ELECTRONIC PROCUREMENT SERVICE
AT THE MINISTRY OF RESEARCH AND TECHNOLOGY

WITH THE GRACE OF THE ALMIGHTY GOD

MINISTER OF STATE RESEARCH AND TECHNOLOGY REPUBLIC OF INDONESIA,

Weigh: a.   that in order to conduct the IBM Software/Services Hosting Services system and facilitation of the Acquisition of Goods/Services in the Ministry of Research and Technology and to implement the provisions of Article 111 of the Regulation (" President Number 54 of the Year 2010 on Governing Goods/Government Services, requires the process of Procurement Of Government Goods/Services;
B.   that based on consideration as intended on the letter a, it needs to establish the Regulation of the Minister of State Research and Technology on Electronic Procurement Services in the Ministry of Research and Technology;

Remembering: 1.   Constitution of the Republic of Indonesia No. 28 Year 1999 on the Clean and Free State of the Colusion, Corruption, and Nepotism (State Gazette 2004 Number 75, Additional Gazette Number 3851);
2. Indonesian Republik Indonesia Act No. 11 Year 2008 on Information and Electronic Transactions (State Sheet 2008 Number 58, Extra State Sheet number 4843);
3. Law No. 14 Year 2008 on Openness Of Public Information (State Sheet 2008 Number 61, Additional Sheet Of State Republic Indonesia Number 4846);
4. Regulation of the President of the Republic of Indonesia No. 47 of 2009 on the Establishment and Organization of the Ministry of State;
5. The Regulation of the President of the Republic of Indonesia No. 54 of 2010 on the Procurement of Government Goods/Services;
6. Decree of the President of the Republic of Indonesia No. 84 /P of the Year 2009 on the United Indonesia Cabinet II;
7. Regulation of the Minister of State for Research and Technology Number 03 /M/PER/VI/2010 on the Organization and the Working Governance of the Ministry of Research and Technology;
8. The Principal Program of the Government of the Government Number 2 of the Goods/Services No. 2 of the Year 2010 of the Electronic Absence Services;

DECIDED:

Establishing: REGULATION OF THE MINISTER OF STATE OF RESEARCH AND TECHNOLOGY ON THE ELECTRONIC BARANG/SERVICE PROCUREMENT SERVICE IN THE MINISTRY OF RESEARCH AND TECHNOLOGY.

BAB I
UMUM PROVISIONS

The Kesatu section
Understanding

Section 1
In Regulation of the Minister this is referred to:
1. The next Electronic Service Offering is a unit of work that is set up to host the Electronic Service Procurement Service system.
2. The subsequent Electronic Abolition System (SPSE) is a friend that includes software applications or SPSE applications and E-Procurement databases "developed by the Policy Institute of Goods/Services". The government for use by the LPSE.
3. An electronic presence or e-procurement is the Procurement of Goods/Services that is executed using information technology and electronic transactions in accordance with the provisions of the laws.
4. The subsequent PA Budget User is the official holder of the Ministry of Research and Technology's use of the Ministry of Technology.

7. The subsequent procurement of goods and services (ULP) is a unit of government organization that serves as a permanent provision of the Goods/Services.
8. Officials of the Goods/Services are personnel who have a Certificate of Granting Of Goods/Services who carry out the Absence Of Goods.
9. The Goods/Services Services are a team appointed by the Budget User/Power Users of the Budget to carry out the selection of the Goods/Services Providers.
(1) The Program may be used for use with the Program for which the Program can be used for the Program.
11.Minister is the Minister of State Research and Technology.

The destination

Section 2
The purpose of Electronic Services (LPSE) in the Ministry of Research and Technology is to increase efficiency, effectiveness, transparency, healthy competition, and accountability in the implementation of Government Goods/Services.

BAB II
THE POSITION, DUTY, AND FUNCTION

Section 3
(1) The LPSE is below and is responsible to the Minister.
(2) The LPSE is led by a Chairman.

Section 4
LPSE has a task:
a.   facilitate the PA or the KPA in announcing the general plan for barang/jasa;
B.   facilitate the ULP showing the announcement of the implementation of the barang/jasa;
c. facilitate the ULP or the Acting Officer in carrying out the conduct of the Goods/Services Provider;
D.   facilitate Provider of Goods/Services and the parties in the interest of being an LPSE; and
e.   carrying out another task given by the Minister.

Section 5
In carrying out its task, the LPSE organizes a function:
a.   Preparation of activities, enterprise, evaluation and reporting management programs.
B.   management of SPSE and its infrastructure;
c. execution of registration and User verification; and
D.   implementation of the SPSE operation of the training and technical support of SPSE.

BAB III
ORGANIZATION ARRANGEMENT

The Kesatu section
The organization

Section 6
(1) The organization of the LPSE organization consists of:
a.   Directing;
B.   Replied;
C.   Speaker;
D.   Secretariat;
e.   Electronic System Administration field;
f.    Registration and Verification Field;
G.   User Services Fieldhelp desk; and
h.   Training field.
(2) The organization ' s Susunan as referred to in paragraph (1) is set forth in this Regulation Attachment.

The Second Part
The requirements

Section 7
(1) The LPSE team is required to meet the requirements:
a.   civil servant or a non civil civil servant;
B.   have technical and managerial qualifications;
c. possess moral integrity, discipline, and responsibility in carrying out the duties; and
D.   not based as a PPK, ULP/Officials Procurement/Procurement Committee.
(2) The LPSE team is not required to have a barang/barber/service procurement expertise certificate.
(3) The LPSE team is appointed and dismissed by the Minister.

The Third Part
The LPSE team task

Section 8
The director has a task:
1. Membre and direct the work program; and
2. Provide the LPSE policy direction.

Section 9
The handler has a task:
1. Approve and be the responsibility of the work program; and
2. Monitor and evaluate the work program.

Section 10
The chairman has a task:
1. Leading daily operations;
2. Provide technical instructions and control the execution of the work program; and
3. Evaluate and deliver a work program report to the Minister through the charge.

Section 11
(1) The Secretariat has the task of assisting the Chair in terms of:
a.   coordination of activities in the LPSE environment;
B.   LPSE budgeting and budgeting management; and
c. Drafting of the work program report.
(2) In addition to the task as referred to in paragraph (1), the Secretariat has a task:
a.   Host and general administration management to support the implementation of the LPSE's tasks and functions;
B.   management of the means and infrastructure; and
c. implementation of the other tasks provided by the Chair in accordance with the task and function of the LPSE.

Section 12
The Electronic System Administration field has a task:
1. Preparing (set up) information system technical, both software and hardware;
2. Maintain the server and other devices;
3. Provide information and handle the technical problems of the information systems that occur; and
4. Executing the technical instructions of the Government ' s Goods/Services Procurement Policy Institute (LKPP).

Section 13
Registration and Verification have a task:
1. Handling registration as the Goods/Jasa;
2. Conduct verification of all information and documents as the Item/Jasa; Providers ' s Provider registration requirements;
3. Approve and reject the Goods/Services Provider registration application based on the verification results; and
4. Perform confirmation to the Goods/Services Provider about approval and rejection of registration based on verification results.

Section 14
The User Services Fieldhelp desk has a task:
1. Provide consulting services on electronic goods procurement process/services;
2. Answer the question about the facilities and feature the SPSE application;
3. Handling complaints about the service LPSE; and
4. Managing the archive and the SPSE complaint document.

Section 15
The Training Field has the task of providing SPSE application usage training to PA, KPA, PPK, Provider, and ULP/Officials The Absence.

The Fourth Part
The duty and rights of the LPSE Team


Section 16
The LPSE team has an obligation to carry out its duties as set out in this Regulation.

Section 17
The LPSE team is entitled to receive an honorarium whose magnitude is adjusted to the task and responsibilities specified by the Ministerial Decision.

BAB IV
WORK LAYOUT

Section 18
(1) LPSE is in a working relationship with PA/KPA/PPK/ULP/Officials Absence.
(2) the LPSE is coordinating with LKPP.

Section 19
(1) LPSE working relationship with PA/KPA/PPK/ULP/Acting Officials, among others:
a.   provide technical support with respect to the screening of the procurement general plan and the procurement announcement in the National Governing Portal;
B.   implement coordination and consulting in order to resolve the technical problem of electronic goods procurement processes/services;
c. provide a report of the SPSE data processing results (e-reporting) related to the electronic procurement of goods/services; and
D.   receive input for increased service provided by LPSE.
(2) The Coordination of the LPSE with LKPP, among others:
a.   conduct consultation in accordance with the need, in order to resolve issues encountered in the process of electronic procurement of goods/services; and
B.   provide technical information and proposals to the LKPP related to the problem and development of SPSE applications.

BAB V
THE FINANCING

Section 20
All costs arising in the framework of the formation and management of the LPSE are charged to the Budget of the Ministry of Research and Technology.

BAB VI
OPERATIONAL PROCEDURE STANDARD

Section 21
(1) LPSE composed and carried out operational procedure standards to ensure the continuity of the implementation of electronic goods procurement systems.
(2) The standard Operating Procedure as referred to in paragraph (1), at least includes:
a.   registration and verification of SPSE users;
B.   SPSE user services;
c. Problem handling (error handling);
D.   maintenance and security of the SPSE infrastructure;
e.   Performance maintenance and SPSE capacity; and
f.    Electronic document archiving (backup file).

Section 22
(1) The standard substance of the Registration Procedure and Verification of the SPSE User as referred to in Section 21 of the paragraph (2) of the letter a must meet the requirements and stages as follows:
a.   For Item/Services Provider:
1. Conduct registration in online via the SPSE application;
2. Concurrent and submit the Registration Form as well as the participating Form by attached a copy of the support document and show the original document consisting of:
a) KTP Director/Owner of the company/Officials in the company;
b) The foundation of the company and the deed of last change (if any);
(NPWP) IBM Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner-Business Partner- d) A business permit according to their respective field of business.
B.   For SPSE Users other than the Goods/Services Providers, show and submit copies of the duty letters and/or decision letters from each instance.
(2) Verification of the IBM Software as a Service Provider for IBM Software as a Service Provider for IBM Software as a Service Provider for IBM Software as a Service Provider ("IBM"), and (2) the following: with a user id and password as a representation of an Entity ID (Entity ID) in person, or a person.
(3) LPSE does not need to perform field checks.
(4) The verification process does not negate the charging process, the delivery of the qualifying data by the Goods/Services Provider, and the clarification of the qualification data by the ULP/Officials Procurement in the process of Providers/Services.
(5) The form as referred to in paragraph (1) the letter a number 2 can be obtained on the SPSE application.
(6) SPSE Users other than the Goods/Services are ULP/Officials, PPK, Auditor or other entity specified in the generally applicable Terms and Conditions of the SPSE Usage Terms and Conditions in effect.

Section 23
LPSE provides:
a.   The bidding services space (bidding room), training, and verification.
B.   Internet and intranet access for SPSE users that visit to the LPSE's location.
C.   SPSE use consultation services via internet, telephone, and visits to the LPSE's location.
D.   Announcements or information to SPSE users if they are facing a technical problem that can inhibit SPSE user activities.

Section 24
(1) The LPSE handles the technical constraints that occur in the holding of the SPSE.
(2) The LPSE to be a witness in terms of the offer document cannot be opened by the ULP/Officials of the Procurement and poured it in the news of the testimony event.
(3) LPSE may forward the technical constraints to the LKPP if it relates to:
a.   The SPSE application problem cannot be solved by LPSE; and
B.   issues that are not yet included in the SPSE application.

Section 25
(1) LPSE makes the management and safeguarding mechanism server and the network.
(2) The management of the SPSE server refers to the management standard data center.
(3) The server room settings SPSE include regard to room temperature provisions, power catu backup, and physical security.
(4) All visitors who will enter the server room must get a written permission from the LPSE Chairperson.
(5) Management server SPSE should pay attention to aspects that make it easier for maintenance activities such as monitoring, documentation, and data storage.

Section 26
(1) The LPSE performs daily monitoring of the conditions and capacities of hardisk and RAM and performs replacement/addition if the component is critically ill.
(2) LPSE makes a bandwith setup internet and monitoring traffic.
(3) LPSE performs monitoring of the server ' s internet connection SPSE and immediately takes the necessary steps in the event of a connection interruption.
(4) The LPSE provides an announcement if it is performing a server maintenance process SPSE and/or any other device.
(5) LPSE monitors the performance of software, hardware and networks as well as performing upgrades/additions if required.
(6) LPSE gives access to LKPP to do monitoring servers SPSE.

Section 27
(1) LPSE must do back up against file system and SPSE database.
(2) Back up must be stored in an easily moved storage medium (portable) and placed in a separate safe place from the server room.
(3) The electronic document archiving provisions follow the applicable provisions.

BAB VII
CLOSING PROVISIONS

Section 28
The Minister ' s rules are beginning to apply at the set date.
