Back NEWS REPUBLIC of INDONESIA No. 159, 2011PERATURAN the MINISTER of FINANCE of the REPUBLIC of INDONESIA NUMBER 54/FMD. 011/2011 ABOUT the IMPOSITION of IMPORT DUTIES PRECAUTIONS AGAINST IMPORTS of STEEL WIRE ROPES PRODUCTS (STEEL WIRE ROPES) and POSTAL RATE 7312.10.90.00 by the GRACE of GOD ALMIGHTY the MINISTER of FINANCE of the REPUBLIC of INDONESIA, Considering: a. that based on the results of the investigation Committee of the Indonesia Trade Safeguards have been demonstrated to occur a surge in the volume of imports of steel wire ropes products (steel wire ropes) and postal rate 7312.10.90.00 thus causing serious losses on the domestic industry;
b. that, in order to follow up on the results of the investigation in a letter, the Secretary of Commerce through Letter number: 1907/M-DAG/SD/12/2010 December 28, 2010, delivered the proposed imposition of security measures against the import duties imports of steel wire ropes products (steel wire ropes) and Postal Rate 7312.10.90.00;
c. that based on the provisions of article 21 of Presidential Decree Number 84 in 2002 about the Precautions of domestic industry due to a surge in imports, fixed security measures can be set in the form of import duties by the Minister of finance;
d. that based on considerations as referred to in letter a, letter b, letter c, and in order to implement the provisions of article paragraph 23D (2) Act No. 10 of 1995 on customs as amended by Act No. 17 of 2006, need to establish the regulation of the Minister of finance concerning the imposition of import duties Precautions Against imports of steel wire Ropes Products (Steel Wire Ropes) and Postal Rate 7312.10.90.00;

Act No. 10 of 1995 on Customs (State Gazette of the Republic of Indonesia Number 75 in 1995, an additional Sheet of the Republic of Indonesia Number 3612) as amended by Act No. 17 of 2006 (State Gazette of the Republic of Indonesia Number 93 in 2006, an additional Sheet of the Republic of Indonesia Number 4661);
3. Presidential Decree Number 84 in 2002 about the Precautions of domestic industry due to a surge in Imports (State Gazette of the Republic of Indonesia Number 134 in 2002);
4. Presidential Decree Number 56/P in 2010;

Notice: 1. Letter of the Secretary of Commerce number: 1907/M-DAG/SD/12/2010 December 28, 2010 subject Proposed the imposition of import duties security measures Against imported products steel wire Rope (Steel Wire Ropes) HS number: 7312.10.90.00 and the letter of the Secretary-General of the Ministry of Commerce number: 51/M-DAG/SD/1/2011 17 January 2011 subject list of developing countries that are exempt from the imposition of import duties (BMTP) Precautions Against Products of Cotton Woven Fabrics , Bleached and not Bleached; Bindrat Wire; Zinc wire and steel wire Ropes;
2. Report of the Committee on Safeguards Trade Indonesia about the results of the investigation To security measures (Safeguard Measures) on imports of steel wire Ropes the HS Number: 7312.10.90.00;
Decide: define: REGULATION of the MINISTER of FINANCE CONCERNING THE IMPOSITION of IMPORT DUTIES PRECAUTIONS AGAINST IMPORTS of STEEL WIRE ROPES PRODUCTS (STEEL WIRE ROPES) and POSTAL RATE 7312.10.90.00.
Article 1 Against imports of steel wire ropes products (steel wire ropes) in the form of dipilin wire with a diameter of 3 mm or more, ropes and cables of iron or steel, plated or coated or not and not isolated, in addition to the lock coil, flattened strands and non rotating wire ropes, which is included in the tariff heading 7312.10.90.00, import duties imposed security measures.

Article 2 of import duty security measures referred to in article 1 subject during the three (3) years with the following conditions: No period of import duty Precautions 1.   The year I, with a period of one year from the date of promulgation of the regulation of the Minister of finance.   RP 24.080/kg 2.   Year II, with a period of one year from the date of expiry of the period of the first year.   RP 21.464/kg 3.   Year III, with a period of one year from the date of expiry of the period of the second year of Rp. 19,128/kg import duty article 3 security measures as referred to in article 1 applies to importation from all countries, except against the steel wire rope products (steel wire ropes) produced from countries as contained in the annex to the regulation of the Minister of finance, which is the part that is an integral part of the regulation of the Minister of finance.

Article 4 (1) the imposition of import duties security measures as referred to in article 1 is: a. additional import duty General (Most Favored destinations with Nation); or b.  additional import duty preferences based on scheme-a scheme of international goods trade agreement apply in respect of imports from countries that are included in the scheme-the scheme of international goods trade agreement referred to and meet the terms of the scheme-a scheme for international trade in goods agreement.
(2) in terms of the provisions of the scheme-a scheme for international trade in goods agreement is not fulfilled, the imposition of import duties Precautions over the importation from countries that are included in the scheme-the scheme of international goods trade agreement referred to in subsection (1) letter b is an additional import duty General (Most Favored destinations with Nation).
Article 5 Against imports of steel wire ropes products (steel wire ropes) that come from countries that are exempt from the imposition of import duties security measures referred to in article 3 and who come from countries that have trade agreements with Indonesia as referred to in article 4 paragraph (1) letter b, the importer is obligated to submit the Certificate of origin (Certificate of Origin).

Article 6 Provisions concerning the imposition of import duties rates security measures referred to in article 2 in full force against the import of goods that customs import notification document in question got the registration number of the Customs Office of the port of income from the date of the enactment of the regulation of the Minister of finance.

Article 7 1.  Regulation of the Minister of Finance began in force on the date of promulgation.
2. Regulation of the Minister of finance is valid for 3 (three) years counted from the date of the enactment of the regulation of the Minister of finance.

In order to make everyone aware of it, ordered the enactment of these Regulations the Minister of finance with its placement in the news of the Republic of Indonesia.
