WITH THE GRACE OF THE ALMIGHTY GOD

MINISTER FOR ENVIRONMENT OF THE REPUBLIC OF INDONESIA,

Weigh: a.  that under the provisions of Article 17 paragraph (1) of the Law No. 43 of 1999 on the Changes to the Law No. 8 of the Year of the Public Service, each civil servant is appointed in a particular position and rank;
B.  that to support the agility of the execution of the tasks and functions of the Ministry of the Environment in the protection and management of the environment, it needs to be developed in general functional office;
c. that under consideration as referred to in the letter a, and the letter b, need to establish the Environment Minister Regulation on the Guidelines of the General Functional Office in the Environment of the Ministry of the Environment;

Given: 1.   Law No. 8 of the Year 1974 on Subjects of the Republic of Indonesia (1974) Number 55, Additional Gazette of the Republic of Indonesia Number 3041) as amended by Law No. 43 of 1999 (Sheet) State of the Republic of Indonesia in 1999 No. 169, Additional Gazette of the Republic of Indonesia Number 3890);
2. Law No. 32 Year 2009 on the Protection and Management of the Environment of Life (State Gazette of the Republic of Indonesia Year 2009 Number 140, Additional Gazette of the Republic of Indonesia No. 5059);
3. Presidential Regulation No. 47 of 2009 on the Establishment and Organization of the Ministry of State as it has been several times amended last with the Presidential Regulation Number 91 of 2011 (State Sheet of the Republic of Indonesia 2011 No. 141);
4. Presidential Regulation No. 24 of 2010 on Occupation, Duty and Functions of the Ministry of State as well as Susunan Organization, Duty and Functions of the Ministry of State as it has been several times amended last by Presidential Regulation No. 38 2013 (sheet of State of the Republic of Indonesia in 2013 Number 90);
5. Presidential Regulation No. 81 Year 2010 on Grand Design Reform Bureaucracy 2011-2014;
6. Ordinance of Minister of State Pendayagunaan State of Personnel and Bureaucratic Reform Number PER/15/M. PAN/7/2008 about the Bureaucratic Reform General Guidelines;
7. Regulation of the Minister of the Environment of the Environment Number 16 of 2010 on the Organization and the Working Environment of the Ministry of the Environment as amended by the Regulation of the Minister of the Environment Number 18 of 2012 (State News of the Republic of Indonesia of the Year 2012 No. 1067);

DECIDED:

Establish: ENVIRONMENTAL MINISTER REGULATIONS ON THE GUIDELINES OF GENERAL FUNCTIONAL OFFICE IN THE ENVIRONMENTAL MINISTRY ENVIRONMENT.

Article 1
In Regulation of this Minister referred to:
1. Prospective Civil Servants, subsequently called CPNS, are Indonesian Citizens who apply, pass the selection and are appointed to be prepared to be a civil servant in accordance with the provisions of the laws.
2. Civil Servants, further abbreviated to civil servants, are any eligible citizens of the Republic of Indonesia who have been eligible to be determined, appointed by authorized officials and to be assigned a duty in a state office or a duty of duty. other countries, and underpaid under applicable laws.
3. The General Functional Office is the position that indicates the task, responsibility, authority and rights of a CPNS and civil service in order to perform the underlying tasks and functions of expertise and/or skills to achieve the organization's objectives.
4. Structural Office is a position that indicates the duty of responsibility, authority, and the right of a civil servant in order to lead an organizational unit.
5. Certain Functional Functional posts are the positions that show the task, responsibility, authority and right of a civil servant in a unit of organization which in the conduct of its duties is based on certain skills and/or skills as well as the nature of the organization. Self-suss and the ascension of the rank is required by credit.
6. This type of General Functional Office is a designation that is the identity of the naming of a post under the eselon IV.
7. The Minister is the minister who organizes government affairs in the areas of protection and environmental management of the living.

Article 2
General Functional Office aims to provide clarity on the tasks and functions of CPNS and PNS in assisting the execution of the task and function of the eselon IV in each working unit.

Article 3
(1) The General Functional office is formulated based on the results of the office analysis.
(2) Based on the results of the term analysis as referred to in paragraph (1) results in the List of Types of General Functional Office in the Environment Ministry Environment which is an inseparable part of this Minister's Regulation.
(3) The use of the General Functional Office Type in the Environment Ministry Environment as referred to in paragraph (2) is set by the Minister.
(4) The use of a common functional type of office as referred to in paragraph (3) is adjusted to the needs of the organization of the Ministry of the Environment.

Section 4
(1) Any PNS that has not occupied a Certain Structural and Functional Title, is appointed in the General Functional Office.
(2) The provisions of the appointment of PNS in the General Functional Office as referred to in paragraph (1) are specified by the Minister.

Section 5
PNS Transfer in general functional office to a specific structural position or Functional Position is set by the Minister.

Section 6
(1) The type of general functional office as referred to in Article 3 of the paragraph (2) becomes the base of the General Functional Title formation.
(2) The General Functional Title Formation as referred to in paragraph (1) is used as the basis for:
a. procurement of CPNS; and
B. Civil servant transfer.

Section 7
(1) Each CPNS is appointed in general functional office.
(2) CPNS appointed in general functional office as referred to in paragraph (1) is set by the Minister.
(3) CPNS who are appointed in general functional office as referred to in paragraph (1), cannot be transferred to another General Functional Office before being elevated to the PNS.
