THE SIXTH CHANGE TO THE DECISION OF THE MINISTER OF PERRELATION NUMBER KM 18 IN 2002 ABOUT
CERTIFICATION REQUIREMENTS AND OPERATIONS FOR AIR FREIGHT COMPANIES
NIAGA FOR COMMUTER AND CHARTER FLIGHTS

WITH THE GRACE OF THE ALMIGHTY GOD

MINISTER OF PERRELATIONS REPUBLIC OF INDONESIA,

Weigh: a. that in the Regulation of Minister Perrelation Number KM 42 Year 2009 on the Fifth Amendment to the Decree of the Minister of Transportation Number KM 18 Year 2002 on Certification Requirements and Operations For The Air Transport Company Niaga To Commuter Flights and Charter, have set provisions regarding the installation obligations of new equipment (new equipments) of the Enhanced Ground Proximity Warning Systems (EGPWS) /Terrain Awareness and Warning Systems (TAWS), Traffic Alert and Collision Avoidance Systems II (TCAS II), Digital Flight Data Recorderand Emergency Locator Transmitter 406 (ELT 406)on air aircraft owned by the air freight agency for commuter and charter flights;
B. That currently, there are air aircraft that have been registered and operated in the Indonesian region not equipped with equipment as intended on a letter a, given the unavailability of the design aspect of the wake and altitude data of the area. soil surface (terrain) as well as the low air traffic of certain regions;
c. that under consideration as intended on letter a and letter b, need to establish the Regulation of the Minister of Transportation on the Sixth Amendment to the Decree of the Minister of Transportation Number KM 18 Year 2002 on Requirements Certification and Operations For Commercial Air Transport Companies For Commuter And Charter Flights;

Remembering: 1. Act No. 1 Year 2009 on Flight (Sheet State Republic Of Indonesia 2009 Number 1, Additional Sheet Of State Republic Of Indonesia Number 4956);
2. Presidential Regulation No. 47 of 2009 on the Establishment and Organization of the Ministry of State as amended last with the Presidential Regulation Number 91 of 2011;
3. Presidential Regulation No. 24 Year 2010 on Occupation, Duty, and Functions of the Ministry of State as well as Susunan Oranization, Tasting, and Functions of the Ministry of State as amended by the Presidential Regulation No. 67 of 2010;
4. Decree of the Minister of Transportation Number KM 18 Year 2002 on Terms of Certification and Operations Requirements for Commuter Air Freight Companies for Commuter And Charter Flights as amended last with the Minister's Ordinance Perrelation Number KM 42 Year 2009;
5. Regulation of the Minister of Transportation Number KM 60 Year 2010 on the Organization and the Working Governance of the Ministry of Transportation;

DECIDED:

Establishing: REGULATION OF THE MINISTER OF RELATIONS ON THE SIXTH CHANGE IN THE DECISION OF THE MINISTER OF PERRELATION TO NUMBER KM 18 OF 2002 ON CERTIFICATION REQUIREMENTS AND OPERATIONS FOR THE AIR FREIGHT COMPANY NIAGA FOR COMMUTER FLIGHTS AND -CHARTER.

Section 1
Some of the provisions in the Decree of the Ministerial Decree Number KM 18 Year 2002 concerning the Requirements of Certification and Operations Requirements for the Commercial Transport Company for Commuter Flights and Charter (Civil Aviation Safety Regulations (CASR) Part 135), amended as follows:
1. Add to the letter (f) and (g) on Sub Section K item 135,319, so it reads as follows:
(f) The requirements contained in Sub Section K grains 135,319 letters (a), letters (b), letters (c), letters (d) and letters (e) are excluded for the Bell 412 SP, Bell 412 EP, CASA 212-100 and SD3-30 which are currently registered and operate in the Indonesia region.
(g) The requirements contained in Sub Section K item 135,319 for the DHC 6-300 and CASA 212-200 aircraft that are currently registered and operating in the Indonesian region, it was delayed by the slowest treatment on 31 December 2012.
2. Add up letter (d) and (e) on Sub Section K item 135,320, so it reads as follows:
(d) The requirements contained in Sub Section K grains 135,320 letters (a) and letters (c) are excluded for the Bell 412 SP, Bell 412 EP, CASA 212-100 and SD3-30 which are currently registered and operate in the Indonesian region.
(e) The requirements that were contained in Sub Section K item 135,320 for DHC 6-300 and CASA 212-200 which are currently registered and operating in the Indonesian region, were delayed by the slowest treatment date of 31 December 2012.
3. Add up letter (c) and (d) on Sub Section K item 135,322, so it reads as follows:
(c) The requirements contained in Sub Section K grains 135,322 letters (a) and letters (b) are excluded for the Bell 412 SP, Bell 412 EP, CASA 212-100 and SD3-30 which are currently registered and operate in the Indonesian region.
(d) The requirements contained in Sub Section K item 135,322 for the DHC 6-300 and CASA 212-200 aircraft that are currently registered and operating in the Indonesian region, it was delayed by the slowest treatment on 31 December 2012.
4. Add up letter (l) and (m) on Sub Section K grains 135,329, so it reads as follows:
(l) The requirements that are contained in Sub Section K grains 135,329 letters (a), letters (b), letters (c), letters (d), letters (e), letters (f), letters (g), letters (h), letters (i), and letters (j) are excluded for the Bell 412 SP aircraft, Bell 412 EP, CASA 212-100 and The SD3-30 currently registered and operates in the Indonesian region.
(m) The requirements that are contained in Sub Section K item 135,329 for DHC 6-300 and CASA 212-200 which are currently registered and operating in the Indonesian region, are delayed by the slowest treatment date of 31 December 2012.
5. Add up letter (b) and (c) Sub Section K grains 135,357, so it reads as follows:
(b) The requirements contained in Sub Section K grain 135,357 letters (a) are excluded for Bell 412 SP aircraft, Bell 412 EP, CASA 212-100 and SD3-30 which are currently registered and operate in the Indonesian region.
(c) The requirements contained in Sub Section K item 135,357 for the DHC 6-300 and CASA 212-200 aircraft that are currently registered and operating in the Indonesian region, it was delayed by the slowest treatment on 31 December 2012.

Section II
This rule is set to apply at the specified date.
