9. Mining is part of the activities of Mining Effort to produce minerals and/or coal and its following minerals.

10. Processing and Purity is the activities of Mining Effort to improve the mineral and/or coal quality and to utilize and acquire the following minerals.

11. Transport is the activities of the Mining Company to remove the minerals and/or coal from the mining area and/or place of Processing and Purity until the handover place.

12. Pascatverge is a planned, systematic and ongoing activity after the end of some or all of the activities of the Mining Effort to restore the functioning of the natural environment and social function according to local conditions throughout the mining area.

17. The Registered letter, which is subsequently called SKT, is a registered sign letter given to the Non-Core Mining Services Business Company which conducts activities continuously at the site of the mine.

18. Classification is the class of the Mining Services Business Group based on the category of consultants, planners, executors and equipment testing.

19. Qualifying is a Mining Services group based on the company's financial capability level.

20. The entity is any legal entity that moves in the field of mining established under Indonesian law and is based in the territory of the Republic of Indonesia.

21. The Local Mining Services Company is an Indonesian legal services company, which is established in the district/city or province, whose entire capital is from within the country and is largely derived from the local law. County/town or local province, as well as operate within the county/city or province in question.

22. The National Mining Services Company is an established corporation and Indonesian legal entity whose entire capital comes from within the country and operates in the territory of the Republic of Indonesia or outside of the Republic of Indonesia.

23. Another Mining Services company is a service company established in Indonesia or an Indonesian legal entity that is partially owned by a foreign party in accordance with the provisions of the laws.

24. lzin Mining Effort, which is next called IUP, is the permission to carry out mining efforts.

25. lzin The Special Mining Effort, which is then called IUPK, is the permission to carry out mining efforts in the special mining business permit area.

26. The Minister is the Minister who organizes government affairs in the fields of mineral and coal mining.

27. The Director-General is the General Director whose field of duty and responsibility covers the mineral and coal mining activities.

2. The provisions of paragraph (3) and paragraph (4) of Section 4 are amended and added 1 (one) the paragraph (1) of paragraph (5), the following reads as follows:

Section 4

(1) The Mining Service Entrepreneurship is grouped over:

a. Mining Services; and

b. Non-Core Mining Services.

(2) The type of Mining Service Effort as referred to in paragraph (1) of the letter a includes:

a. consulting, planning, execution and testing of equipment in the field:

1. General Inquiry;

2. Exploration;

3. Feasibility study;

4. Construction Of The Mining;

5. Transport;

6. Environment Mining;

7. Pascatverge and Reclamation; and/or

8. Safety and Occupation Health.

b. consulting, planning, and testing of equipment in the field:

1. mining; or

2. processing and refining.

(3) The field of Mining Services as referred to in paragraph (2) consists of subfields as set forth in Annex I A which is an inseparable part of the Regulation of this Minister.

(4) The field of Non-Core Mining Services as referred to in paragraph (1) letter b is as set forth in Appendix I B which is an inseparable part of this Minister Regulation.

(5) Changes in the field and Subfields, subfields, Mining Services and Non-Core Mining Services Business. as referred to in paragraph (3) and paragraph (4) is set forth by the Director General.

3. The provisions of paragraph (4) of Section 5 are amended, so it reads as follows:

Article 5

(1) The IUP holder or IUPK in performing its business activities can use the Mining Services after the work plan of its activities gets the consent of the Minister, governor, or regent/mayor in accordance with its authority.

(2) The IUP or IUPK as referred to in paragraph (1) is required to use the Local Mining Services Company and/or National Mining Services Company.

(3) In the event there are no Local Mining Services Companies and/or Services Companies National Mining as referred to in paragraph (2), IUP or IUPK holders may use the Other Mining Services Company.

(4) The IUP or IUPK can use the Other Mining Services as referred to in the paragraph (3), if after making an announcement to local and/or national mass media, there is no Local Mining Services Company and/or National Mining Services Company that meets the classification and qualifications required by IUP or IUPK.

(5) In terms of the Other Mining Services Corporation obtaining a job in the field of Mining Services as referred to in paragraph (4), Other Mining Services Corporation must provide a portion of the work that is acquired to the Services Company Local mining as a subcontractor corresponds to its competitors.

(6) The IUP Holder or IUPK in using the Other Mining Services Companies as referred to in verse (4) is required to apply the asas of pateness, transparent and pertinness.

h. implement the Occupational Safety and Health provisions in accordance with the provisions of the laws of law;

12. The provisions of paragraph (3) and paragraph (4) of Section 24 are amended, so it reads as follows:

Section 24

(1) The order of the compiling of the report as referred to in Section 23 of the letter j is a report of the execution of activities:

a. quarterly; and

b. annual.

(2) The quarterly and annual reports as referred to in paragraph (1) include:

a. investment;

b. contract value;

c. contract realization;

d. The contract provider;

e. workforce;

f. equipment (masterlist);

g. State acceptance;

h. region acceptance;

i. local, national and/or import shopper; and

d. Community development (community development).

(3) The form and layout of the quarterly report and the annual IUJP are compiled based on the format as set forth in Annex IV A and Annex IV B which is an inseparable part of the Regulation of this Minister.

(4) Forms and tata the way the quarterly and annual SKT reports are compiled based on the format as set forth in Annex IV C which is an inseparable part of the Regulation of this Minister.

13. The provisions of paragraph (1) of the letter b Section 31 are amended and added 1 (one) letter, i.e. the letter e, so that it reads as follows:

Article 31

(1) Minister, governor, or regent/mayor in accordance with his authority may provide sanctions administrative to IUJP or SKT holders who commit the offence as follows:

a. carrying out activities is not compatible with IUJP or SKT; or

b. not to submit reports of execution of quarterly and/or annual activities in the slowest 30 (thirty) business days after the end of the period of 3 (three) times respectively;

c. does not carry out the obligations as referred to in Article 23 up to Article 26;

d. provides data that is not true or falsifying documents; or

e. move forward IUJP or SKTnya to the other party.

(2) administrative sanctions as referred to in paragraph (1) are:

a. written warning;

b. a temporary termination of activities over some or all areas of mining services; or

c. or the revocation of IUJP or SKT.
