Back NEWS REPUBLIC of INDONESIA No. 112, 2011 REGULATIONS the MINISTER of FINANCE of the REPUBLIC of INDONESIA NUMBER 33/PMK.07/2011 ABOUT the ALLOCATION of TEMPORARY FUNDS for EXCISE TOBACCO RESULTS RESULTS FISCAL YEAR 2011 with the GRACE of GOD ALMIGHTY the MINISTER of FINANCE of the REPUBLIC of INDONESIA, Considering: a. that based on Act No. 10 of 2010 about the budget of the State Expenditures and revenues of the fiscal year 2011, has allocated funds for Excise Tobacco Results Results fiscal year 2011;
b. that under section 66A paragraph (4) Act No. 11 of 1995 about the tax as amended by Act No. 39 of 2007, the Division of funds for Excise Tobacco Results Results are arranged by the Governor, to provinces, districts, and cities is done with the approval of the Minister of finance;
c. that based on considerations as referred to in letter a and letter b, need to establish the regulation of the Minister of finance about the allocation of Temporary funds for Excise Tobacco Results Results fiscal year 2011;
Remember: 1. Act No. 11 of 1995 about customs (Gazette of the Republic of Indonesia Number 76 in 1995, an additional Sheet of the Republic Indonesia 3613) as amended by Act No. 39 of 2007 (State Gazette of the Republic of Indonesia Number 105 in 2007, an additional Sheet of the Republic Indonesia 4755);
2. Act No. 10 of 2010 about the budget revenue and Expenditure of the State fiscal year 2011 (State Gazette of the Republic of Indonesia Number 126 of 2010, an additional Sheet of the Republic of Indonesia Number 5167);
3. Presidential Decree Number 56/P in 2010;
4. Regulation of the Minister of finance Number 84/FMD. 07/2008 on the use of funds for Excise Tobacco Results Results and sanctions Over abuse of the allocation of funds for Excise Tobacco Results Results as amended by regulation of the Minister of finance Number 20/FMD. 07/2009;
4. Regulation of the Minister of finance Number 126/FMD. 07/2010 about implementation and accountability of budget transfers to the region;
Decide: define: REGULATION of the MINISTER of FINANCE ABOUT the ALLOCATION of TEMPORARY FUNDS for EXCISE TOBACCO RESULTS RESULTS of FISCAL YEAR 2011.
Article 1 (1) funds for Excise Tobacco Results Results, hereinafter abbreviated CHT DBH, is part of a budget Transfer to the area in the form of funds for the 2011 fiscal year Results.
(2) DBH CHT as referred to in paragraph (1) distributed to tax tobacco results-producing provinces and/or provincial tobacco producers.
Article 2 (1) DBH CHT for Year 2011 budget allocated is Rp RP 1.201.357.960.000 (one trillion two hundred one billion three hundred and fifty-seven million nine hundred sixty thousand rupiah).
(2) DBH CHT for the year 2011 budget as referred to in subsection (1) is 2% (two percent) of the receipt of the tax results of Tobacco referred to in Act No. 10 of 2010 about the budget of the State Expenditures and revenues of the fiscal year 2011.
(3) DBH CHT as referred to in subsection (1) is a temporary allocation for the provinces, regencies, and cities that the Division is in each region is set by the Governor in the area concerned.
(4) the provisional Allocations DBH CHT as mentioned on paragraph (3), shared with composition of 30% (thirty per cent) for the provinces, 40% (forty percent) to kabupaten/kota-producing area, and 30% (thirty per cent) for other district/city.
(5) the Division of the allocation while DBH CHT 2011 budget Year referred to in subsection (4) to the province, district, and the city is as listed in the annex which is an integral part of the regulation of the Minister of finance.
Article 3 (1) in the event that the Governor gave the Division allocations DBH CHT to the Minister of finance, then the allocation of DBH CHT set out in the regulation of the Minister of finance is an allocation of DBH CHT for provinces, regencies, and cities in the province concerned.
(2) the Governor who gave the Division allocations DBH CHT as referred to in subsection (1) includes the Governor of Aceh province, the Governor of West Sumatra Province, the Governor of South Sumatra Province, Governor of Banten Province, Governor of West Java province, the Governor of Central Java province, the Governor of Yogyakarta special region province, Governor of East Java, provincial Governor of Central Kalimantan, the Governor of South Sulawesi province, Governor of the province of Nusa Tenggara Barat , and the Governor of East Nusa Tenggara province.
(3) in the event that the Governor has not delivered the DBH allocation Division of CHT to the Minister of finance, then the allocation of DBH CHT set out in the regulation of the Minister of finance is an allocation of DBH CHT per province as a whole is not specified for the provinces, districts, and cities in the province concerned.
(4) the Governor who has not delivered a division of DBH CHT allocation as referred to in subsection (3) includes the Governor of North Sumatra Province, Governor of the province of Jambi, Riau Islands Province Governor, Governor of the province of Lampung, the Governor of DKI Jakarta, Bali provincial Governor, Governor of North Sulawesi province, and Governor of Central Sulawesi province.
(5) in the case of the Governor as referred to in paragraph (3) gave the Division allocations DBH CHT provincial, district, and city, all did not go beyond the fiscal year 2011, then against the regulation of the Minister of finance is going to do the change by adding the details of the allocation to the provinces, districts, and municipalities concerned.
Article 4 use of the DBH CHT for provinces, regencies, and cities carried out in accordance with the provisions of the legislation.

Article 5 (1) distribution of DBH CHT Budget Year 2011 held quarterly in accordance with the legislation.
(2) the distribution of DBH CHT as referred to in subsection (1) for the first quarter of 20% (twenty per cent), second quarter of 30% (thirty per cent) and the third quarter amounted to 30% (thirty percent) of the fixing of the DBH CHT as stipulated in article 2.
(3) distribution of DBH CHT as referred to in subsection (1) for the Fourth Quarter was as big as the difference between the determination of the definitive allocation of DBH CHT with the amount of funds that have been disbursed during the first quarter up to the third quarter based on DBH CHT designation referred to in article 2.
(4) Distribution as referred to in paragraph (2) was carried out to the provinces, regencies and cities in areas of the province in question as referred to in article 3 paragraph (2).
Article 6 of the regulation the Finance Ministers began in force on the date of promulgation.

In order to make everyone aware of it, ordered the enactment of these Regulations the Minister of finance with its placement in the news of the Republic of Indonesia.
