REGULATION OF MARINE AND FISHERIES MINISTER REPUBLIC OF INDONESIA

NUMBER PER.16/MEN/2012 ON

NATIONAL COMMISSION OF FISH RESOURCES REVIEW

WITH THE GRACE OF THE ALMIGHTY GOD THE MINISTER OF MARINE AND FISHERY REPUBLIC OF INDONESIA,

TO DRAW: a. that to optimize the study of the fish resources in order to establish the potential and number of the captured catches and implement the provisions of Section 7 of the paragraph (5) of the Law No. 31 Year 2004 on Fisheries, as amended by The Law No. 45 Year 2009, has been designated the Regulation of the Minister of Marine and Fisheries of the PER.13/MEN/2009 on the National Commission for the Study of Fish Resources, as amended by the Regulation of the Minister of the Marine and Fisheries of the Number of Fish. PER.13/MEN/2010;

b. That in order to effectiveness the implementation of the National Commission for the Study of Fish Resources, it is necessary to review the Regulation of the Minister of Marine and Fisheries Number. Amended by the Regulation of the Minister of Marine and Fisheries. Number PER.13/MEN/2010;

c. that based on consideration as in letter a and letter b, it is necessary to establish the Minister of Marine and Fisheries Regulations on the National Commission for the Study of Fish Resources;

Given: 1. Law No. 17 Year 1985 on Unrest United Nations Convention on the Law of the Sea (United Nations Convention on the Law of the Sea) (Sheet of State of the Republic of Indonesia 1985 No. 76, Additional Gazette of the State of Indonesia Republic of Indonesia Number 3319);

2. Law No. 31 Year 2004 on Fisheries (State of the Republic of Indonesia 2004 number 118, Additional Gazette Republic of Indonesia Number 4433), as amended by Law No. 45 Year 2009 (State Sheet) Republic Of Indonesia In 2009 Number 154, Additional Gazette Republic of Indonesia Number 5073);

3. Government Regulation Number 60 Year 2007 On The Conservation Of Fish Resources (State Sheet Of The Republic Of Indonesia Year 2007 Number 134, Extra State Sheet Of Republic Indonesia Number 4779);

4. Government Regulation No. 30 Year 2008 on Hosting Research and Development of Fisheries (State Sheet of the Republic of Indonesia 2008 No. 55, Additional Gazette of the Republic of Indonesia Number 4840);

5. The Presidential Decree No. 47 of 2009 on the Establishment and Organization of the Ministry of State, as it has been changed several times, was last with the Presidential Regulation No. 91 of 2011;

6. Presidential Decree No. 24 of 2010 on Occupation, Duty and Functions of the Ministry of State as well as the Organizational Functions, duties and Functions of the Ministry of State, as have been several times amended, last with the Presidential Regulation Number 92 2011;

9. Marine Minister and Fisheries Regulation Number PER.01/MEN/2009 on the Republic of Indonesia Fisheries Management Area;

10. Marine Minister and Fisheries Regulation Number PER.15/MEN/2010 on the Organization and Tata Works of the Ministry of Marine and Fisheries;

Pay attention to: Code of Conduct for Responsible Fisheries, Food and Agriculture Organization of the United Nations, 1995;

DECIDED:

SET: A REGULATION OF MARINE AND FISHERY MINISTERS ABOUT THE NATIONAL COMMISSION OF THE STUDY OF FISH RESOURCES.

BAB I

POSITION, DUTIES, AND FUNCTION Article 1

National Commission of Fish Resource Review, which is next in the Ordinance of this Minister called KAJAL, is a non-independent, non-structural institution located in the United States. below and is responsible to the Minister of Oceans and Fisheries.

Article 2

The KAJAL Komnas as referred to in Article 1 have the duty of providing input and/or recommendation to the Minister of Oceans and Fisheries through The set and review of the study/study of the fish resources of the various sources, including available scientific evidence (best scientific evidence available), in the designation of potential and number of catches allowed as policy materials in responsible fishery management (responsible fisheries) in the State fisheries management area of the Republic of Indonesia.

Article 3

In carrying out the duties as referred to in Article 2, the KAJAL Komnas function:

a. exercise identification of data needs and information both in the field of fisheries as well as in the field of aquatic environment in the framework of the study of fish resources;

b. execution of the identification of needs and the inclusion of research programs in the framework of the study of fish resources;

c. implementation of validation and synthesis of the results of national fish resource stockpiles in order of potential designation and the number of catches allowed as a recommendation material to the Minister of Oceans and Fisheries; and

d. The ongoing and/or will be implemented in any of the country's Republic of Indonesia fisheries management areas, in accordance with the law-invitation regulations.

BAB II ARRANGEMENT OF MEMBERSHIP AND SECRETARIAT

Article 4

(1) The KAJAL Comnas consists of at least 23 (twenty-three) people, made up of experts in their fields derived from related agencies.

(2) The experts referred to the paragraph (1) included Experts, college representatives, and related government agencies that have expertise in the field of fish resources.

(3) The field of experts ' expertise as referred to paragraph (1) and verse (2) includes fisheries biology, fish stock studies, fishery/fishing capacity, bio-economics fishery, management fisheries, marine biology, aquatic ecology, limnology, oceanography, population dynamics, fishery acoustics, remote sensing, geographic information systems, and fisheries statistics.

(4) Membership KAJAL's membership as referred to in paragraph (1) up to the paragraph (3) as set forth in the Attachment that is part of the inseparable from this Minister Rule.

Article 5 (1) The KAJAL Komnas membership is on duty for 3 (three) years and

can be reappointed for the next term.

(2) Replacement of the KAJAL Komnas member as it is referred to in paragraph (1) proposed by the Head of the Marine and Fisheries Research Agency and Fisheries to the Minister of Oceans and Fisheries by considering the advice of the KAJAL Komnas Chairman the previous period.

Article 6 (1) The KAJAL Komnas are led by a selected Chairman of /dan

(1) The replacement and/or changes to the KAJAL Komnas member can be done before the term of the KAJAL Komnas member ends in terms of: a. Died; b. Resign at your own request; or c. permanently physical and/or spiritual pain.

(2) The replacement and/or change of the KAJAL Komnas member as referred to in paragraph (1) is proposed by the KAJAL Comnas Chairman to the Minister Marine and Fisheries through Head of Marine Research and Marine Development and Fisheries.

Article 8 Membership of the next period, the replacement, and/or changes to the members of the KAJAL Komnas as referred to in Article 5 and Section 7, set by the Decree of the Minister of Oceans and Fisheries.

Article 9 (1) To The implementation of the KAJAL Komnas task was formed

(4) Secretariat of the Comnas KAJAL is based in the offices of the Research and Conservation Research Center of Fish, Marine and Marine Development and Fisheries Agency.

CHAPTER III OF THE WORKING MECHANISM

Article 10 (1) To carry out the duties of the Comnas KAJAL as

(3) If the number of the attendance of the KAJAL Komnas as referred to in paragraph (2) is not met in 2 (two) times the trial in a row then in a third trial may take a decision.

Article 12 (1) The KAJAL compaction can invite stakeholders

as a source of the purpose. (2) The interests of interest as referred to in paragraph (1) consist

of government institutions whose scope of duty in the field of fisheries management, the organizer of research and development in the field of fisheries, and/or perpetrators of business in the field fishing.

Article 13 (1) To improve the KAJAL Komnas task force may

Article 14 (1) At the end of its membership term, KAJAL ' s Komnas

FINANCING Article 15

All costs required in the implementation of the KAJAL Komnas task are charged on the Budget of the Fisheries Research and Fish Resource Conservation, the Marine Research and Development Agency and Fisheries.

CHAPTER V PROVISIONS TRANSITION

Article 16 of the KAJAL Komnas activities performed before the Ordinance of the Minister's Ordinance remain in reference to the Regulation of the Minister of Marine and Fisheries Number PER.13/MEN/2009 about the National Commission for the Study of Fish Resources, as amended by the Regulation of the Minister of Marine and Fisheries Number PER.13/MEN/2010, as long as it does not conflict with the Regulation of this Minister.

CHAPTER VI OF THE PROVISIONS OF THE COVER

Article 17

With the Ordinance of this Minister Regulation, the Regulation of the Minister of Oceans and Fisheries Number PER.13/MEN/2009 about the National Commission for the Study of Fish Resources, as amended by the Regulation of the Minister of Marine and Fisheries Number PER.13/MEN/2010, revoked and declared to be not applicable.
