ABOUT
THE ADDITION OF THE INCLUSION OF THE REPUBLIC OF INDONESIA CAPITAL
INTO THE COMPANY ' S SHARE CAPITAL PERSEROAN (PERSERO)
PT ASDP INDONESIA FERRY
BY THE GRACE OF THE ALMIGHTY GOD
PRESIDENT OF THE REPUBLIC OF INDONESIA,
Weigh: a. that to improve the structure of the Perseroan Company (Persero) PT ASDP Indonesia Ferry, it is necessary to increase the inclusion of capital of the Republic of Indonesia into the stock capital of Perseroan Company (Persero) PT ASDP Indonesia Ferry which is derived from the transfer of state-owned goods to the Ministry of Transportation, which is the source of the Budget and State Shopping of the Year of the Budget 2006, 2007, 2008, 2009, and 2010;
B. that under consideration as referred to in the letter a and to carry out the provisions of Article 4 of the paragraph (4) of the Law No. 19 Year 2003 on the State-Owed Business Agency, it needs to establish the Government Regulation on the Addition of the Inclusion Capital Of The Republic Of Indonesia Into The Modal Stock Company Perseroan (Persero) PT ASDP Indonesia Ferry;
Remembering: 1. Article 5 of the paragraph (2) of the Basic Law of the Republic of Indonesia in 1945;
2. Act No. 19 of 2003 on the State Governing Body (Indonesian Republic of Indonesia Year 2003 Number 70, Additional Gazette of the Republic of Indonesia Number 4297);
3. Act No. 1 Year 2004 on the State Treasury (State Sheet Indonesia 2004 Number 5, Additional Gazette Republic of Indonesia Number 4355);
4. Law No. 22 Year 2011 on Budget and Shopping of State of the Year of the 2012 Budget (State of the Republic of Indonesia Year 2011 Number 113, Additional Gazette of the Republic of Indonesia No. 5254) as amended by Law No. 4 of the Year 2012 on Changes to the Law No. 22 Year 2011 on Budget and State Shopping of the Year 2012 Budget (State Sheet of Indonesia 2012 No. 87, Additional Gazette of the Republic of Indonesia) Indonesia No. 5303);
5. Government Regulation No. 44 Year 2005 on the Tata Way Inclusion And Entrepreneurship Enterprises of the State-owned Enterprises and Limited Perseroan (State Sheet of the Republic of Indonesia 2005 No. 116, Additional Gazette of the Republic of Indonesia) Indonesia Number 4555).
DECIDED:
SET: GOVERNMENT REGULATION ON THE ADDITION OF THE INCLUSION OF CAPITAL OF THE REPUBLIC OF INDONESIA INTO THE STOCK CAPITAL OF THE COMPANY PERSEROAN (PERSERO) PT ASDP INDONESIA FERRY.
Section 1
The State of the Republic of Indonesia did the addition of a capital inclusion into the capital Perseroan (Persero) PT ASDP Indonesia Ferry whose status as a Perseroan Company (Persero) was set to be based on
Government Regulation Number 15 Year 1992 on Diversion Of The General Enterprise (perum) River Transport, Lake, and The Crossing into Perseroan Company (Persero).
Section 2
(1) The added value of the inclusion of the State capital as referred to in Article 1 of Rp588.168.456.038.00 (five hundred eighty-eight billion hundred and sixty-eight million four hundred and fifty-six thousand thirty-eight rupiah);
(2) The addition of the inclusion of the State capital as referred to in paragraph (1) comes from the transfer of state-owned goods to the Ministry of Transportation that its existence is sourced from the State Budget of Revenue and Shopping of the Budget Year 2006, 2007, 2008, 2009, and 2010 with details as set forth in the Attachment that are an inseparable part of this Government Regulation.
Section 3
This Government Regulation shall begin in effect on the date of the promulctest.
