CHANGES TO THE ENERGY MINISTER ' S REGULATIONS AND RESOURCES
MINERAL NUMBER 04 OF 2011 ABOUT THE ENERGY AWARD

BY THE GRACE OF THE ALMIGHTY GOD
MINISTER OF ENERGY AND MINERAL RESOURCES REPUBLIC OF INDONESIA,


Weigh: a.  that in order to increase effectiveness in the granting of Penghar ` gaan Energy, it needs to fine-tune the Regulation of the Minister of Energy and Mineral Resources No. 04 of 2011 on the Energy Award, by arranging more detail on the provisions the requirements and implementation of the Energy Award grant;
B. that under consideration as intended in the letter a, it is necessary to establish the Regulation of the Minister of Energy and Mineral Resources on the Changes to the Regulation of the Minister of Energy and Mineral Resources No. 04 of 2011 on the Energy Award;

Given: 1. Law Number 22 Year 2001 on Oil and Earth Gas (State Of The Republic Of Indonesia In 2001 Number 136, Additional Sheet Of State Republic Indonesia Number 4152);
2. Act No. 27 of 2003 on the Geothermal (Sheet Of State Of The Republic Of Indonesia In 2003 Number 115, Additional Leaf Of State Republic Of Indonesia Number 4327);
3. Law Number 30 Year 2007 on Energy (Sheet State Republic Indonesia Year 2007 Number 96, Additional Leaf Republic Of Indonesia Number 4746);
4. Act No. 4 Year 2009 on Mineral Mining and Coal (State Of The Republic Of Indonesia 2009 Number 4, Additional Sheet Of State Republic Indonesia Number 4959);
5. Law No. 20 Year 2009 on Title, Order of Merit, and Honorary Sign (State Sheet of the Republic of Indonesia Year 2009 Number 94, Additional Gazette of the Republic of Indonesia No. 5023);
6. Act No. 30 Year 2009 on Fame of the Republic of Indonesia (2009) Number 133, Additional Gazette of the Republic of Indonesia No. 5052);
7. Presidential Regulation Number 5 of 2006 dated January 25, 2006 on National Energy Policy;
8. Ordinance of the Minister of Energy and Mineral Resources No. 18 of 2010 on the Organization and the Working Governance of the Ministry of Energy and Mineral Resources (State News Indonesia of 2010 No. 552);
9. Ordinance of the Minister of Energy and Mineral Resources No. 04 of 2011 on the Energy Award (State News of the Republic of Indonesia of 2011 Number 90);

DECIDED:


Setting: REGULATION OF ENERGY MINISTER AND MINERAL RESOURCES ON CHANGES TO THE REGULATION OF ENERGY MINISTER AND MINERAL RESOURCES NUMBER 04 OF 2011 ON ENERGY AWARDS.

Article I

Some provisions in the Regulation of the Minister of Energy and Mineral Resources No. 04 of 2011 on the Energy Award (Indonesian Republic of Indonesia 2011 Number 90), are changed as follows:

1. The provisions of the number 4 Article 1 are changed, so that Article 1 reads as follows:

Section 1

In Regulation of this Minister, referred to by:
1. Energy is the ability to do work that can be of heat, light, mechanics, chemistry, and electromagnetics.
2. Energy diversification is the multiplicity of energy sources utilization.
3. Energy Conservation is a systematic, planned, and integrated effort to preserve internal energy resources as well as improve the efficiency of its efficiency.
4. Energy Award is an award in the field of energy given to the Outstanding Contributing Importance of conducting the activities of the development, provisioning, and utilization of energy with the principles of Conservation of Energy and/or Diversify Energy through its policies/regulations, activities, and/or physical products as a result of the innovation and development of new technologies that have a major impact on the development and improvement of community welfare around, role and the performance of the energy sector and the mineral resources, and/or the nation and the country.
5. Government Instancy is a unit of government organization that exercises its duties and functions in accordance with the provisions of the laws, including the Coordinating Ministry/State Ministry/Government Non-Ministry, as well as It is a government that exercises government functions using the State Budget and Revenue Budget.
6. The Regional Government is the governor, regent, mayor, and device of the area as an element of the organizing government of the area.
7. The Ministry is the Ministry of Energy and Mineral Resources.
8. Minister is the Minister of Energy and Mineral Resources.
9. Head of the Agency is the Head of the Agency whose duties and responsibilities in the field of research and development of energy and mineral resources.

2. The terms of the letter b Section 5 are changed, so that Article 5 reads as follows:

Section 5

The general requirement as referred to in Article 4 of the letter a is as follows:
a. For individuals, it comes from Indonesian/foreign nationals domiciled in Indonesia and activities performed by and on behalf of a person;
B. for the Community Group, derived from Indonesian/Foreign Citizens domiciled in Indonesia and activities performed by and on behalf of:
1. The Group that is housed within the Institution that has the Basic Budget and Household Budget; or
2. College;
c. for the Company, derived from the National/Regional or Foreign Company that has been operating in the Indonesia Region constantly and activities are conducted by and on behalf of the Company and must be equipped the Company Establishment Act according to The rules of the laws of the law;
D. for the Government Instancy or the Local Government, for activities performed by the Government Instancy or the Local Government concerned and known by the Government Instancy Chair, the governor or the mayor/mayor in question;
e. run for or be nominated by the Group or other Organizations including the Ministry of Energy and Mineral Resources;
f. The Energy Award nominee has never conducted any activities against Pancasila, the Constitution of the Republic of Indonesia in 1945, the State, and the Government of Indonesia.

3. The terms of the letter c Section 6 are changed, so that Article 6 reads as follows:

Section 6

Special requirements as referred to in Section 4 of the letter b, are as follows:
a. For the element of the Society both individually and the group of people that are exceptional and can be used as role models, pioneers and their high commitment to actively participating in the continuous and/or conducts energy development, provisioning and energy utilization with conservation principles and/or diversified, resulting in physical real products that are the result of new technologies and innovations, impacting the large and positive to the development and improvement of community welfare around in sustainable and efficient energy management;
B. for elements of the Company derived from an outstanding National/Area or Foreign Company and have a high commitment to active participation as corporates perform, providing real donations in terms of technology development new, innovation, provisioning and energy utilization with the principle of conservation and/or diversified, resulting in physical tangible products for the Company's own operations as well as a major impact on development and improvement of roles and performance the energy sector and the mineral resources in the energy management that sustainable and efficient;
c. for Government Instancy and the Local Government is outstanding and can be made a role model, pioneer as well as having a high commitment in the spur of programs and activities of the development, provision and utilization of energy by principle Conservation and/or diversified through policies/regulations, resulting in physical tangible products that are the result of new technological innovations and development, which have a significant and positive impact on development and improvement of roles and performance the energy sector and mineral resources, nation, and country in energy management Sustainable and efficient.

4. The provisions of paragraph (3) of Article 7 are changed, so that Article 7 reads as follows:

Section 7

(1) the Minister grants the Energy Award as referred to in Article 2.
(2) To provide the Energy Award as referred to in paragraph (1), the Minister formed the Committee of Energy Awards and established the Jury Council.
(3) The Energy Award grant is implemented as a series of observable Days of Mining and Energy and can be given at:
a. The Presidential State Palace of the Republic of Indonesia; or
B. another place to be determined by the Minister.
(4) In the event of the recipient of the death of the world, it can be submitted to the relevant Warists accompanied by valid evidence of the Letter of Adorance signed by the local Chief of Village/Lurah or the Assignment Letter of Instancy Government, Local Government or Company.

5. The provisions of paragraph (3) of Section 8 are amended, so that Article 8 reads as follows:

Section 8

(1) The Energy Award Committee, referred to in Article 7 of the paragraph (2), consists of the Pembina, the Director and the Chairman of the Managing Committee which oversees the Secretariat, the Awards, and the Publication Fields.
(2) The Structure of the Energy Award Committee is as set forth in Annex III which is an inseparable part of the Regulation of this Minister.
(3) The Energy Award Committee as referred to in paragraph (1) consists of:
a. Minister as Pembina;
B. Deputy Minister, Secretary General, Inspector General, Director General of Petroleum and Gas Earth, Director General of Fame, Director General of Mineral and Coal, Director General of New Energy, Renewable Energy, and Conservation of Energy as a Pengarah;
C. Head of the Agency as the Chairman of the Managing Committee;
D. The areas of the Awards and Publications Fields are coordinated by the Staff of the Expert Minister
(4) The Jury Council as referred to in Article 7 of the paragraph (2) at most 9 (nine) persons, consists of the Chairman, Secretary and Member of the Association of Energy Sector and Mineral Resources, College, Practice, Public Figures, and The Swadaya Society.

6. Annex IV is changed, so it becomes as set forth in Annex IVA, Annex IVB, and Annex IVC which is an inseparable part of the Regulation of this Minister.

Article II

The rules of this Minister begin to take effect on the date of promulglement.
So that everyone knows it, order the invitation of the Regulation of the Minister with its placement in the News of the Republic of Indonesia.
