THE REGULATION OF THE REPUBLIC OF INDONESIA ' S INTERIOR MINISTER 67 YEARS 2012

ON THE GUIDELINES OF THE CONDUCT OF THE STRATEGIC ENVIRONMENTAL STUDY

IN THE DRAFTING OR EVALUATION OF THE REGIONAL DEVELOPMENT PLAN

WITH THE GRACE OF GOD ALMIGHTY IN THE COUNTRY OF REPUBLIC OF INDONESIA,

DRAWS: A. that in Article 15 of the Law No. 32 Year 2009 on the Protection and Management of the Environment requires the local government to carry out strategic environmental studies in the drafting or evaluation of the Long-Term Development Plan Areas, Regional Mid-Term Development Plans, and policies, plans, and/or programs that potentially pose an impact and/or environmental risk of life;

b. that based on consideration as referred to in the letter a, it needs to establish the Regulation of the Minister of the Interior of the Republic of Indonesia on the Implementation Guidelines Of The Strategic Environment In Drafting or Evaluation Of The Regional Development Plan;

CHAPTER I OF THE GENERAL PROVISIONS

Article 1 In this Ministerial Regulation, referred to: 1. The subsequent Strategic Environment Studies abbreviated KLHS

is a series of systematic analysis, thorough and participatory to ensure that sustainable development rules have become the basis and integrated in the building of a region and/or policy, plan, and or program.

2. The implementation of KLHS in the drafting or evaluation of the Regional Development Plan is the process of making and executing KLHS performed on the drafting or at the time of the evaluation of the Regional Long Term Development Plan; the Mid-Term Development Plan Areas; and/or policies, plans, and or programs that potentially pose an impact and/or environmental risk that is contained in the Regional Device Workspace Strategic Plan;

3. The Regional Long-Term Development Plan, which is next abbreviated as RPJPD, is an area planning document for a period of 20 (twenty) years.

4. The Regional Long-Term Development Plan, which is next abbreviated as RPJMD, is an area planning document for a period of 5 (five) years.

5. Renstra SKPD Strategic Plan for the Strategic Task Force is a SKPD document for a period of 5 (five) years.

6. The next unit of unit work, abbreviated as SKPD, is a regional device in the provinces of the province and district/city.

7. The next Environmental Control Working Group is abbreviated as Pokja PL as part of the RPJPD and/or RPJMD compilers.

8. Sustainable development is an attempt to ensure the integrity of the environment and the safety, ability, welfare, and quality of human life, in a way: (a) utilizing a biological resource not exceeding its regenerative capabilities, and or leverage non-biological resources that do not exceed the rate of its substitable innovation; (b) leverage current natural resources at the expense of the needs of future generations; and (c) leverage the unknown resources. its impact is carefully and supported by adequate scientific research.

9. The principles of sustainable development are principles that must be applied in planning, execution and control of development to achieve the natural conditions of living environment and safety, ability, welfare and quality of life Human beings, including at least the principle of interdependence, principles of balance, and principles of justice.

10. Interdependence is interregional interdependence, between sectors, between stakeholders and the interunity of ecosystems.

11. Balance is a proportional alignment between the economic interests, socio-cultural and environmental interests.

12. Justice is equality proportionally in accepting the benefits of development between generations and the intergroup of communities in the area.

13. The living environment is the unity of space with all things, power, circumstances, and living things, including humans and their behavior, which affect nature itself, the survival, and the well-being of humans as well as other living beings.

14. The protection and management of the environment is a systematic and integrated effort undertaken to preserve the functioning of the environment and prevent the occurrence of pollution and/or environmental damage that includes planning, utilization, and protection of the environment. control, maintenance, surveillance, and law enforcement.

15. Stakeholders are individuals and representatives of community groups, institution/institutions that affect and/or be affected by RPJPD, RPJMD and Renstra SKPD, which include government elements, non-governmental organizations, colleges, the world effort, and society.

16. Pre-covering is the process of using a long list of issues-a continuous development issue consisting of social/cultural, economic, and environmental issues.

17. Covering the long list of sustainable development issues to be shortlisted by using strategic criteria and sustainable development.

18. Baseline data is an early condition of ongoing development issues at a period of RPJPD and RPJMD.

19. Mitigation/Adaptation is a series of attempts to reduce the negative impact and/or risk the implementation of development programs.

Section 2 (1) Governor and Regent/Mayor must carry out KLHS in

drafting of RPJPD, RPJMD, and Renstra SKPD which could potentially result in impact and/or environmental risks.

(2) In carrying out KLHS in the drafting of RPJPD and RPJMD as referred to in paragraph (1), Governor and Regent/Mayor can delegate its implementation to SKPD that is drugging the area building planning affairs.

(3) In implementing KLHS in the drafting of Renstra SKPD as referred to in paragraph (1), Governor and The regent/Mayor delegated its implementation to the head of the SKPD in question.

Article 3 of the KLHS implementation objective:

a. ensuring that sustainable development principles have become a basis and integrated in the drafting of RPJPD, RPJMD and Renstra SKPD: and

b. improving the quality of RPJPD, RPJMD and Renstra SKPD as a protection and managing environment management effort.

CHAPTER II OF EXECUTION OF KLHS

Section 5 (1) The focus of the objective requires that the implementation process

study is consistent with the agreed needs and objectives.

The Second Section of the Mechanism

Article 6 of KLHS is carried out with the mechanism: a. The study of policy influence, plan, and/or program against

environment conditions in a region; b. Alternative formulation of policy improvements, plans, and/or

programs; and

c. Recommendations for improvement for policy decision making, plan, and/or programs that integrate sustainable development principles.

Paragraph 1 Review

Article 7 The mechanism of study influence, plan, and/or program on environmental conditions in a region as referred to in Article 6 letters a is performed through phase: a. Making Preparations, B. -Covering the covers, and c. Compiling Baseline Data.

Section 8

The Preparatory Phase as referred to in Article 7 of the letter includes: a. form Pokja PL; b. Compiling a KLHS Working Base Framework; and c. perform pre-covered.

Article 9 (1) The Governor and Regent/Mayor form Pokja PL as

(3) The membership of Pokja PL as referred to in paragraph (1) consists of:

Speaker: the leadership of the SKPD who is aiming for environmental affairs

Member: SKPD related to the subject matter building area

Article 11 (1) Pokja PL compiles a KLHS work reference framework as

referred to in Article 8 of the letter b. (2) The work reference framework as referred to in paragraph (1)

is a work guideline for Pokja PL in the implementation plan of KLHS in the drafting of RPJPD and RPJMD since the analysis phase of the general overview of the area conditions up to the drafting The final design of the RPJPD and the RPJMD.

(3) The work reference framework as referred to in paragraph (1) consists of: a. Background. B. Destination and Target. C. Scope of Activities. D. Expected results. e. Work plan and method of study. f. Narasumber/Academic needs are required to help

Pokja PL in conducting analysis. G. Time and Financing.

Article 12 (1) Pokja PL performs pre-enclament as intended

in Article 8 of the letter c. (2) The Pra enclament as referred to in paragraph (1) includes

activities: a. identifying environmental issues, socio-cultural issues, and issues-

economic issues, through the internal discussion of Pokja PL; b. collecting data and information related to issues

as letter a, such as the general image of regional conditions, the results of study, and existing publications;

c. identify the type and source of the data that is still necessary but not yet available; and

d. Inventory of stakeholders will be included in the implementation of the KLHS in accordance with a long list of development issues.

Article 13 (1) Preaching as referred to in Article 12

Article 14

Article 18 (1) Pokja PL performs the study of connectedness, balance and

justice in the RPJPD and RPJMD design. (2) Pokja PL performs an influence study indication of priority program

in RPJMD design.

Article 19 (1) The presentation of the connection as referred to in Article 18 includes:

a. Interconnecte; b. Interconnectedness between time; c. interconnectivity between sectors; d. connectedness between stakeholders.

(2) The presentation of the balance as referred to in Article 18 includes the balance between economic interests, cultural social, environmental life.

(3) The presentation of justice as referred to in Article 18 covers: a. justice between community groups; b. intergenerational justice.

Second paragraph Alternative Perumusan

Article 20 (1) Pokja PL performs an alternative formulation of the policy refinement,

plan, and/or program as referred to in Article 6 of the letter b.

(2) The alternative formulation of the refinement of policies, plans, and/or programs as referred to in paragraph (1) is performed through the identification stage of mitigation/adaptation measures, and/or alternatives.

(3) Identification of the measures mitigation/adaptation, and/or alternative done based on the results of the study as referred to in Article 18.

(4) Pokja PL convex the alternative formula as referred to in paragraph (3) to the RPJPD and RPJMD compilers.

(5) Alternative formulas as referred to in paragraph (4) are inexalted with strategic issues as referred to in Article 16.

Paragraph 3 Of The Fix Recommendation

Article 21 (1) Pokja PL formulating a KLHS recommendation as referred to

in Article 6 of the letter c. (2) The formulation of the recommendation as referred to in paragraph (1)

is done based on the results of the mitigation/adaptation formulation, and/or alternatively as in Article 20 of the paragraph (4).

CHAPTER III KLHS IN DRAFTING RPJPD

Article 22 (1) Pokja PL performs the study as referred to in Article 7. (2) The study as referred to in paragraph (1) is conducted against

the description of the vision and mission of the region as well as the principal objective and direction of the area's long-term development policy.

Article 23 (1) Pokja PL performs alternative formulation of the vision description and area missions

as well as the principal objective and direction of the regional long-term development policy.

(2) The alternative formulation of the vision and area mission as well as the principal objective and direction of the long-term development policy of the area as intended in verse (1) performed through the identification stage of the mitigation/adaptation measures, and/or alternatively.

(3) Identification of mitigation/adaptation measures, and/or alternatives done based on the results of the study of connection, balance, justice as referred to in Article 19.

(4) Pokja PL convex alternative formulas as referred to in verse (3) to the RPJPD Compiler Team.

(5) Alternative formulas as referred to in paragraph (4) are inexalted with strategic issues as referred to in Article 16.

Article 24 (1) Pokja PL formulating a KLHS recommendation based on the formulation

mitigation/adaptation, and/or alternatives as referred to in Section 23.

(2) The recommendation as referred to in paragraph (1) is the recommendation of the refinement of the definition of vision and the mission of the region and the subject matter and direction of the area's long-term development plan.

(3) Recommendations as referred to in paragraph (2) are used by the RPJPD Comcompiler Team as a material in carrying out a public consultation forum.

Article 25 (1) Pokja PL accompanying the RPJPD Syncing Team aligning vision, the mission

and the direction of the RPJPD policy based on the results of the public consultation as referred to in Article 24 of the paragraph (3).

(2) The results of the alignment of vision, the mission and the direction of the policy as referred to in paragraph (1) are used by the RPJPD Compiler Team for the initial design formulation of the RPJPD.

CHAPTER IV KLHS IN DRAFTING RPJMD

Article 26 (1) Pokja PL performs the study as referred to in Article 7. (2) The study referred to in paragraph (1) is conducted against

description of vision and mission, goals and objectives, policy direction and direction, general policy and area medium-term development programs.

Article 27 (1) Pokja PL performs an alternative formulation of vision and mission descriptions, objectives

and objectives, policy and policy direction, general policy and regional medium-term development programs.

(2) Alternative formulation of vision and mission description, objectives and objectives, strategy and Policy direction, general policy and area medium-term development programs as referred to the paragraph (1) is performed through the identification stages of the mitigation/adaptation, and/or alternative measures.

Article 28 (1) Pokja PL formulating KLHS recommendations based on the results of the formula

mitigation/adaptation, and/or alternatives as referred to in Article 27.

(2) The recommendation as referred to in paragraph (1) is a recommendation of the refinement of vision and mission formulas, objectives and objectives, policies and direction of policy, general policy and regional medium-term development programs.

(3) The recommendation as referred to in paragraph (2) is used by the RPJMD Comcompiler Team as a material in carrying out a public consultation forum.

as referred to in Article 30 of the strategic issue as referred to in Article 16.

(2) The presentation of the influence as referred to in paragraph (1) is performed with: a. selecting a priority program associated with a strategic issue. B. review the influence of each priority program on the letter a

Article 34

(1) Pokja PL formulating a KLHS recommendation based on the formulation of the mitigation/adaptation and/or alternative measures as referred to in Article 33.

BAB V

KLHS IN DRAFTING STRATEGIC PLAN Article 36

(1) The Governor and Regent/Mayor assigned the Renstra SKPD compiler team to carry out KLHS in the drafting of the Renstra SKPD draft that could potentially inflict the impact and/or environmental risks of life.

(2) The Renstra SKPD Design that potentially poses the impact and/or risk of a living environment as referred to the paragraph (1) is set on the basis of the KLHS RPJMD recommendation as referred to in Article 34 of 2 letters b.

Article 37 (1) The Renstra SKPD compiler team performs an influence study

program plans on the relevant RPJMD strategic issue.

(2) The program plan as referred to in paragraph (1) is the recommendation of the KLHS RPJMD process as referred to in Article 34 of the paragraph (2) letter b.

Article 38 The presentation of influence as referred to in Article 37 results in a description describing the influence of the SKPD program plan on the strategic issue of RPJMD.

Article 39 The Renstra SKPD compiler Team formulating mitigation/adaptation measures and/or alternatives based on description of the influence of the SKPD program plan with the strategic issue of RPJMD as an attempt minimizes the potential impact to the environment expected to appear.

Section 40 (1) of the Renstra SKPD compiler team formulating a KLHS recommendation

based on the formulation of the mitigation/adaptation and/or alternative measures as referred to in Article 39.

(2) The recommendation as referred to in paragraph (1) is a summary of the mitigation/adaptation measures And/or an alternative to the SKPD program plan.

Section 41 of the Renstra SKPD compiler team performs a consummation of the program plan and funding needs based on the recommendation as referred to in Article 40 of the paragraph (2).

CHAPTER VI IMPLEMENTATION OF KLHS IN RPJPD EVALUATION AND RPJMD

Section 42 Implementation Of KLHS in evaluation of RPJPD and RPJMD following the KLHS stage of execution in the drafting of RPJPD and RPJMD.

BAB VII DOCUMENTING PROCESS AND KLHS RESULTS

Article 43 Pokja PL is required to document the process and results of KLHS implementation in the drafting of RPJPD and RPJMD to KLHS Report RPJPD and RPJMD.

Section 44 The compiler of Renstra SKPD is required to document the process and results of the KLHS draft Renstra SKPD into the KLHS Report Renstra SKPD

Article 45 (1) The Regent/Mayor delivers the KLHS Report RPJPD and RPJMD

to the Governor. (2) The KLHS report as referred to in paragraph (1) is included in

in the consultation of the Final Design of the RPJPD and RPJMD to the Governor.

(3) The governor delivered the Report KLHS RPJPD and RPJMD the scope of the province to the Minister of the Interior.

(4) The KLHS report referred to in paragraph (3) is included at the time of the RPJPD and RPJMD Final Design consultation to the Minister of the Interior.

Article 46 (1) Head of SKPD delivered a KLHS Report of the Renstra SKPD design

to The head of the SKPD is leading to the management and planning business and the SKPD. (2) Reports as referred to in paragraph (1) are included at the time of the verification of the Renstra SKPD design.

(3) The head of the SKPD who is guiding the environmental affairs of life as referred to in paragraph (1) provides the refinement of the integration of KLHS results into the Renstra SKPD design.

Article 47 of the KLHS Report as referred to in Section 43, Section 44, Section 45, and Section 46 may be accessed by stakeholders.

Article 48

Further provisions concerning the conduct of the KLHS implementation are listed in the Attachment Regulation of this Minister.

BAB VIII CONTROL AND EVALUATION

Article 49

(1) The Minister is doing control and evaluation to ensure that the recommendations of KLHS RPJPD and RPJMD provinces have been integrated into the Final Draft RPJPD and RPJMD provinces.

(2) The results of the Minister ' s bending and evaluation results as referred to the verse (1) is an inseparable part of the letter of the Minister concerning the results of the final draft consultancy RPJPD and RPJMD province.

Article 50 (1) Governor does control and evaluation to ensure

that the JHS recommendations of RPJPD and RPJMD provinces have been integrated into the Final Draft of the RPJPD and RPJMD of the provincial sphere.

(2) The Governor does control and evaluation to ensure that KLHS recommendations RPJPD and RPJMD districts/cities have been integrated into the RPJPD Final Design and the district/city RPJMD.

(3) The Governor ' s evaluation and evaluation results as referred to in paragraph (1) and paragraph (2) are an inseparable part of the Governor's letter concerning the outcome of the final draft consultation.

CHAPTER IX COACHING AND SUPERVISION

Article 52 (1) Minister through Director General of Bina Regional Development

conducts coaching and supervision to the governor in the implementation of KLHS in drafting and/or evaluation of RPJPD and RPJMD.

(2) The governor conducts coaching and supervision to the regent/mayor in the implementation of KLHS in the drafting and/or evaluation of RPJPD and RPJMD the scope of the province and county/city in its territory.

(3) The Regent/mayor is doing coaching and supervision to SKPD on its territory in the implementation of KLHS in the drafting and/or evaluation of the RPJPD and RPJMD sphere/city scope.

Article 53 Coaching as referred to in Article 52 includes: a. coordination: b. supervision: c. technical guidance: d. facilitation: and e. consulting.

Article 54 (1) Governor through Head of SKPD that is conducting environmental affairs

Financing implementation of KLHS dalan drafting or evaluation of RPJPD, RPJMD and Renstra SKPD sourced from the State Budget and Shopping Budget, Regional Revenue and Shopping Budget, among others lawful and non-binding source of income.

BAB XI

TRANSITIONAL provisions

Article 56 In terms of RPJPD and RPJMD has been promulred before the Regulation of this Minister, or already carrying out KLHS but not in accordance with Regulation This Minister, the Governor and the Regent/Mayor are obliged to carry out KLHS in the evaluation of RPJPD and RPJMD.

BAB XII CLOSING provisions

Article 57 of the Regulation of the Minister goes into effect on the date of the promulcings.
