WITNESS PROTECTION AGENCY RULES AND VICTIMS
No. 2 YEAR 2013
ABOUT
SET THE WAY OF SELECTION OF THE CHAIRMAN AND VICE CHAIRMAN
WITNESS PROTECTION AGENCIES AND VICTIMS

WITH THE GRACE OF THE ALMIGHTY GOD

CHAIRMAN OF WITNESS PROTECTION AGENCIES AND VICTIMS

Weighing: That to implement Article 16 and Article 17 of the Law No. 13 Year 2006 on the Protection of Witness and Victims as well as the presence of certainty and order in the order of the election of the Chairman and Vice Chairman of the Witness Protection Society and Victims, then need to establish regulations governing the rules of the election of the Chairman and the Vice Chairman;
Remembering: 1.    Law Number 13 Year 2006 on Witness Protection and Victims (State Sheet Indonesia Year 2006 Number 64, Additional Gazette of the Republic of Indonesia Number 4635);
2. Presidential Regulation Number 82 of 2008 on the secretariacy of the Witness Protection Society and the Victims;
3. Witness Protection Regulation and Victim Number 3 of the Year 2012 on the Tata Cara Hosting Meeting on the Witness Protection Society and Victims (State News of the Republic of Indonesia 2012 Number 1286);

DECIDED
Establish: REGULATION OF WITNESS PROTECTION AGENCIES AND VICTIMS ON THE MANNER OF THE ELECTION OF THE CHAIRMAN AND THE DEPUTY CHAIRMAN OF THE WITNESS PROTECTION AGENCY AND THE VICTIM.

BAB I
UMUM CONDITIONS
Section 1
In this rule referred to:
1. Witness Protection and Victims Protection Agency, which is further abbreviated as LPSK, is a self-sufficient institution responsible for addressing protection and assistance for Witnesses and Victims based on their duties and authority as safeguards Law Number 13 Year 2006.
2. Chairman is the Chairman of the Witness Protection Agency and the Victim.
3. The Vice Chairman is the Deputy Chairman of the Witness Protection Agency and the Victim.
4. Members are Members of the Witness Protection Society and the Victims appointed by the President with the approval of the People ' s Representative Council.
5. LPSK Secretary is the Head of the LPSK Secretariat based on the provisions of the Regulation of the Secretary of State Number 5 of 2009.
6. Election is a Meeting to elect the Chairman and Deputy Chairman of the Witness Protection Society and Victims.
7. Election Panitia is a committee set up with the Decision of the Chairman of the LPSK to organize the election of the Chairman and Vice Chairman.
8. The Chairman of the Election Meeting is the LPSK Secretary as Chairman of the Election Committee.
9. Election witnesses are designated persons and witness the implementation of the Election consisting of the elements of the Government, the Swadaya Society and the Internal LPSK elements determined by the Speaker of the Committee.
10. Day is a work day.


BAB II
Principles
Section 2
In the selection of the Chair and the Vice Chairman is based on the principles as follows:
a.   directly;
B.   free;
C.   secrets; and
D.   non-discrimination.

BAB III
SELECTION COMMITTEE
Section 3
(1) Election panels were formed at least seven (seven) days after the election of 7 (seven) Members of the LPSK by the People's Representative Council.
(2) The election committee as referred to in paragraph (1) is formed under the Decree of the Chairman of the Witness Protection Society and the Victim, consisting of:
a.   committee chairman;
B.   committee secretary;
c. member of the committee; and
D.   Secretariat staff.
(3) Election Panitia has a task:
a.   conduct the preparation of the selection which includes the preparation of the means and infrastructure, sound paper, sound box, stationery, and other completeness;
B.   establish communications with Member for selection of selection;
c. carry out orientation activities and prepare a temporary place for Members;
D.   hosting elections, as set out in this regulation;
e.   sets 3 (three) Witnesses people to attend and witness the selection; and
f.   Setting up the news for the election meeting and the news of the election meeting.

BAB IV
ELECTION MEETING
Section 4
(1) The Chairman and Vice Chairman are selected from and by Member through the Election Meeting.
(2) Election meetings are conducted at least seven (seven) days after the receipt of the President's Decision on the Governing Member of the LPSK.
(3) The mandatory election meeting is attended by 7 (seven) Members and the selection committee.
(4) The election meeting is led by the LPSK Secretary.
(5) In the event that the Member is not able to be in attendance as stated in the paragraph (2), the Election Meeting is suspended at least 2 (two) times in the second half of the hour (no more than one hour).
(6) After the Election Meeting is suspended as referred to in paragraph (3), then the election meeting uses the quorum system.
(7) Kuorum is achieved if attended at least 5 (5) Members.
(8) If the Quorum is not reached as set forth in verse (5), the Election Meeting is adjourn in a 24-hour time (twenty-four) hour.
(9) Election meetings are conducted at the LPSK Office on the day specified by the Election Committee.

Section 5
(1) Each Member is entitled to vote and be selected and obliged to follow the selection of the Chairman and the Vice Chairman.
(2) Each Member is entitled to vote for 1 (one) Chairperson and 1 (one) Vice Chairman person.
(3) Members who are not present in the Election Meeting are not entitled to vote and are selected.
(4) Each Member is required to present its vision and mission as the Chairman or Vice Chairman prior to the Election.

BAB V
SET THE WAY OF SELECTION OF THE CHAIRMAN AND VICE CHAIRMAN
Section 6
(1) The leadership of the election meeting addresses the rules of the Speaker and the Vice Chairman
(2) The terms of the election as referred to in paragraph (1) are required to be agreed upon by all Members who are present.
(3) The decision of the Speaker and the Vice Chairman is done in deliberation to reach the mufakat.
(4) In terms of the deliberation of the mufakat not achieved as referred to in verse (2), the decision is taken on the basis of the most votes by vote.

Section 8
(1) The vote is done in 2 (two) stages.
(2) The voting stage as referred to in paragraph (1) consists of:
a.   the first stage to select the Chairman; and
B.   The second step is to elect the Vice Chairman.

Section 9
(1) The first stage as referred to in Section 8 of the paragraph (2) of the letter is done as follows:
a.   election committee provides sound paper and ballot box;
B.   voice paper loading the number of the order and the list of Member names compiled by order in the Presidential Decree on the appointment of LPSK membership;
c. Each Member chooses 1 (one) Person of the Candidate with a manner circumvindicated by 1 (one) of the number of the Member names indicated in the provided sound paper;
D.   after circled the selected sequence number, the Member inserts the ballot paper into the provided voice box;
e.   The candidate who has the most voice support is set as chairman of the LPSK;
f.   If there are no candidates for the most votes in the letter e then the vote will be held.
(2) The second stage as referred to in Section 8 of the paragraph (2) of the letter b is done as follows:
a.   election committee provides sound paper and ballot box;
B.   voice paper loading the number of the order and the list of Member names compiled by order in the Presidential Decree on the appointment of LPSK membership;
c. Each Member chooses 1 (one) Person of the Vice Chairman by circled 1 (one) reverse number on the list of Member names indicated in the provided sound paper;
D.   after circled the selected sequence number, the Member inserts the ballot paper into the provided voice box;
e.   the candidate of the vice chairman who gained the most votes votes set to be the vice chairman of the LPSK;
G.   If there are no candidates for the most votes in the letter e then the vote will be held.

Section 10
(1) After the vote, the Election Committee conducted a vote count.
(2) The members who did not circle the number of the order on Paper were declared abstentions.
(3) The circled sound paper of more than 1 (one) of the order number is declared invalid.
(4) The total number of votes is counted with the following provisions:
a.   the ballot paper circled on 1 (one) the order number is counted as 1 (one) valid voice;
B.   the circled sound paper more than 1 (one) of the order number counted as 1 (one) invalid voice; and
c. The uncircled ballot papers counted as 1 (one) the vote abstained.

BAB VI
RESULT SELECTION OF THE CHAIRMAN AND VICE CHAIRMAN
Section 11
(1) The results of the Chairman and Vice Chairman are being poured in the Election News Meeting Event.
(2) The news of the election meeting of the mandatory election is signed by all the Members present, the Speaker of the Election Committee and the Election Witness.

BAB VII
CLOSING PROVISIONS
Section 12
This rule came into effect on the date of promulgations.
