REGULATIONS of the INSTITUTION of WITNESS PROTECTION and VICTIM No. 2 by 2013 on the ELECTION of the CHAIRMAN and VICE-CHAIRMAN of the INSTITUTE of PROTECTION of WITNESSES and VICTIMS with the GRACE of GOD ALMIGHTY the CHAIRMAN of WITNESS PROTECTION and VICTIM INSTITUTION Considering: that in order to implement article 16 and article 17 of Act No. 13 of 2006 on the protection of witnesses and Victims and in order for certainty and order within the framework of the election of the Chairman and Vice-Chairman of the Institute of protection of witnesses and victims , then the need to establish regulations governing the procedures for the election of the Chairman and Vice Chairman;
Remember: 1. Act No. 13 of 2006 on the protection of witnesses and Victims (State Gazette of the Republic of Indonesia year 2006 Number 64, an additional Sheet of the Republic of Indonesia Number 4635);
2. Presidential regulation Number 82 in 2008 about witness protection Agency Secretarial and victims;
3. the regulations of the institution of witness protection and Victim number 3 in 2012 about The holding of the meeting on the Protection of witnesses and victims (news of the Republic of Indonesia in 2012 the number 1286);
DECIDING Set: regulatory INSTITUTION of WITNESS PROTECTION and VICTIMS ABOUT HOW the ELECTION of CHAIRMAN and VICE-CHAIRMAN of the INSTITUTE of PROTECTION of WITNESSES and victims.
CHAPTER I GENERAL PROVISIONS article 1 in this rule is: 1. Protection of witnesses and victims, hereinafter abbreviated LPSK, independent agency is responsible for handling the granting protection and assistance to witnesses and Victims based on task and its mandate as Act No. 13 of 2006.
2. The Chairman is the Chairman of the Institute of protection of witnesses and victims.
3. the Vice Chairman is Vice Chairman of the Institute of protection of witnesses and victims.
4. A member is a member of the institution of witness protection and victims who are appointed by the President with the approval of the House of representatives.
5. The Secretary of the LPSK is the head of the Secretariat of the LPSK based on rules of State Secretary no. 5 in 2009.
6. The election of the meeting is to elect the Chairman and Vice-Chairman of the Institute of protection of witnesses and victims.
7. The Election Committee is a Committee established by the decision to hold the election of the Chairman of the LPSK Chairman and Vice Chairman.
8. Election of the Chairman of the meeting was Secretary of the LPSK as Chairman of the Election Committee.
9. Election of the Witness is a person who is appointed and witnessed the election consists of Government, non-governmental organizations and internally the LPSK is determined by the Chairman of the Committee.
10. The day is a working day.

CHAPTER II principles of article 2 in the election of the Chairman and Vice Chairman are based on the following principles: a. directly;
b. free;
c. secrets; and d.  non discrimination.
CHAPTER III ELECTION COMMITTEE of article 3 (1) the Election Committee is formed no later than 7 (seven) days after the election of seven members of the LPSK name by the House of representatives.
(2) the Election Committee as referred to in paragraph (1) was formed based on the decision of the Chairman of the institution of witness protection and Victim consisting of: a. the Chairman of the Committee;
b. the Secretary of the Committee;
c. a member of the Committee; and d.  the staff of the Secretariat.
(3) the Election Committee has the task of: a. the preparation of organizing elections that includes preparation and infrastructure, ballots, ballot box, stationery, and completeness;
b. establish communication with Members for the preparation of elections;
c. conduct orientation and setting up a temporary place for members;
d. organizing elections, as provided for in this regulation;
e. assign three (3) witnesses to attend and witness the election; and f.  setting up a news event of organizing Meetings and events News Election results election meetings.
CHAPTER IV ELECTION MEETING of article 4 (1) the Chairman and Deputy Chairman are elected from and by the members through Meetings of the election.
(2) meeting the election was conducted in a period not later than 7 (seven) days after receipt of the Presidential Decree on the appointment of members of the LPSK.
(3) a mandatory selection Meeting attended by 7 (seven) members and the Election Committee.
(4) election Meetings chaired by the Secretary of the LPSK.
(5) in the event that Members have not been able to present entirely as intended in paragraph (2), then Meeting the election was suspended at least 2 (two) times in each period of not more than 1 (one) hour.
(6) After Meeting the election was suspended as referred to in paragraph (3), then the system uses the selection meeting the quorum.
(7) the quorum has been reached if attended by at least 5 (five) members.
(8) If a quorum is not achieved as mentioned in subsection (5), then Meeting the election was delayed in a grace period of 24 (twenty four) hours.
(9) an election Meeting was held in the offices of the LPSK on a day determined by the Election Committee.
Article 5 (1) each Member shall have the right to vote and elected and obligated to follow the election of the Chairman and Vice Chairman.
(2) every member entitled to vote for one (1) Chairman and one (1) Vice Chairman.
(3) a member who is not present in the meeting of the election does not have the right to choose and be chosen.
(4) any Member compulsory lays out its vision and mission as Chairman or Vice Chairman prior to the election.
Chapter V of the ORDINANCE the ELECTION of CHAIRMAN and VICE CHAIRMAN of article 6 (1) Leadership meeting Election of the Chairperson and election provisions convey the Vice Chairman (2) the provisions of the election referred to in subsection (1) obligatory agreed upon all members are present.

Article 8 (1) voting is conducted in two stages.

Article 9 (1) of the first stage referred to in article 8 paragraph (2) letter a is done as follows: a. Election Committee provides ballots and ballot box;
b. the ballots contain numbers and sort a list of names arranged by members of the order of the Presidential Decree on the appointment of the membership of the LPSK;
c. each Member chooses one (1) candidate for Chairman of the encircled by way of one (1) number sort on a list of the names of the Members listed in the ballots that have been provided;
d. After encircling the number sequence that is selected, members enter the ballots into a ballot box has been provided;
e. the Chairman candidates gained the most votes is designated as Chairman of the LPSK;
f. If no candidates who obtained the most votes as stated on the letter e then held the vote again.
(2) the second stage referred to in article 8 paragraph (2) letter b is done as follows: a. Election Committee provides ballots and ballot box;
b. the ballots contain numbers and sort a list of names arranged by members of the order of the Presidential Decree on the appointment of the membership of the LPSK;
c. each Member chooses one (1) Candidate Vice Chairman by way of encircling the number 1 (one) sort on a list of the names of the Members listed in the ballots that have been provided;
d. After encircling the number sequence that is selected, members enter the ballots into a ballot box has been provided;
e. prospective Vice Chairman who gained the most votes is designated as Vice Chairman of the LPSK;
g. If no candidates who obtained the most votes as stated on the letter e then held the vote again.
Article 10 (1) after the ballot, the Election Committee conducts the vote count.
(2) a Member does not circle the number sequence on the paper votes abstained.
(3) the ballots that circled over 1 (one) ordinal number is declared invalid.
(4) the total number of votes tallied with the following conditions: a. the ballots that are circled on 1 (one) ordinal number is counted as one (1) valid votes;
b. the ballots that circled over 1 (one) ordinal number is counted as one (1) vote is invalid; and c.  ballots that are not encircled is counted as one (1) vote abstained.
CHAPTER VI ELECTION RESULTS the CHAIRMAN and VICE CHAIRMAN of section 11 (1) election results for the Chairman and Vice-Chairman of the Meeting News poured in the election.
