is either unintentional and as a material/icacup comorganizer of the irradiation, if irradiation is not

18. Captions, writings or images that offend people, religion, race and/or certain types.

19. Inclusion of raffle, sayembara, gifts and writing or any image that does not conform to the label approved on the approval of food product registration or approval of processed food data changes.
