ABOUT
COMMERCIAL POSTAL SERVICE TARIFF FORMULA

WITH THE GRACE OF THE ALMIGHTY GOD

MINISTER OF COMMUNICATIONS AND INFORMATICS,

Weighing: that to determine the specified Commercial Postal Service rates by cost-based calculations by considering hosting fees issued by the Postal Organizer in order to prevent the occurrence of competition. unsanitary, as well as to implement the provisions of Article 18 paragraph (2) of Law Number 38 of 2009 on Post, need to establish the Minister of Communications and Informatics Regulation on the Formula Tarif Commercial Post Services;

Given: 1. Law No. 19 of 2003 on the State Owned Entity (Indonesian Republic of Indonesia Year 2003 Number 70, Additional Gazette of the Republic of Indonesia No. 4297);
2. Act No. 40 Year 2007 on Limited Perseroan (State Sheet Of The Republic Of Indonesia Year 2007 Number 106, Additional Sheet Of State Republic Indonesia Number 4756);
3. Act No. 38 Year 2009 on Post (leaf State of the Republic of Indonesia in 2009 Number 146, Additional Sheet of State of Indonesia Republic No. 5065);
4. Government Regulation No. 12 of 1998 on the Company Perseroan (State Sheet of the Republic of Indonesia Year 1998 Number 15, Additional Gazette State Number 3731);
5. Presidential Regulation No. 47 of 2009 on the Establishment and Organization of the Ministry of State as amended last several times with the Presidential Regulation No. 77 of 2011 on the Second Amendment to the Presidential Regulation No. 47 Year 2009 on the Establishment and Organization of the Ministry of State;
6. Presidential Regulation No. 24 of 2010 on Occupation, Duty, and Functions of the Ministry of State as well as the Susunan Organization, Task and Functions of the Ministry of State, as amended by the Presidential Regulation No. 67 of 2010 on Changes to the Presidential Regulation No. 24 of 2010;
7. Ordinance of the Minister of Transportation Number KM 5 Year 2005 on Hosting Services Titipan;
8. Regulation of Minister of Communications and Informatics Number: 17 /PER/M. KOMINFO/10/ 2010 about the Organization and the Working Governance of the Ministry of Communications and Informatics;

DECIDED:

Establish: MINISTER OF COMMUNICATION AND INFORMATICS REGULATIONS ABOUT THE COMMERCIAL POSTAL SERVICE RATE FORMULA.

BAB I
UMUM PROVISIONS

Section 1
In Regulation of the Minister this is referred to:
1. The post is a written communication service and/or email, package service, logistics services, financial transaction services, and postal agency services for general interest.
2. The Postal Organizer is a governing body that organizes the Post.
3. The following are the total number of IBM products and services that are not available to the IBM Cloud Service.
4. Commercial Postal Service is a service that magnification and its services standards are not specified by the Government.
5. The business agency is the state-owned enterprise, the state-owned business agency, the private-owned business agency, and the cooperative.
6. The Minister is the Minister whose duty and responsibility is in the field of post.
7. Director General is the Director General whose duties and responsibilities are in the field of post.

BAB II
COMMERCIAL POSTAL SERVICE

Section 2
(1) The Commercial Postal Service type includes:
a. written and/or electronic communication services;
B. package service;
c. logistics service;
D. financial transaction service; and
e. services to the postal agency.
(2) The Services as referred to in paragraph (1) are executed by the Postal Organizer in accordance with the standards set forth by the Postal Host with guidelines on this Minister's Regulation.

BAB III
THE CALCULATION AND PRICING OF THE TARIFF

Section 3
(1) The Commercial Postal Service tariff calculation component, consists of:
a. fixed cost (fixed cost); and
B. Unfixed cost (variable cost).
(2) The charge group of the tariff calculation component as referred to in paragraph (1), consists of:
a. the group of operation/producti; cost groups; (including risk costs)
B. marketing expense group;
c. administrative charge group;
D. the general charge group; and
e. expenses that are not directly linked to the production process (
Cost overhead).

Section 4
The Commercial Post Service rate formula is set by a fee-based calculation that includes all cost components plus margin for the hosting of a Commercial Postal Service.

Section 5
(1) The Postal Host sets out the quantity of Commercial Post Service rates based on the tariff formula as referred to in Section 4 and is the published fare.
(2) The Commercial Postal Service tariff (s) as referred to in paragraph (1) after being reduced by margin is the principal price of production.
(3) The Commercial Postal Service tariff rate should not be lower than the principal price of production.

BAB IV
REPORTING AND EVALUATION

Section 6
(1) The Host Host is required to make a report to the Director General both physically and electronically, at least 30 (thirty) business days after the assignment and/or the change in the rate published.
(2) The reports referred to in paragraph (1) are supplemented by the charge component used as a tariff calculation basis in accordance with the format as set forth in the Attachment that is an inseparable part of the Regulation of this Minister.
(3) The report as referred to in paragraph (1) and paragraph (2) must be accounted for by the Postal Host.

Section 7
(1) The Director General conducts an evaluation of the report as referred to in Article 6 at least 30 (thirty) business days since the report was received.
(2) The organizers of the Post are required to review and adjust the published rate, if the rate set is not in accordance with the rate formula, as set forth in the Attachment that is an inseparable part of this Minister's Regulation.
(3) The adjustment of the tariff designation as referred to in paragraph (2) is carried out by the Host of the Postal Service at least 90 (ninety) days of work since the receipt of the notice of the Director General.

BAB V
ADMINISTRATIVE SANCTION

Section 8
(1) The Host Host who does not carry out the obligations as set out in Article 6 and Article 7 of the paragraph (2) are subject to administrative sanction.
(2) administrative sanctions as referred to in paragraph (1) may be:
a. written reprimand; and
B. Revocation.

Section 9
(1) The written notice as referred to in Article 8 of the paragraph (2) of the item a is imposed 3 (3) times in a row for a period of 30 (thirty) days each.
(2) After the term of the third written rebuke (three) as it is referred to in paragraph (1) is terminated, the revocation is done.

BAB VI
THE TRANSITION PROVISION

Section 10
Postal organizers are required to adjust the assignment of fares no later than 1 year since the promulgations of this Minister Rule.

BAB VII
CLOSING PROVISIONS

Section 11
The Minister ' s rules are beginning to apply to the date of the undrased.
