THE ALLOCATION OF FUNDS FOR NATURAL RESOURCE OUTCOMES
EARTH OIL AND GAS MINING
IN ORDER OF SPECIAL AUTONOMY IN THE PROVINCE OF WEST PAPUA
BUDGET YEAR 2012
WITH THE GRACE OF THE ALMIGHTY GOD
FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,
Weigh: a. that to carry out the provisions of Article 34 of the paragraph (3) of the Law No. 21 Year 2001 on Special Autonomy of the Province of Papua as amended by Law No. 35 of 2008, the Regulation of the Minister of Finance Number 35 has been established. 09 /PMK.07/ 2012 on the Estimated Alocation of the Fund for the Result of the Earth and Earth Gas Mining in the Rangka Special Autonomy in West Papua Province 2012 as amended by the Regulation of the Minister of Finance Number 185 /PMK.07/2012;
B. that based on the outcome of the reconciliation of the Fund for the Results of the Earth's Natural Resources and Earth Gas Triwulan IV Year of the Budget 2012, it is necessary to adjust the allocation of funds for the results of the Natural Resources of the Petroleum Mining and Gas Earth in the Order of Special Autonomy in the Province of West Papua New Year of Budget 2012;
c. that under consideration as intended in letter a and letter b, need to establish the Finance Minister's Regulation on the Allocation Of Funds For The Results Of The Natural Resources Of Petroleum And Petroleum Mining In Order Of Special Autonomy In The Province. West Papua New Year of Budget 2012;
Remembering: 1. Law No. 21 of 2001 on Special Autonomy of Papua Province (State of the Republic of Indonesia 2001 Number 135, Additional Gazette of the Republic of Indonesia No. 4151) as amended by Law Number 35 Year (2001). 2008 (sheet State of the Republic of Indonesia 2008 No. 112, Additional Gazette of the Republic of Indonesia No. 4844);
2. Law No. 22 Year 2011 on Budget and State Shopping of 2012 Budget (State of the Republic of Indonesia Year 2011 Number 113, Additional Gazette of the Republic of Indonesia No. 5254) as amended by Law Number 4 Of 2012 (Sheet State Of The Republic Of Indonesia In 2012 Number 87, Addition Of State Sheet Indonesia Number 5303);
3. Finance Minister Regulation Number 06 /PMK.07/ 2012 on the Implementation and Accouncability of the Transfer Budget to the Regions;
4. Finance Minister Regulation Number 165 /PMK.07/ 2012 on the Alignment of the Transfer Budget to the Regions;
DECIDED:
Establish: FINANCIAL MINISTER REGULATION ON THE ALLOCATION OF FUNDS FOR THE NATURAL RESOURCES OF PETROLEUM AND PETROLEUM MINING RESOURCES IN ORDER OF SPECIAL AUTONOMY IN THE WESTERN PAPUA PROVINCE OF BUDGET YEAR 2012.
Section 1
The allocation of the Fund for Natural Resources derived from Earth Oil and Earth Gas Mining (DBH SDA Migas) in order of special autonomy in the Province of West Papua is based on the realization of acceptance of the SDA Migas Year of Budget 2012 and the realization of DBH SDA Migas of the 2012 Budget Year presentation.
Section 2
The allocation of DBH SDA Migas as referred to in Article 1 is Rp140.522,958.180.00 (one hundred forty billion five hundred and twenty-two million ninety-eight thousand hundred and fifty-eight thousand), with the following details as follows:
a. The allocation of the DBH SDA derived from the Petroleum Mining of the Earth is 55% (fifty-five percent) of the total estimate of the total revenue of the state derived from the SDA of the Petroleum of the Earth Province of West Papua is the size of Rp129.406.298,800,00 (one hundred and twenty-nine) billion four hundred and six million two hundred and ninety-eight thousand eight hundred rupiah); and
B. The allocation of DBH SDA derived from the Earth Gas Mining is 40% (forty percent) of the total estimated State Reception derived from the Natural Resources of the Earth Gas Province West Papua is Rp11.116.659,380.00 (eleven billion 100) Sixteen million six hundred and fifty-nine thousand three hundred and eighty-hundred thousand.
Section 3
(1) Alocation as referred to in Article 2 of the letter a and letter b is derived from the realization of DBH SDA Migas Triwulan IV based on the results of the SDA Migas period receipt of the lifting Migas period December 2011 to August 2012.
(2) The DBH SDA Migas Alocation for the 2012 Budget completed presentation was based on the realization of DBH SDA Migas for the receipt of the SDA Migas in December 2011 up to November 2012 with which it has been routed up to the Triwulan 4th Year of Budget 2012.
(3) The Alocation of DBH SDA Migas as referred to in paragraph (2) is sourced to the allocation of the DBH SDA Migas Reserve Fund which is contained in the Finance Minister's Regulation on the Alocation of the Fund for the Result of the Earth's Petroleum Mining and Earth Year's Gas. Budget 2012.
(4) In terms of pagu over the estimated DBH allocation specified in the 2012 Budget Year insufficient supply requirement or realisation exceeds the pagu in the 2012 Budget Year, the Government channeled the DBH allocation based on the realization of acceptance in accordance with the provisions of the laws.
Section 4
