CHANGES TO FINANCE MINISTER ' S REGULATION NUMBER
74 /PMK.010/ 2007 ABOUT THE STAGING OF
INSURANCE ON THE MOTOR VEHICLE INSURANCE VENTURE LINE
WITH THE GRACE OF THE ALMIGHTY GOD
FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,
Weigh: a. that in order to obtain the calculation of the reference premium rate, the cost and backup of the premium that is not an income related to the marketing of the insurance on the motor vehicle insurance venture line, need to fine-tune the risk profile report format and damages and other administrative and general costs data for motorized vehicle insurance venture lines as set forth in the Finance Minister Regulation No. 74 /PMK.010/ 2007 on the Hosting Of Insurance Coverage On The Line Motor Vehicle Insurance Efforts;
B. that under consideration as referred to in the letter a, it is necessary to establish the Minister of Finance Regulation on the Change of the Regulation of the Finance Minister Number 74 /PMK.010/ 2007 on the Hosting Of Insurance On The Business Line Motor Vehicle Insurance;
Given: 1. Law No. 2 of 1992 on the Perinsurance (Sheet Of State Of The Republic Of Indonesia In 1992 Number 13, Addition Of The Republic Of Indonesia State Sheet Number 3467);
2. Government Regulation No. 73 of 1992 on the Organizing Efforts of the Perinsurance (sheet of State of the Republic of Indonesia in 1992 No. 120, Additional Gazette of the Republic of Indonesia Number 3506) as has been the last several times amended with Government Regulation No. 81 of 2008 (State Gazette of the Republic of Indonesia 2008 No. 212, additional sheet of state of the Republic of Indonesia No. 4954);
3. Presidential Decree No. 56/P of 2010;
4. Finance Minister Regulation No. 74 /PMK.010/ 2007 on the Host of Insurance Liability On The Line Of Motor Vehicle Insurance Ventures;
DECIDED:
Establish: FINANCIAL MINISTER REGULATION ON THE CHANGES TO THE REGULATION OF FINANCE MINISTER NUMBER 74 /PMK.010/ 2007 ABOUT THE HOSTING OF INSURANCE COVERAGE ON THE MOTOR VEHICLE INSURANCE VENTURE LINE.
Section 1
Some of the provisions in Finance Minister Regulation No. 74 /PMK.010/ 2007 on the Host of Insurance Liability On The Motor Vehicle Insurance Venture Line, are changed as follows:
1. The provisions of Article 7 are changed so that it reads as follows:
Section 7
(1) General Insurance Company marketing of Motor Vehicle Insurance products each year is required to deliver risk and loss profile data reports and other administrative and public expenses data for the Motor Vehicle Insurance venture line which is presented based on the calendar year to the Minister.
(2) The report as referred to in paragraph (1) is mandatory at most slowly every 30 April.
(3) The report as referred to in paragraph (1) must be supplemented by:
a. an introductory letter signed by the board of the General Insurance Company which among others contains:
1) delivery of the risk profile data report and Motor Vehicle Insurance loss; and
2) the appointment of the employee in charge of providing information relating to the report of the risk profile data and the Motor Vehicle Insurance Loss is accompanied by phone number and e-mail;
B. the statement of directors and experts stating that the General Insurance Company has presented the data correctly;
c. Perdependents data;
D. claim data;
e. recapitulation of dependament data;
f. recapitulation data claim;
G. Premium analysis;
h. analysis of claims; and
i. underwriting surplus analysis.
(4) The report document as referred to in paragraph (3) must meet the provisions as follows:
a. documents as referred to in letters a and b are delivered in the form
hard copy;
B. document as referred to in the letter c and the letter d is delivered in a soft copy with the format databasefile (*.dbf);
c. documents referred to in letter e up to the letter i delivered in the form hard copy and soft copy with the spreadsheet format; and
D. The document as referred to in the letter c up to the letter i contains the risk and loss profile data and other administrative and cost data data for the previous 1 (one) calendar year.
(5) The format of the report as referred to in paragraph (3) is as set forth in this Annex of the Regulation of the Minister of Finance, which is an inseparable part of the Regulation of this Financial Minister.
(6) The report format as referred to in paragraph (5) may be reviewed and its changes are set forth by the Chairman of the Modal Market Supervising Board and the Financial Instituts.
2. The provisions of Section 8 are amended so that it reads as follows:
Section 8
In the 2011 delivery of the report, the General Insurance Company is required to report on risk and loss profile data as well as administrative and other general costs data for the Vehicle Insurance business line, as referred to in Section 7 of the paragraph. (1), for the calendar year 2009 and 2010.
3. Annex 2 of the Financial Minister Regulation No. 74 /PMK.010/ 2007 on the Hosting Of Insurance on the Line of Motor Vehicle Insurance Act is amended so as to be as set forth in this Financial Minister Regulation Attachment, which is an inseparable part of the Regulation of this Finance Minister.
Section II
The Finance Minister ' s regulation comes into effect on the date of the promulctest.
