NATURAL DISASTER RELIEF IN SUMATRA

WITH THE GRACE OF THE ALMIGHTY GOD

FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,

Weigh: a. That in order for the management of the Restitution Fund, the Sumatra Natural Disaster Relief Fund can be implemented in accordance with the State Shopping and Shopping Budget mechanism, it has been assigned the Finance Minister's Regulation Number 173 /PMK.05/ 2010 on the Tata's Way of the Fund Management Relief in the Natural Disaster Relief Measures of Sumatra;
B. that the natural disaster relief activities in Sumatra which are financed with the Sumatra Natural disaster relief fund grant are expected to be unsettled until 31 December 2011 as set in the Minister's Ordinance. Finance Number 173 /PMK.05/ 2010 on the Tata Way of Assistance Fund Management in the Order of Natural Disaster Relief in Sumatra;
c. that in order for natural disaster relief activities in Sumatra may be resolved, it is necessary to adjust the time of implementation of the natural disaster relief activities in Sumatra as referred to in letter b by changing some provisions in Regulation of the Finance Minister Number 173 /PMK.05/ 2010 on the Tata Way of Assistance Fund Management in the Order of Natural Disaster Relief in Sumatra;
D. that under consideration as intended in the letter a, the letter b, and the letter c, need to establish the Finance Minister's Regulation on the Changes to the Regulation of the Minister of Finance Number 173 /PMK.05/ 2010 on the Order of the Assistance Fund Management in the The Disaster of the Natural Disaster In Sumatra;

Remembering: 1. Presidential Decree No. 56/P of 2010;
2. Finance Minister Regulation Number 173 /PMK.05/ 2010 on the Tata Way of Assistance Fund Management in the Framework For Natural Disaster Relief in Sumatra;

Pay attention to: National Security Council Regulation No. 12 of 2009 on Rehabilitation Action Plans and the reconstruction of the post-disaster disaster area in West Sumatra Province in 2009-2011 as amended by the National Governing Body ' s Rule of Disaster Number 7 Year 2011;

DECIDED:

Establish: REGULATION OF THE MINISTER OF FINANCE ON CHANGES TO THE REGULATION OF FINANCE MINISTER NUMBER 173 /PMK.05/ 2010 ABOUT THE GOVERNANCE OF THE MANAGEMENT OF AID FUNDS IN ORDER TO COUNTERMEASURE THE NATURAL DISASTER IN SUMATRA.

Section 1
Some of the provisions in Finance Minister Regulation Number 173 /PMK.05/ 2010 on the Tata Way Management Relief Fund in the Natural Disaster Relief Measures in Sumatra, are changed as follows:
1. The provisions of Article 5 are changed so that it reads as follows:

Section 5
(1) Hibah of the Natural Disaster Relief Fund of Sumatra as referred to in Article 4 as a source of funding for the activities of natural disaster relief in West Sumatra Province and Aceh Province.
(2) The Head of the BNPB corresponds to the task and function set as PA The Natural Disaster Relief Fund of Sumatra as referred to in paragraph (1).
(3) BNPB submitted a revision of the Ministry/Institute (RKAKL) Work and Budget Plan (RKAKL) and Revised Implementation of the Working Task Force (DIPA) of the Working Unit in order to accommodate funds and the implementation of natural disaster relief activities in Sumatra.
(4) Based on the Revision of the DIPA as referred to in paragraph (3), the General Treasurer of the Central Country is moving the funds in the Account of Disaster Relief Reception to the KUN Account.
(5) Natural disaster relief activities in Sumatra as referred to in paragraph (3) were completed in the Budget Year 2011.
2. The provisions of Article 6 are changed so that it reads as follows:

Section 6
(1) In terms of the events of natural disaster relief in Sumatra may not be resolved in the 2011 Budget Year as referred to in Article 5 of the paragraph (5), the completion of the intended activities may be continued in the 2012 Budget Year.
(2) In that case there is still residual funding in the DIPA as referred to in Article 5 of the paragraph (3) that is not realized until the end of the Budget Year 2011, the funds are referred to the government commitment which should be allocated from the Rest of the Budget (SAL) for disaster relief activities.
(3) Funding for the completion of advanced activities as referred to in paragraph (1) sourced from SAL as referred to in paragraph (2).
3. The provisions of Article 12 of the paragraph (1) are changed and added one new paragraph (3), paragraph (3), so that Article 12 reads as follows:

Section 12
(1) The deadline of financing the activities of natural disaster relief activities in Sumatra until the 31st December 2012.
(2) If up to the extent of the financing term as referred to in paragraph (1) there are still balances in DIPA and balances in the Disaster Relief Reception Account, such balances can be used for financing other disaster relief activities.
(3) The Saldo in DIPA and the balance in the Disaster Relief Reception Account which may be used for financing other disaster relief activities as referred to in paragraph (2), excluding the balance allocated for countermeasures activities Natural disaster in Aceh Province.

Section II
The rules of the Ministry of Finance are effective on the date of promulgations.
