REGULATIONS OF THE FOREIGN MINISTER OF THE REPUBLIC OF INDONESIA

HOME RENT ALLOWANCEHOME STAFF REPRESENTATIVE OF THE REPUBLIC OF INDONESIA

WITH THE GRACE OF THE ALMIGHTY GOD

FOREIGN MINISTER OF THE REPUBLIC OF INDONESIA,

Weigh: a. that to obtain a suitable and representative place in supporting the vision and mission of the Representative of the Republic of Indonesia, it needs to be granted the Home Staff ' s Rent Rent Allowance Representative of the Republic of Indonesia;
B. that with the release of the Director General of the Ministry of Finance the number S-3073/AG/2011, it needs to be done adjusting the Home Staff ' s Rent Allowance to Representative of the Republic of Indonesia;
c. that under consideration as referred to in the letter a and the letter b, need to establish the Minister of Foreign Affairs on the Home Staff ' s Home Staff of the Representative of the Republic of Indonesia;

Given: 1. Law Number 37 Year 1999 on Foreign Relations (Sheet State Republic Of Indonesia In 1999 Number 156, Additional Sheet Of State Republic Of Indonesia Number 3882);
2. Act Number 17 Year 2003 on State Finance (Sheet State Republic Of Indonesia In 2003 Number 47, Additional Sheet Of State Republic Of Indonesia Number 4286);
3. Act Number 1 Of 2004 On State Treasury (Sheet State Of The Republic Of Indonesia In 2004 Number 5, Addition Of State Sheet Republic Of Indonesia Number 4355);
4. Decree of President No. 108 of 2003 on the Organization of Representatives of the Republic of Indonesia Abroad;
5. Presidential Decree No. 42 of 2002 on the Guidelines for the Implementation of the State Budget and Shopping Budget as it has been several times amended last with the Presidential Regulation No. 53 of 2010;
6. Decree of Foreign Minister Number SK. 06/A/OT/VI/2004/01 of 2004 on the Organization and Tata Works of the Republic of Indonesia in Foreign Affairs as amended by the Regulation of the Foreign Minister Number 05 Year 2011;
7. Foreign Minister Regulation No. 04 of 2009 on Officials of Diplomatic Foreign Service and Consular;
8. Finance Minister Regulation Number 93 /PMK.02/ 2011 Year 2011 on the Drafting Guidelines and the Willingness To Plan Work And Budget Of The Ministry Of State/Lemes;

DECIDED:

SET: THE FOREIGN MINISTER ' S REGULATION ON HOUSE RENT ALLOWANCE HOME STAFF REPRESENTATIVE OF THE REPUBLIC OF INDONESIA.

Section 1
(1) Home rent allowances are provided to home staff which is in charge of Representative of the Republic of Indonesia abroad.
(2) Home staff as referred to in verse (1) is the acting element and the supporting element in the Indonesian Representative of the Republic of Indonesia.
(3) The acting element as referred to in paragraph (2) consists of the Diplomatic Officer of Consular, Technical Atase and Technical Staff.
(4) The supporting element as referred to in paragraph (2) consists of the Communications Officer, and the Bendaharawan and Directors Representative (BPKRT) and/or to the staff of the other Foreign Ministry in charge of the Indonesian Representative Foreign Affairs. On the basis of the Foreign Secretary's Decree.

Section 2
(1) Home-staff allowance for home staff is given a maximum of 25% of the Foreign Livelihood Benefits.
(2) For certain submissions, the Home Rent Allowance is given a maximum of 40% of the Foreign Livelihood Allowance.
(3) The benefits of the Foreign Affairs referred to in verse (1) and paragraph (2) are the underlying allowance plus the allowance of the wife/husband and child support.
(4) Certain representatives as referred to in paragraph (2) are contained in an Attachment that is an inseparable part of this Regulation.

Section 3
(1) The payment of the Home rent allowance is paid in the corresponding currency listed in the rental contract.
(2) In the case of the payment of the Household Lease Allowance, then the External User's Allowance Allowance for establishing the maximum limit on the rental of the Home Rent is referred to in Section 2 of the paragraph (1) and (2) above, done by using the kurs on a walking month.

Section 4
(1) In terms of lower house rental fees than the maximum limit of the home rent allowance, the home rental allowance is paid as much as the rent of the house as stated in the rental contract.
(2) In terms of the cost of a house rent higher than the maximum limit of the House Rent Allowance, The Home Rent Allowance is paid only as much as the maximum limit of which it is entitled.

Section 5
(1) The home to be leased by home staff is required to obtain approval first from the Chief Representative.
(2) In giving the consent as referred to in paragraph (1), the Chief Representative of the Republic of Indonesia is obliged to conduct an assessment of the home eligibility that will be rented by home staff and the lease contract.
(3) The approval of the Chief Representative is given in the form of a Chief Representative Decision on the Giving of Home Rent Allowance.

Section 6
(1) In terms of the Representative having other buildings which can function as a residence, the Chief Representative can determine the utilization of the building as a residence for home staff.
(2) The utilization arrangement of the residence as referred to in paragraph (1) is specified with the Decree of the Chief Representative.
(3) Home staffwhich occupies the building as referred to in paragraph (1) is not subject to a lease of rent.

Section 7
(1) At the time this Regulation is in effect, all the provisions set about the Home staff ' s Rent Allowance are revoked and declared to be not applicable.
(2) This Regulation shall begin to apply to the date of promulgance.
