Back NEWS REPUBLIC of INDONESIA No. 161, 2011 REGULATIONS the MINISTER of FINANCE of the REPUBLIC of INDONESIA NUMBER 56/FMD. 011/2011 ABOUT the IMPOSITION of IMPORT DUTIES PRECAUTIONS AGAINST IMPORT PRODUCTS of ZINC WIRE with the GRACE of GOD ALMIGHTY the MINISTER of FINANCE of the REPUBLIC of INDONESIA, Considering: a. that based on the results of the investigation Committee of the Indonesia Trade Safeguards have been demonstrated to occur a surge in imports of zinc wire products causing serious losses on the domestic industry;
b. that, in order to follow up on the results of the investigation in a letter, the Secretary of Commerce through Letter number: 989/M-DAG/SD/7/2010 dated July 20, 2010, number: 1669/M-DAG/11/2010 dated 3 November 2010, and the number: 1855/M-DAG/SD/12/2010 dated December 20, 2010, delivered the proposed imposition of security measures against the import duties imports of zinc wire products;
c. that based on the provisions of article 21 of Presidential Decree Number 84 in 2002 about the Precautions of domestic industry due to a surge in imports, fixed security measures can be set in the form of import duties by the Minister of finance;
d. that based on considerations as referred to in letter a, letter b, letter c, and in order to implement the provisions of article paragraph 23D (2) Act No. 10 of 1995 on customs as amended by Act No. 17 of 2006, need to establish the regulation of the Minister of finance concerning the imposition of import duties Precautions Against imports of Zinc Wire Products;
Remember: 1. Act No. 7 of 1994 about an endorsement Agreement Establishing the World Trade Organization (State Gazette of the Republic of Indonesia Number 57 in 1994, an additional Sheet of the Republic of Indonesia Number 3564);
2. Act No. 10 of 1995 on Customs (State Gazette of the Republic of Indonesia Number 75 in 1995, an additional Sheet of the Republic of Indonesia Number 3612) as amended by Act No. 17 of 2006 (State Gazette of the Republic of Indonesia year 2006 Number 93);
3. Presidential Decree Number 84 in 2002 about the Precautions of domestic industry due to a surge in Imports (State Gazette of the Republic of Indonesia Number 134 in 2002);
4. Presidential Decree Number 56/P in 2010;

4. Trading Safeguards Committee Chairman Letter Indonesia number: 430/KPPI/VII/2010 dated 28 July 2010 about the exceptions to Goods originating from Certain countries;
5. Report of the Committee on Safeguards Trade Indonesia about the results of the investigation to security measures (Safeguard Measures) of Wire Products of zinc;
Decide: define: REGULATION of the MINISTER of FINANCE CONCERNING THE IMPOSITION of IMPORT DUTIES PRECAUTIONS AGAINST IMPORT PRODUCTS of ZINC WIRE.
Article 1 Against import products of zinc wire of iron or steel wire that is not an alloy, plated or coated with zinc carbon, less than 0.25% by weight, except for the size of the British Weight Gauge (BWG) more than 20 or less diameter of 0.89 mm and a diameter of 1.9 mm up to 4.2 mm with a layer of zinc above 240 gr/m2, which is included in the tariff heading ex 7217.20.10.00 Import duties, subject to security measures.

Article 2 of import duty security measures referred to in article 1 subject during the three (3) years with the following conditions: No period of import duty Precautions 1 year I, with a period of one (1) year from the date of promulgation of the regulation of the Minister of finance. RP 6.658/kg 2 years II, with a period of one (1) year from the date of expiry of the period of the first year. RP 5.643/kg 3 Year III, with a period of one (1) year from the date of expiry of the period of the second year. RP 4.629/kg import duty article 3 security measures as referred to in article 1 applies to importation from all countries, except zinc wire products manufactured from countries as contained in the annex to the regulation of the Minister of finance, which is the part that is an integral part of the regulation of the Minister of finance.

Article 4 (1) the imposition of import duties security measures as referred to in article 1 is: a. additional import duty General (Most Favored destinations with Nation); or b.  additional import duty preferences based on scheme-a scheme of international goods trade agreement apply in respect of imports from countries that are included in the scheme-the scheme of international goods trade agreement referred to and meet the terms of the scheme-a scheme for international trade in goods agreement.
(2) in terms of the provisions of the scheme-a scheme for international trade in goods agreement is not fulfilled, the imposition of import duties Precautions over the importation from countries that are included in the scheme-the scheme of international goods trade agreement referred to in subsection (1) letter b is an additional import duty General (Most Favored destinations with Nation).
Article 5 Against imports of zinc wire products that come from countries that are exempt from the imposition of import duties security measures referred to in article 3 and who come from countries that have trade agreements with Indonesia as referred to in article 4 paragraph (1) letter b, the importer is obligated to submit the Certificate of origin (Certificate of Origin).

Article 6 Provisions concerning the imposition of import duties rates security measures referred to in article 2 in full force against the import of goods that customs import notification document in question got the registration number of the Customs Office of the port of income from the date of the enactment of the regulation of the Minister of finance.

Article 7 1.  Regulation of the Minister of Finance began in force on the date of promulgation.
2. Regulation of the Minister of finance is valid for 3 (three) years counted from the date of entry into force of this regulation of the Minister of finance referred to in number 1.

In order to make everyone aware of it, ordered the enactment of these Regulations the Minister of finance with its placement in the news of the Republic of Indonesia.
