16. The Project Setup document is a document prepared by the PJPK that its inclusion is executed on the preparation phase of the Cooperation Project.

17. The Eligibility document is a document that is prepared by the PJPK that is executed on the transaction phase of the Cooperation Project or by the Proventable Candidate at the approval stage of the Cooperation Project's initiative on the initiative of the Entity in order to meets one of the requirements to obtain a Approval Letter to perform the Eligibility Study of PJPK.

18. The head of the county is the governor of the province or the regent for the county or mayor for the city area.

19. The Minister/Head of the Institution is the head of the Ministry/Instituts whose scope, duties and responsibilities include the type of infrastructure set out in the Regulation of this Minister.

20. The Ministry/Institute is the state ministry/non-ministerial government agency of the state.

21. The National Development Planning Minister/Head of the National Development Planning Agency, subsequently called the Minister of Planning, is the minister who organizes government affairs in the field of national development planning.

22. The Minister of Finance is the minister who organizes government affairs in the field of finance and wealth of the country.

23. Government support is a fiscal or non fiscal contribution provided by the Minister/Head of the Regional and/or Minister of Finance pursuant to each authority under the laws in order to improve Financial feasibility of Project Cooperation.

24. Government guarantees are financial compensation and/or compensation in other forms provided by the Finance Minister to the Entity through a risk-sharing scheme for the Cooperation Project.

Article 2 of the Minister ' s Regulation is intended to:

a. be a guideline for the Planning Minister to compile a List of Infrastructure Project Plans; and

b. To be a guideline for the Minister/Head of the Agency/Regional Head in order to present the proposal of the Cooperation Project Plan.

CHAPTER II OF THE INFRASTRUCTURE PROJECT PLAN

Article 3 (1) The Planning Minister is compiling and setting a Plan List

Infrastructure Project based on the readiness of the Cooperation Project at each stage execution of the Cooperation Project.

(2) The Infrastructure Project Plan as referred to in paragraph (1) is a list of Cooperation Projects conducted through the Cooperation Agreement.

(3) The Project of Infrastructure Project Plans as of referred to in paragraph (2) consists of: a. Project of Potential Cooperation; b. Prospective Cooperation Projects; and c. Cooperation Projects Are Ready To Offer.

Section 4 (1) The Project Infrastructure Plan List as referred to in

Article 3 of the paragraph (1) is compiled annually by following the process of drafting the Government Work Plan.

(2) The Plan List The Infrastructure Project is published to all stakeholders.

Article 5

The type of infrastructure contained in the Joint Venture Project List is made up: a. Transportation infrastructure, including service delivery services,

provisioning and/or services services to the port, utility and rail infrastructure;

b. Road infrastructure, covering toll roads and toll bridges; c. watering infrastructure, covering the default waterbearer channel; d. Drinking water infrastructure that includes water retrieval buildings

e. Sanitation infrastructure that includes waste water processing installations, major network and network collectors, and the means of outpouring that includes the carrier and the dump;

g. The infrastructure of composure, including the plant, includes the development of electric power derived from geothermal, transmission or distribution of electrical power; and

h. Petroleum and petroleum infrastructure, covering the transmission and/or distribution of petroleum and gas.

CHAPTER III OF THE WAY OF THE PROPOSED LIST AND THE DRAFTING OF THE PLAN

INFRASTRUCTURE PROJECT

PROPOSAL OF THE PLAN

SECTION 6 (1) Minister of Planning to deliver a letter to the Minister/Head

Institut/Head of the Regions to address the proposed Cooperation Project Plan that will be listed in the Infrastructure Project Plan List.

(2) Based on the letter as referred to the paragraph (1), the Minister/Head of the Institution/Regional Chief delivered the proposal Cooperation Project Plan to be listed in the Infrastructure Project Plan List to the Minister of Planning.

(3) The proposed Cooperation Project Plan as referred to in paragraph (2) is accompanied by a statement regarding the work unit on Ministry/Institute or work unit on the Local Government that will be responsible for the planning, preparation and transaction of the Cooperation Project.

The Second Part of the Documents

Section 7 (1) Proposed Project Plan Cooperation as referred to in

Section 6 of the paragraph (2) is provided with the document supporters.

(2) The supporting documents for the proposal of the Potential Cooperation Project consist of:

a. Preliminary study documents; and b. Summary Sheet of the Preliminary Study Document.

(3) The supporting documents for the proposed Prospective Cooperation Project consist of: a. Cooperation of the Project of Cooperation; and b. Summary Sheet of the Cooperation Project Setup Document.

(4) Supporting documents for the proposed Cooperation Project are offered consisting of:

a. The eligibility for the Cloud Service is not available in the Cloud Service. Summary Sheet of the Prastudi Document; and c. The Government Support principle approval statement letter

and/or Government Warranty when necessary. (5) Supporting documents as referred to in paragraph (2), (3) and

(4) refer to the Minister Regulation on the General Guide of Government Cooperation with the entity in the provisioning of the Infrastructure.

Article 8 (1) of the Broadcast Document Cooperation Projects as referred to in

Section 7 of the paragraph (3) of the letter a covering the Preliminary Study of the feasibility and the Study of Readiness.

(2) The applicability of the project cooperation as referred to in Article 7 of the paragraph (4) of the letter a Includes the IBrospective Cooperation Project Plan is a Cooperation Project Plan that has met the requirements as a Prospective Cooperation Project in accordance with the criteria set out in this Ministerial Regulation.

13. The Plan of Jointly Offered Cooperation Project is a Cooperation Project Plan which has met the requirements for auction in accordance with the criteria set out in this Ministerial Regulation.

14. Candidate for Pemrakarsa is a limited liability business entity, State-owned Enterprises (BUMN), the Regional Governing Body (BUMD), the Foreign Law Agency, and the cooperative that proposes an initiative of the Cooperation Project to the Government or Government. Area.

be used; e. have performed an identification of the Government Support needs and

Government Guarantee, when necessary; and f. have performed an identification of the land procurement needs.

Article 11

The proposed Cooperation Project Plan as a Joint Cooperation Project Offered as referred to in Article 7 of the paragraph (4) must meet the criteria: a. obtaining the consent of the PJPK for the Project Co-operation

initiative and agreement of the stakeholders over the Cooperation Project;

b. obtaining certainty about the readiness of the Cooperation Project, technical suitability, market interest, and the form of cooperation shape;

c. has completed the analysis document regarding environmental impact; d. have compiled a detailed design specification of the output; e. It has been compiled by the tariff structure; f. have done a financial model analysis, risk allocation and mitigation

as well as the Government Support and/or Support giving mechanism when necessary;

g. have been drafted by the Business Agency for the following:

1) the potential for the interest of the Agency in the Cooperation Project; 2) the plan or schedule of procurement implementation; and 3) the existence and readiness of the procurement committee.

h. has been drafted into the Agreement. Section 12

(1) The Planning Minister performs assessment of the proposed Cooperation Project Plan based on criteria as referred to in Article 9, Section 10 and Section 11.

(2) Based on the results of the assessment as referred to in paragraph (1), the Planning Minister compiled a List of Infrastructure Project Plans.

Fourth Quarter Term PPlanned tuman

Section 13 (1) Term of the inclusion of a Cooperation Project as a Plan

A Potential Cooperation Project in the 2nd most Infrastructure Project Plan List (two) years.

(2) If in the timeframe as referred to in paragraph (1), the Potential Cooperation Project Plan may not be improved to be a Prospective or Ready-to-Offer Project Plan, then the Cooperation Project is deleted from the list of potential Cooperation Project Plans.

Article 14

(1) Term The inclusion of a Cooperation Project as a Prospective Cooperation Project Plan on the list of the most durable Infrastructure Project Plan 3 (three) years.

(2) If in the timeframe as referred to in paragraph (1), the Cooperation Project Plan Prospective can not be upgraded to be a Ready-to-Be-Offered Cooperation Project Plan, then the Cooperation Project is removed from the Prospective Cooperation Project Plan.

(3) The provisions of the deletion as referred to in paragraph (2) do not apply, in the event of a change to the scope of the Prospective Cooperation Project plan That.

BAB IV

PROPOSAL OF A JOINT VENTURE PROJECT PLAN

CHAPTER V MONITORING THE DEVELOPMENT OF COOPERATION PROJECT THAT

LISTED IN THE LIST OF INFRASTRUCTURE PROJECTS Section 17

(1) The Minister of Planning conducted monitoring the development of the progress status of the Project Plan The cooperation set forth in the Infrastructure Project Plan List.

(2) The Minister/Head of the Institute/Head of the Regions delivered information on the development of the Cooperation Project Plan to the Minister of Planning.

(3) The results of the status assessment the progress of the Cooperation Project as referred to in paragraph (1) delivered to Minister/Regional Head/Head to use as input for the drafting of work and budgeting plans in order to increase the status of the Cooperation Project and/or a new proposal of the Cooperation Project.

BAB VI

PROVISIONS OF THE TRANSITION OF ARTICLES 18

At the time the Ordinance of the Minister came into force: 1. The projects listed in the Project Plan List

The Government and Private Cooperation Infrastructure which are set before the Order of the Minister, remain in effect.

2. A list of Government and Private Cooperation Infrastructure Project Plans as referred to in paragraph (1) must be adjusted to the Ordinance of this Minister the slowest 1 (one) year since the Minister's Ordinance is promulred.

BAB VII

CLOSING provisions

Article 19 At the time the Minister 's Ordinance came into effect, then the National Development Planning Minister' s Regulation/Head of the National Development Planning Board Number 3 of 2009 on the Tata How Drafting Lists The Plan of the Government Cooperation Project with the Entity in Infrastructure Services is repealed and declared not applicable.
