PETROLEUM AND EARTH OIL MINING IN ORDER

AUTONOMY SPECIAL IN WEST PAPUA PROVINCE

THE FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,

DRAW: that to implement the provisions of Article 34 of the paragraph (3) of the Law No. 21 Year 2001 on Special Autonomy of the Province of Papua as amended by Law Number 35 of 2008 and Article 27 paragraph (5) Government Regulation Number 55 of the Year 2005 on the Balance Fund, it needs to establish the Minister of Finance Regulation on the Estimation of the Alocation of the Fund for the Results of the Natural Resources of Earth Oil and Earth Gas In the Special Autonomy Rangka in West Papua Province 2010 Budget Year;

Given: 1. Law No. 21 of 2001 on Special Autonomy of Papua Province (State of the Republic of Indonesia 2001 Number 135, Additional Gazette of the Republic of Indonesia Number 4151) as it has

amended by Act No. 35 of 2008 (State Gazette 2008 2008 Number 112, Additional Gazette of the Republic of Indonesia Number 4884);

2. Law Number 10 of the Year 2010 on Budget and State Shopping of the Budget of the Year 2010 (Indonesian Republic of Indonesia Year Number 126, Additional Gazette Republic of Indonesia Number 5167);

3. Government Regulation No. 55 of 2005 on the Balancing Fund (State Of The Republic Of Indonesia In 2005 Number 137, Additional Gazette Of The Republic Of Indonesia Number 4575);

4. President's Decision No. 56/P of 2010;

5. Regulation of the Finance Minister Number 126 /PMK.07/ 2010 on the Implementation and Accountiveness of the Budget Transfer to the Regions;

DECIDED:

Establits: THE FINANCE MINISTER ' S REGULATION ON THE ESTIMATED ALLOCATION OF FUNDS FOR THE NATURAL RESOURCES OF PETROLEUM AND PETROLEUM MINING RESOURCES IN THE FRAMEWORK OF SPECIAL AUTONOMY IN THE WESTERN PAPUA PROVINCE OF THE BUDGET YEAR 2011.

Article 1

(1) Estimation of the Alocation of the Fund for Natural Resources derived from Earth Oil and Earth Gas Mining (DBH SDA Migas) in the framework of Special Autonomy in West Papua Province is based on the acceptance plan as was referred to in Law Number 10 of the Year 2010 on the State Budget and Shopping Budget of 2011.

(2) The estimated allocation of DBH SDA Migas as referred to in verse (1) is as large as Rp680.292.930.000.00 (six hundred and eighty-eighty-two million nine hundred and thirty thousand rupiah), with details as follows:

a. The estimated allocation of DBH SDA derived from Petroleum Mining is 55% (fifty-five percent) of the total estimate of the country's total acceptance of the Natural Resources of the Province of West Papua, which is Rp550,548,835,000.00 (5%). Hundred and fifty billion five hundred and forty-eight million eight hundred and thirty-five thousand rupiah); and

b. The estimated additional allocation of DBH SDA derived from Earth Gas Mining is 40% (forty percent) of the estimated total state revenue derived from the Natural Gas Natural Resources of West Papua Province, namely Rp129.744,095.000.00. (one hundred and twenty-nine billion seven hundred and forty-four million and ninety-five thousand rupiah).

(3) In terms of changes to the assumptions of the macroeconomic indicators as referred to in Law Number 10 of 2010 on the State Budget and Budget Year 2011, then the estimated additional allocation of DBH SDA Migas as referred to in paragraph (2) need to be made an adjustment.

Section 2

(1) The DBH SDA Migas distribution in order of special autonomy for West Papua Province is implemented quarterly.

(2) The DBH SDA Migas in the Special Autonomy to West Papua Province First Triwulan and Second Triwulan respectively-respectively exercised at least 20% (twenty percent) of the estimated allocation terms as referred to in Section 1 of the paragraph (2).

(3) The DBH SDA Migas injection in Special Autonomy to West Papua Province as referred to in paragraph (2) is further taken into account with the realization of the acceptance of DBH SDA Migas Triwulan Third and Fourth Triwulers.

(4) The distribution of DBH SDA Migas in the order of Special Autonomy to West Papua Province as referred to in verse (3) is carried out by calculation through a data reconciliation mechanism between the Central Government and its producing regions.

(5) Tata method of additional allocation of DBH SDA Migas allocation in order of Special Autonomy to West Papua Province is exercised in accordance with the provisions of the laws.

Section 3

In terms of pagu over the estimated allocation of DBH SDA Migas specified in the Budget Year 2011 insufficient supply requirement or realisation exceeds the pagu in the 2011 Budget Year, then it can be carried out based on the realization of acceptance in accordance with the provisions of laws

Article 4

This Finance Minister ' s Regulation is beginning to take effect on the date of the promulcity.
